FRENCH TAPE LEVY INTO OPERATION BUT ROYALTIES UNDER DEBATE ,France's new audio-visual law, im- plementing a royalty on blank au- dio and video tapes, came into force on New Year's Day. However, no money has yet been collected because the amount of the royalty is still being debated. Indeed little progress has been made since July 1985, when the new legislation, dubbed the Lang Law after France's Culture Minister Jack Lang, was passed by the French Parliament. Besides providing for a tape levy it includes recognition of neighbouring rights and an extension of copyright du- ration from 50 years to 70 years af- ter the death of the composer, as in West Germany. A collecting society for the au- dio tape royalty has at least been set up. SORECOP will collect the levy on behalf of four organiza- tions: mechanical rights society SDRM, the two artists' and com- posers' societies, and SCPP, the new public company formed by record manufacturers. According to SORECOP secretary-general Jacques Moinot the level of the audio royalty is still under discussion, and revenue due will be calculated retroactively once it has been set. Also to be decided is whether the royalty will vary according to tape quality and price, Moinot adds. FRENCH TAPE LEVY INTO OPERATIONBUT ROYALTIES UNDER DEBATE

,France's new audio-visual law, im-plementing a royalty on blank au-dio and video tapes, came intoforce on New Year's Day.However, no money has yet beencollected because the amount ofthe royalty is still being debated.

Indeed little progress has beenmade since July 1985, when thenew legislation, dubbed the LangLaw after France's CultureMinister Jack Lang, was passedby the French Parliament. Besidesproviding for a tape levy it includesrecognition of neighbouring rightsand an extension of copyright du-ration from 50 years to 70 years af-ter the death of the composer, asin West Germany.

That is the chief finding of anew report prepared for the Cour-cid of Europe by Austrian organiza-tion Mediacult and discussed at acouncil meeting in Austria also at-tended by representatives of IFPI,CISAC, IMZ and the EuropeanBroadcasting Union.

The report is based on a ques-tionnaire sent to record companiesand radio stations throughout Eu-rope, and its findings are likely toform the basis for industry strategyon new technology, legislation andother key issues. It recommends a

Instead of the usual highlights page we wouldWe to give you an overview of the best sellingsingles of '85 country by country. Many localhitparades are still either not being compiledor have later issue dates due to seasonalinfluences.

UNITED KINGDOMThe best selling single of 1985 in the UK wasa German production that is on its way to hit-ting the one and a half million mark, the 5week topper The Power Of Love by JenniferRush. It is definitely '85's best selling single,the difference with number 2 - Barbara Dick-son & Elaine Page's I Know Him So Well(from Chess) is very big.

Madonna caused some waves in thecharts of '85 when her Into The Groove singleentered the UK charts at 4 which was thehighest debuting single for any female artist inthe history of the English charts; already in itssecond week it went to number 1 (and it wasfollowed by the re-released Holiday at 2!). IntoThe Groove is '85's third best selling singleand is followed by Patti Hardcastle's hip hopdocumentary 19 and by Sister Sledge withthe doo-wop track Freckle.

Bowie & Jagger made the charity single ofthe year, Dancing In The Street, the 6th bestselling single. The beautiful slow love songMove Closer by Phyllis Nelson was the firstnumber 1 in ages without a video to supportit and it was, together with Kate Bush(Wuthering Heights- a four week topper in1978)- the only woman to have written andsung a number 1 record (dismissing JenniferRush and Madonna who co -wrote their no. 1hits).

The rest of the Top 10 is taken by FeargalSharkey (A Good Heart), A -Ha and King'sLove and Pride.

On the album front obviously Dire Straitshave best selling album of '85 followed by PhilCollins, Madonna, Bruce Springsteen andTears For Fears. It is very remarkable that hitcompilation albums take the 6th, 7th, 8th and9th place of the Top 10.

GERMANYLooking at the Top 5 Single Best Sellers of1985 one immediately notes the dominanceof German productions sung in the Englishlanguage (see also front page article). Austri-an Opus with Live Is Life is on top followed byModern Talking's You're My Heart, and Fal-co's Amadeus and Sandra's Maria Magdale-na at 4 and 5. Other best sellers were: PaulHardcastle (3), Tina Turner (Hero- at 6), Mur-ray Head (One Night in Bangkok- 7), TearsFor Fears (Shout- 8), Baltimore (Tarzan Boy -9) and Modern Talking (You Can Win- 10).

It is strange to see that Jennifer Rush's twosingles Destiny and The Power Of Love oc-cupy the 74th and 75th places of the top bestselling list. She obviously did not reach thesame levels of success with The Power as inthe UK (although one must state that the suc-cess of this single in Germany already startedin 1984).

