City Council Approves Funding to Clean up Local PropertiesByKentMiller
TaftCityCouncil-membersattheirmeet-ingTuesdayeveningapprovedspendingmorethan$8,000toclean-uppropertiesatfoursitesinthecom-munity.Theactioncameafterthepropertyown-ersfailedtorespondtocityCodeEnforce-mentDepartmentrequeststobringtheareasuptostandardsortoabatesafetyhazards,CityManagerCraigJonestoldthecouncil.“Atthistimethecitywillhavetopayfortheclean-upandattempttoseekreimbursementofthecost,”Jonessaidinhismaterialstothecouncil.Onlyonebidperpropertywasreceivedforthecleanups,allfromJ.E.BurkeConstructionInc.,hesaid.Thepropertiesandcostsare: *9056thSt.,$2,215; *6105thSt.,$1,057; *522KernSt.,$1,057; *407S.6thSt.,$3,822;foratotalof$8,151.Worktobedoneincludes:disposingoftrashanddebris,trimmingtrees,cuttinggrass/weeds,removingortrimmingovergrownvegetation,fillingasinkholeat522KernSt.,painting/removinggraffitiandboardingandsecuringthestructureat9056thSt.,andpaintingthewallsandsecuringtheroofforweatherprotectionat407S.6thSt.

CityrepresentativeswillattendtheInternationalCouncilofShoppingCenters’WesternDivisionConference&DealMakingExpoinSanDiegoinSeptembertopromotethecityanditsEnterpriseZone.Termsofthecity’sEnterpriseZoneMemorandumofUnderstandingwiththestaterequireTaftofficialstoattendatleastoneICSC-sponsoredeventeachyear,Jonestoldthecouncil.InthepastthecityhasattendedtheconferenceinLasVegas,hesaid.“(But)theconferencethatisheldinSanDiegoisgearedtowardthewesternUnitedStatesandthosecompaniesthatareseekinglocationsinCalifornia,whereastheLasVegasconferencehasworld-wideexposure,”Jonessaid.ThecitywillhaveaboothattheSanDiegoconference,whileitdidn’thaveaboothattheLasVegasconference,hesaid.TheTaftChamberofCommercewillhavetwoofitsrepresentativesmantheboothduringconferencehours,free-ingthecitymanagerandEnterpriseZonemanagertomeetwithretailersanddevelopers,hesaid.

Clean it up! One of the buildings targeted by the city of Taft for clean-up. Cost of property clean-up will placed in a lien against propoerty owners who do not respond to city demands to clean-up thier properties.

Kern County Farm Bureau Votes to Oppose the High Speed Rail Project AttheirJulymeeting,theKernCountyFarmBureauBoardofDirectorsunanimouslyvotedtoopposeCalifornia’sHigh-SpeedTrainProject.Thedecisioncameafterreviewoftherecentlyre-leasedDraftEnvironmentalImpactReport(DEIR),inwhichtheboarddeterminedthattheirretrievablelossofimportantfarm-landandtheunavoidableimpactsitwouldhaveonneighboringfarmingoperationswouldbeunacceptabletoKernCountyFarmBureau’smembership.Furthermore,thebondmeasureauthorizingconstructionstressedthegoaltobuildthesystemalongexistingtransportationcorridors;however,theDEIRfortheFresnotoBakersfieldrouteisstillconsideringneedlesslycriss-crossingthroughfarmsandranch-esviatheWasco-Shafterbypass.Theimpactofwhichwouldresultinthebifurcationoffarmingoperationsandrenderingindividualparcelsoflanduneconomicaltofarm,somethingtheKernCountyFarmBureauhadbeenferventlyopposedtofromthebeginning.TheKernCountyFarmBureaujoinswithCaliforniaFarmBu-reauFederation,otherCentralValleyCountyFarmBureaus,KernCounty’sLocalGovernmentsandLegislatorstoprotectaffectedfarmersandourtaxpayerdollars.

