Section 3. Amendment to Sec- tion 12(B)(3). Paragraph 5 of Section 12(B)(3) of Ordinance No. 2020-2 is hereby amended to read in its entirety as follows. "The JUNIOR LIEN BOND RE- SERVE ACCOUNT (the "Juni- or Lien Bond Reserve 5001 Legals or Lien Bond Reserve Account") is hereby continued. In addition to the requirements of Ordinance Nos. 141, 6-2007 and 2020-1, transfers shall be made to the Junior Lien Bond Reserve Account as follows: there shall be withdrawn from the Receiving Fund at the be- ginning of each Fiscal Year quarter and set aside in and transferred to the Junior Lien Bond Reserve Account, after provision has been made for t he Operation and Mainten- ance Account and the current requirements of the Junior Li- en Bond and Interest Redemp- tion Account, commencing Oc- t ober 1, 2020, the sum of at least $725 per quarter ($2,900 annually) related to the Series 2020C Bond (or $502.50 per quarter ($2,010 annually) if the Series 2020C Bonds are is- sued prior to September 30, 2020), and the sum of at least $100 per quarter ($400 annu- a lly) related to the Serie s 2 020D Bond (or $92 pe r quarter ($368 annually) if the Series 2020D Bonds are is- sued prior to September 30, 2020), until there is accumu- l ated in the Junior Lien Bond Reserve Account the lesser of the sum of $29,000 related to t he Series 2020C Bond (or $20,100 if the Series 2020C B onds are issued prior t o S eptember 30, 2020) an d $4,000 related to the Series 2020D Bond (or $3,680 if the Series 2020D Bonds are is- sued prior to September 30, 2020) or the Reserve Amount. Except as hereinafter provided, no further deposits shall be made into the Junior Lien Bond Reserve Account for the pur- pose of Junior Lien Bond Re- serve Account once the lesser of the sum of $29,000 related to the Series 2020C Bond (or $20,100 if the Series 2020C B onds are issued prior t o S eptember 30, 2020) and $4,000 related to the Series 2020D Bond (or $3,680 if the Series 2020D Bonds are is- sued prior to September 30, 2020) or the Reserve Amount has been deposited therein as herein provided. The moneys i n the Junior Lien Bond Re- serve Account shall be used solely for the payment of the principal installments of and in- terest on the Bonds as to which there would otherwise be de- fault; provided however, that in t he event the amount on de- posit in the Junior Lien Bond Reserve Account exceeds the Reserve Amount, the moneys i n excess of the Reserv e Amount shall be used to pay principal installment of and in- terest on the Bonds on the next payment date." Section 3. Publication and Re- cordation. This Ordinance shall be published in full in the Mid- land Daily News, a newspaper of general circulation in the City of qualified under State law to publish legal notices, promptly after its adoption, and shall be r ecorded in the Ordinanc e Book of the City and such re- cording authenticated by the signatures of the Mayor and t he City Clerk. Section 4. Severability; Para- graph Headings; and Conflict. I f any section, paragraph , clause or provision of this Or- dinance shall be held invalid, the invalidity of such section, paragraph, clause or provision shall not affect any of the other provisions of this Ordinance. The paragraph headings in this Ordinance are furnished for convenience of reference only and shall not be considered to be part of this Ordinance. Section 5. Effective Date. Pur- suant to the provisions of Sec- tion 6 of Act 94, Public Acts of Michigan, 1933, as amended, t his Ordinance shall be ap- proved on the date of first read- ing and accordingly this Ordin- ance shall immediately be ef- fective upon its adoption. "The JUNIOR LIEN BOND RE-SERVE ACCOUNT (the "Juni-o r L i e n B o n d R e s e r v eAccount") is hereby continued.In addition to the requirementsof Ordinance Nos. 141, 6-2007and 2020-1, transfers shall bemade to the Junior Lien BondReserve Account as follows:there shall be withdrawn fromthe Receiving Fund at the be-ginning of each Fiscal Yearquarter and set aside in andtransferred to the Junior LienBond Reserve Account, afterprovision has been made forthe Operation and Mainten-ance Account and the currentrequirements of the Junior Li-en Bond and Interest Redemp-tion Account, commencing Oc-tober 1, 2020, the sum of atleast $725 per quarter ($2,900annually) related to the Series2020C Bond (or $502.50 perquarter ($2,010 annually) if theSeries 2020C Bonds are is-sued prior to September 30,2020), and the sum of at least$100 per quarter ($400 annu-ally) related to the Series2020D Bond (or $92 perquarter ($368 annually) if theSeries 2020D Bonds are is-sued prior to September 30,2020), until there is accumu-lated in the Junior Lien BondReserve Account the lesser ofthe sum of $29,000 related tothe Series 2020C Bond (or$20,100 if the Series 2020CBonds are issued prior toSeptember 30, 2020) and$4,000 related to the Series2020D Bond (or $3,680 if theSeries 2020D Bonds are is-sued prior to September 30,2020) or the Reserve Amount.Except as hereinafter provided,no further deposits shall bemade into the Junior Lien BondReserve Account for the pur-pose of Junior Lien Bond Re-serve Account once the lesserof the sum of $29,000 relatedto the Series 2020C Bond (or$20,100 if the Series 2020CBonds are issued prior toSeptember 30, 2020) and$4,000 related to the Series2020D Bond (or $3,680 if theSeries 2020D Bonds are is-sued prior to September 30,2020) or the Reserve Amounthas been deposited therein asherein provided. The moneysin the Junior Lien Bond Re-serve Account shall be usedsolely for the payment of theprincipal installments of and in-terest on the Bonds as to whichthere would otherwise be de-fault; provided however, that inthe event the amount on de-posit in the Junior Lien BondReserve Account exceeds theReserve Amount, the moneysin excess of the ReserveAmount shall be used to payprincipal installment of and in-terest on the Bonds on the nextpayment date."

Section 3. Publication and Re-cordation. This Ordinance shallbe published in full in the Mid-land Daily News, a newspaperof general circulation in the Cityof qualified under State law topublish legal notices, promptlyafter its adoption, and shall berecorded in the OrdinanceBook of the City and such re-cording authenticated by thesignatures of the Mayor andthe City Clerk.

Section 4. Severability; Para-graph Headings; and Conflict.I f any section, paragraph,clause or provision of this Or-dinance shall be held invalid,the invalidity of such section,paragraph, clause or provisionshall not affect any of the otherprovisions of this Ordinance.The paragraph headings in thisOrdinance are furnished forconvenience of reference onlyand shall not be considered tobe part of this Ordinance.

Section 5. Effective Date. Pur-suant to the provisions of Sec-tion 6 of Act 94, Public Acts ofMichigan, 1933, as amended,this Ordinance shall be ap-proved on the date of first read-ing and accordingly this Ordin-ance shall immediately be ef-fective upon its adoption.
