WHEREAS the Service requires an experienced service providerto develop and implement a flex ible state of the art Firearm ControlSystem;

AND WHEREAS the Service has invited tenders from serviceproviders to develop and implement a Firearm Control System ;

AND WHEREAS Waymark has responded to such tender and hasconsequently been awarded the Tender,

NOW therefore the Parties agree as follows-

1. DEFINITIONS

Unless the context otherwise indicates the following words andexpressions shall bear the meanings assigned to them below andcognate expressions shall bear a corresponding meaning-

(1 ) "Acceptance procedure" means the procedure in respect of theacceptance of the Oeliverables and System by the Service, as setout in Annexure "C";

(2) "Additional Items " mean unforeseen items , which are not, providedfor in this Contract and which will be necessary for the successfuldevelopment, implementation and suppo rt of the System;

(3) "Business Process and Technical GAP' mean the variation fromthe Tender and Tender response as set out in Annexure "G";

(4) "Confidential Information" means confidential information asdescribed in Clause 12;

(5) "this Contracf' means this Contract together with the followingannexures:

(9) "Maintenance" means Software and Hardware Maintenance;

(10) "System Maintenance" means the Corrective, Adaptive andPerfective maintenance of the System;

(11 ) "the Parties" mean Waymark and the Service;

(12) "Signature date" means the date of signature of this Contract bythe signatory which signs it last in time ;

(13) "S/TA" means the State Information Technology Agency (Pty) Ltd,a private company with limited liability duly registered andincorporated in terms of the company laws of the Republic ofSouth Africa with registration number 1999/001899/07;

(14) "System" means the Firearms Control System and includes all theOe/iverab/es as stipulated in the Project Schedule Annexure "E";

(15) "the Tender' means the request for Tender Number 232 for thesupply and installation of a Firearms Control System, attached asAnnexure "A";

(16) "Tender response" means the complete response submitted byWaymark which was used to select Waymark as the successfulbidder, attached as Annexure "B"; and

(17) "VAT' means Value Added Tax as levied in accordance with theValue Added Tax Act , 1991 (Act No. 89 of 1991).

2. INTERPRETATION

(1) The clause headings contained in this Contract are used for easeof reference only and will have no bearing on the interpretation ofthe terms of this Contract. Such headings shall not be deemed togovern , limit , modify or affect the scope, meaning or intent of theprovisions of this Contract or any part of it.

(2) In this Contract, unless the context indicates a contrary intention ,an expression which denotes any gender includes the othergenders, a natural person includes a juristic person and vice versaand the singular includes the plural and vice versa .

(3) Any reference to any legislation , enactment or by-law is to suchlegislation , enactment or by-law as at the Signature date and asamended and re-enacted from time to time.

(4) If any provision in a definition is a substantive provision conferringany right or imposing any obligation on any party, then ,notwithstanding that it is only in the definition section , effect shallbe given to it as if it were a substantive provision in the body of thisContract.

(6) When any number of days is prescribed in this Contract, suchnumber shall be calculated by counting the working days excludingthe first day and including the last day unless the last day falls on aSaturday, Sunday or public holiday, in which case, the last dayshall be the next succeeding day which is not a Saturday, Sundayor public holiday .

(7) The use of the word "including" followed by a specific example/sshall not be construed as limiting the meaning of the genera lwording preceding it and the eiusdem generis" rule shall not beapplied in the interpretation of such general wording or suchspecific example/s.

3. SUPPLY OF DELIVERABLES

~ As a result of the awarding of the Tender to Waymark and theU acceptance of such Tender, Waymark shall with effect from theSignature date , supply the Oeliverables in accordance with thisContract as well as any mutually agreed , written , deviationsthereto.

((;)l The Parties agree that as a result of the changes to the business'? \J process and technical specifications as provided for in the Tender,amendments have been made and provided for in the Bill ofMaterial Annexure "0", Project Schedule Annexure "E" andBusiness Process and Technical GAP Annexure "G". Any furtheramendments or variations to this Contract , must be recorded ,planned, scoped , costed and approved by the Service andadditional costs for the rendering of additional services must beagreed upon between the Parties : Provided that suchamendments and costs are in writing and signed by both Parties.

(3) Waymark shall supply a back scanning service on the followingbasis:

(d) The Service shall be responsible to renew the licencesannually in advance as indicated in the ProjectSchedule Annexure "E".

(e) The Service will be responsible to comm it resources toensure the capability is established at the Service.

(4) The Service undertakes to inform Waymark timeously whetherthey will be responsible for the rollout of the System if it is decidedthat Waymark will be responsible for such rollout.

(5) Waymark will be responsible for the training of 100 trainers thatwill be used to train the users. The training and payment will takeplace as set out in the Project Schedule Annexure "E".

(6) Waymark will be responsible for System Maintenance for a periodof two years from the date of System acceptance: Provided thatthe- »" ---==-

a) Parties shall enter into a service level agreementprior to System acceptance;

b) cost for the System Maintenance shall be as set outin the Project Schedule Annexure "E"; and

c) Service reserves the right to extend the SystemMaintenance part of this Contract on the terms andconditions as may be agreed between the Parties.

(7) Waymark will be responsible to provide an interface capability forthe System in the manner as set out in the Tender Annexure "A".Provision has been made for 10 interfaces, the specific interfacesto be agreed upon between the Parties. The cost for interfacingwill be as set out in the Project Schedule Annexure "E".

(8) Additional Items must be procured in the manner set out inAnnexure "H".

(9) It is specifically agreed that the System will be a centralised basedapplication on an ORACLE platform.

(10) The Parties agree to comply with the Acceptance procedure as setout in Annexure "C".

(11) If Waymark fails to meet any Delivery due dates , to the exclusionof any third party's and/or the Service's negligent or wilful act oromission and/or circumstances beyond the reasonable control ofWaymark, then the Service's remedy will be to demand thatWaymark meets the Deliverable, at Waymark's cost , on or beforea revised date agreed to between the Parties . If Waymark fails tomeet the Delivery due date on the revised agreed date , the penaltyas set out in clause 11 will be applied.

(12) If Waymark fails to meet any Delivery due date to:

(a) a negligent or wilful act or omission on the part of thService; and/or

(b) Waymark relying on and acting upon information providedto Waymark by the Service , which information wasincomplete, incorrect and/or inaccurate,

then Waymark shall , without prejudice to any other right itmay have in law or in terms of this Contract, meet theDeliverable, on or before a revised date agreed between theparties. Any additional costs incurred by Waymark inmeeting the Deliverable shall be for the account of theService.

