Discovery—Motion to Compel—In Camera Review— Work Product Doctrine—Attorney-Client Privilege—
Medical Malpractice.Plaintiffs brought a medical malpractice against several hospital and physician defen-
dants. Counsel for the hospital defendants orally provided the hospital’s risk administrator with several questions counsel wanted one of the hospital’s doctors to answer. The adminis-trator handwrote the questions on the documents and forwarded the documents with the questions to the doctor. The doctor handwrote on the documents his answers to the questions and returned the documents to the administrator who then forwarded them to counsel. The doctor mentioned these documents during his deposition.
Plaintiffs filed a motion to compel to obtain these documents. The hospital defendants objected on the bases that the written questions from counsel and the responses of the doc-tor were protected by the work-product doctrine and/or attorney-client privilege. The Trial Court conducted an in camera review of these documents. Following this review, the Court denied the motion to compel.
The Court found that the specific written questions from hospital’s counsel contained the attorney’s mental impressions and, therefore, were protected by the work-product doctrine. The Court reasoned that the underlying purpose of the doctrine is to protect the mental processes of an attorney by providing a privileged area within which the attorney can analyze and prepare the client’s case. The Court also noted the work-product privilege protects materials prepared by the attorney’s agents and concluded both the administrator and doctor were the attorney’s agents such that the responses were also covered by this doctrine.
Further, the Court found that the questions and responses were confidential com-munications between an attorney and her client and, thus, were protected by attorney-client privilege. The Court noted that the intended beneficiary of this privilege is not the individ-ual client so much as the systematic administration of justice which depends on frank and open communication between an attorney and client.

I. INTRODUCTION
Before the Court for consideration is the portion of Plaintiffs’ Motion to Compel Complete Responses to Discovery Requests From Lehigh Valley Hospital Defendants filed November 2, 2018 which seeks “the written questions about the revisions to the pro-cedure note given to Dr. Miller and the responses of Dr. Miller as described in his deposition” (hereinafter, “Subject Document A”). A hearing was held on December 4, 2018 at which the Court was provided with three (3) pages of medical records containing hand-written questions given to Dr. Miller (hereinafter, “Subject Docu-ment B”). Thereafter, the Court conducted an in camera review of Subject Document B.
II. FINDINGS OF FACT
Defendants’ Counsel, Kimberly Krupka (“Attorney Krupka”), in furtherance of her representation of Defendant Lehigh Valley Health Network, Inc., Lehigh Valley Hospital and Health Network, Lehigh Valley Hospital Center and Lehigh Valley Hospital, Inc. (hereinafter, “Defendant Lehigh Valley Hospital”) in this case, had a telephone conversation with Carolyn Coleman, Administrator of Risk Management for Defendant Lehigh Valley Hospital (“Risk Manager”) and asked her to ask Dr. Matthew Miller, an employee of Defendant Lehigh Valley Hospital (“Dr. Miller”), specific ques-tions relating to the Subject Documents. Coleman handwrote those specific questions on the portions of the medical records to which they related and forwarded the so marked documents, thus creat-ing Subject Document B, to Dr. Miller. Thereafter, Dr. Miller wrote his answers to the specific questions on Subject Document B, thus creating Subject Document A, and delivered Subject Document A to Risk Manager, who forwarded Subject Document A to Attorney Krupka.
III. ISSUES PRESENTED

