Reasonable Conditions.
The Zoning Hearing Board granted the Appellants a variance whereby they were permitted to house up to 10 rescue cats, in addition to up to 3 house cats, at their property. The Appellants filed a notice of appeal, asking the Court to rule that variance conditions imposed by the Zoning Hearing Board were not reasonable. The Court held that the limi-tation on the number of cats which could be maintained at the property was directly re-lated to the applicable Zoning Ordinance, which limited the number of animals which may be maintained at a single-family residence, located within a residential district. Accord-ingly, the Court denied Appellants’ Notice of Appeal.

I. INTROdUCTION
Before the Court for consideration is Appellants’ Notice of Appeal filed on August 31, 2016. The Court heard oral argument on december 7, 2016.
II. FACTUAL BACKGROUNd
Appellants, Catherine McCulloch (“McCulloch”) and Feline Finish Line (“Feline”) (collectively “Appellants”), filed a Notice of Appeal to the Zoning Hearing Board of the Borough of Catasauqua (“ZHB”) seeking a use variance and dimensional variances in order to operate a feline rescue at the property situate and known as 415 prospect Street, Catasauqua, pennsylvania 18032 (“property”).

The testimony and other evidence presented before the ZHB at the time of hearing indicates that the single-family home pres-ently located upon the property was being occupied and utilized as a single-family residence for McCulloch and her grandson and had been used as a single-family residence since it was originally constructed. The property is located in a Medium density Resi-dential district (R-2) under Section 280-20 of the Zoning Ordi-nance of the Borough of Catasauqua (“Ordinance”). In addition to utilizing the property and the home thereon as a single-family residence, the evidence indicated that McCulloch and Feline, a non-profit entity, used it as a feline rescue accommodating forty (40) cats in addition to McCulloch’s three (3) “family cats.”
The ZHB granted Appellants’ request for a use variance for Appellants to operate a kennel for a maximum of ten (10) cats on the property, not including McCulloch’s three (3) “family cats” along with dimensional variances as well as a variance from Section 280-29(17)(h) regarding inspections of the kennel operation. The ZHB further placed certain conditions on the use and dimen-sional variances as follows:
1. The operation will be limited to a maximum of ten cats, in addition to up to three cats which are the household pets of the Applicant;
2. That the variance will only be authorized for as long as the Appellants, [sic] Mrs. McCulloch, resides in the house; and
3. That the property will be subject to a monthly inspec-tion by the Borough to determine that everything is being run properly, and the cats don’t exceed the maximum number.
III. ISSUE
Whether the conditions imposed by the ZHB on the use and dimensional variances granted to the Appellants are reasonable?
Iv. dISCUSSION
Although Appellants raise a number of issues, the only issue for this Court is whether the conditions imposed by the Board on the use and dimensional variances granted to the Appellants were reasonable. (For example, Appellants argue that they should have

been granted a use variance. In fact, the Appellants were granted a use variance, so there is no true issue on this point.)
We begin our discussion with a review of the Ordinance re-garding the definition of a kennel. Section 280-19 of the Ordinance defines the term “kennel” as follows: “The keeping of a greater number of dogs and/or cats than are permitted under the ‘keeping of pets’ provisions of this chapter. A kennel may also serve other animals.” Section 280-30(9) of the Ordinance governs the use re-ferred to as the “keeping of pets.” Subsection 280-30(9)(c) provides as follows:
See Chapter 105, Animals, of the Code of the Borough of Catasauqua, which regulates the number of animals. In any case if more than 10 dogs over 5 months in age are kept on a lot, it shall be regulated by this chapter as a kennel.
Additionally, Section 105-14 of the Code of the Borough of Catasauqua (“Code”) provides as follows: “No person shall keep in an individual dwelling or on one individual lot of land more than three household pets.” The term “household pet” is defined at Section 105-11 of the Code as “Any dog, cat or other domestic animal normally and ordinarily kept in or permitted to be at large in the dwelling of its owners.”
Since the number of cats Appellants propose to maintain on the property exceeds three (3), the use proposed by the Appellants is, by definition, a kennel under the provisions of the Ordinance. The kennel use is not a permitted use in the R-2 Zoning district. In addition, there are specific requirements applicable to a kennel use as per Section 280-29(17) of the Ordinance.
Although Appellants’ Notice of Appeal requests that “this Court reverse the decision of the Zoning Hearing Board of the Borough of Catasauqua and direct that the Appellants’ request for the above mentioned variances be granted,” it is clear from the content of said notice of appeal that it is the limitation upon the number of cats which may be maintained on the property which is being challenged, i.e., limiting the number of cats permitted to be maintained on the property to ten (10) cats in addition to the three (3) household cat pets of McCulloch rather than allowing forty (40) cats to be maintained on the property.