4. ACCOMMODATION

The Service shall provide accommodation and be responsible forthe cost of the infrastructure and development facilities as set outin Annexure "I".

5. RESPONSIBILITIES OF THE SERVICE

(1) The Service agrees and undertakes to-

(a) provide assistance in connection with obtaininginformation Waymark may require pertinent to theprovisioning of the System;

(b) provide Waymark with timely and uninterrupted access todata pertinent to the performance to supply the System,when required;

(c) in the case of specifications provide the necessaryresources to operate the environment in which thespecifications are maintained in order to prov ide the datato Waymark;

(d) promptly render all decisions and approvals required so asnot to delay or impede the performance of Waymark inthe supply of the System;

(e) promptly and efficiently provide or perform any matterreferred to in this Contract as a responsibility of theService;

(f) be responsible for the accuracy and completeness of alldata and information provided to Waymark for thepurposes of Waymark providing the System;

(g) comply with its responsibilities listed in this clause withoutany entitlement to claim any payment from Waymark;

(h) conf irm all deviations in writing (can also be agreed uponin minute of meetings) . Deviations on this Contract mustbe signed by duly authorised personnel of the Petties 1<\\

U) promptly notify Waymark of any issues, concerns ordisputes with respect to the supply of the System ; and

(k) ensure that all their vendors and service providers assistWaymark and allow the utilisation of their products andservices for establishment , implementa tion andmaintenance of the System.

6. RESPONSIBILITIES OF WAYMARK

(1) Waymark agrees and undertakes to-

(a) supply the System in compliance with the provisions ofthis Contract as well as any mutually agreed , written ,deviations thereto ;

(b) supply the System as specified diligently , competentlyand efficiently;

(c) in supplying the System , comply with all requirements,requests and directions as may be given in writing orminutes of a meeting by the Service;

(d) submit to the ISM management of the Service, or anysuch persons nominated by them, such information andreports as may be required by it in connection with thesupply of the System. This will include monthly progressand financial expenditure reports;

(e) adhere to all accommodation rules and otherrequirements as may be specified by the Service;

(f) promptly escalate all decisions and approvals required soas not to delay or impede the performance of Waymarkin the supply of the System; and

(g) promptly notify the Service of any issues, concerns ordisputes regarding the supplying of the System.

(2) Waymark agrees that it shall be entitled to appoint sub-contractorsoutside of those specified in the Tender Response only upon theprior written consent of the Service and upon disclosure of theidentity and full particulars of the SUb-contractors, and providedthat the proposed sub-contractor/s satisfy the Black EconomicEmpowerment requirements and Security Clearances asstipulated in the Tender.

7. PAYMENT

(1) In consideration of Waymark carrying out its obligations in terms -<KIof this Contract, the Service shall pay Waymark in accordance p~ \with the Project Schedule Annexure "E". '4

Upon acceptance of a Deliverable by the Service, the Service willpay Waymark, within thirty days after receipt of the invoice andacceptance certificate , the full amount invoiced: Provided that theService is in respect of cost related to development entitled toretain 10% of the cost as a retainer. The full amount retained bythe Service will be paid to Waymark upon acceptance of theSystem by the Service.

If Waymark procures Additional Items in the manner provided forin Annexure "H", the Service shall pay Waymark within 30 daysafter receipt of an invoice and acceptance certificate in accordancewith the quotation 's terms and conditions. All such amountspayable by the Service must expressed as being inclusive of VAT.

It is noted that Rand-values in the Tender response werecalculated according to a specified rate of exchange and that theactual rate of exchange for amounts that have to be paid in foreigncurrency , will be applicable.

When Waymark must obtain Hardware or Software from a foreignsupplier and Waymark is required to remit part of the amountabroad, the Service undertakes to pay Waymark 50 % of thequoted amount in South African currency within 30 days after thedate of placement of the order with the foreign supplier, providedthat Waymark provides the Service with an invoice on the date ofthe placement of the order and proof of the exchange rateapplicable for the payment.

Where Waymark is not required to remit part of the amountabroad in obtaining Hardware or Software from a foreign supplieror in instances where the provisions of sub-clause (6) isapplicable , the full amount or the remaining 50% will be paid toWaymark by the Service in the manner set out below:

(a) Waymark will invoice the Service in accordance withthe Acceptance procedure. The invoice must indicatethe remittance amount paid by Waymark to the foreignsupplier, a bank certificate and proof of the exchangerate at the date of payment.

(b) The Service will pay Waymark in South Africancurrency within 30 days after receipt of the invoice.

PROJECT CO-ORDINATOR AND MANAGER

The Service shall appoint the representatives identified inAnnexure "F" who shall be responsible for the supervision and theexecution of this Contract.

Waymark shall appoint the project manager identified in Annexure"F" who will be responsible for the overall planning , supervis ion ~and control of the project and who will report according to the f"-7 \structures defined in Annexure "F". If the Project Manager is notAi

delivering according to the contract the Service may require thatWaymark replace the Project Manager.

(3) Either Party may within 7 (seven) days give written notice to theother Party , to appoint an alternative individual who is suitablyqual ified and responsible in any of the roles defined in sub clauses(1) and (2), at the ir own cost

9. RELATIONSHIP MANAGEMENT

In order to fac ilitate the smooth and effective management of therelationship , the Parties shall form a steering committee cons istingof representatives of each Party , which steering committee shallexecute the roles and responsibilities as defined in Annexure "F".

1O. WARRANTY

(1) Waymark warrants and guarantees to the Service that-

(a) Waymark is authorised to enter into this Contract and thatthe Contract shall be executed in a proper andprofessional manner by properly qualified personnel andthat the System will fulfil the technical and functionalspecifications.

(a) Waymark is suitably qualified to supply theOeliverables;

(b) Waymark shall provide services -

(i) with due care and skill ; and

(ii) in accordance with the terms of this Contract andin compliance with all applicable laws andregulations;

(c) Waymark has the right to license the Software suppliedin connection with the System; and

(d) the System will operate fully by the due date indicated inthe Projec t Schedule Annexure " E'~

(2) Where any Act of Parliament implies in this Contract any term ,condition or warranty, such term , condition or warranty shall bedeemed to be included in this Contract.

(3) The Service warrants and guarantees to Waymark that theService shall provide professional and properly qualifiedpersonnel to assist Waymark in the execution of this Contract .