The most successful artists of 1985definitely are Modern Talking with You're MyHeart on 2, You Can Win on 10 and Cheri on18 (all three singles went to number 1 in the

charts)! Falco has two singles, Amadeus at 4and Vienna Calling at 70 and Madonna twosingles as well, Groove at 21 and Virgin at 40.

FRANCEAs you may be aware of, in France there aremany different hitparades in operation. Weuse two of them this week as illustrations forthe year-end results but as they both employdifferent techniques in compiling theseresults, they both differ greatly in contents.

The RTL hitparade makes it calculationson the basis of artists. Therefore Alphaville isthe most successful artist of 1985 as theyhave had different singles doing very well inthe RTL hitparades. Alphaville is followed byAl Corley, Tears For Fears, USA For Africa(imagine the strength of this single as it standsamidst artists who have more than one singlecharted), Bronski Beat, Sade, Dire Straits,Modern Talking, Duran Duran and Ivan.

It is quite unusual to see a German bandon top followed by an artist, Al Corley, who ispractically unknown in the rest of Europe,while the superstars like Madonna (13), Sting(16), Bruce Springsteen (19) and Tina Turner(20) only follow long after.

On the national front Jean -Jacques Gold-man is single artist of the year with chart top-ping singles like Je Marche Seul and Je TeDonne and he is followed by Johnny Nally -day and Michel Sardou.

In the Europe 1 charts however compila-tions are made on the basis of single titles andthis makes Ray Parker's Ghostbusters themost successful single in France according toEurope 1. Another very successful single wasthe duet between Pia Zadora & JermaineJackson, When The Rain Begins To Fall. Thisduet is followed by three French productionsincluding our longtime French favourite RitaMitsouko with Marcia Baila, La CompagnieCreole with Le Bel Masque and Peter &Sloane with their Besoin De Rien, Envie DeToi. Other popular records include ModernTalking's You're My Heart, Moonray's Corn-manchero, Stevie Wonder's I Just Called, Tel-ephone (the local rock band) with Un AutreMonde and George Michael's CarelessWhisper.

From the above list it is clear that theFrench market is rather slow as singles likeGhostbusters, When The Rain, I Just Calledand Careless Whisper already reached theirbiggest successes in 1984.

HOLLANDEvery country has it's own specific top sellingsingle and in Holland it is The Commodores'Nightshift, folloWing the successes of We AreThe World and Dancin' In The Dark at 3. Onlyone local production appears in the Top 10,singer Benny Njjman with Waarom Fiuister 1kJe Naam Nog, the successful Dutch transla-tion of a Greek song (at 7). The other success-ful singles of 1985 include Madonna's Groove(4), Paul Hardcastle (5), UB40 and ChrissieHynde (6), Simple Minds (Don't You at 8), AView To A Kill (9) and Tears For Fears Shout(10).

Alison Moyet was very successful in Hol-land and her debut album was the best sellingalbum in Holland. Moyet is followed by U2,

Madonna, Sade (Diamond Life), Bruce, DireStraits, Chris Rea, Sting, Eurythmics andTears For Fears.

BELGIUMModern Talking was undoubtedly the mostsuccessful act in Belgium during 1985. Alltheir first 3 singles appear in the Top 10 of1985: You're My Heart at 3, You Can Win at4 and Cheri Cheri Lady at 9. Despite the factthat USA For Africa collected the best resultsof 1985, Euro productions dominate the Top10, with Tarzan Boy at 2, Live Is Life at 5 andMaria Magdalena at B. The other internationalproductions that did well included Madonna'sGroove (6), Tears For Fears with Shout (7)and Paul Hardcastle with 19 (10).

ITALYIn Italy the theme to the Bond movie A ViewTo A Kill by Duran Duran was best single of'85 and the USA For Africa single is close by.At 3 another soundtrack recording, Don't Youby Simple Minds. Duran Duran returns at 4with The Wild Boys and the Mexican born 15year old singer Luis Miguel with Noi, RagazziDi Oggi at 5. The Italian artist Eros Ramazzot-ti reached high levels of success in Europewith his Una Storia Importante; in Italy 6thbest single of '85 and further to that it reachedgold in France and Switzerland. Other popu-lar singles in '85 include Dead Or Alive (YouSpin Me Round), Righeira (L'Estate Sta Finen-do), New Glory (Sorrisi) and Christian (NolteSerena).

