Council Meeting Minutes July 11, 2011

The Village of Chippewa Lake Council met in regular session on Monday, July 11, 2011 at the Chippewa Lake Community Center-Pochedley Hall located at 24 Circle Crest. Melter seconded. 6 Ayes. Motion approved. Mayor Dodaro asked if anyone was here for a zoning complaint or a zoning permit. No one answered. Mayor Dodaro gave her thanks to everyone who helped with all of the Fourth of July activities that took place in the village. Wendy from the Medina County Auditor’s office was present to report on upcoming news. The county hired twenty new employees as data collectors for the auditor’s office recently. They will be taking measurements of every outside building in preparation for the 2013 property taxes. These employees have gone through a drug and background check by the county. They will be wearing blue county auditor shirts. The auditor’s office will have a booth at the Medina County Fair which will be held August 1-7.

Committee Reports

Safety: Fire Department Report: Hunter reported that there were 4 EMS calls and 1 fire call for the month of June. The report states that there were 8 fire calls and 27 EMS calls so far this year. (See attached report) Hunter read the patrol report for the deputies as follows: 3.5 hours working on reports, 2 written reports taken, 4 calls assigned by dispatch, 16 self-initiated calls, 1 in person complaint, 93 citizen contacts, 3 assists to citizens, 6 traffic stops, 5 village citations, 5 written warnings, 13 suspicious persons, 6 suspicious vehicles and 6 assists to other police departments. The deputies worked a total of 110.5 hours for the month. They logged 526.2 miles on the cruiser using 59.6 gallons of gasoline. (See attached patrol report) Hunter said that Deputy Easterday took a sheet protector and made up samples to show what current permits look like. Now each deputy has a copy of these for their reference. Hunter said that Deputy Easterday also gave a year to date stat report. The report showed the deputies worked a total of 504 hours; they logged 2302.7 miles on the cruiser using 274.2 gallons of fuel. Hunter said that a Safety Committee meeting was held on Wednesday, June 22 at 9:30 am at the village hall. (See attached minutes) Hunter said the meeting was called because of some issues involving several teenagers in the village and what residents can do to put a stop to the activities.

Village of Chippewa Lake Council Meeting Minutes July 11, 2011 Page 5 Safety (Continued): Deputy Easterday and Law Director Allan Michelson were invited to this meeting to provide insight. Some of the issues addressed were: foul language, curfew, obstructing traffic by walking down the middle of the road and refusing to yield to cars or golf carts, activities at the playground and trespassing. The trespassing was on private property, docks and boats. The group discussed our options with Deputy Easterday and Allan Michelson. Claire List who also attended the meeting posted some valuable information on the Neighborhood Watch email bulletins. Hunter said one of the best things we can do is to document when something happens by getting out your camera phone or start your video recorder on your phone. It is important that you get as much information as you can such as who was involved, what they were wearing, how many people were involved, when and where the activity took place and what happened. Deputy Easterday also suggested that residents put NO TRESPASSING signs on their docks. It won’t necessarily keep people off or out, but it does give the deputies grounds for a citation or a warning. The first thing to do when something happens is to make a report with a deputy ASAP. The non-emergency number for dispatch is 330-725-6631. Please also send a message to Neighborhood Watch so a bulletin can go out right away. Little can be done two or three days later and in the meantime another offense could be repeated in another area of the village. The Law Director and Deputy Easterday confirms that charges can and have been brought against kids for disorderly conduct and curfew violations.

Village of Chippewa Lake Council Meeting Minutes July 11, 2011 Page 6 Safety (Continued): Deputy Easterday said that the curfew violations would be enforced for all village minors. Discussion was had about a minor with a guardian. The guardian would mean a parent, legal guardian or an adult relative, not an older sibling or friend. Mayor Dodaro asked that the deputies work more hours during the peak activity times rather than when it was convenient for them to work. It is mentioned that golf carts can park on the grass near the docks, but other motor vehicles cannot. The south lot on Bungalow Bay near the tennis courts is available for parking at anytime, but residents MUST have a parking permit to park there. The west lot has restricted hours and is available to residents with a permit who are using the playground or the tennis courts. There is no parking permitted after 10 pm at this location. It was also noted that toy vehicles are not permitted on village streets. Cathy said that she did get a call from the County Prosecutor’s office today and someone was cited for a curfew violation. They asked her to fax over a copy of Ordinance #407-91 (Curfew Ordinance) which she did. Robbins asked if Mr. Jansen’s complaint at the last meeting was ever resolved. Hunter said that he indicated that Mrs. Jansen had been knocked down by kids that were trespassing through their property. Following the Council meeting, Deputy Girard spoke with Mr. Jansen in detail about the incident.