11. PENALTIES

(1) Subject to the provisions of clause 3(11) a penalty stipulated in this #\Contract , shall be enforced by the Service : Provided thatunacceptable services giving rise to such a penalty shall not be ~

on the part of the Service, is not proved to be due to a wilful ornegligent act or omission on the part of Waymark.

(2) In the event that Waymark fails to deliver a Deliverable on theDelivery due date set out in the Project Schedule Annexure "E", apenalty calculated as follows may be claimed by the Service:

N = Number of working days by which the completion dateexceeds the agreed time .

C = Total fixed price for the labour portion of the applicablephase agreed to for the specified Deliverable.

P = The working days quoted for the completion of thespecific Deliverable , expressed as a percentage of the totalworking days planned for the applicable phase as outlined inthe detailed cost breakdown of the Tender.

F = 1/14 of one percent.

Penalty = Multiplied result of N x ex P x F x 0 .5

12. CONFIDENTIALITY

(1) For purposes of this Contract, Confidential Information means:

(a) the details of the Deliverables and System;

(b) price information of the Deliverables ;

(c) the terms and conditions of this Contract;

(d) information of material proprietary to or deemed to beproprietary to a Party;

(e) information designated as confidential by a party ;

(f) information acquired by the other party solely by virtueof provision of the System; or

(g) trade secrets of a Party,

and extends to all forms of storage or representation of theConfidential Information including , but not limited to, loosenotes, diaries, memoranda, drawings, photographs, electron icstorage and computer print-outs.

(2) Confidential Information excludes any information , or any portionthereof, which , from the date from which any of the informationbecomes publicly available-

(a) is disclosed to any of the Part ies by a third party andsuch party reasonably believes the third party is legallyentitled to disclose such information;

(b) was known to any Party prior to its receipt from the otherParty;

(c) is developed by any Party independently of anydisclosures previously made by the other Party;

(d) is disclosed with any of the Parties' prior writtenconsent; or

(e) is required to be disclosed by any of Party by order ofthe court, other legal process or other profess ionalstandard.

(3) The Parties agree that Confidential Information disclosed by oneParty to the other Party shal l be used by the other Party solely inconnection with the provision of the services and the supply of theSystem. The Parties shall preven t disclosure of ConfidentialInformation, except as required by law.

(4) The Parties shall carry out their obligat ions hereunder using thesame degree of care used in protect ing their own proprietaryinformation, but always at least a reasonable degree of care:Provided that the Parties shall have met the foregoing standard ofcare, none of the Parties shall be liable or responsible for anyinadvertent or accidental disclosure by the other Party ofConfidential Information.

(5) None of the Parties shall use the Confidential Information or dataof the other Party without prior authorisation for any purpose otherthan the lawful carrying out of its obligations under this Contract.

13. INTELLECTUAL PROPERTY RIGHTS AND GRANT OFLICENCE

(1) All rights and titles in and to the System, including withoutlimitat ion, any copyr ight and other Intellectual Property Rightsused or embodied in or in connection with the System shall be andremain the sole property of the Service, and no IntellectualProperty Rights therein are granted or assigned under thisContract. Waymark shall not, at any time, in any manner,question or dispute the ownership of the Service in and to theSystem and undertakes not to infringe or prejudice any rights ofthe Service in and to the System.

(2) Waymark shall not acquire any right, title or interest entitling it touse the Intellectual Property of the Service. Insofar as Waymarkis considered in law to be the original owner of the Copyright, ithereby assigns the Copyright to the Service.

(3) Waymark grants to the Service perpetual rights and license touse the System after passing of ownership from Waymark to theService.

(4) Waymark will have the right to market the System on behalf of theServ ice to other countries for mutual benefit. Should such anopportunity arise Waymark will detail in writing the opportunity anda joint decision will be formulated to enable Waymark to pursuethe opportunity.

(5) Ownership and Intellectual Property Rights of a Deliverable willonly pass to the Serv ice after acceptance and payment has beenmade by the Service to Waymark.

14. TERM AND TERMINATION

(1) This Contract will commence on the Signature Date and willcontinue in effect until comp letion of the services as set out in theProject Schedule Annexure "E" or as agreed between the Partiesor until otherwise terminated in accordance with this clause.

(2) Without prejudice to any other remedies which either of the Partiesmay otherwise have in terms of this Contract or at law either of theParties may terminate this Contract by written notice to the other,in the event that:

(a) Waymark is liquidated ;

(b) Either of the Parties breaches a material term of thisContract and fails to remedy such a breach within fourteen(14) days after receiving written notice from the otherParty specifying the breach and stating the intention toterminate this Contract if the breach is not remedied.

(3) Termination or expiry of this Contract for whatever reason shall notaffect any rights of either of the Parties that may have accruedbefore the termination of the Contract or which specifically or bytheir nature survives the termination of this Contract.

15. LIMITATION OF LIABILITY AND INDEMNITY

(1) The Parties hereby indemnify each other against damages andclaims resulting from the rendering of services in terms of thisContract, except where it is due to a wilful or negligent act oromission of one of the Parties , its employees, agents, sub­contractors or assignees.

(2) The risk in any Hardware or Software transferred to the Service interms of this Contract passes to the Service on delivery andsignature therefor, in accordance with the pre-arranged place , dateand specia l conditions agreed to by the Service.

(3) The Service hereby indemnifies Waymark against all loss anddamages arising from the loss and/or damage of such Hardwareand/or Software once such Hardware or Software has been sodelivered and signed for , and against all damages which theService may suffer due to such loss or damage or in any otherway arising due to the use of such Hardware and/or Softwaresupplied to its sub-contractors in terms of this Contract.

(4) The liability of Waymark for faulty execution of services rende redin terms of this Contract will be limited to Waymark rectifying,within a reasonable time and free of charge any errors cause d byWaymark as a result of such faulty execution of services:

Provided that Waymark is notified of the damage or faultyexecution of the services.

(5) Waymark warrants that to the best of its knowledge, all equipmentused in the rendering of services in terms of this Contract do notinfringe upon any patent right or copyright of any third party.

16. ASSIGNMENT, CESSION AND DELEGATION

(1) Neither Party is entitled to cede , assign or transfer its rights andobligations or in any other manner to dispose of, delegate or makeover any of their rights or obligations in terms of this Contractwithout the prior written consent of the other Party, which consentshall not be unreasonably withheld .

(2) The use of sub-contractors by Waymark to render the services interms of this Contract , shall not be construed to be a session orassignment for the purposes of this clause.

