New Delhi: Chief Justice Di-pak Misra rejected a seniorlawyer’s suggestion to bar the media from reporting the courtroom drama on Fri-day, where a sea of lawyers re-acted angrily to advocatePrashant Bhushan’s unsub-stantiated allegationsagainst the CJI and soughtcontempt of court proceed-ings against him.

The CJI said, “I believe, allof us believe, in the freedom ofpress. I am always in support offreedom of speech and expres-sion and the right of media toreport proceedings accurately.I do not favour restraining thepress in any matter. A similarprayer was made before mewhen I was a judge of MadhyaPradesh high court during thehearing of a very sensitivematter. I had outright refusedto restrain the media from re-porting the proceedings. Press

Not new to the court initia-ting contempt of court pro-ceedings against him — one ispending in the SC against himfor alleging seven years agothat most former CJIs were

corrupt — Bhushan tried tomake his submission.

But his voice was drownedas a large number of lawyersspoke in unison accusing himand his band of lawyers of at-tempting to terrorise judgesthrough wild allegations.

Frustrated by his voice be-ing drowned in the cacophony,Bhushan stormed out of thecourtroom. After this, Su-preme Court Advocates on Record Association office-bearer Gopal Singh suggestedto the bench to treat the pro-ceedings in camera and re-strain the media from report-ing it. The CJI immediatelyshot down the suggestion.

The bench also rejected asuggestion from former Su-preme Court Bar Associationoffice-bearer Ranji Thomas toconstitute a full court andplace both the petitions, whichalleged judge-middleman nex-us in grant of favourable or-ders to undeserving privatemedical colleges, before it.

The bench questioned thepropriety of senior advocateDushyant Dave mentioningKamini Jaiswal’s petition before a bench headed by Justice J Chelameswar onThursday despite knowingthat a similar petition by Cam-paign for Judicial Account-ability and Reforms was or-dered to be listed before abench led by Justice A K Sikri.

But there were lighter mo-ments too in the courtroom.When Bhushan pleaded withthe CJI to grant him “some in-dulgence” to make his argu-ments, a smiling CJI said, “Inevery case you argue before us,you are given indulgence. It isanother matter that you havemade wild allegations today.”

Bhushan returned thesmile and acknowledged theindulgence granted to him.But minutes later, he angrilytold the CJI to pass any orderas the bench was not givinghim opportunity to argue andstormed out of the courtroom.

It added, “Once the CJI isrecognised as the master of theroster, neither a two-judgebench nor a three-judge benchcan allot a matter to itself or or-der constitution of a largerbench as if it is a direction tothe CJI. Such an order cannotbe passed. It is not in accord-ance with law and is irrespon-sible... There cannot be a direc-tion to the CJI to constitute aparticular bench.”

Making it clear that the or-der of Justices Chelameswarand Nazir was null and void,the five-judge bench stressed,“If any such order is passed byany bench, that should nothold the field as this will becounter to the order of the de-cision of this ConstitutionBench of the SC. Needless tosay, no judge can take up mat-ters on his own without it be-ing referred to the CJI.”

The five-judge bench said

the two petitions alleging ajudge-middlemen nexus wouldbe listed before an appropriatebench. Both pleas were basedon common information — aCBI FIR that led to the arrest ofa retired HC judge and othersin connection with a conspir-acy to obtain favourable ordersfor private medical collegesfrom courts by offering illegalgratification to public servantsand judges — and sought iden-tical relief in setting up of an

SIT to probe this under the su-pervision of a retired CJI.

Justices Chelameswar andNazir had acceded on Wednes-day to advocate PrashantBhushan’s plea and orderedlisting of a petition by Cam-paign for Judicial Accountabil-ity and Reforms (CJAR), whichalleged that the CBI FIR relat-ing to admissions to a Luck-now-based private medical col-lege had detailed how a judge-middleman nexus was beingused to obtain orders favouringmedical colleges debarredfrom admitting students.

The CJI had ordered listing

of this petition on Friday be-fore a bench of Justices A KSikri and Ashok Bhushan.

However, on Thursday, se-nior advocate Dushyant Davementioned a petition by advo-cate Kamini Jaiswal, identicalto CJAR’s plea, for urgent hear-ing before a bench headed byJustice Chelameswar. Dave’spleaded that the petition mustbe heard by Justice Chelames-war’s bench, and not by the CJIas the latter had been hearingmedical college cases and Jus-tice Chelameswar’s benchagreed to hear the matter. It or-dered the petition to be listedbefore a bench comprising firstfive senior judges on Monday.

On Friday, the bench of Jus-tices Sikri and Bhushan re-ferred the CJAR petition to theCJI for listing before an appro-priate bench. The registry tookout a notification at 2.42pm say-ing the matter would be heardby a seven-judge bench at 3pm.

However, at 2.52pm, anoth-er notification said the CJARpetition would be heard by afive-judge bench at 3pm.

Word spread rapidly andthe CJI’s courtroom waspacked with lawyers. Bhushan

and Kamini Jaiswal wereswamped by a sea of lawyerswho demanded contempt ofcourt action against them formaking wild allegations mo-ments after Bhushan said theCBI FIR in the medical scammentioned the CJI’s name.

The five-judge bench re-peatedly questioned Bhushanas to how a lawyer of his stand-ing could make such an irre-sponsible statement. “Can anFIR be registered against a ma-gistrate, a district judge, an HCjudge, an SC judge or the CJI?There is a procedure. You mustwithdraw this irresponsiblestatement,” it said.

Bhushan repeatedly re-quested the bench to hear himout. But the bench questionedhis arguments incessantly.

Simultaneously, SC Bar As-sociation leaders insisted oncontempt proceedings againstBhushan. ASG Narasimha P Ssaid the CJI alone had the pow-er to order listing of cases.

Tired of keeping cool,Bhushan raised his voice, “You(the bench) want to pass orderswithout hearing me. Go aheadand pass any order you want,”and stormed out amid protests.
