Provided that if any President of an A~lchalik Parislrad communicales to the Chairman OF the Z i l h Parishad, in writing, his unwilIingness to act as a member of h e ZiIIa Parisbad, hc shall, '$th clfcct from thc datc of such communication, ceuc lo bc a mcmbcr of Ihc Zilla Parisfrad, and [he vacancy so caused shall be filled by election from among the members of lhat At~clialik Parishad in such manner and wilhin such time as may be prescribed:

(b) LAO Adlryaksfras, one from each of ~ w o such conslituencies comprised in a sub-division of the dislrict a may be specified by notification, elected by he Adf1)lakshas i n each consti~uency from among themselves at such time and in such manner as may be prescribed:

(3) A mcmbcr clccted under sub-clause (b) or clausc (1) of scction 4 shall, subjcct lo the provisions of seclion 5, hold office for a pcriod of [our ycars or for so long hc continues lo be Ihc Adl~y~kslla, whichevcr is earlier.

(4) A Chairman or a Mayor appoinled undcr sub-clause (d) of clause ( 1 ) of sec~ion 4 shall hold ofice For a ~ r i o d of four years or for so long as he continucs to bc such Chairman or Mayor. whichevcr i s carlier.

(5) Subjcct to the provisions of sub-sechon (2), a mcmber appointed under the second proviso to sub-clausc (a) of clause (1) of scction 4, and a member appointed under sub.clausc (0 of clause ( 1 ) of that section shall hold oflicc for a period of four years:

Provided that such a member shall continue 10 hold orficc on rhe expiry of UIC said rerrn until anothcr member is appoin~cd by !he State Govcrnmen t i n his place.

(6) If any Presidenr or an A~~clial ik Parislrod or i f any person rereerrcd to in sub-clauses (d) and (I) of clause ( I ) of sccrion 4 be disqualified to bc a member, thc Statc Government may f i l l he vacancy in such mnnner and For such pcriod as may be prcscribcd.

Chairn~nn 7. (1) Therc shall be a Chairman and a Vice-chairman for a Zilla and Vicc. ChJinl,..n, Parishad elecred by the members thereol lorn among he mcmbcrs

referred lo in sub-clauses (a), (b). (c) and ( f ) of clause ( 1 ) of sccrion 4.

(2) The Chairman and the Vice-Chairman shall, subject to ~ h c provisiohs of section 9 and 10 his condnuing as a member, hold office for n pcriod oC four years: -,

(3) (a) When the office of ~ h c Chairman falls vacant by rcason of dcarh, resignation or removal or is athenvise vacant, or'

(b) when the Chairman is, by rcason of leave, illness or o h e r causc, temporarily unable lo cxcrcjse the powers, pcrform the functions and discharge the duties of his officc.

100. 108. (1) If, in the opinion ol the Stmc Governmcnt, a Zilla Parislrud or an Atzchalik Pui-islrod-

(a) has shown its incompetence to perform or has persistently made derault i n he pcrformancc of thc dulies or exercise of thc funcdons imposed on it by or under this Acl or by any olhcr law, or

(b) has cxceeded or abused iu pawcrs,

lhc Slate Governmcn~ may by an order to be published in the Oficial Gazerre slating the reasons rhcrefor, supersedc the Zilla Paiisl~ud or [he A~~cha l i f : Parishad, as thc case may bc, for such pcriod, not excecding thc maximum pcriod of rwo yccm, as may bc specified in lhc ordcr:

(a) any matter for which power to make provision is conrerrcd expressly or by implication on the Stale Governnlent by [his Act;