IV. DISCUSSION
A. Whether the Written Questions About Revisions to the Procedure Note Given to Dr. Miller and the Responses of Dr.
Miller Are Precluded by the Work-Product Doctrine?
Pursuant to the Pennsylvania Rules of Civil Procedure, the work-product doctrine provides that a party may obtain discovery material prepared in anticipation of litigation or trial by a party’s attorney, but such discovery “shall not include disclosure of the mental impressions of a party’s attorney or his or her conclusions, opinions, memoranda, notes or summaries, legal research or legal theories.” See Pa. R.C.P. No. 4003.3; Bagwell v. Pennsylvania Department of Education, 103 A.3d 409, 415 (Pa. Cwmlth. 2014). The work-product “doctrine also protects materials prepared by agents for the attorney.” Id. at 416 (citation and interal quotation marks omitted). This includes “an attorney’s ‘[investigator’s or other agent’s] opinions, theories, or conclusions’ as part of prepar-ing his client’s case.” Id. (citation omitted). The work product of an attorney must necessarily relate to legal work performed for a client, not to notes memorializing the statements of witnesses taken by an investigator acting as mere agent of the client or of the attorney. McIlmail v. Archdiocese of Philadelphia, 189 A.3d 1100 (Pa. Super. 2018).
In this case, Attorney Krupka was communicating her mental impressions as they related to the medical records and directed Risk Manager to obtain answers to those questions from Dr. Miller in order to assist with Attorney Krupka’s legal analysis and preparation of the defense in this case. In these circumstances, Risk Manager was an agent for Attorney Krupka when Attorney Krukpa directed her to obtain answers to specific questions from Dr. Miller. Further, Dr. Miller was an agent, when, as an em-ployee of Defendant Lehigh Valley Hospital, he provided answers to Attorney Krupka through Risk Manager to aid in Attorney Krupka’s legal analysis and preparation of the defense in this case.
“The underlying purpose of the work product doctrine is to [protect] the mental processes of an attorney, providing a privileged area within which the attorney can analyze and prepare [the] cli-ent’s case.” Bagwell, supra at 415-16 (quotations and citations omitted). The Court finds that the specific questions Attorney

Krupka relayed to Risk Manager and Risk Manager wrote on Sub-ject Document B reflect the mental impressions of Attorney Krupka. As with any attorney, Attorney Krupka’s mental impres-sions are based upon her education, experience, understanding of this case and potentially a variety of other personal factors. The varying education and experience of different attorneys arguably results in different mental impressions for each attorney in the same situation and, thus, could result in each attorney reading and approaching that situation differently and, thus, asking different questions. Indeed, the facts or questions that one attorney finds important may not be seem as significant to a different attorney.
For these reasons, the Court finds that Subject Document B is protected by the attorney work-product doctrine and is, there-fore, not discoverable by Plaintiff. Since the questions of Attorney Krupka are not discoverable, the answers to those questions are, likewise, not discoverable. Thus, the Court finds that Subject Document A is also protected by the attorney work-product doc-trine and is not discoverable by Plaintiff.
B. Whether the Written Questions About Revisions to the Procedure Note Given to Dr. Miller and the Responses of Dr.
Miller Are Precluded by Attorney-Client Privilege?
The Pennsylvania Judiciary and Judicial Procedure statute, at 42 Pa. C.S. §5928 Confidential Communications to Attorney, creates the statutory construction of attorney-client privilege as follows: “Counsel shall not be competent or permitted to testify to confidential communications made to him by his client, nor shall the client be compelled to disclose the same, unless in either case this privilege is waived upon the trial by the client.” 42 Pa. C.S. §5928.
Case law discusses that privilege this way: “Recognizing that its purpose is to create an atmosphere that will encourage confi-dence and dialogue between attorney and client, the privilege is founded upon a policy extrinsic to the protection of the fact-finding process[.” In re Thirty-Third Statewide Investigating Grand Jury, 624 Pa. 361, 382, 86 A.3d 204, 216-17 (2014). “W]hen the client is a corporation, the privilege extends to communications between its attorney and agents or employees authorized to act on the corporation’s behalf.” Red Vision Sys., Inc. v. Nat’l Real Estate

Info. Servs., L.P., 108 A.3d 54, 60 (Pa. Super. 2015). The intended beneficiary of this policy is not the individual client so much as the systematic administration of justice which depends on frank and open client-attorney communication.” Twp. Of Neshannock v. Kirila Contractors, Inc., 181 A.3d 467, 473 (Pa. Cmwlth. 2018)[(citation omitted)]. Further, the attorney-client privilege operates in a two-way fashion to protect confidential client-to-attorney or attorney-to-client communications made for the purpose of obtain-ing or providing professional legal advice. See Gillard v. AIG Ins. Co., 609 Pa. 65, 15 A.3d 44 (2011).
In this case, Attorney Krupka was communicating with her client when she asked Risk Manager to obtain answers to her spe-cific questions from Dr. Miller in order to assist with Attorney Krupka’s legal analysis and preparation of the defense in this case. In these circumstances, Risk Manager was a representative of Defendant Lehigh Valley Hospital and Attorney Krupka was com-municating with her as such. Further, Dr. Miller was an employee of Defendant Lehigh Valley Hospital, Attorney Krupka’s client, and was acting in the capacity when he provided answers to At-torney Krupka through Risk Manager to aid in Attorney Krupka’s legal analysis and preparation of the defense in this case.
Any disclosure of the questions and answers written on Sub-ject Document A and/or the questions written on Subject Docu-ment B would disclose communications between attorney and client and would, thus, constitute a violation of the attorney-client privilege.
Thus, the Court finds that Subject Document A and Subject Document B are protected by attorney-client privilege and are, therefore, not discoverable.
V. CONCLUSION
For the foregoing reasons, the portion of Plaintiffs’ Motion to Compel Complete Responses to Discovery Requests From Lehigh Valley Hospital Defendants filed November 2, 2018 which seeks “the written questions about the revisions to the procedure note given to Dr. Miller and the responses of Dr. Miller as de-scribed in his deposition” is DENIED.

