CALL TO ORDER

F. M. Simmons Patterson, Jr., M.D., President of the Board of Medical Examiners of theState of North Carolina called the meeting to order on Wednesday May 22, 1991, at 7:00'p.m. , at the North Raleigh Hilton, Raleigh, North Carolina.

Board members present at this meeting included: Nicholas E. Stratas, M.D., Secretary; JohnT. Daniel, Jr. , M.D.; Harold L. Godwin, Jr., M.D.; Walter M. Roufail, M.D.; Hector H.Henry, M.D.; John W. Nance, M.D.; and Mrs. Kathryn H. Willis.

Staff members present included: Bryant D. Paris, Jr., Executive Secretary; Donald R.Pittman; William H. Breeze, Jr. ; Robert J. Broyles; L. D. Beaver; Edmund Kirby-Smith;Leslie Newton; Kathy Burke; Wanda Long; Joy Cook; and Rhonda Lavelle.

On May 25, 1991,the Board of Medical Examiners unanimously adopted a motion made byDr. Daniel and seconded by Dr. Nance that another hearing regarding interosseous infussionbe held in compliance with the direction of the Administrative Rules Review Commission.

On May 22, 1991, the Board of Medical Examiners adopted a motion made by Dr. Stratasand seconded by Dr. Godwin that the Board increase our contribution for 1992 to PHEP tocover the anticipated shortfall of $71,31L For: NS,JN, HG, WR, Opposed: SP,HH. Motionpassed.

BERRIOS, Oswald, M.D. - Carolina Beach, NC - wl

On May 22, 1991,during the formal action report, Mike Weddington reported that this caseis pending before the Office of Administrative Hearings. The Administrative Law Judge hasset a tentative hearing date for the first week in December, 1991. The Board of MedicalExaininers unanimously adopted a motion made by Dr. Godwin and seconded by Dr. Danielthat it dismiss the last part of the charge.

MOORE REGIONAL HOSPITAL —SURGICAL ASSISTANT QUESTION —wl

John F. Krahnert, Jr. , M.D. requested in a letter dated March 12, 1991 to Dr. Patterson thatsurgical technicians and registered nurses be allowed to close in the operating room, underthe conditions that a responsible surgeon be in the operating room at the time of the closureand that documentation of their training and competency be on file.

On May 23, 1991,the Board of Medical Examiners unanimously adopted a motion made byDr. Patterson and seconded by Ms. Willis that a letter be sent to Dr. Krahnert stating theBoard feels that what they are describing is the practice of medicine and only physicians orapproved physician extenders may practice medicine.

BOARD OF ELECTROLYSIS EXAMINERS - VACANCY —wl

On May 23, 1991,the Board of Medical Examiners unanimously adopted a motion made byDr. Patterson that the Board of Medical Examiners nominate Dr. Tafeen to the Board ofElectrolysis Examiners.

ACCELERATED FAMILY PRACIICE RESIDENCY PROGRAM —ECU - wl

Mr. Paris reported that Dr. Patton and Dr. Jones came to Medical Board office to discusssetting up a program at ECU. Mr. Paris shared his concerns with the doctors regarding theBoard's involvement in Medical Education, which has not been done in the past.

Dr. Patton however, did request that the Board address the request that if a forth yearmedical student is caring out the same duties as a first year resident, then at the end of thatyear, would that person then be eligible to receive a full license? The statute now states thata physician must have an M.D. degree, pass an exam that satisfies the Board, and have oneyear of post-graduate training approved by the Board.

Dr. Nance indicated that he would like to know more about what happened in Kentucky.We should not close the door on this concept.

On May 23, 1991, the Board of Medical Examiners unanimously adopted a motion made byDr. Godwin and seconded by Dr. Nance that the Board accept this as information and thatwe have a progress report on the Kentucky program a year from now.

1992 REGISTRATION APPLICATION —wl

Mr. Paris reported on the revised application registration form. He indicated that the onlychange to the form from the last meeting was a question which was added regarding thedelivery of babies. A section has also been added regarding retired physicians and out ofstate physicians.

On May 23, 1991, the Board of Medical Examiners unanimously adopted a motion made byDr. Stratas and seconded by Dr. Godwin that we accept the proposed registrationapplication with a registration fee of $100.00.

PRESCRIPTION FORMAT - wl

On May 23, 1991, the Board of Medical Examiners unanimously adopted a motion made byDr. Stratas and seconded by Dr. Patterson that the Board adopt the proposed wordingchange as follows:

It is the usual and accepted standard of care in North Carolina thata ~sin le medication be written on an individual prescription.

ACUPUNCI'URE —wl

On May 23, 1991, the Board of Medical Examiners unanimously adopted a motion made byDr. Stratas and seconded by Dr. Nance that we adopt the proposed position statement onacupuncture.

One December 5, 1972, the Board of Medical Examiners of. theState of North Carolina stated its position that the practice ofacupuncture is the practice of medicine.

Therefore, anyone wishing to practice acupuncture in the State ofNorth Carolina, must first be licensed to practice medicine by theBoard of Medical Examiners.

Dr. Giles was also granted permission to take the FLEX in June1991 if he wishes but that he must take and pass FLEX within one year. He stated hepreferred to wait and take the exam in December.

To be eligible for licensure by endorsement of credentials, applicantsmust appear before the Executive Secretary, a Board member, ~au eut ofthe Board, or the full Board for a personal interview upon completion ofall credentials.