There are 5 singles appearing in the Top50 best seller list that are still charted up todate. These include Madonna's Groove, stillcharted arid no. 12 in the year-end survey, Ti-na's Hero (no. 28), Stevie Wonder (no. 32),Fine Young Cannibals (no. 48) and Arcadia(no. 50).

SPAINThe best selling single in Spain is again Opuswith Live Is Life and it was also a very goodyear for the local act Alaska Y Di nerama, theyhad two singles in the Top 10 (one at 2 andone at 4). Other popular '85 singles for USAFor Africa (3), Stevie Wonder (I Just Called at5 and Part-time Lover at 6), the Dutch produc-tion Woodpeckers From Space by Videokidsat 7, CBS local artist Miguel Bose with hisAmante Bandit) at 8,. Baltimore at 9 andMadonna's Groove at 10.

On the albums front it is again the bandAlaska Y Dinerama who hit the top followedby Dire Straits, Stevie Wonder (Woman In Redand In Square Circle), Madonna, USA ForAfrica, Julian Lennon, Manuel Serrat, Collinsand Jagger.

DENMARKIn Denmark the top is taken by 2 charity sin-gles, the first One being the gathering of localartists for Africa entitled Afrika and at 2 theUSA For Africa project. Euro-productions thatsold substantially well include: Modern Talk-ing (You're My Heart at 3), Tarzan Boy (4) andMaria Magdalena (8). Of the internationalproductions Duran's A Vieuw To A Kill (5), Ti-na's Hero (6) and Hardcastle's 19 (10) faredthe best over 1985. One local artist appears inContinued on page 22

As we're still in the middle of the influence ofthe Christmas season, many albums are re-entering the local hitparades and the Hot 100,due to lack of competition from new albums.There is not one single new album enteringthe Hot 100, there are only re-entries thisweek.

The albums of Sade and Sting haveproven to be good Christmas sellers andbacked up by the success of Is It A Crime, thePromise album stays in its 4th week at no. 1.The Sting album even rises 1 notch and isnow at 4 and Jennifer Rush does likewisewith her first album (8-9; in its 64th week!). Thepopular Norwegians A -Ha even hit Top 10this week (10-14) and Grace Jones 'bumps'her compilation album Island Life up to no. 17(from 23). The Duran Duran spin-off Arca-dia is of all the European markets most popu-lar in Italy; their single Election Day is no.1and so is the album So Red The Rose. But theinterest in other European countries is

definitely growing, with new entries in Germa-ny and further good positions in the UK,Benelux, Sweden and Denmark. The album isone of the fastest movers of this week as itjumps from 43 to 21. Another very goodmover is the Alison Moyet album. Especiallyin Germany and Holland sales on this onecontinue and after re-entering the Hot 100 lastweek at 53, it now moves up to 27. The SunCity album follows at 29 (from 36) and againGermany and Holland are the markets wherethe album is doing best.

The Eurythmics have just released a newsingle, ft's Alright (Baby's Coming Back), andthe UK and France show significant sales in-

creases over the last 2 weeks and the albumis now 38 from 44 (the LP is also 3rd bestplayed this week). The UK and France arealso responsible for the big move that FineYoung Cannibals make with their debut al-bum. Cautiously debuting at 91 last week, thealbum got a good push this week and is al-ready up to 43. The French market, usuallyvery slow in accepting new bands, is nowtogether with the UK trendsetting by chartingthe album that early in the game. In the mean-time the band has just issued their 3th single,the Presley cover Suspicious Minds, for usnot the most logical choice as a follow-up to'Blue' as we are more in favour of the trackTime isn't Kind.

The reaction on the new Alan ParsonsProject album Stereotomy is not as over-whelming as last year's Vulture Culture. Thelatter was the highest debuting album of 1985as it entered in its first week straight at no. 12.So far Stereotomy is charted in Germany, Bel-gium and Holland and the UK is yet to come.The French artist Renaud has changed fromPolydor to Virgin and his latest album MistralGagnant shows a good move this week from67 to 48. And although the French lyrics mayfor many of you be a hindrance to really ap-preciate his music, it is however a very worth-while album to check into: contemporary pop -rock music with a very good production (LPwas recorded in L.A.). Tips include Fatigue, SiT'es Mon Pote and the current French singleMiss Maggie (which seems to be causingquite some controversy due to its very out-spoken lyrics about Thatcher- this may be anincentive for you to at least give it a go!).