Melter that is was important to note that Deputy Girard did take a statement from Mr. Jansen and his neighbor who witnessed the incident. Mayor Dodaro added that Deputy Girard also went to some of the kids’ houses. Zoning: Osborn reported that the Zoning Board held a Work Session meeting on June 16, 2011 at 7 pm at the village hall. (See attached minutes) Osborn said that the Board found that decks are not mentioned in the R4 section and they should be so they will be added. The Board also discussed whether to eliminate the hard surface requirement for driveways to enhance drainage. The Board is discussing whether to regulate weed growth on driveways and parking pads. Nick Schmitz recommended stiffer fines ($1,000.00) for people who do not get a variance when needed. Nick Schmitz complained about fishermen parking on Shadow Shore. Shadow Shore is a “No Parking” street. Paul Vereb complained about kids on playing on the docks and people parking at the beach parking lot without a proper permit. They were both told to contact the Sheriff’s Office when they see these problems. The next Work Session will be scheduled for late August or in September. The regular Zoning Board meeting was held on July 5, 2011 at 7 pm at the village hall. (See attached minutes) Under new business, Margaret Glenn at 140 Brookshore wanted a variance for a new front porch.

Village of Chippewa Lake Council Meeting Minutes July 11, 2011 Page 8 Zoning (Continued): It’s going to be smaller than the original one but still encroaches into the right of way. The variance was approved. Mark Krosse was at the meeting for three separate variances. The first one was a variance for moving the existing home at 461 Shorefield to a new lot at 462 Shorefield. The house would be 3½ feet too close to the rear lot line. Zoning requires 10 feet in that situation and it would be only 6½ feet so the variance was approved. The second variance was for the driveway at the new house at 461 Shorefield. The driveway is only going to be 19½ feet long instead of the 20 feet that code requires. That variance was approved. The third variance was for grassy pavers at the new house at 461 Shorefield for overflow parking and that variance was approved. Cruse from 51 Willow Wood was at the meeting for a variance for a new deck on the front of their house. It’s going to be 8 foot by 10 foot and about 10-12 inches high. This is considered a “floating deck” because it is not attached to the house and that variance was approved. Wills from Bass Bay needed a variance for a driveway that was put in without the proper permit. The driveway runs all the way to the property line and a two foot setback is required by code. The variance was approved by a vote of 3 in favor and 1 against. Sherry Clarkson was at the meeting and she questioned if the village should eliminate the hard surface requirement for driveways and parking pads as gravel would allow for better drainage. The Board is discussing this issue in their Work Session meetings.

Village of Chippewa Lake Council Meeting Minutes July 11, 2011 Page 9 Zoning (Continued): Osborn personally thinks it would be a good idea to eliminate the hard surface requirement especially on residential properties but not on commercial or industrial properties. He thinks it would keep a lot of the water from being shot down our storm drains into the lake. Under old business, Demeter on Lee Lore has been given until August 2nd to move the placement of his shed. He has been given extensions because that area is still muddy and wet from all the rain. Benninger on Bungalow Bay will apply for a variance to pave the entire driveway including the illegal extension at the next Zoning Board meeting on August 2nd. There has been no further word from Derwin Slabaugh on Craggy Creek. The Law Director Allan Michelson is charging the neighbor, Sexton, for draining water onto neighboring properties. Schmitz asked if there was anything that could be done about someone blocking the lake view with new construction. He was told that as long as the structure complied with the zoning code it would be allowed. Mayor Dodaro addressed the Zoning Board with a caution about variances and they are supposed to be approved when there is a hardship. A hardship is not something of one’s own making. Some variances are too easy to get after something has been completed without prior approval. She also questioned if all homeowners were being treated the same.