AND NOW, this 10th day of December, 2018, upon con-sideration of Plaintiffs’ Motion To Compel Responses To Dis-covery Requests From Lehigh Valley Hospital Defendants filed on November 2, 2018, and after Hearing held on December 4, 2018;
IT IS ORDERED, upon oral motion of Plaintiffs which is GRANTED, that the following requested relief set forth in the Motion To Compel shall be “Withdrawn, without prejudice:”
1. A full and complete audit trail of all data for Plaintiff, Lidia J. Krynicki’s, admission from 9/26/16-10/26/16, includ-ing all data from midnight on September 7 until approxi-mately 11:00 a.m. on September 8, 2016;
2. A witness capable of identifying the medical records identified by the following reference numbers in the audit trail (Bates numbered 120076-120940) ‘IP: Note 23430,’ ‘Note: 213983056,’ ‘IP Clinical Report: 3044560202,’ and ‘Note: 213979196;’ and
3. A witness capable of identifying the reference num-ber for Dr. Aleem’s withheld procedure note in the audit trail Bates numbered 120076-120940);
IT IS FURTHER ORDERED, after hearing and for the reasons set forth in the accompanying Opinion, that portion of Plaintiffs’ Motion to Compel that seeks “the written questions about the revisions to the procedure note given to Dr. Matthew Miller and the responses of Dr. Matthew Miller as described in his deposition” is DENIED; and
IT IS FURTHER ORDERED that Defendants, Lehigh Valley Health Network, Inc., Lehigh Valley Hospital And Health Network, Lehigh Valley Hospital Center and Lehigh Valley Hos-pital, Inc., shall provide Plaintiff, within seven (7) days of the date of this Order, with either additional revision histories, Dr. Aleem’s procedure note printed out by Dr. Matthew Miller as described in his deposition, or an affidavit from Dr. Matthew Miller stating

that no other revision histories exist and, upon receiving any such document(s) from said Defendants, Plaintiff may elect to take an additional deposition of Dr. Matthew Miller to ask questions related only to the subject matter of those documents within thirty (30) days of Plaintiff ’s receipt of such document(s).

Dear Bar Association Member,
The Bar Association of Lehigh County has started the Annual Ask for the Lehigh
County Lawyer’s Charitable Fund Grant. This year’s theme is “Summer School
Programs & Camps”.
We are proud to remind all lawyers that the Bar Association of Lehigh County
has conducted an Assistance Program to benefit area 501c3 organizations to
provide much needed assistance to our surrounding communities for many
years. This program has raised over $230,000 throughout that time and
distributed these funds to many deserving area organizations.
This year to assist these organizations, we are asking each lawyer to give
generously to help support those in our local community. Remember, these
contributions stay in the Greater Lehigh Valley area.
The Program is administered through the Lehigh Valley Community Foundation
and all gifts are tax deductible to the fullest extent of the law. The Foundation
will automatically acknowledge all gifts for tax purposes over $250.
We will recognize all those nonprofit organizations receiving funds as part of our
Law Day celebration in May.

“Nuts and Bolts of Interlock in PA Update” Presented by: Kathleen Riley
Tuesday, February 5, 2019 Approved for CLE and CJE Credit
This session will review the requirements of the Ignition Interlock program in Pennsylvania, review the changes that occurred when Act 33 went into effect in 2017 and update participants on the changes in 2018, including Interlock as a option for ARD and surrendering of license. Attendees will be better prepared to answer client’s questions and provide information, so they may help their client’s through the interlock process and respond to questions and concerns. Topics to be covered will include what is Interlock and how it works, the PennDOT process and paperwork, violations, fees and what their clients can expect from the Interlock installation to removal. Kathleen Riley is the Judicial Services Liaison for Smart Start in Pennsylvania & West Virginia. Before starting with Smart Start in 2012, Ms. Riley worked for the WV DMV – DUI Interlock Department as a Customer Service Representative, handling DUI clients from the initial phone call right through to the completion of the WV Test & Lock Program. Her responsibilities also included handling all violations reports and working with out-of-state DUI clients, who had a WV DUI requirement. Ms. Riley holds a BS in Marketing from Indiana University of PA and lived and worked in the Pittsburgh area for over 13 years as a Pharmaceutical Sales Representative, which gives her a unique perspective on DUID’s. Although her home is in West Virginia, Kathy is proud to exclaim that Pennsylvania is her Home State and that she is a Clinton County girl at heart.