The bat-tle over payment for the use of promo videos, which in '85 alreadyresulted in a 4 months black -out, continues. This comes after the expiryof the temporary agreement between the industry and the TV compa-nies. A new meeting has been set for Midem but until that time videoclips can only be exploited on French national pay TV Canal Plus *

As you can seethis week the favourite clips in Europe are Sun City, Elton John's Nikitaand Feargal Sharkey's A Good Heart (who would have thought that thisex -Undertones singer would reach this level of success in '85?) *

Have you seen the new Eurythmics video, It's Alright (Baby's Corn-ing Back)? The surrealistic images, the impressions of a city by nightand the beautiful radiant face of Annie Lennox all support the song andin fact makes one re-evaluate its impact. The clip was directed by WillieSmax, and is a 90% animation short * The new Billy Ocean single hasjust been released and the video to the song When The Going GetsTough (The Tough Get Going) is out as well. The song is the theme tothe motion picture The Jewel Of The Nile and the video clip shows trail-ers of the movie, mixed with Ocean and his band performing the songon a huge stage. Even the three main actors of the movie share thestage and while Michael Douglas and Cathleen Turner do the backingvocals, Danny DeVito even plays the sax at the end *

A -Ha have a follow-up to their awardwinning Take On Me video,The Sun Always Shines On TV, another Steve Barron directed videowith semi -animated effects * One video that has been out on the mar-ket for some time now but still deserves to get played, is the hilariousclip by American comedian Billy Crystal, You Look Marvellous. Bothlyrical and visual there are parodies on Sting, Grace Jones, Madonnaand Tina Turner and the impersonations work very well *

CBS Fox just released the music video from King, a compilation ofmusic promos entitled From Steps In Time To Bittersweet, The VideoSingles. it features five of their most popular tracks including Love AndPride (in the 12" U.S.A. mix), Won't You Hold My Hand Now, AloneWithout You, The Taste 01 Your Tears and their latest single Torture *

MEMORABILIAThe British Library in London is to put Beatlesmemorabilia on proud display alongside suchhistoric documents as the Magna Carta,Horatio Nelson's last letter to Emma Hamiltonand the 7th century Lindisfarne Gospels.

The display is provided, on indefinite loan,bij Hunter Davies, noted British author whowrote one of the most successful books on

the group. It includes the lyrics of songs like'Yesterday', 'I Wanna Hold Your Hand' and'Help!' in the handwriting of John Lennon orPaul McCartney or both. And the lyrics of'Michelle' are shown on the back of an en-velope and at least one unpublished andunrecorded song by John Lennon is thereon view.

The library authorities say: "These ma-nuscripts reflect the phenomenal popularity ofthe Beatles and their unique contribution tothe social, literary and musical history ofBritain."

The display runs alongside other Beatles'material which is of a more commercial na-ture, such as record releases and sheet musicfor John and Paul's songs.

The relationship between therecord and radio industries is con-sidered in some detail. Radio quo-tas limiting the amount of foreignmaterial broadcast are suggestedas a way of preserving nationalcultural identity. A similar quotasystem could also limit the propor-tion of canned music broadcast, ifthis is thought to be desirable,though the same result could beachieved by agreements betweenradio organizations and collectingsocieties, as in the British 'needle -time' arrangement. The cause ofEuropean cultural cohesion mightbe better served, the report goeson, if steps were taken to improverecord distribution systems andencourage pan-European ex-change of music programmes.

A proper legal and administra-tive framework for cooperation be-tween record companies, radiostations, orchestras and theatrescould also be useful to all parties,the report suggests. Radio stationscould overcome the problemsthey currently encounter whenthey try to distribute their musicprogrammes by means other thanbroadcasting, and joint venturessuch as the production of worth-while but neglected musical workswould be encouraged.

Regional and ethnic musicwould also stand to benefit. In theirquestionnaire replies many recordcompanies claimed to make ef-forts to promote ethnic music, butin practice the small market it cancommand restricts what can bedone. Additional incentives aretherefore needed, either in theform of co -financing or co-production deals, or else by radioand tv broadcasters devotingmore airtime to the genre.

The Norwegian duo, signed to EMI UK, are picking up good responsesoutside Scandinavia with this typical MOR ballad with some very strong and commercialcommunity -singing on the end. Album sold 280.000 copies so far, which is more than any otherNorwegian act has sold before (including A -Hal). Publishing available outside Scandinavia.

UK already likes them and a bigcampaign on the Continent beginning of '86 follows.

