SCHEDULE 1South Australian coastal waters between the meridians of

longitude 136°30′E and 139°E but not including the waters of theCoorong or any other waters inside the Murray Mouth.

SCHEDULE 21. The permit holder may take a maximum of 50 greenlip

abalone (Haliotis laevigata). All abalone taken pursuant to thisnotice may not be sold or transferred to another party.

2. The permit holder may engage in the permitted activity fromthe date of gazettal of this notice until 31 December 1999.

3. The permitted activity may only be conducted by GeoffreyWallman and/or Ian Dale.

4. The permit holder shall notify the PIRSA Fisheries andAquaculture Compliance Unit on 1800 065 522 at least 24 hoursprior to conducting the permitted activity with the followinginformation:

(a) details of the boat that will be used to engage in thepermitted activity;

(b) the name of the person who will be conducting thepermitted activity;

(c) the intended place and time of launching and retrieval ofthe nominated boat for that day; and

(d) the intended area of conducting the permitted activity.5. The permit holder must, within 50 m of the point of landing

of any abalone taken pursuant to this notice, complete the PIRSAFisheries and Aquaculture form Abalone Broodstock CollectionStatement. Immediately upon arrival at the permit holder’sregistered aquaculture site this form must be faxed to PIRSAFisheries and Aquaculture on (08) 8226 2320. Prior to release intothe registered aquaculture site, all abalone taken pursuant to thisnotice must be tagged so as to be clearly identified as wildbroodstock.

6. The permit holder shall record the number of wild broodstockheld pursuant to this notice in a register to be maintained at theregistered aquaculture site, which must be made available forinspection by a Fisheries Compliance Officer upon request.

7. PIRSA Fisheries and Aquaculture retains the right for adepartmental officer to accompany the fisher at any time duringthe permitted activity.

8. While engaged in the permitted activity the permit holdershall carry or have about or near his person a copy of this notice.Such notice must be produced to a Fisheries Compliance Officerupon request.

WATER RESOURCES ACT 1997

Notice of Restriction of Water Use in the Marne River Catchment

PURSUANT to section 16 (1) of the Water Resources Act 1997, I,Dorothy Kotz, Minister for Environment and Heritage, being ofthe opinion that the rate at which water is being taken fromsurface water, watercourses and from wells accessing the upperunconfined aquifer in the Murray Group Formation and the lowerconfined aquifer in the Renmark Beds in the area described inSchedule 1, is likely to affect the quality of water in the surfacewater, watercourses and those underground aquifers, and is suchthat there is a risk that the available water will not be sufficient tomeet future demand, hereby prohibit the taking of water fromsurface water, watercourses and wells, subject to the exceptionsspecified in Schedule 2.

SCHEDULE 2

1. A person who takes water for a pre-existing purpose but onlyat the rate at which he or she takes does not exceed the pre-existing rate in accordance with a written authorisation granted byme, or my delegate, pursuant to this notice.

2. Any other person may take water from the surface water,watercourses, or wells in accordance with the terms of a writtenauthorisation granted by me, or my delegate, pursuant to thisnotice.

3. This prohibition shall not apply to the taking of water forstock and domestic purposes as defined in the Water ResourcesAct 1997, nor to the taking of water for the purposes of fightingfires, or for reticulated supplies of potable water to townships inthe area.

In this notice:

‘pre-existing use’ in relation to a person means a purpose forwhich the person took water in the areas in Schedule 1during the 3 years immediately preceding the date ofcommencement of this notice;

‘pre-existing rate’ means the amount of water used in the 3years immediately preceding the date of commencement ofthis notice.

The period of this restriction will commence at the expiration ofseven days from the publication of this notice in the Gazette ornewspaper (whichever is the latter).

This notice will remain in effect for 2 years unless earlierrevoked or varied.