17. WAIVER

(1) Failure or neglect by either Party to, at any time , enforce any of theprovisions of this Contract shall not, in any manner, be construedto be a waiver of any of that Party's rights in that regard and interms of this Contract . Such failure or neglect shall not, in anymanner, affect the continued, unaltered validity of this Contract orprejudice the right of that Party to institute subsequent action.

(2) No indulgence or extension of time which any Party may grant tothe other shall constitute a waiver of or, whether by estoppel orotherwise, limit any of the existing or future rights of the grantor interms hereof, save in the event and to the extent that the grantorhas signed a written document expressly waiv ing or limiting suchright.

18. NON-EXCLUSIVITY

Nothing in this Contract shall be construed as creating an exclus iverelationship between Waymark and the Service and Waymarkmay continue to provide other serv ices or services of a similar oridentical nature to other clients from time to time provided thatWaymark does not utilise or disclose the Confidential Informationof the Service in the provision of such services. Waymarkundertakes to inform the Service where similar initiatives/projectsare being pursued .

19. AMENDMENTS TO CONTRACT

(5)NO amendment to this Contract shall be valid or have any force oreffect unless reduced to writing and signed by duly authorisedrepresentatives of both Parties.

20. DISPUTE RESOLUTION

(1) The Parties accept that disputes and differences may arisebetween the Parties during the course of this Contract . Anydispute , which may arise , shall be referred to a joint committeeconsisting of two representatives of each Party, who will use theirbest endeavou rs to resolve the dispute within two daX? of thedispute having been referred to them .

(2) In the event that the Parties are unable to resolve their dispute interms of sub-clause (1), such dispute shall be finally resolved inaccordance with the Rules of the Arbitration Foundation ofSouthern Africa ("AFSA") by an arbitrator or arbitrators appointedby AFSA.

(3) Either Party to this Contract may demand that a dispute bereferred to arbitration by giving written notice to that effect to theother Party.

(4) This clause shall not preclude either Party from obtaining interimrelief on an urgent basis from a court of competent jurisdictionpending the decision of the arbitrator.

(5) The arbitration referred to in sub-clauses (2) and (3) shall beheld-

(a) at Pretoria ; and

(b) with a request to be completed within five working daysafter it was requested.

(6) The Parties irrevocably agree that the decision in arbitrat ionproceedings-

(a) shall be final and binding upon the Parties ;

(b) shall be carried into effect; and

(c) may be made an order of any court of competentjurisdiction .

(7) This clause is severable from the rest of this Contract and shallremain valid and binding on the Parties notwithstanding anytermination of this Contract .

(8) Notwithstanding any dispute , which may exist between the Partiesand be subject to resolution in accordance with the aforegoing ,neither party shall, pending the outcome of the dispute , delay theprovision of any of their obligations in accordance with thisContract.

21. FORCE MAJEURE

(1) Neither of the Parties shall be liable for a failure to perform any ofits obligations insofar as it proves:

(a) that the failure was due to an impediment beyond itscontrol;

(b) that it could not reasonably be expected to have taken theimpediment and its effects upon the Party 's ability toperform into account at the time of the conclusion of thisContract ; and

(c) that it could not reasonably have avoided or overcome theimpediment or at least its effects.

(2) An impediment, as aforesaid , may result from events such as thefollowing , this enumeration not being exhaustive:

(a) war, whether declared or not, civil war, civil violence , riotsand revolutions , acts of sabotage ;

(b) natural disasters such as violent storms, cyclones,earthquakes, tidal waves, floods , destruction by lightning;

(c) explosions , fires , destruction of machines , of factories andof any kind of installations;

(d) boycotts , strikes and lock-outs of all kinds, go-slows,occupat ion of factories and premises , and workstoppages; or

(e) acts of authority, whether lawful or unlawful , apart fromacts from which the party seeking relief has assumed therisk by virtue of any other provisions of this Contract .

(3) For the purposes of this clause "impediment" does not include lackof authorisations, of licences , of permits or of approvals necessaryfor the performance of this Contract and to be issued by theappropriate public author ity.

(4) Relief from liability for non-performance by reason of theprovisions of this clause shall commence on the date upon whichthe party seeking relief gives notice of the impediment relied uponand shall terminate upon the date upon which such impedimentceases to exist; Provided that if such impediment continues for aperiod of more than sixty (60) days either of the Parties shall beentitled to terminate this Contract .

22. NOTICE

(1) Notices in terms of this Contract must be in writing and the Partieschoose as their respective domicilium citandi et executandi for thepurposes of legal proceed ings and for the purposes of giving orsending any notice provided for or necessary in terms of thisContract , the following addresses:

(c) if delivered , be presumed to have been received on thedate of delivery ; or

(d) if sent by prepaid registered post, be presumed to havebeen received within five working days of posting unlessthe contrary is proved; or

(e) if sent by telefax , be presumed to have been received onthe first working day following the date of sending of thetelefax unless the contrary is proved.

23. SURVIVAL OF CONTRACT

Each Party acknowledges and agrees that the undertakings givenin relation to Confidential Information and Intellectual PropertyRights shall survive the termination of . this Contract and shallcontinue in force until such time as the Confidential Informationbecomes public knowledge other than by breach of this Contract .

24. SEVERABILITY

In the event that any of the terms of this Contract are found to beinvalid, unlawful or unenforceable, such terms will be severablefrom the remaining terms of this Contract, which will continue to bevalid and enforceable.

25. ENTIRE CONTRACT

(1) This Contract constitutes the entire agreement between theParties and supersedes all prior verbal or written agreements,arrangements, representations or undertakings between theParties regarding the subject matter of this Contract and theParties will not be entitled to rely in any dispute regarding thisContract on any terms, conditions or representations notexpressly contained in this Contract.

(2) No variation of or addition to this Contract will be of any force oreffect unless reduced to writing and signed by the Parties.

26. GOVERNING LAW

This Contract shall be governed by and interpreted in accordancewith the laws of the Republic of South Africa.

27. EMPLOYEE SCREENING, PERFORMANCE REVIEWS ANDOTHER REQUIREMENTS

(1) The Parties agree that the Service may require that anyemployee, consultant, agent , representative or sub-contractor(collect ively hereinafter, for the purposes of this clause, referredto as an "employee") employed or appointed by Waymark, inthe execut ion of this Contract, to undergo integrity testingand/or screening as the Service may deem appropriate, at thejoint expense of the Parties .

(2) In the event that the Service is not satisfied with the results ofthe integrity testing and/or screening of the employee , asstipulated in subclause (1), the Service shall advise Waymarkof its dissatisfaction and the reasons therefo re and Waymarkshall immediately replace such employee with another suitablyqualified and appropriately trained employee.