"De Wilde Wereld is a magazine -likeprogramme with columns, short inter-views, info and the emphasis on new mus-ic, The main aim of the programme is tofollow the new developments in pop musicand in this way fulfill a trendsetting functionin our broadcasting system. It happensvery often that we are the first to startplaying a particular record and someweeks later the record is picked up by the.other Dutch stations. Some recent ex-amples include Chris isaak, Doug E Freshand Don Dixon.Talking about crossover, there is a brand-new Belgian group, produced by Jean-Marie Aarts (of T C Matic fame) calledFlesh & Fell, who just released a 12" enti-tled Hunger. The band consists of one fe-male and two males and the nice thingabout the record is that it shows a mixtureof light electronic funk with European in-fluences; a modern synthesizer and drum'machine backing, coupled with French vo-cals and romantic acoordeorisiIf it comes to trends, I think New York willplay a dominant role as the source of newtalent. Especially in the fields of the N.Y.rap exciting things have happened lately.Think about the Beastie Boys with theirmix of heavy metal and rap: She's On It -from the OST Krush Groove, A definite tipand a favourite in our programme. Listen-ing to Jazzy Jeff, it is also clear that rapgets fuller and heavier instrumentation,heavy guitars and fuller productions. Ofcourse the new interest in rap was initiatedby the fantastic record of Doug E Fresh -The Show.For me, personally, most of the new talentcontinues to come from the US and latelya few of those guitar bands have actuallycrossed over. Green On Red is a verygood example: Some new names: Doc-tor's Mob, Rave Up's (album is calledTown And Country) and the West Coastband Fishbone (dynamic and energeticaka).

Welcome to the first regular singles guide of'86 and although the holiday season is still af-fecting the charts and playlists, there are stillsome notable changes in the Hot 100. With asteady Top 4, Sting jumps in at 5 (from 15)with his most successful single so far Russi-ans. Another newcomer in the Top 10 is theAmerican Whitney Houston, her Saving AllMy Love For You jumps to 6 (from 12) and ischarted in 7 European markets. The Pet ShopBoys, who claim to get their inspiration fromEuro-productions such as Tarzan Boy andSelf Control (they love the 'oh-woah-oh' ef-fects and the like), have been able to extendtheir success in the UK (this week at no. 1) toother European markets like Germany, Hol-land and Ireland.

Despite the departure of singer JimmySommerville, Bronski Beat have proved tocontinue their success story without his dis-tinctive falsetto voice; the electro pulses of HitThat Perfect Beat make a very good jump thisweek from 28 to 16 and the single is so farcharted in the UK, Germany, Benelux andIreland. Sommerville's new band The Corn-munards, is bubbling under the Hot 100 withits single You Are My World (the single justdidn't gather enough points to enter and iscurrently at 101).

Christmas singles are this year not sopopular compared with last year when singleslike Wham!'s Last Christmas and the BandAid single were Top 10 toppers long after De-cember. This year there are only 4 seasonalsingles left in the charts of which the Shakin'Stevens' single Merry Christmas Everyone isthe most successful: this week from 40 to 23.The other 3 Christmas singles (Wham!, Bruceand Band Aid) are both in the second half ofthe Hot 100 and it doesn't look like they willhave more impact next week. Good movesthis week for Mike Oldfield (27-35), the se-cond A -Ha single, The Sun Always Shines OnTV (jumping from 78 to 39 in its second week),the Italian production I'm A Lover by Andrea(from 77 to 42 in its second week), the reggaesong Girlie Girlie by Sophia George (45-58),Talk Talk (47-57), the slow disco song Satur-

day Love by Cherrelle (49-69; one of ourdefinite tips this week!) and Elton John's WrapHer Up (50-62).

Obviously there aren't many new singlesreleased and the only significant entry is at 57where the fourth Dire Straits single of the al-bum Brothers In Arms, Walk Of Life, enters at57. The Money For Nothing single is very te-nacious and is still in its 25th week at 37(maintaining steady positions in France, Ger-many, Austria Denmark and Finland).

Together with Madonna, Jennifer Rush isthe only artist in the Hot 100 who has 3 differ-ent singles charted. With The Power Of Lovesingle holding quite steady in the Top 10,Ring Of Ice moves up to 67 (from 81) and ischarted in the UK and Ireland while Destiny

follows just after at 68 and charted in theGAS -countries.

One record that will undoubtedly enter theHot 100 next week is the new Eurythmics sin-gle It's Alright, bubbling under the Hot 100 (at102) and a major add on European radio thisweek. Check out the 12" version with its bo-nus track Tous Les Garcons Et Les Filles,recorded on a portastudio in London duringspring 1983.After a lengthy absence 70's superstar PeterFrampton (whose album 'Frampton ComesAlive' was a very big seller several yearsback) returns to the scene with a new singleentitled Lying, from his forthcoming albumPremonition, produced by Pete Salley.