The Environmentalists’ Misguided Plan to Repeal and Replace’ Fossil Fuels

TheRepublicansloganforwhattodoaboutPresidentObama’shealthcarereformis“repealandreplace.”Similarly,environmental-istshavelongengagedintheirownrepeal-and-replaceeffort.Theywantto“repeal”traditionalenergysources-coal,oilandnaturalgas,whichareabundantandeconomical-andreplacethemwithso-calledgreenenergysources,suchassolarandwindpowerandbiofuels.Butexactlyhowrealisticistheenvironmentalists’vision?Atleastforthenextquarter-century,notrealisticatall.Accordingtothefederalgovernment’sEnergyInformationAdministration,oil,naturalgasandcoalwereresponsiblefor83percentofU.S.energyconsumptionin2010.Nuclearpowerac-countedfor9percent.Biofuelsmadeup1percentandallotherrenewablesourcesrep-resented7percent,forarenewableenergytotalof8percent-notmuchwithwhichtobuildadynamic,competitiveeconomy.Butatleastgreenenergysourceswillgrow,right?Probably,butnotbymuch.TheEnergyInformationAdministrationestimatesthatby2035,biofuelswillprovide4percentofU.S.energycon-sumptionandrenewablesourceslikesolarandwindwillmakeup11percent-foratotalof15percent.Theseestimates,meanwhile,comefromthesameadministrationthatthoughtwewouldhave1millionelectriccarsonU.S.roadsby2015.Thusthereisreasontodoubtwhetherwewillcomeany-wherenearthoseEnergyInformationAdministrationprojectionsby2035.Let’sseewhy.-SolarPower:Solaristheclean-energydarling.Onthepositiveside,thesolarindustrypredictsthattheU.S.willinstallabouttwiceasmanysolarpanelsthisyearasin2011.Priceshavebeendecliningrapidly,thankslargelytoanexplosionofChinese-madepanels.There’stroubleahead,though.TheObamaadministrationsaystheChinesearedumpingcheapsolarpanelsintheU.S.marketandhasslappedonnewtariffsrangingashighas250percent,accord-ingtoaWallStreetJournalreport.Nevermindthepoliticalembarrassmentforanadministrationthathaspouredbillionsoftaxdollarsintosubsidizingourownsolarindustry,oftenwithdisastrousresultsliketheSolyndrabank-ruptcy.IncreasingthepriceofChinese-madepanelswilldepressthesolar-powerexpansiontheObamaadministrationisdependingon.-WindPower:IfyouaredrivinginplaceslikeWestTexas,youwilllikelyencounteraconvoyoftruckshaulingmassivewindturbinestotheirdestination.Buttakeacloserlookandyou’llnoticetheyalwaysseemtobeheadingintheoppositedirectionofthenearesturbanarea.Mostpeopledon’tlikeseeingorhearingthosehugewindturbines.Thenot-in-my-backyardproblemforwindpowerisespeciallyacute.
Thenthere’stheinefficiency.Becausethewinddoesn’talwaysblow,theturbinesproduceonlyabout20percentoftheenergytheycouldiftheywereabletooperate24/7.Duringcalmintervals,thepowercompanieshavetoturntomorereliablesources-tradi-tionalfossilfuels.Plus,thewindturbineshavebecomeabird-killingnightmare.TheU.S.FishandWildlifeServiceestimatesthatwindturbineskillabouthalfamillionbirdsayear,includingraptorslikeeagles.Thatcarnageisanother,albeitindirect,costofthisasyetinefficientandexpensiveenergy.