The Council of t h e Town of Lmsden has submitted copy o f proposed Agreement between the said Town and the Saskatchewan Mousing Corporation, respecting the acquisition and developing of lands and the const~uction thereon of a rental housing projec t o f approxinately 7 housing units, supported by a request from the s a i d Council of the Town of Lumsden f o r the approval o f the Local Government h a r d o f the said Agreement and consent t o the passing of proposed Bylaw No. 5 /80 i n connection therewith, pursuant to the provis ions o f The Saskatchewan Housing Corporation Act,

NOW THEREFORE THIS AGREEMENT WITNESSETH t h a t t h e p a r t i e s he re to , i n .

ag ree with each o t h e r as fol lows:

1, The p a r t i e s h e r e t o mutually ag ree , pursuant t o Sec t ion 40 of t h e

National Housing Act and Sec t ion 15 o f t h e Saskatchewan Housing Corporation

Act, t o co-operate , i n accordance wi th t h e terms and cond i t i ons hereunder and

on t h e b a s i s o f t h e terms and c o n d i t i o n s con ta ined i n t h e above noted

des igna t ion agreement and t h e master agreement, i n t he cons t ruc t ion and/or

a c q u i s i t i o n of t h e housing p r o j e c t as named and r e f e r r e d t o i n t h e designa-

t i o n agreement hereunto annexed as Schedule "Aq1 t o t h i s agreement.

2 . The m u n i c i p a l i t y agrees t o s e l l t o t h e P r o v i n c i a l Corporation, o r t h e

" respons ib le parry" a s nominated i n t h e des igna t ion agreement, t he lands

shown o u t l i n e d i n r ed on t h e p l a n s ' h e r e u n t o a t t a c h e d and marked a s Schedule "B1?

t o t h i s agreement ( h e r e i n a f t e r r e f e r r e d t o as '!the lands") as are required

f o r t h e development of t h e p r o j e c t and s h a l l accept a s c o n s i d e r a ~ i o n f o r the

s a i d t r a n s f e r sum of NIL

3. The Municipal i ty f u r t h e r ag rees t h a t t h e l and s h a l l be t r a n s f e r r e d ,

f r e e and c l e a r of a l l encumbrances, t o t h e Corporat ion, o r t h e " respons ib le

party", which lands s h a l l be he ld i n t r u s t f o r t h e p a r t i e s a s e s t ab l i shed

i n t h e master agreement a s above o u t l i n e d .

4. The Municipal i ty f u r t h e r agrees t h a t it w i l l assume i t s appropr i a t e

s h a r e o f t h e c a p i t a l c o s t s o f t h e p r o j e c t , which sha re s h a l l be 20% o f t h e

Provincia l Corporat ion 's 25% s h a r e o f t h e c a p i t a l c o s t s , and s i m i l a r l y ,

t h a t it w i l l pay o r r ece ive a s i m i l a r p ropor t iona te s h a r e o f t h e p r o f i t s

o r d e f i c i t s r e s u l t i n g from t h e o p e r a t i o n o f t h e p r o j e c t during each ca lendar

year . The i n t e r e s t r a t e s f o r t h e purpose o f t h i s agreement s h a l l be 1 4 h

p e r annum i n r e s p e c t o f t h e Corporat ion and 15 % p e r annum i n r e spec t

o f t h e Provincia l Corporation and t h e Munic ipa l i ty , bo th r a t e s ca lcu la t ed

semi-annually and not i n advance.

5. The Municipal i ty agrees t h a t it w i l l c a r r y o u t t h e engineering design,

cons t ruc t ion and i n s t a l l a t i o n , inc luding f i e l d i n v e s t i g a t i o n and layout ,

prel iminary f i n a l planning and t h e p repa ra t ion o f such p lans , working

drawings and s p e c i f i c a t i o n s as may b e necessary i n connect ion with the

provis ion of s e r v i c e s and/or improvements in accordance wi th s tandard

engineer ing p r a c t i c e s , and without r e s t r i c t i n g t h e g e n e r a l i t y o f t h e foregoing,

provide t h e fol lowing se rv ices :

1 . Sewer and wate r mains; 2. Grave l led roads; 3. Grave l led lane ; and 4. S t r e e t l i g h t i n g .

6. The Corporation and/or t h e " respons ib le par ty" s h a l l r e q u i r e a l l

c o n t r a c t o r s engaged i n cons t ruc t ion o f t h e p r o j e c t t o apply t o t h e

Municipal i ty and f o r a l l r equ i red permits , i nc lud ing bu i ld ing , plumbing

and water s e r v i c e permits . The Munic ipa l i ty may i n s p e c t t h e bui ld ing

opera t ions and s f ia l l i n spec t t h e plumbing i n s t a l l a t i o n s and any represen-

t a t i o n s a s a r e s u l t o f such inspec t ion , s h a l l be made t o t h e Corporation

and/or t h e "responsible party". The housing u n i t s s h a l l b e o f a standard

a t l e a s t equal t o t h e minimum requirements f o r planning, cons t ruc t ion

and m a t e r i a l s f o r bu i ld ings upon whicfi l oans a r e made under t h e National

Housing Act.