Please join BALC’s esteemed panel for this one-hour program discussing one of 2018’s largest settlements in a personal injury case in Lehigh County. You will hear a summary of the 4½ years of litigation and some of the challenging legal issues that were faced during this construction/personal injury/workers’ compensation case that occurred at Dorney Park in April of 2014. Tyler Tomlinson, Joseph Cullen, Jr., and Ian Abovitz, shareholders with Stark & Stark, represented Mr. Dos Santos and secured a settlement of $2.75 million for lost wages, pain and suffering, and medical bills for the gravely injured worker. He concentrates his practice on complex injury, medical negligence and construction accident claims. Attorney Abovitz earned his J.D. from Temple University Beasley School of Law in 2009 and a B.S. in 2006 from The Pennsylvania State University. Attorney Matthew L. Wilson has practiced Pennsylvania workers’ compensation law exclusively since 1988. For the last 14 years he has co-authored the Pennsylvania Bar Institute’s Workers’ Compensation Practice and Procedure Manual, which is known among attorneys and judges as the “bible” on workers’ compensation law. Recent studies show that there has been a dramatic increase in impairment due to alcoholism, addiction and mental health disorders among members of the legal profession.
As Lawyers Concerned for Lawyers Educator, Mr. Quinn will discuss the early warning signs of impairment, how best to approach the impaired individual and the LCL services that are available to lawyers, judges, their family members and law students.
A complete review of the 2016 ABA study on Impairment in the Legal Profession, the problems presented by societal and professional stigma, enabling, and the reluctance of attorneys to utilize Lawyers Assistance programs are also discussed.
A practicing lawyer with over 40 years of experience, Mr. Quinn will also share his own story of addiction and impairment and the role that Lawyers Concerned for Lawyers played in saving his life and restoring his place in the legal profession.

MASTER CLASS CLE/CJE SERIES
A Master Class is a class given to students of a particular discipline by an expert of that discipline – usually music, but also painting, drama, any of the arts or on any other occasion where skills are being developed.
We hope you will join us at BALC’s new ‘Master Class’ seminars – a series of seminars directed toward newly admitted attorneys but useful to new lawyers, young lawyers or any lawyer looking to broaden their awareness of any area of practice where they are not already familiar with and want to become so. We highly encourage the larger firms to send their new associates to as many of these seminars as they are able to attend.
We are hoping that these classes will promote an interactive atmosphere where presenters and attendees will share in the conversation on the topic at hand.

The Lawyer Referral office receives phone calls from clients requesting services from attorneys. At this time, the office will obtain all needed information from the client and contact the attorney to schedule. They are entitled to a half-hour consultation with the attorney for a $30 fee. An information sheet will be faxed to each attorney, which needs to be completed at the end of each consultation. The referral form must be faxed back to the LRS office upon completion of the consultation. Client fees are pre-paid to the LRS office. Fees are determined by the attorney for any services requested after the consultation. Please notify the LRS office if you are unavailable to accept referrals due to vacations, etc. This will ensure no clients are referred to your office while you are away. Please note that screening of clients is not permitted – no telephone consultations prior to the client coming in unless specified on the referral form. Honorable Robert L. Steinberg graduated from American University in 1973 and earned a J.D. from Western New England School of Law in 1976. Judge Steinberg served Lehigh County as an Assistant Public Defender from 1976 to 1978. He served in the District Attorney’s Office as an Assistant from 1978 to 1983, as Deputy District Attorney from 1985 to 1988, and as First Assistant District Attorney from 1988 to 1991. He served as District Attorney for Lehigh County from 1991 to 1998. He is the recipient of a number of awards, including the Colonel John J. Schafer Award for excellence in law enforcement. He was elected Judge of the Court of Common Pleas for Lehigh County in November 1997 and retained for a ten-year term in 2007 and again in 2017.
Honorable J. Brian Johnson is Administrative Judge of the Civil and Orphans’ Court Division of the Court of Common Pleas of Lehigh County, Pennsylvania since January 2004. He has chaired the Lehigh County Children’s Roundtable since 2006 and has served on the Pennsylvania Supreme Court’s Leadership and State Roundtables since 2007. From 1986 to 1996, he engaged in private practice based in Lehigh County as a sole practitioner and as a partner in the firms of Johnson & Ashcraft and Johnson, Ashcraft & Giordano. From 1983 to 1985, he was an associate with the firm of Lanshe, Lanshe & Lanshe. In the course of his career as an attorney, he practiced primarily in the areas of civil, family and criminal litigation, business and real estate transactions, municipal law, and wills and estates. He served Lehigh County as an Assistant Public Defender from 1981 to 1983, as Criminal Arraignment Master from 1984 to 1986, as Assistant County Solicitor from 1987 to 1989 and as Criminal Costs and Fines Master from 1990 to 1991. Judge Johnson is a graduate of Villanova University (B.A. English 1977) and Temple University School of Law (J.D. 1981).