-Biofuels:Congresshasmandatedtheuseofcorn-basedethanolasanadditivetogasolineforyears.Ethanolwassupposedtobecleanerthanfossilfuels.Butthenwelearnedthatproducingetha-nolrequiresalotmorewater,whichisofteninshortsupply.Plusittakesfossilfuelstoharvestandtransportit.Oh,andusingsomuchcornforfueldroveupdemandandthereforetheprice,whichmadeitunaffordableformillionsofpoorpeopleincountriesthatdependoncornproducts,likeMexico.Inordertofindanothersource,PresidentGeorgeW.Bush,alongwithaDemocraticCongress,decidedtomandatetheuseofcellulosicfuelsuchasfromswitchgrass-500millionbarrelsby2012.Butthenthecentralplannersdiscoveredthattheindustrysimplycouldn’tmeetanyofitsgoals,evenwithbillionsoftaxpayerdollarsinsubsidies.Thedaymaycomewhenwecantransitiontocleanenergy,butnotfordecades.Untilthereisareal“replace”vision,environmen-talistsshouldquittryingto“repeal”fossilfuels,whicharecheapandabundant,createrealhigh-paying(non-subsidized)jobs,andaregettingcleanerallthetime. StatelawrequiresDPRtocontinuouslyevaluatepesticidesaftertheyareinuse.Aspartofthisprocess,DPRconductsfieldstudiestomonitorexposuretoworkersandtomeasurehowpes-ticidesmoveandbreakdowninair,soilandwater.DPRusesthisinformationtodecideiffurtherregulatorymeasuresarenecessary.Pesticideusevariesfromyeartoyeardependingonanumberoffactors,includingweather,pestproblems,economicsandtypesofcropsplanted.OneoffivedepartmentsandboardswithintheCaliforniaEnvironmentalProtectionAgency,DPRregulatestheregistration,saleanduseofpesticidesandfostersreduced-riskpestmanage-menttoprotectpeopleandtheenvironment.Additionalinforma-tionaboutDPRispostedatwww.cdpr.ca.gov.
Pit Bulls: Vicious Dogs or Loving Pets?

Ofthevastamountofdogbreedsinexistence,pitbullsmayhavethemostcontroversialreputation.Tomanyfamilies,pitbullsarelovingcompanionsandloyalprotectors.Forothers,pitbullsposeathreattoanyonewhocomesincontactwiththembecauseoftheirstrengthandaggressivebehavior.Localdog-ownerBillWickwirerecentlyhadanegativeencoun-terwithagroupofpitbullswhiletakinghisLhasaApsoforawalkontheTaftbikepath.“Therewereagroupofpeopleonthelawnonthesideofthepathandtheyhadtwopitbullpuppiesandoneadultpitbullwiththem,”saidWickwire.“Aswepassed,theadultattackedourdogandwentrightforherthroat.”Thereisnodoubtthatanyunrestrainedanimalcouldbeasafetyissue,butforhowmuchshouldthedogbeheldaccountable?AninformalsurveywasgiventoasmallamountofpeopleintheTaftareaandtheresultsreflectedmixedopinions.Somepeoplebelievedthattheownerisresponsibleforthedog’sbehaviorandthatpitbullssimplyhaveabadname.“Foranyonewhogetsattackedbyapitbull,it’smorethanlikelytrainingissues,”saida24-year-oldTaftlocal.“Thedogsaren’tbadiftheyaretrainedcorrectlyandnotneglected.”Ontheotherhand,somebelievedthatpitbullsweremoredan-gerousthanotherbreedsandthattheyshouldbetreatedassuch.“Theyaredangerous!Theycausemoredamagethanotherdogsandthey’rehardertocontrol,”saida34-year-oldTaftlocal.Therewerealsoafewpeopleinthesurveywhosawnothingnegativeaboutpitbullswhatsoever.“Ihavealwayshadpitbullsallmylife,”saida19-year-oldTaftlocal.“Theyhavealwaysprotectedmeandgivenmeuncondi-tionallove.Ihavetakeninonesthathavebeenbeaten,starved,abandoned,andhurtintheworstways;neverhavetheyeverbeenaproblemformeoranykindpersonthatwentaroundthem.Ifyougiveananimallove,theywillloveyou100%timesmoreandbetter.”Eventhoughpeoplegenerallydisagreedonthetopic,acon-sensuswasreachedononepoint:thisattackshouldneverhavehappened.“Peopleneedtotakeresponsibilityfortheirpets,”saidWick-wire.“Thismeanstheyneedtobeabletocontrolthem,aswellascleanupafterthem.Thepathisanassettothecommunityanditneedstobesafe.Iamnotfullysatisfiedwithwhatthecityhasdone.”WickwireinformedthelocalAnimalControlabouttheattack,buthedidn’tgetastrongresponse.“Animalcontrolbasicallysaid‘thereisnothingwecando,’”saidWickwire.“Whatifitwasakidorifthedogattackedme?It’smainlyaboutsafety.”