7. The Corporat ion and/or t h e "responsible party" s h a l l provide such

easements a s t h e Municipal i ty, o r o t h e r publ ic u t i l i t y "may r e q u i r e f o r

sewers, water mains and pub l i c u t i l i t y se rv ice l i n e s ( inc lud ing s t r e e t

l i g h t i n g l i n e s ) as a r e necessary wi th in t h e p r o j e c t a r e a s .

8. (1) The p a r t i e s hereunto agree t h a t t h e p r o j e c t , when completed, w i l l

be administered by a l o c a l housing a u t h o r i t y ( h e r e i n a f t e r c a l l e d "the

Authority") duly appointed under and by provis ions o f t h e Saskatchewan

Housing Corporat ion Act, and f u r t h e r agree t o e n t e r i n t o an agreement

between t h e Local Housing Authori ty o f t h e f i r s t p a r t , t h e Corporation and

t h e Provincia l Corporat ion of t h e second p a r t , and t h e Town o f

Lumsden of t h e t h i r d p a r t . The agreement s h a l l provide f o r t h e

payment by t h e a u t h o r i t y t o t h e Municipal i ty, annually, i n l i e u o f general

and school t axes wi th r e spec t t o t h e land and b u i l d i n g s used f o r such

housing accommodation, a sum of money equal t o t h a t which would otherwise

be payable t o t h e Municipal i ty, i f such lands were no t o therwise exempt

from taxa t ion .

(2) The r e n t a l s t o b e charged by t h e Local Housing Author i ty s h a l l be

e s t ab l i shed from time t o time by t h e Corporation and t h e P rov inc ia l

Corporation o r s h a l l be such a s may b e determined by t h e Local Housing

Authori ty pursuant t o a formula t o b e e s t ab l i shed from t ime t o time by the

Corporation and t h e Provincia l Corporation.

9. The Munic ipa l i ty agrees t h a t no municipal t axes , r a t e s o r charges . s h a l l be l e v i e d o r imposed a g a i n s t t h e Corporation and/or t h e "responsible

party" i n r e s p e c t o f t h e p r o j e c t , so long a s owned by it, and no grant

i n l i e u the reof s h a l l be pa id i n r e spec t of t h e per iod p r i o r t o t h e

occupancy o f each bu i ld ing o r group o f bu i ld ings i n t h e s a i d pro jec t . .

10. The Municipal i ty s h a l l provde t o t h e t e n a n t s o r occupants of the

housing u n i t s wi th in t h e p r o j e c t , a l l f a c i l i t i e s and s e r v i c e s t h a t a r e

provided t o o t h e r proper ty owners o r t enan t s i n t h e Munic ipa l i ty , including,

bu t without l i m i t i n g t h e g e n e r a l i t y o f t h e foregoing, garbage col lec t ion ,

f i r e and p o l i c e p r o t e c t i o n and educat ional f a c i l i t i e s .

11. Kothing h e r e i n s h a l l b e construed t o prevent t h e s a l e o r o the r

d i s p o s i t i o n of any of t h e lands and bu i ld ings forming p a r t o f t h e project ,

and t h e Corporat ion and/or t h e "responsible party" may s e l l o r otherwise

dispose o f any. o f such lands o r bu i ld ings , o r both, f o r such amount Upon

such terms and condi'tions a s may b e agreed upon by t h e Corporat ion and/or

t h e " resyons ib le party".

12. I n t h e event t h a t t h e housing u n i t s o r any of them a r e des t royed from

any cause, o r s o l d by t h e p a r t i e s h e r e t o a t any t ime p r i o r t o t h e complete

amor t i za t ion of t h e cost o f t h e p r o j e c t , then t h e P r o v i n c i a l Corporat ion

s h a l l pay t o t h e Munic ipa l i ty , such sum o r sums as s h a l l b e r equ i r ed t o

r e s t o r e t h e r e s p e c t i v e s h z r e o f t h e c a p i t a l inves tment t o t h e Munic ipa l i ty .

1 3 . The p a r t i e s hereunto mutual ly a g r e e t o execure such f u r t h e r

RE: FEDERAL-PROVINCIAL HOUSING AGREEMENT, SECTION 40 NATIONAL HOUSING ACT

WHEREAS by an agreement dated t h e 18th day of June 1974 between Canada, the Province of Saskatchewan, Canada Mortgage and Housing Corporation, t h e Corporatj.on, and t h e Saskatchewan Housing Corporation may finance j o i n t l y - t h e acquis i t ion o r cons t ruc t ion of houses.

3. The i n t e r e s t r a t e s for t h e purpose o f t h i s agreement s h a l l be 15 " 6 per annum i n r e spec t of t h e share of the Saskatchewan Housing Corporation and 14; % per annum i n respec t o f t h e share of t he Corporation, both r a t e s calcula ted semi-annually not i n advance.