The pennsylvania Municipalities planning Code (“MpC”) authorizes a zoning hearing board to impose reasonable conditions on any variance granted as follows: “In granting any variance, the board may attach such reasonable conditions and safeguards as it may deem necessary to implement the purposes of this act and the Zoning Ordinance.” Municipalities planning Code, 53 p.S. §10910.2(b).
In the instant case, the use proposed by the Appellants, a kennel, is not a permitted use in the zoning district where the property is located. Moreover, the property does not contain the minimum lot size of one (1) acre necessary for a kennel. The No-tice of Appeal that Appellants filed with the ZHB indicates a lot size of 9,457 square feet, less than 1/4 acre. Also, the total number of cats that Appellants proposed to maintain at the property, in-clusive of the three (3) permitted family pets, was forty-three (43), which is fourteen (14) times the number of cats permitted as household pets in an R-2 Zoning district.
The condition contested by the Appellants involves a “cap” of ten (10) rescue felines in addition to the three (3) permitted household pets. In pfile v. Zoning Board of Adjustment of Speers Borough, Washington County, 7 pa. Commonwealth Ct. 226, 298 A.2d 598 (1972), the Commonwealth Court addressed a variance request to establish a gasoline service station in a residential district where the use was not permitted. The evidence indicated that there were two (2) other gasoline service stations in close proximity to the proposed service station for which a use variance was necessary. The lower court granted the use variance reversing the zoning hearing board but imposed a condition that “no ‘highrise’ (over 20 feet) sign advertise the proposed station’s location.” Id. at 231, 298 A.2d at 601. The Commonwealth Court upheld the imposition of the restriction on the height of any proposed freestanding on-site advertising sign stating:
Here the lower court reversed the Board and had the same power to impose reasonable conditions relative to the grant of the variance. We believe that the height limitation imposed by the lower court is reasonable.
Id. at 237, 298 A.2d at 604.12

In Scalise v. Zoning Hearing Board of Borough of West Mif-flin, 756 A.2d 163 (pa. Commw. 2000) the Commonwealth Court addressed an appeal in which the property owner sought a use variance to allow a commercial tenant at the property owner’s lot to expand its commercial use which was not permitted in the residential district where the property was located by creating a storage area for pool supplies and accessories associated with the tenant’s business. Id. at 165. The requested variance was granted with limitations confining the expanded use to storage, limiting loading and unloading of materials during specific hours and pro-hibiting sales, manufacturing or construction activities. Id. In upholding the conditions imposed by the zoning hearing board in connection with the variance relief granted, the Commonwealth Court stated: “there is also no merit to [Appellants’] argument that the ZHB erred in imposing conditions on the variance granted. Section 910.2(b) of the MpC, 53 p.S. §10910.2(b), authorizes the attachment of reasonable conditions to a variance.” Id. at 168.
In the instant case, the limitation upon the number of felines which may be maintained on the property is directly related to the provision in the Ordinance limiting the number of animals which are permitted to be maintained at a single-family residence in a residential district. Therefore, we find that the conditions imposed by the Board on the use and dimensional variances granted to the Appellants are reasonable.
v. CONCLUSION
For the foregoing reasons, Appellants’ Notice of Appeal is dENIEd and dISMISSEd.

The Lawyer Referral office receives phone calls from clients requesting services from attorneys. At this time, the office will obtain all needed information from the client and contact the attorney to schedule. They are entitled to a half-hour consultation with the attorney for a $25 fee. An information sheet will be faxed to each attorney, which needs to be completed at the end of each consultation. The referral form must be faxed back to the LRS office upon completion of the consultation. Client fees are pre-paid to the LRS office. Fees are determined by the attorney for any services requested after the consultation. Please notify the LRS office if you are unavailable to accept referrals due to vacations, etc. This will ensure no clients are referred to your office while you are away. Please note that screening of clients is not permitted – no telephone consultations prior to the client coming in unless specified on the referral form. All attorneys must contact the client within 3-5 business days upon receipt of referral.