Village of Chippewa Lake Council Meeting Minutes July 11, 2011 Page 10 Zoning (Continued): Paul Vereb suggests that the village require the zoning permits be displayed while work is being completed. This would make it easy to tell if a village permit was issued for this work to be done. This will be discussed further at the next Work Session. Zoning Inspector’s Report: The Lake Road property next to Stop N Go is in violation of the Property Maintenance Code. Contact has been made with an employee who works for Helms who is the property owner. The property is to be secured by July 18th or the Zoning Inspector will turn this over to the County Prosecutor. The Bungalow/Shadywood property that has not been maintained should be taken care of in the near future. Contact has been made with someone who will comply with the violations. The Law Director is working on the complaint about large amounts of wood on the property at Willow Wood. The Law Director is filing charges concerning the parking of a semi truck on the Latex factory property and the storage of many tires. Complaint of wood and junk in front of garage on Clover Cliff will be referred to the Law Director if not removed by July 18, 2011. There is a tree that is half dead in the backyard of a property on Bass Bay. That is currently under investigation by the Zoning Inspector.

Village of Chippewa Lake Council Meeting Minutes July 11, 2011 Page 11 Zoning (Continued): The house at 73 Willow Wood Drive is in foreclosure. The yard has been mowed but there is still furniture and trash in the driveway. The Zoning Inspector is still working to contact the current owner. The next regular Zoning Board meeting will be held on Tuesday, August 2, 2011 at 7 pm at the village hall. Finance: Cathy said that everyone on Council received a new Information list recently. She said she knows she has sent out a couple since the first of the year. She said when that happens there have been changes in contact information. Cathy presents the bank statement and accounting reconciliation ending June 30, 2011 for Council’s review. She said that balances are reconciled. The only adjusting factor is a direct deposit not entered until July 1st and also interest not entered until today. She asks for Council’s signatures on her copy of these documents. She next goes over the monthly report which is the Cash Summary by Fund report. The balance in all funds (General, Streets, Road & Bridge Levy, Permissive and Parking Violations Bureau) was $193,221.11. The revenue deposited from June 1st through July 11th was $31,888.13 and the expenditures were $48,517.84. The fund balances were $176,591.40 before the approved bills were paid. With no questions on the monthly report she continues on with the second quarter reports. Cathy first reviews the Revenue Status report as of June 30, 2011 with Council and Mayor.

Village of Chippewa Lake Council Meeting Minutes July 11, 2011 Page 12 Finance (Continued): Cathy said that all members have seen this report many times before and it is pretty simple to understand. This reports show the actual dollars collected since January 1, 2011 to June 30, 2011 in each labeled account. She said the last column shows the percentage of funds received as estimated in the budget. Cathy reviews this report line by line to explain in detail. With no questions she moves on to the Appropriation Status Report. Robbins asked about any word received about Local Government Funding. Cathy said she has not received any official word about the expected reduction in this funding. Lynda Bowers who was at the last month’s meeting said to expect about 5% reduced revenue this year and 30% for next year. The reduction in this revenue will be taken into consideration when preparing the 2012 Appropriations. Cathy has labeled the accounts in the General Fund so all members of Council know very clearly what each account represents. Cathy said that the final appropriation column shows what Council approved in January. Cathy said the YTD expenditures are $77,671.77 spending only about 24% of what was appropriated for the General Fund so far. She reviews several accounts as examples of what this report shows. She continues with reporting on the Street, Road & Bridge Levy, Permissive and Parking Violations Bureau Funds to show how much has been spent in those funds and what is remaining in unencumbered balances.

