New Delhi: Delhi high courton Thursday asked the Centreand the AAP government to ta-ke a call on online gamblingwebsites after verifying if thesewere games of skill or chance.

Abench of Chief Justice DN Patel and Justice C HariShankar asked both the go-

vernments to treat a PIL inthis regard as a representa-tion and take a reasoned deci-sion about the status of onli-ne gambling, including poker,and if these needed to be ban-ned or partially restricted.

The court also made it cle-ar that the Centre would keepin mind the aspects of moneylaundering, Foreign Ex-

change Management Act(FEMA) violations and taxa-tion of the gaming proceedswhenever it takes a decisionon the legality and validity ofthe online activity.

The high court bench ac-ted after the central govern-ment, through standing co-unsel Gaurang Kanth, sub-mitted that regulating gamb-

ling was a state subject andthe Union government has alimited role in this. The Cent-re added that blocking ofonline gaming sites, inclu-ding card games, was “tech-nologically not feasible” as many states had enactedlaws that partially or fully allowed such activities.

Meanwhile, the AAP go-

vernment’s standing coun-sel, Ramesh Singh, told thecourt it could only take actionif a gambling site was beinghosted in Delhi or if there we-re instances of offline gamb-ling. The court asked the sta-te government to also take aview on the representation,while keeping all theseaspects in mind.

The plea, filed through ad-vocates B S Joon and MohdIrshad, has relied upon tweets

and re-tweets by BJP leadersto claim that Sisodia’s imagewas tarnished. Sisodia’s lawy-ers have shown that the allega-tions pertained to corruptionof Rs 2,000 crore, attributing itto the deputy chief minister.

The plea said that the “fal-se and defamatory allegationsby the accused” were seen andheard by AAP councillors Ge-eta Rawat and Kuldeep.