(3) Waymark agrees that it shall at the request of the Service atany time during the existence of this Contract require an

employee to undergo performance rev iews, and in the eventthat the Service is not sat isfied with the performance review,the Service shall advise Waymark of its dissa tisfaction and thereasons therefore, and Waymark shall immediately replace theemployee with another suitably qualified and appropriatelytra ined employee.

(4) In the event that any Party deems the conduct of any employeeemployed by the other Party in the execution of this Contractunsuitable, in any manner whatsoever, such Party shall advisethe other Party thereof and such Party shall endeavour toreplace the employee with another suitably qualified andappropriately trained employee.

(5) During the execution of this Contract at the premises of eitherParty any employees employed by either Party shal l adhere tosuch work procedures, rules and regulations of such Party andshall , at all times, conduct themselves in a professional mannerand shall refrain from any conduct which may disrupt therelationship between the Parties and the relationship betweenthe employee and any such other person with whom he isobliged to work or co-operate.

~(6) No employee of either Party may in the execution of this

Contract do anything , which may prejudice or be adverse to orcompromise , in any manner whatsoever, the business or otherinterests of the other Party.

(7) An employee employed by Waymark for the purpose ofexecuting this Contract shall , as and when required by theService , execute confidentiality agreements with the Service.The Service may require that an employee of Waymark obtainsecurity clearance from the Service in accordance with theMinimum Information Security Standards stipulated in thePublic Service Act , 1994 (Act No.1 03 of 1994) at the expenseof Waymark.

28. RELATIONSHIP

(1)Nothing in this Contract shall be construed as creating anyrelationship of agency, employment, partnership or joint venturebetween the Service and Waymark.

(2)Waymark sha ll not have any authority whatsoever to incur anydebt, enter into any agreement, undertake any promise orobligation on behalf of the Service, or to bind the Service in anymanner whatsoever and Waymark shall not hold itself out ashaving any such authority.

1. TYPES OF DELIVERABLES

The Deliverables cons ist of the following generic types of outputs:

(a) Delivery of reports , specifications and other documentation (Type 1)

(b) Predefined commercially acquired hardware and software components (Type 2)

(c) Commercially acquired additional hardware and software components acquiredaccording to the Acquisition procedure set out in Annexu re "H" (Type 3).

(d) Bespoke (developed) components that consist of (software) appl ications, trainingmaterials, etc (Type 4)

2. ACCEPTANCE PROCEDURE

2.1 Each of the types of Deliverables set out in paragraph 1 has different procedures attachedto acceptance. These are defined below.

Type 1: (a) The cost associated to this type of Deliverable will be known prior tothe event. The Deliverable will be provided to the Project Officer of theService who is responsible to inform Waymark of the decision of theService within five working days after delivery of the Deliverable.

(b) If the Deliverable is accepted, an acceptance certificate must beprovided to Waymark. If the Deliverable is not accepted, Waymarkmust be notified in writing that the Service does not accept theDeliverable specifying the reasons therefor.

(c) Depending on the decision of the Service, corrective action orinvoicing will proceed.

Type 2: (a) The cost associated to this type of Deliverable will be known prior tothe event. The place of delivery will be agreed upon prior to deliverybetween the Petties.

(b) Waymark will provide the Project Office r of the Service with a deliverynote and a packing list together with the Deliverable. The ProjectOfficer of the Service must provide Waymark with an acceptancecertificate within five days after delivery of the Deliverable. If theService does not accept the Deliverable, the Project Officer mustinform Waymark in writing that it does not accept the Deliverable andthe reasons therefor.

(c) If the Serv ice fails to provide Waymark with the accep tance certif icatewithin the period mentioned in subparagraph (b), the Deliverable willbe deemed accepted.

If the Service accepts theDeliverable or fails to provide Waymark with an acceptance cert ificate ,Waymark will proceed with the invoicing.

Type 3: (a) Based on the selected quotations and the specification , the costassociated to this type of Deliverable will be known prior to the event.

(b) Waymark will provide the Project Officer of the Service with a deliverynote and a packing list together with the Deliverable. The ProjectOfficer of the Service must provide Waymark with an acceptancecertificate within five days after delivery of the Deliverable. If theService does not accept the Deliverable, the Project Officer mustinform Waymark in writing that it does not accept the Deliverable andthe reasons therefor.

(c) If the Service fails to provide Waymark with the acceptance certificatewithin the period mentioned in subparagraph (b), the Deliverable willbe deemed accepted.

(d) In the event that the Service does not accept the Deliverable,corrective action must be taken by Waymark whereafter theAcceptance procedure must be repeated. If the Service accepts theDeliverable or fails to provide Waymark with an acceptance certificate ,Waymark will proceed with the invoicing.

Type 4: (a) The Service must within ten working days or such longer period as theParties, acting reasonably , agree after the completion of theDeliverable:

(aa) advise Waymark that it accepts the Deliverable ; or

(bb) notify Waymark in writing that it does not accept the Deliverablespecifying the reasons therefor.

(b) If the Service fails to advise or to not ify Waymark as required inparagraph (a), the Deliverable will be deemed accepted.

(c) If the Service notifies Waymark that it does not accept theDeliverable, then Way mark shall modify the Deliverable so as toensure that same meets the Acceptance Criteria and Specifications .

1. PROJECT STRUCTURE

The structures to control the project will essentia lly consist of a Steering Committee , and

a Project Management Team.

2. PROJECT STEERING COMMITTEE

2.1 Role of Steering Committee

Main responsibility is to oversee the whole project , to verify with project managers the

financial and scheduling impacts of major decis ions and to delegate decision -making as

appropriate. The Steering Committee should be the reference point from contractual

point of view as well as the review of regular progress reports and associated action

activation. Specific roles are listed below:

(a) Final point of responsibility.

(b) To provide top-level guidance and policy measures for implementation of this project.

(c) To provide suggestions for a working methodology and directions from time to time.

(d) To advise any mid course correction required in execution of project.

(e) To monitor the progress of the project.

(f) Review and approve project scope and funding changes.

(g) Approve communication with the media.

(h) Uphold the project intemal commun ication structure guidelines.

2.2 COMPOSITION

The Project Steering Committee will consist of the following :

1 Introduction

1.1 Background1.1.1 DoSS required a technical gap analysis between the Waymark proposed FCS solution

and the current DoSS infrastructure.1.1.2 The proposed solution must prevent the proliferation of illegally possessed firearms

and, by providing for the capability to manage the removal of those firearms andimprove control over legally possessed firearms, to prevent crime involving the use offirearms.