Village of Chippewa Lake Council Meeting Minutes July 11, 2011 Page 13 Finance (Continued): Mayor Dodaro said that a Mitigation Wish List was created several years ago and turned in to Medina County Emergency Management. They would like to know what items, if any, have been completed since the list was created. Most of the items on the list were roads and storm water related. Riedel adds that the list includes land renovation including the hills and the bank near the boat ramp and some storm sewer reconstruction. Riedel has reviewed the list with Mayor Dodaro and now she will mail this back into Emergency Management with the update. Melter said he met with Patrice Theken who was retiring but has been picked up by the county to consult and help Chris Jakab. Melter gives an update about the ADA request for handicapped parking at the Circle Park and the Point Park. Patrice informed Melter that they would only pay for the handicapped spaces not the entire parking lot. Melter sent her a revised request of $1,575.00 but he thinks we should consider pulling the request. Melter said that the village doesn’t have the money to cover paving the remaining portion of the lots. Motion made by Melter to withdraw the ADA grant request. Riedel seconded. 6 Ayes. Motion approved. Melter will send Chris Jakab a letter stating the village’s intention to withdraw the ADA request. He will mention that we did not mean to waste his time and hope this will not affect future grant considerations. He will also explain with the budget cuts coming the village doesn’t have the money to cover the extra paving at this time.

Village of Chippewa Lake Council Meeting Minutes July 11, 2011 Page 14 Finance (Continued): Mayor Dodaro has received information about a meeting concerning the Brownfield Grant program. Mayor Dodaro asks Melter if he would attend this meeting and he agrees. Buildings & Utilities: Melter read the Buildings & Utilities report for July. (See attached report) He reports that Jenkins Maintenance has completed the gutter drain pipe work behind the Community Center. Melter contacted Ohio Edison about moving the guy wire on the pole behind the building and they say it cannot be moved. Melter said Asphalt Specialists have us on the schedule to pave the parking lot on July 13th. They say it will take about two days to complete. The Community Center will not be available for use during this time. Melter said the women’s restroom door does not lock and he is meeting with Bill Lee to get that fixed. Pfaff Electric fixed all the beach lighting and installed a power outlet to the Point Park. The street light that is out on Beachside Blvd/Point Park cannot be fixed due to water problems on the lakefront. They cannot get a utility truck out to the pole. Tom will pursue this repair when the ground dries up. Mayor Dodaro asked Melter to please train the officers on how to check the security camera. He said he would develop a log and sit down with Deputy Easterday to train him on this system. Mayor Dodaro asked Melter if he was happy with the new system. He said it is much easier to use than the old one.

Village of Chippewa Lake Council Meeting Minutes July 11, 2011 Page 15 Buildings & Utilities (Continued): Robbins asked Melter if he could obtain a quote to add another circuit down at the beach parking lot. He said there are events held in that area such as Lions Club Carnival and the Polar Bear Jump where the extra circuit would be helpful. Mayor Dodaro said that those events aren’t really village events so maybe those organizations could donate towards this upgrade. Community Relations: Robbins said that the village just came out of a fabulous Fourth of July weekend. Things that really make this village shine took place over that weekend. The community involvement and the success of the events were extraordinary. (See attached report) Robbins said the Village Pride put in a winning float in the Fourth of July parade. On July 4th, they sponsored the Cardboard Boat Race which was won by Bud Hardesty and another fellow. Keith Riedel placed second and Alan Robbins placed third. There was a lot of hard work put into the design and creation of the many boats that entered. Robbins estimated there were about 1,000 people in attendance at the close of the ski show. On July 30th the Village Pride will have the Lighted Boat Parade. The Lions Club on the same day will hold their Carnival on the beach parking lot. The Village Pride will hold their annual Appreciation Party on Sunday, August 21st starting at 6 pm at Point Park. There will be music, games, food and the beautification awards will be presented.

Village of Chippewa Lake Council Meeting Minutes July 11, 2011 Page 16 Community Relations (Continued): Robbins will be working with leadership on the some target areas for planting next year. On Sunday, December 18th there will be a Christmas Caroling Party at the Point Park with awards for house lighting displays. The Neighborhood Watch has nothing new to report. Claire continues to send email bulletins as needed to keep the residents up to date with current information. There is nothing new to report concerning the Lafayette Fire Fighters Association, Local Government Funding, Upper Chippewa Creek Watershed, Chippewa Landings or the Medina County Parks District. Robbins said the Show Ski Club did a bang up job with the July Fourth program and they will be putting on a Labor Day show also. He said they practice at home on Thursday evenings and Saturday mornings and there is great attendance then also. They practice at Emerald Lake on Wednesday evenings at 7 pm. The Learn to Ski date had to be rescheduled for sometime in August because of the high water. Their dinner show at Emerald Lake has been scheduled for August 6th. He said that Doug and Rebecca Ribley recently went over to China to compete and won first place. We have world champions among us. Robbins said the Regionals were held last weekend and the ski team is waiting to hear how other teams did that will affect the Nationals. The Lions Club had a terrific parade this year with 123 entries and the theme of “Holidays on Parade”. The Lions Club also puts out all of the flags along the roadways.

