ORDER DISMISSING MOTIONS FOR POSTCONVICTION RELIEF

THIS CAUSE is before the Court on Defendant's pro se "Motion for Post-Conviction

Relief," filed July 2, 2012, and his "Motion to Amend the Pending Motion for Post-Conviction

Relief," filed July 23, 2012, pursuant to Rule 3.850, Florida Rules of Criminal Procedure. After

due consideration of the instant motions, record, and relevant legal authority, the Court finds that

the motions should be dismissed as untimely and successive.

On January 24, 2001, Defendant was found guilty by a jury of second degree murder. On

March 16, 2001, Defendant was sentenced to life in prison as a habitual violent felony offender.

The judgment and sentence ofthe Court were affirmed in June 2002.

Defendant filed a motion for postconviction relief in January 2003, which was denied by

order filed on December 15, 2003.' A second motion for postconviction relief was dismissed by

the Court by order filed on June 15, 2004.2 A third motion for postconviction relief was denied

in part and dismissed in part by order filed on October 18, 2005.3

In the instant motions, Defendant asserts several claims which he characterizes as

fundamental error. In his first two claims, Defendant alleges that the trial court erred by

providing erroneous instructions to the jury. In his third claim, Defendant alleges that the

evidence presented at his trial was insufficient to support the jury's verdict. In his fourth claim,

Defendant asserts that he was denied due process because he was tried on an indictment which

was based on perjured testimony. In a letter attached to his "Motion to Amend the Pending

Motion for Post Conviction Relief," Defendant requests "that the initial motion be struck from

the record and replaced with the amended motion," apparently waiving the claims in the original

motion which are not included in the amended motion.

The rules of criminal procedure require a defendant to file a motion for postconviction

relief within two years of the date that the judgment and sentence under attack become final.

See Fla.R.Crim.P. 3.850(b). A sentence becomes final for the purposes of rule 3.850 when

direct review proceedings are concluded and jurisdiction to entertain a motion for postconviction

relief returns to the trial court. _S_eee Jones v. State, 602 So. 2d 606, 607-608 (Fla. 1st DCA

1992). In the instant case, Defendant's judgment and sentence were affirmed in June 2002.

Consequently, Defendant's instant motions were filed beyond the two-year time limit stated in

the rule.

In addition, the instant motions are successive. Defendant does not include, and the

Court does not find, any valid reason why Defendant's claims could not have been raised on

direct appeal or in his original postconviction motion.4 Simply construing these alleged errors

as "fundamental" does not relieve Defendant of the time bar contained in Fla. R. Crim. P. 3.850,

or of the rule's provisions regarding successive motions. See Hughes v. State, 22 So. 3d 132

(Fla. 2d DCA 2009)(holding that allegations of "fundamental error" could not be used as

mechanism for seeking review ofuntimely motion for postconviction relief). As such, the Court

finds that the instant motions are an abuse ofprocedure pursuant to Fla.R.Crim.P. 3.850(f). The

motions are properly dismissed.

Accordingly, it is hereby ORDERED and ADJUDGED that: .

.. 1. Defendant's pro se "Motion for Post-Conviction Relief," filed July 2, 2012, and his