1.1.3 This document should be read in conjunction with the other baseline architecturerequirements and tender documents such as:

i. FCSY-00366 User requirements specification for the FCS;ii. FCSY-00185 FCS ICT Architecture;iii. FCSY-00372 IS Architecture for FCS;iv . FCSY-00192 Security requirements definition for FCS; andv. FCSY-00237 FCS ICT Principles, Strategy and Standards.

1.2 Purpose1.2 .1 This document is intended to prov ide the key technical requirements required to

implement a solution for the Firearm control services. Recommendations will beprovided if alternative options exist.

1.2.2 The focus of this document is on the technical infrastructure and the deploymentthereof. However, some functional issues regarding the solution is also included whereappropriate.

1.3 Approach1.3.1 An assessment of the proposed FCS solution requirements was reviewed and mapped

to the existing DoSS infrastructure and proposal requirements. Furthermore, possiblegaps were identified regarding technical and functional requirements. Suggestions andor recommendations are included in this document where appropriate to mitigatesome gaps.

1.3.4 The current FCS technical infrastructure is discussed in detail which includes adepiction of the available bandwidth to the relevant swltchlnq centres (and if possiblethe last mile of the DFOs).

2 DoSS leT Infrastructure (summary technical overview)

2.1 Platform Architecture Solutions2.1.1 Business requirements drive application product choice, application product choice

drives the choice of hardware platforms. The Firearms soluti on proposed determines tosome extent the choice of hardware platforms . Some platform components are forcedby existing reality within the DoSS envi roment: in addition to the desired platformsituation described below, there will always be additional platform elements forced bya specific solution. For example, the following :

i) Oracle Applications can only run on an Oracle database ;ii ) Industry trends have it that Oracle databases should not be used on the

mainframe; andiii) Documentum Media services, Autorender and Input Accel can only run on Intel

platforms.

2.2 Current DoSS Central Server Hardware Infrastructure2.2 .1 This layer primarily provides core low level computing and foundation services to t he

application components running on it. It has lead system characteristics such asusability, performance, robustness, upgradeability, supportability, cost-effecti venessand interoperabilit y of components (openness).

2.2.2 Core services provided by this layer include aspects such as the following:i) Computing and storage components;ii) Security; andiii) Data management.

2.8 Bandwidth measures2.8.1 Data transfer is measured by the size of a file, and how many times it is delivered to

people viewing the images . Quick response for viewing or handling images wouldrequire a high bandwidth.

2.8.2 Images are created and used within digitising / scanning projects. All scanners anddigital cameras produce raster images. Raster images are made up of a grid or matrixof pixels. Each pixel represents a colour sample from the original analogue image orscene and is capable of being edited individually. Because raster images recordinformat ion about each pixel, they tend to be quite large: a 24-bit image uses 8 bits ofdata for each colour (red, green and blue), giving 256 values of each colour and atotal of 16.7 million colours . A 24-bit image of 600 x 400 pixels in size, would result ina file of around 700KB. Common raster formats include TIFF, JPEG, GIF and PNG.

2.8.3 All paper-based imaging processes result in requiring additiona l resources to capture(scan), index and verify the images, which is neither time nor cost effective. However,the requirement to process imaged documents should reduce due to enhancedelectronic forms technology that is now available. In utilising e-fo rms the applicant'stime is utilised to filling his form online (self-serve). A kiosk solution should enable theapplicants that don't have their own on-line facilities to fill their applications forms on­line. Currently the DFO assists the illiterate in filling out the paper form manually, thesame can be done utilising an electronic form.

2.8.4 Attempting to determine the average bandwidth is a difficult task. Many variableshave an affect on bandwidth use on any given network. The following factors mayaffect the amount of network bandwidth:

i) The complexity of the shared program and files or data being shared. Forexample, files with animation use more bandwidth, while text files use lessbandwidth.

ii) The types of actions or tasks that the user is performing within a program. Forexample, rapid scrolling uses more bandwidth, while typing uses less bandwidth.

iii) The rate at which tasks are completed, with or without normal pausing, and thenumber of users / tasks involved.

iv) The ability of the program and operating system to efficiently process tasks andinformation, as well as their performance characteristics.

v) The types of information being shared and the ability to cache the information.For example, to cache information to accommodate repeated views will notaffect the bandwidth .

Implications of new ActThe Firearms Control Act, 2000 (Act No. 60 of 2000) requires that the CentralFirearms Register must contain:

i) The central firearms database;ii) The central dealers database;iii) The central manufacturers database;iv) The central gunsmiths database;v) The central importers and exporters database;v i) The central Official Institutions database;vii) Information concerning competency certificates, licences, authorisations, permits,

renewals, transfers and cancellations;Information concerning the transport of firearms and ammunition, the loss,recovery, theft or destruction of firearms;Fingerprints which have been submitted for the purposes of an application; and.Information regarding licence holders, firearms and firearm warrants must beretained in an auditable manner.

Currently, firearms and ammunition are not managed from import or manufacturing todestruction, deactivation or export as required by the Firearms Control Act.

Proposed Solution SummaryIt is proposed that the Firearm Control System (FCS) will operate from a central datacentre that will service one central administration office, 9 provincial offices, 44 areaoffices, 312 designated firearm centres (DFOs), approximately 1 200 police stations(enquiry functions), 70 border posts, 43 radio control centres and several specializedunits.A range of stakeholders from manufacturers to dealers and associations will alsointerface with the FCS to provide and receive information. The following is noted on Figure 7 regarding user terminology and processresponsibilities:

i) Fire Arm Control Centre must be Fire Arm Registration Centre;ii) The Border Posts are official DFOs and should have the same capabilities as the

FRC to process and issue import and export applications and permits; andiii) The Provincial and Area offices are also responsible to capture declarations of

unfitness to possess a firearm.

It must be possible that at any time duringthe life cycle of a firearm the FCS database should be able to be interrogated and thelocation and owner of a firearm established.

5 Security

5.1 DoSS Required Security Functionality

5.1.1 Persal Interface5.1.1.1 As the PERSAL system is the point of HR management for SAPS human resource

logist ical information such as delegation rank and reporting area it is suggested thatthe system interface, currently in place, be maintained, enhanced and carried over tothe FCS.

5.1.1.2 This will ensure that the user information is maintained and that any changes will becarried through to the FCS automatically.

5.1.1.3 This interface can also be expanded to incorporate additional functionality regardingpersonnel transfers and resignations to adjust access conditions.