Village of Chippewa Lake Council Meeting Minutes July 11, 2011 Page 17 Community Relations (Continued): Robbins reminds people to “Save that Date” on January 28th for the next Polar Bear Jump. He mentions again about the Carnival on July 30th on the beach parking lot. The Yacht Club will hold their Regatta on the July 30th weekend. They are still working with the Sea Scouts on their project. The Chippewa Lake Watersports Association has had several meetings. They started their Monday programs on June 6th. They are having some Learn to Ski clinics. They are looking at bringing in a pro-barefoot instructor the week of the Medina County Fair which is August 1-7. The Association is look for ways to get common sense boating courtesies out to those using the lake. Such items mentioned were: cutting between sailing boats during races, jet skis too close to the shoreline and cutting through the slalom course while in use. They would also like to place a sign “Slalom Course provided by Chippewa Lake Watersports Association” somewhere near the boat ramp. Mayor Dodaro asked if they are going to put a sign near the Gloria Glens boat ramp too. Robbins said that was a good question. They would to fine tune this request before formally coming to Council. The Briarwood Beach Garden Club’s community gardens are planted, well maintained and it is doing well. Village of Chippewa Lake Council Meeting Minutes July 11, 2011 Page 18 Streets (Continued): He’s trying to get some answers on where it is coming from, who is responsible for it, how to fix it and where do we get the money. Riedel said that Sanitary Engineers have come out and taken their camera through their lines and smoke tested storm sewers and sanitary sewers. They have tested the water for chlorine and fecal matter. Riedel said it looks like it is surface water that is seeping down from the top of the hill. Riedel plans to contact Medina Soil & Water to help pinpoint the problem and how to fix it. Riedel thinks that a French drain into the lake might alleviate the problem and he has discussed this with Tom James of the Parks District. Riedel is still looking into all options. Riedel passes around pictures of parking violations on Bass Bay. Riedel said he has picked a new sign for this area that says: “No Parking From Here To Corner” and it will be put up tomorrow. Riedel said that the major pot holes have been taken care of. He said when we get a few more dollars we will get some cold mix and take care of the ones that still need attention. Riedel wanted to publicly thank all the people that remain unknown and un-named for the wonderful accomplishments that just mysteriously happen in the village. Riedel said at the end of tonight’s meeting he would like to go into executive session to discuss some possible acquisition of land with the Law Director for the village. Ordinance #718-11 “An Ordinance Approving the Maintenance Agreement Between Medina County and the Village of Chippewa Lake for Boundary Roads and Authorizing the Mayor to Execute the Same.” had its third and final reading by the Law Director.

Village of Chippewa Lake Council Meeting Minutes July 11, 2011 Page 19 Streets (Continued): The Law Director said this ordinance is not an emergency so if you pass it tonight it will go into effect in 30 days. The agreement basically says that the county is responsible for maintaining Chippewa and Lake Roads which are the village’s boundary roads. He explains that if there is a change or extraordinary work proposed then the village would be asked to contribute. The village will have the option to say no. Mayor Dodaro asked what if the village decides not to pass this ordinance accepting the agreement. The Law Director said that he thinks the County will still maintain the roads. The Law Director said that what the agreement says is: “If the County and the Village agree that it is necessary and desirable that more extensive or unusual maintenance and repair is needed then the cost would be prorated.” The Law Director recommends the passage of this agreement and he thinks it’s a good idea. Melter asked if there is legislation that requires Medina County to take care of these streets. The Law Director said they are county roads and it is up to the County to maintain them. Melter and Mayor Dodaro question why this agreement is necessary. Melter asked if the other villages are receiving a boundary roads agreement. The Law Director said he has not seen one for the Village of Gloria Glens. Mayor Dodaro asks what will happen if we table this agreement for a while. The Law Director doesn’t think anything will happen. The Law Director said that if there is no motion to adopt this ordinance it can be brought up again next month. Motion made by Riedel to consider this ordinance at the August 8th Council meeting. Melter seconded. 6 Ayes. Motion approved.