Judge Douglas G. Reichley graduated from Lafayette College in 1983 with honors in Government and Law and received his J.D. from the Dickinson School of Law in 1986. Judge Reichley served in the Lehigh County District Attorney’s Office from 1989-2000, rising to the position of Deputy District Attorney for violent crime prosecutions. He also served in the Philadelphia District Attorney’s Office from 2000-2001 in the Special Investigations Unit. Before his election to the bench, Judge Reichley served in the Pennsylvania State House from 2003-2011. During his five terms in office, he was appointed to the House Appropriations Committee as the Vice-Chairman, and also served on the Consumer Affairs, Health and Human Services, Judiciary, Professional Licensure, Transportation, and Urban Affairs committees. He was the recipient of several recognitions for his legislative service, including being named the State Public Official of the year by PA Bio in 2010 and the Outstanding Legislator of the Year in 2010 by the Pennsylvania Association of School Retirees.
John E. Roberts, III, Esq., Lehigh County Family Court Master, received a B.A. from the University of Delaware in 1990 and his J.D. from Cornell Law School in 1993. He served as law clerk for the Hon. Robert A. Freedberg in Northampton County in 1993 and 1994. After the clerkship he engaged in private practice until his appointment as Family Court Master for Lehigh County in 2002.

New Clean Slate legislation has recently been signed into law in Pennsylvania that allows for individuals to petition the courts to have their criminal records sealed if the person has been free from conviction for 10 years for an offense that resulted in a year or more in prison and has paid all court-ordered financial debts.
Additionally, the new law allows automatic sealing of records for second or third-degree misdemeanor offenses that included a less than two-year prison sentence if a person has been free from convictions for 10 years, as well as sealing of criminal history records related to charges that resulted in non-convictions.

U.S. Magistrate Judge Henry S. Perkin is a graduate of Duquesne University (1969) and the Duquesne University School of Law (1972). Upon graduation from Law School he served a clerkship with the Honorable Alfred T. Williams, Jr. He worked as an Assistant Public Defender (1975-1977) and Assistant District Attorney (1977-1987) in Lehigh County. He served as the Lehigh County Solicitor from 1995 through 2006. From 2006 to March 1, 2007 he served as the Solicitor for the City of Allentown. Judge Perkin served as President of the Bar Association of Lehigh County in 1993 and has been a member of the Pennsylvania Bar Association House of Delegates since 1994. From 2011 to 2013, Judge Perkin was the President of the Donald E. Wieand Inn of Court. During his years as an attorney, Judge Perkin maintained a private practice in which he handled a variety of commercial and land use litigation as well as transaction matters. He was sworn in as a United States Magistrate Judge on March 2, 2007.
For more than 20 years Attorney Nancy Conrad has represented businesses, educational institutions and non-profit organizations. She has defended all types of employment actions, including the defense of federal and state discrimination claims, wrongful discharge claims, whistleblower claims, employment contract matters and restrictive covenant cases.
She is Vice-Chair of the PBA’s Federal Practice Committee, Past Co-Chair and current Executive Council Member of the PBA Commission for Women in the Profession, Immediate Past Chair and current Executive Council Member of the PBA Labor and Employment Section.