I further agree that I will not charge nor solicit any fees other than the $25.00 referral fee for the first conference, of one-half hour in duration, with the referral client. As part of the initial conference, I will advise the client in writing as to what further legal action I feel is required, if any. It is understood that the initial conference is for legal advice only and does not include the preparation of letters or legal documents and further that I will be compensated for any additional legal services in an amount to be agreed upon in writing by myself and the referral client. Any complaints submitted to the Bar Association of Lehigh County regarding attorneys who are members of the Lawyer Referral Service will be reviewed by the Lawyer Referral Committee and subsequently by the Board of Directors. Any actions will then be determined. All referrals must be processed within 3-5 business days. Any attorney who fails to process three (3) referrals within such period will be terminated from the program. case management tool Mark K. Altschuler, M.S. is Actuary for Pension Analysis Consultants, Inc. He is a professional qualified actuary with more than 25 years experience, with 15 years prior experience as an applied mathematician and analytical engineer. Mr. Altschuler has performed actuarial work in both the pension and commercial casualty areas. Mr. Altschuler has prepared thousands of marital pension valuations and draft QDRO’s for counsel. He has served as an expert witness in the equitable distribution of pension values and his testimony has been favorably cited by Appellate Courts on complex pension issues. He has produced rate filings in various lines of commercial insurance, performed actuarial analysis and developed actuarial software packages. As an actuary and as an analytical engineer, Mr. Altschuler has developed complex software packages and mathematical models. Mr. Altschuler earned a B.A. in Mathematics from the University of Pennsylvania in 1968 and a M.S. in Applied Physics at Case Western Reserve University in 1978.

“The Compromise of 1850 and the Role of the Constitution and Law in American Life as the
Civil War Approached” Presented by: Malcolm Gross, Esq.

This program will cover the struggle to avoid the path to Civil War by adoption of a compromise regarding numerous points of difference between the north and south. In 1850 the surviving greats of American history came together in an effort to save the Union. Henry Clay, Daniel Webster, William Seward, John C. Calhoun, Thaddeus Stevens and others all labored to arrive at answers to the problems of slavery. The result was a “Compromise” which instead of solving the problems, fueled the legal and political struggles between not only the north and south but the political parties. Attorney Malcolm J. Gross is a founding partner of Gross McGinley, LLP, headquartered in Allentown, where he has long represented media interests, including representing them in their pursuit of access to government records. Malcolm J. Gross was born in Allentown, PA. He graduated from Muhlenberg College, cum laude in 1962, with a Bachelor’s Degree in History and Political Science. He earned his J.D. from Villanova University School of Law in Philadelphia in 1965 and was admitted to the Pennsylvania Bar that year. While at Villanova, he was an editor of the Law Review. Mr. Gross also is admitted to the United States District Court for the Eastern District and Middle Districts of Pennsylvania, the United States Court of Appeals for the Third Circuit and the Supreme Court of the United States. Attorney Gross has written on a wide range of topics, and his articles have appeared in such national publications as Social Work, Case & Comment, and Communications and the Law. He also has published work in the Pennsylvania Bar Quarterly and the Pennsylvania Law Journal Reporter. Some of his articles cover press law including defamation, subpoenas, and freedom of information issues. He also writes about general-interest issues such as custody and domestic relations. In 2004, 2006, and 2012, Attorney Gross was named a Pennsylvania Super Lawyer, reserved for the top 5 percent of Pennsylvania attorneys, and holds an AV Rating by Martindale-Hubbell Legal Directory.

The Bar Association of Lehigh County has started the Annual Ask for the Lehigh County Lawyer’s Charitable Fund Grant. This year’s theme is “School Programs in Need” and we are asking all organizations applying to keep that mind as they complete their request.
We are proud to remind all lawyers that the Bar Association of Lehigh County has conducted an Assistance Program to benefit area 501c3 organizations to provide much needed assistance to our surrounding communities for many years. This program has raised over $200,000 throughout that time and distributed these funds to many deserving area organizations.
This year to assist these organizations, we are asking each lawyer to give generously to help support those in our local community. Remember, these contributions stay in the Greater Lehigh Valley area.
The Program is administered through the Lehigh Valley Community Foundation and all gifts are tax deductible to the fullest extent of the law. The Foundation will acknowledge all gifts for tax purposes.
We will recognize all those nonprofit organizations receiving funds as part of our Law Day celebration in May.