Village of Chippewa Lake Council Meeting Minutes July 11, 2011 Page 20 Parks: Bican also wanted to thank some of those un-named people that Riedel was referring to. She thanked several residents that take it upon themselves to go the extra mile. Bican said that the lattice work and the new planting in the pavilion in the median strip on Briarwood Blvd look great. She mentioned how nice the hostas are near the beach and boat ramp. She said the tennis courts are finished and they look awesome. She said the next project she is working on is getting the beachwall power washed and painted. She has received a quote for $300.00 to do this work. Motion made by Bican to encumber up to $300.00 to have the beachwall power washed and painted. Riedel seconded. 6 Ayes. Motion approved. Bican asks the Law Director if he knows exactly what the boundaries are for the Pochedley Park property. The Law Director said he has maps and he will bring them to the August Council meeting. Bican asks Robbins to please look at the benches on the beach. She wants to know if the plastic lumber benches would work. The benches need replaced badly. Robbins said he would look at them. Melter said that he checked into the chemical for Reese’s Pond. When we first looked into this treatment it was implied that a $300.00 application would do it. Unfortunately, that $300.00 application would only last 10 days and you have to repeat it. Mayor Dodaro asked about the Soil & Water people. Bican said she met with them and they said basically this is what happens when a pond has set for a lot of years. They recommended dredging the pond but that is expensive.

Riedel would like to encumber some money to find a dredging expert to evaluate the dredging of Reese’s Pond. Motion made Riedel to encumber up to $150.00 to investigate dredging options for Reese’s Pond. Melter seconded. 6 Ayes. Motion approved. Mayor Dodaro said she received a call about a resident wanting to use the Point Park for a kid’s party on Sunday, August 7th. There was no other village events taking place then so no one had an objection. Mayor Dodaro told the resident that the park still remains open to the public. Mayor Dodaro thanked Cyndy Naragon for taking care of the stickers, keys, permits and lake access passes. Many people are still coming to her house. Mayor Dodaro said the village really needs to re-think how these are disbursed next year. Law Director: He said there is now legislation in place that allows the village to contract with any other political subdivision including townships. This would cover any type of service we need done such as: snow plowing and pothole repair for examples. Lafayette Trustees Lynda and Byron would like a meeting with the village to discuss this further. Mayor Dodaro said that we will set up a meeting because we are looking for options for road work and snow plowing. We already pay Lafayette Township millage and if that would go towards the cost of these services that would be even better. The Law Director thought the millage we pay to Lafayette Township amounts to about $3,400.00 per year. They get that as part of the property tax.

Village of Chippewa Lake Council Meeting Minutes July 11, 2011 Page 22 Law Director (Continued): The Law Director said that what the village gets for that is the ability to vote for their trustees. The Law Director said he has seven cases to report on tonight. Three of them are zoning cases that have been filed. They are all set for arraignment on July 20th. The fourth case is a guilty finding of persistent disorderly conduct and is set for sentencing on July 20th. The fifth case is a drug paraphernalia charge. The defendant had a clean record and was accepted into the “First Offenders Program”. This is a program of counseling and awareness and upon successful completion the charge is dismissed. The sixth case is for aggregated menacing, resisting arrest, drug use and drug paraphernalia. There is a competency hearing scheduled for Friday, July 15th to determine if the defendant is competent to stand trial. There is a new domestic violence case that is pending. No trial date has been set. On July 15th there is a trial on the charges of failure to reinstate operator’s license and driving under a suspended license. Old Business: None New Business: Cyndy Naragon wanted it added for the record that one of her favorite events is the end of summer Labor Day Dance on the beach parking lot. She said she didn’t hear that mentioned in Robbin’s report. Robbins said he did overlook that in his report. Dee Dee Duecker said that there will be a Blood Drive at the Church at the Lake tomorrow, July 12th, from 3-7 pm.

At 9:25 pm, Riedel made a motion to go into executive session to discuss the possible acquisition of land with the attorney for the village. Melter seconded.