Measure C Approval Brings Improvement Funds to SchoolsMeasureCwasrecentlyfinalizedandpassed,allowing$23.6milliontobeusedbytheTaftCitySchoolDistricttorepairandrenovatethedistrict’sschoolfacilities.MeasureCisageneralobligationbondmeasurethatwasplacedontheJune5ballotthisyear.ThemeasurewillprovidethestudentsofTaftwithabetterlearningenvironmentaswellasimprovingenergyefficiencyandloweringutilitycosts.“Themeasureneeded55%approvaltopassandrevenuewillcomefromhomeowners,”saidDistrictSuperintendentRonBryant.“Itwillcost$30per$100,000ofassessedvalueperyearforeachpropertyownerinthedistrict.Alargepercentageofthiscomesfromlocalindustry.”ThefirstofmanyproposedrepairprojectsistheadditionofsolarpanelstoeachoftheschoolsintheTaftCitySchoolDistrict.AlargepercentageoftheallottedfundsfrommeasureCwillbeusedtorepairandrenovateLincolnJuniorHighSchool.“Followingthesolarproject,we’llbeinstallingHVAC(heating,ventilationandairconditioning)forLincolnandJefferson,”saidBryant.“We’llalsobeworkingonafewsmallprojectsforConelyaswellasrenovatingtheirbathrooms.”ThesolarprojectisexpectedtobegininlateAugustandtheserenovationswilltakeapproximately3-4yearstocomplete.Beforetheybeginrepairs,thedistrictisrequiredbylawtohaveabond-oversightcommittee.“Weneedsevencitizenstoparticipateinthiscommittee,”saidBryant.“Therearespotsforonebonafidetaxpayergroup,onelocalindustrymember,twoparents,twoat-largemembersandoneseniorcitizen.Wewillmakemoreinformationavailablesoonaboutwhatisexpectedfromcommitteemembersandtheirduties,butthedeadlinetoapplyforthesecommitteepositionsisSeptember7.”Ifyouareinterestedinbeingapartofthiscommittee,contacttheTaftCitySchoolDistrictat661-763-1521.

pleasebothsidesratherthan“lettingthecardsfallwheretheymay,”rulingaloneonconstitutionalityasdesigned?IntheendneithersideisreallyhappyandtheCourt’sfunctionisblurredordiscredited.Whatifpreservingitsownimagebecamemoreim-portanttojusticesthandefendingtheConstitution?Orworse,whatiftheCourtforcedaroundpegintoasquarehole,sotospeak,toforceadecisionnotintended,orarguedforbyeithersidethereforecreatingnewlaw—afunctionofCongressalone?WhatifalloftheabovewereinonedecisionsuchaswiththerecentSupremeCourtdecisiononNationalHealthcare?HowcanthestatesorpeoplekeeptheSupremeCourtinlinewiththeU.S.Constitution?TheanswerisintheConstitutionasunderstoodbytheFounders.Ourconstitutionfirstdividedpowerbetweenthestatesandthefederalgovernmentwiththepowersgiventothefederalgov-ernmentlisted,definedandlimitedandthoseofthestatesleftundefinedandnotlisted,asperAmendment10.Thisisknownasfederalismandissometimesthoughtofasamarriage—sharedandequal—neitherthestatenorfederalgovernmentthemasternorslaveoftheother.Theportionofpowerlefttothefederalgovernmentisthendividedbetweenthelegislative,executive,andjudicialbranches.Thedownsideoffederalism(ourmarriage)isthattheumpireisoneofthethreebranchesofgovernmentatthefederallevelandassuchislikelytoruleinfavorofastrengthenedfederalgovern-mentwereittoarbitratebetweenthestatesandthefederalgovernment.Itisequivalenttotwoadversarialteamsplayingbasketballandtherefereeisamemberofthefederalteam.Thebalancingcomponenttothis,potentiallylopsideddivisionofpower,isthedoctrineofnullification.IsitconstitutionaltosaynotothefederalgovernmentwhenastatebelievesaSupremeCourtdecisiontobeunconstitutional?OnehavingalimitedknowledgeoftheConstitutionwouldsaynoandciteArticleVI,thesupremacyclause,astheendofthematter.OnmatterslistedintheConstitutionhewouldberight,butthistimetheSupremeCourthasruledonsomethingwhereitlacksauthoritytorule,clearlyastateissue,andassuch,ifleftunchallenged,certainlydamages,perhapsevennullifies,the10thAmendmentoftheConstitution,whichleavestothestatesallareasnotdelegatedtothefederalgovernment.Thisunderstand-ingpre-existedanylawonhealthbyacoupleofcenturies.Tocurbtheumpire(SupremeCourt)shouldheclearlyfavoroneside,theFounderssupportedthedoctrineofnullification.
