Status of WPDES Wastewater Permit• Existing five year permit issued on 4/1/13 and expired

on 3/31/18• Challenged the permit in 2013 for phosphorus limits• Settled the challenge in March 2016 and agreed to a

compliance schedule in the settlement; requiring compliance with phosphorus limit by 2022, subject to seeking a variance

• Yorkville applied for a Phosphorus variance in October 2017

• DNR approved variance in November 2017, which will extend compliance deadline date another 5 years.

• Expectation at time that regional solution would replace existing facilities

NOV for Wastewater Permit• DNR issued an NOV in November 2017 for violating

the following limits: – Chlorides, BOD5, TSS, and Ammonia-Nitrogen

• Yorkville Commission commitments made at enforcement conference on December 12, 2017:– Agreed to develop a plan to bring the treatment plant back into

compliance– Committed to filing the plan by 10/1/18 after referendum to

become a village

• Commission filed the Compliance Plan on 10/1/18.• DNR issued a decision on November 11, 2018 closing

out the NOV based upon compliance plan assurances

Overview of Regional Water/Wastewater Solution

• Limited window for negotiation:– October 2017 to January

2018

• Parties to negotiation: – State– County– Mt. Pleasant– Racine– Yorkville

• Yorkville Negotiation Team: – Chairman– Town Attorney– SEH– Ehlers– G&K

• Intense three months of negotiations culminated in January 20, 2018 meeting

• Yorkville Negotiation Team Withdrew from Regional Solution: Too Expensive

March 20, 2018 DNR/Yorkville Stand Alone Option Meeting

• Goal: Solicit State/SEWRPC support for Yorkville stand alone water/wastewater option to support go-slow approach for development west of I-94

• Participants: – County– DNR Water/Wastewater– SEWRPC– RCEDC– Yorkville Team

March 20, 2018 DNR/Yorkville Stand Alone Option Meeting• Outcomes:

– Support backup well proposal with no Lake Michigan diversion– County commitment to control chlorides for Wastewater– Support upgrade of existing wastewater to accommodate

development in Short Term– Need for compliance plan to meet outstanding NOV for existing

facility– Need to set up PSC/DNR meeting to discuss back up well proposal

• April 3, 2018 – Referendum to become a Village• April 18, 2018 - State of Wisconsin recognizes Yorkville as a

• August 22, 2018 DNR/Yorkville Wastewater Meeting– Discussed 5-year planning window for a modest facility

upgrade to accommodate existing needs and future slow growth during early phase

– DNR anticipates a 2-year compliance schedule to address NOV’s via a facility upgrade

• April 1, 2019 – Permit Reissued with compliance schedule• Will include interim compliance tasks of facility plan, design and

construction• Achieve NOV compliance by April 1, 2021

– DNR willing to continue variance and compliance plan for chlorides reduction plan