RACFRACF is the primary product utilised to control and manage external access throughthe protection areas / firewalls into the data storage areas. It is imperat ive that thisbe maintained for interfacing with applications on 05390. RACF will be the masterregard ing the synchronisation between RACF and the proposed identity managementcomponent.

Security DiscussionThe ability to ensure that the user accessing data and systems is in fact who they saythey are and that they have access only to those resources to which they areauthorized is critical to the success of any security plan.The DoSS is currently investigating an Identity Management solution includingdirectory service functionality. It was decided in a workshop held between SITA, DoSSand Waymark, on 24 August 2004 that the proposed solution will be developed whilsttaking the requirements of directory services into consideration . The securitycomponent must be developed utilising standards and best practise principles so thatit can easily be replaced with future security components.

5.2.1 User Authentication5.2.1.1 The solution proposed smartcards including biometrics as an alternative method for

authentication. The client raised an objection towards smartcards practicality due tonormal human behaviour when having to use tokens to perform a task.

5.2.1.2 It is recommended that a biometric solution together with a directory serv ice(including digital certificates) capability be implemented for FCS for authenticationpurposes. User authentication will be done via Oracle Single Sign-on, which willintegrate into the portal interface.

5.2.1.3 The system will be configured to function with both password and biometricauthentication. This will allow various users levels to have different forms ofauthentication . It must be noted that it is assumed that SITA will provide the X509certificates for each of the users.

6 Network Discussion6.1 This section is intended to discuss network requirements, where appropriate,

those elements of the network that are not aligned with the requirements of theproposed FCS solution, which incorporates the Internet, Extranet, Intranet andWeb-based technologies. The existing DoSS network details are depicted infigure 3.

6.2 Currently most-of the DFO units only have 64 KB - 128 KB bandwidth which isentirely inadequate to process applications that must deliver documents andimages. There is currently a task group assigned to determine the requirednetwork capacity to fulfil the expanding applications requirements. The findingsshould be used to specify the requirements mapped out on the current DoSSnetwork.

6.3 The DoSS component of the FCS will reside within the SSL network of the DoSSWAN and must fully utilise this backbone as the primary communicationplatform.

6.4 New routers can integrate the functionality usually contained in separateplatforms or components, e.g. combining security services such as IP VPN,firewall, and IDS-as well as traffic management features such as NetworkAddress Translation (NAT), QoS, content delivery, caching, and applicationswitching to the same router. This is different to the basic throughput. Managingthe switch, the flows, and associated business rules can be quite complex, i.e.which blade should the traffic go through first? How much latency does it entailfor every packet? How does this impact the backplane capacity, when everypacket goes over the backplane 10 times to traverse each blade?

7 Identified FCS Gaps

7.1 Adobe Acrobat 6 Electronic Forms7.1.1 Although the proposed solution includes a forms processing capability, the actual

development of specific electronic forms is proposed as an option. It is recommended /~that the option to use electronic forms within the FCS system is given the necessary v~

well the burden on DFO resources to scan and index paper documents. A scan processis resource intensive and very t ime consuming . The electronic forms can also beutilised to initiate self service from the public sector within a proper FCS definedapplication process.

7.2 Adobe Acrobat 6 Approval7.2.1 The proposed solution includes 100 approval licenses, which is based on licensing the

forms within the solution and not on the number of DFOs. There are currentlyapproximately 60 DFO forms required for the Firearm solution. The forms total will notescalate if the forms are e.g. available in several languages, the licenses areapplicable to specific forms. The proposed 100 approval licences is thus sufficient forthe existing requirement.

Records ManagementThe Waymark proposed solution includes an integrated Records Managementcomponent. Careful consideration must be given to the retention periods and thedisposal instructions of the electronic records. It is recommended that a project beinitiated to consider / review the retention periods of the original paper documentsand the disposal instructions due to the fact that the information thereof is availableelectronically.

Oracle Software LicensesAdditional Oracle software licensing is required for the capacity proposed to upgradethe existing Sun Fire 15k with an additional 3 sunblades. It is assumed that thelicences proposed are only for the development Sun servers environment.Although Oracle 9i was proposed, the DoSS is busy with an upgrade to Oracle 109which must be utilised for developing the proposed FCS system.

7.5 Local Servers7.5.1 The proposed solution provides for a central application and central storage and

management of data as well as for 312 local data capture servers (scan) . Theproposed solution adheres to best practice regarding facilitating the capture of data atthe point of source, so as to reduce bottlenecks of capturing data at one central pointand enabling better turn-around-time to get data captured online .

7.5.2 The solution proposed a local server at each DFO (312) site. It is recommended thatthe proposed architecture change to a distributed content architecture. The centralDocumentum content server provides the capability to manage and store contentcentrally whereas the distributed content servers enable distributed capture of data aswell as local retrieval of captured images. This will have an advantage on the networkbandwidth availability when retrieving images locally. All the content will be replicatedto the central server. This suggestion implies the proposed Input Accel component isthen not needed and can thus be discarded, on the other hand future maintenanceand support will be required for these servers.

7.5.3 Provision is made for only 312 local servers for the DFO units . However, the provinc ialand area offices will be processing e.g. unfit declarations and thus also require thesame infrastructure as the DFOs, i.e. ScanMann licenses and a distributed contentserver which could incur additional costs. There are other options that can beconsidered. If the provincial and/or area offices are located close geographically to aDFO unit, they could share the distributed content server.

7.5 .4 There are pro's and con's to both a federated and central architecture. The centralisedarchitectu re will have a negative impact on the current network, whereas t hefederated architecture will incur additional cost regarding Oracle and Documentu mlicenses for distributed databases and applicat ion. capability that prov ides for accessing documents locally is best fit for t he current DoSSenvironment.

7.6 Servers and workstations7.6.1 The solution proposed Dell servers and workstations, however the DoSS will only

acquire servers and workstations that are in accordance with their standards. Thespecifications proposed for the workstations must change to meet the standardspecifications as supplied in the current FCS workstation hardware infrastructure tablein paragraph 2.4. There are currently no specific server specifications standards,therefore servers will be acquired with the specifications as proposed in considerationwith the DoSS standards to come.

7.7 Central Capture Server7.7 .1 Should the recommended distributed content architecture be considered, the Input

Accel document imaging server that is used to export images to Documentum can beexcluded from the solution, This could incur a saving in cost, approximately Rl00 500for the licensing and approximately R85 000 for the server hardware.