Ratherthansuethefederalgovernmentforhavingexceededitsconstitutionalpower,the26statessodoingshouldinsteadhavefollowedtheIdahoexampleandinessencesaid“notinourstate.”Theefforttogrowthefederalgovernmentbeyondthelistedboundswouldhavebeenunenforcableifenoughstatesdidso.Suchhastwohistoricalprecedents.ThomasJeffersonin1798attemptedtonullifyTheAlienandSeditionActscreatedbyhisFederalistPartypredecessors.Theseraisedresidencyrequire-mentsforcitizenshipfrom5yearsto14.Moreover,thelawallowedthepresidenttodeport“dangerous”foreignersduringtimesofpeaceandimprisonthemduringtimesofhostilities.Anyonedefamingorimpedinggovernmentofficials,includingthepresident,wassubjecttoheavyfinesand/orimprisonment.Jeffersoniansobjectedonthebasisoftheunreasonableem-powermentofthepresidentandtheattackontheFirstAmend-ment,particularlyfreedomsofspeechandpress.Theytoosaid,“nowilldo.”Becausenullificationwasbetterunderstoodaspartofthe“balanceformula”oftheConstitutionandbecausetheoffendinglawwasdesignedtolastonlyuntil1801,(Federalistsdidnotwantitusedagainstthemshouldtheylosethenextelec-tion),nullificationstayedinplace.NexttousetheNullificationDoctrinewasSouthCarolinawithrespecttothe1828“TariffofAbominations,”believedbythem,andneighboringstates,tobeunconstitutional.Oppo-nentstoitdeclaredittobe“nullandvoid”withintheirborderandthreatenedtotakeSouthCarolinaoutoftheUnionifWash-ingtonattemptedtocollectcustomdutiesbyforce.PresidentAndrewJacksonpreparedtoinvadethestate.AcompromiseTariffof1833graduallyloweredthetarifftoaccept-ablelevelsandtheissuefadedaway.OnemightarguethattheCivilWarendedtheNullificationDoctrinebuttherealrootcauseoftheCivilWarwastheprac-ticeofslavery,(Iamawarethattheimmediatecausewaskeepingtheuniontogether),whichpracticemadeamockeryofthewholelibertyconcept.Theslaveissuepre-datedtheDeclarationofIndependenceandIwouldneedanothercolumntoshowwhythewardidnotexemptthenullificationargument.CriticaltothesuccessoftheNullificationDoctrineisthenumberofstatescommittedtoit.Obviouslyonestateorafew,unabletoprevailatleastamajoritytofollow,wouldbeeasilyoverpoweredbyanoverwhelmingfederalgovernmentpower.Butifthe26states,whosuedthefederalgovernmentonthemandateissue,nowsaidwewillnotcomply,thefederalgovern-mentwouldbeforcedtofindaface-savingexitontheissueandbackdown.Thatisthefinalconstitutionalcheckonoverreach-ingfederalpower—theoneleasttalkedaboutandunderstood.If,atthistime,thestatesdonotcareenoughtopreservetheirpowertheydeservenottohaveit,orliberty.