7.8 Precise Biometric Devices7.8.1 Though Precise biometrics was proposed for user authentication, the Sagem

MorphoSmart 300 has been evaluated by DoSS and is preferred as such. The Precisedevices are considerably cheaper than the preferred Sagem MorphoSmart devices,however the quality of the Precise devices are not yet proven and will have to beevaluated as such prior consideration. There would be additional costs should thepreferred MorphoSmart 300 devices be acquired.

7.9 HP Scanjet 4600 Scanners7.9 .1 The DoSS deployed HP Scanjet 4600 and HP Scanjet 5490C scanners at the DFOs

which prove to be too slow to be used within the FCS scanning processes. It isrecommended that these scanners are upgraded with scanners that have the followinqmin imum specification:

i) A4 duplex and A3;ii) Flatbed;iii) 24 bit colour;iv) Optical resolution: 300dpiv) A4 portrait @200dpi mono, simplex: 25 ppm;vi) A4 portrait @200dpi mono, duplex:vii) ADF capacity of 50 sheets;viii) Twain or ISIS compatibility;

ix) Software support for Win 2000 and XP operating systems;x) SCSI-2 interface.

7.9.2 Provision is made for only 313 ScanMann software licenses for the DFO units.However, the provincial and area offices will be processing e.g. unfit declarations andthus also require ScanMann licenses, which could incur additional costs.

7.9.3 Furthermore it is recommended that the A3 scanners only be deployed centrally andat specific DFO units where it is required to scan e.g. the floor plans of a manufacturer/ dealer.

7.9.4 DoSS must weigh the options of either scanning extensively or ut ilising e-forms inaddition to some of the scanning processes.

7.10 Fax Services7.1 0.1 The proposed solution includes a fax server and Rightfax software which could enable

applications t o be faxed through to th e central FCS. This implies that unable DF/1.an

accept an application and fax the documents to be indexed centrally. This implies acapture process within the centra l FRC to prov ide for indexing and verifying the qualityof the faxed information. The original documents and the electronic (faxed)information must be routed to the designated DFO to continue with the norma lprocess, e.g. approvals etc. This could pose a potential risk if the fax facility ismisused . An option to allow only the DFO officials to fax information to the central faxfacility should be investigated. Another option would be to setup a process tofilter/eliminate all information t hat was faxed by a non-DFO offic ial.

MessagingUse Oracle109 Advanced Queuing capability for messaging that is required within theboundaries of the Oracle environment. Utilise DoSS's MQ Websphere messagingcapability for all information beyond the Oracle environment, l.e. the information ofthe external stakeholders from the web site.

Documentum DesktopThe proposed solution did not include the deployment of the Documentum desktopdue to the requirement for a web-based solution. It is however recommended thatDocumentum Desktop be deployed at the DFOs to allow for an integrated officesolution to capture manual letters / correspondence within the solution. This impliesintegration required between Corel WordPerfect Office 11 and Documentum as well asMicrosoft Outlook and Documentum. The proposal mentions integration with Webapplication servers, authoring tools and Microsoft office.The Documentum Desktop does not require additional licensing, however it requires aphysical integration with the Corel office suite which is not an off the shelf integrationas it would have been with Microsoft Office.

Back-scanningAn additional 3.5TB of storage is required if the client decides to implement backscanning of existing paper documents, which could incur additional cost. The back­scanning infrastructure and services are included in the Bill of Material (BOM). It isrecommended that an internal DoSS Bureau Service be considered to control theentire DoSS scanning requirements in a consolidated manner, which could includecentral management thereof.

BIReportsThe proposed Oracle OLAP component must be reviewed in conjunction with theexisting DoSS BI capacity. At this stage additional storage is included for the OS390environment which means that the existing OLAP licensing for OS390 should besufficient and that the proposed OLAP licenses are not required.The Oracle 9i / Oracle 109 Report component will be utilised to develop theoperational reports. It is recommended that a separate data mart be created withinthe current DoSS BI environment for the new Firearm system to ensure reuse ofcurrent capital investment.The proposal states that Oracle9i Reports Developer uses a declarative, document­centric development model to help the J2EE developer rapidly create high-fidelity weband paper reports against any data source (including Oracle9i, JDBC, XMl, text files,and Oracle9i OLAP). Oracle9iAS Reports Services securely publishes these reports inany format (including HTMl, XMl, PDF, delimited text, Postscript, PCl, and RTF) toany dest ination (including e-mail, web browser, Oracle9iAS Portal , and file system).

7.15 Audits7.15 .1 The proposed solution does not address the audit requirement in much detail. It is

recommended that the audit requirements be given good consideration in the designphase together with the design of the solution.

DoSS Switching CentresThe majority of the DoSS switching centres currently don't have the capacity fordeploying additional servers. A couple of the centres also don't have adequate securitymeasures, i.e. a locked door only. Department of Public Works is responsible for thelocation facilities and air conditioners which makes it difficult to manage the physicalproblems that arise.

DFO BandwidthCurrently most of the DFO units only have 64 KB - 128 KB bandwidth which is entirelyinadequate to process applications that must deliver documents and images. There iscurrently a task group assigned to determine the required network capacity to fulfilthe expanding applications requirements.It is recommended that the entire network be upgraded. Should the new firearmsystem have response problems due to inadequate bandwidth the users will have torevert to manual processes in some instances, e.g. the scanning process currentlywithin the airport.

System FailoverIf the Documentum directory (application and data) becomes inaccessible, thedocuments become unavailable. A planned failover strategy must be implemented toensure that if a server fails, the workload can be carried over to another server toprovide contingency.

7.20 External Stakeholders7.20.1 Although Coldfusion MX is provided, the hardware and Oracle software required for

the Public Web site is not included in the bill of material.7.20.2 DoSS's current internet site is managed by SITA. The same ISP can be considered for

the proposed Public Web site, although the current ISP infrastructure is old andoutdated.

7.20.3 It is recommended that the ISP infrastructure be upgraded to the followingspecification:

i) Pentium 4;ii) 2.8 Mhz;iii) 2 GB RAM;iv) 5 * 80 GB HDD.

7.20.4 A server is required to host Cold Fusion and the Oracle database externally to thefirewall. Additional Oracle licenses will be required for the number of processors of thenew server. The proposal for a public website is not addressed with enough detail.

7.20.5 It is suggested that further discussions take place regarding the architecture andprocesses e.g. process to enable applicants to capture their information themselves onan electronic form via a kiosk or the internet. It will alleviate the burden of the DFOresources to scan and index paper documents which is time consuming. ~
