State health officials continue to monitor the spikes and outbreaks in neighboring states, as well as the rising positivity rate among young people. In keeping with trends states are seeing across the country, the positivity rate among Marylanders under 35 (6.33%) is 84% higher than the positivity rate for Marylanders age 35 and older (3.44%). Anecdotal evidence from local health and law enforcement officials strongly indicates that there are an increasing number of COVID-19 cases due to non-compliance with mandatory social distancing and facial covering requirements. This has been particular notes for bars and restaurants.
To be clear:
All customers over the age of nine are required to wear a face covering while inside the enclosed area of any food service or retail establishment
• All staff must wear a face covering while working and interacting with customers. • Physical distancing measures must be in place, including:
o Customers seated at the bar must be seated at least 6 feet apart. They may not stand at the bar.
o Every other booth must be closed for facilities with booths. o Customers must be seated at least 6 feet away from each other (when not in groups or
households). No more than six people at a table. o No buffets.
• Indoor dining is still limited to 50% occupancy.
Also, we are still actively collecting and reviewing law enforcement responses for face covering and other order violations. Please ensure your personnel are completing the 70-4 form after responding to a complaint or initiating a check based on observations during patrol. This program provides funding to states and units of local government with existing crime laboratories that conduct DNA analysis to increase the capacity of publicly funded forensic DNA and DNA database laboratories to process more DNA samples.

The JAG Program is the primary provider of federal criminal justice funding to states and units of local government. BJA will award JAG Program funds to eligible units of local government as described in this solicitation.

An Update from the National Police Foundation
The National Police Foundation, with support from The Starbucks Foundation and The Motorola Solutions Foundation, is pleased to announce the National First Responder COVID-19 Grant Relief Program. This program will allow first responders and survivors of first responders in underserved communities an opportunity to request a grant to reimburse select COVID-19 related expenses, such as mental health and wellness costs, (i.e. counseling services, suicide prevention), unanticipated dependent care, disinfecting services, and similar costs. These micro-grants may be awarded in an amount up to $1000. Applications will be reviewed by the National Police Foundation, the National Fallen Firefighters Foundation, Concerns of Police Survivors (C.O.P.S.), the National Emergency Number Association (NENA) 9-1-1 Association, and the National Organization of Black Law Enforcement Executives (NOBLE), and the National Association of Women Law Enforcement Executives (NAWLEE). The National Police Foundation will be distributing the grants directly to the recipient. Unique to this program is its focus on highly impacted first responders and their families, which is addressed by prioritizing families of dual first responders or first responder and “essential worker” families, recently laid off or furloughed first responders, survivors of fallen first responders, or a single parent first responder that has children with special needs. The program focuses on a broad definition of first responders, including law enforcement, firefighters, emergency communications professionals, correction/detention officers and analysts who are required to report to work during the pandemic. “We are incredibly honored to have the opportunity to design and administer this program and it is one that we are confident will make a difference for many highly impacted first responders and their families,” said Jim Burch, President of the National Police Foundation. “Together, with the generous contributions from The Starbucks Foundation and the Motorola Solutions Foundation, it is our turn to protect the protectors and to help ease some of the financial burdens incurred by many during these challenging times.” First responders or family members interested in applying for a grant can review eligibility and apply here: https://www.policefoundation.org/national-first-responder-covid-19-grant-relief-program/

End of Watch Report June 2020
In June 2020, fifteen officers died in the line of duty in the United States. This brings the year-to-date total to 114 officers, a 44% increase over this time last year. This increase is largely due to the 51 officers who have died as a result of COVID-19 in the past few months. In June, five officers died as a result of gunfire, five died as a result of COVID-19, four died in auto-related incidents (two automobile crashes, one motorcycle crash, one vehicular assault), and one officer died as a result of a different duty-related illness. The Office Down Memorial Page extends our deepest condolences to the families, friends, and agencies who lost a loved one to a line of duty death in June 2020. Please take a moment to read the memorial and remember those fallen officers.
Maryland Chief of Police & Maryland Sheriff’s Association Members: First, thank you for the opportunity to address your esteemed associations and I hope this introductory letter finds everyone safe and healthy. I wanted to take a brief moment to affirm how much ATF values its relationships with all of our law enforcement partners. I look forward to meeting with you in person and if there is anything we can assist with, feel free to contact me at any time. We are firmly committed to using crime gun intelligence to identify, investigate, and prosecute the offenders committing acts of violence in our communities. As you know, NIBIN (National Integrated Ballistic Information Network) is a large part of this effort and we are always available to assist with your NIBIN sites and following up on leads. My background and contact information are listed below and thanks again for the opportunity to introduce myself. In February 2020, Timothy Jones was assigned as the Special Agent in Charge of the Baltimore Field Division of the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). Mr. Jones was appointed to his current position after serving as the Special Agent in Charge of the ATF Chicago Field Division since January 2019. Mr. Jones was also in the Chicago Field Division as an Assistant Special in Charge in Charge and Commander of the Chicago Crime Gun Strike Force from May 2017 until taking over as the Special Agent in Charge. Mr. Jones began his career with ATF as a Special Agent in the ATF Atlanta Field Division, working violent crime investigations with the Atlanta Police Department from 1998 to 2003. He then became a full-time member of one of ATF’s five Special Response Teams, which are comprised of highly-trained Special Agents who deploy throughout the country to assist with high-risk tactical operations and the apprehension of some of the country’s most violent criminals. Mr. Jones remained on SRT from 2003 to 2013, before becoming the Resident Agent in Charge of ATF Baltimore Field Division’s Hyattsville I Field Office from 2013 to 2016. In 2016, he became the Deputy Chief of the Special Operations Division at ATF Headquarters in Washington, D.C. Prior to joining ATF, Mr. Jones served as a local law enforcement officer with the Charlotte-Mecklenburg Police Department in Charlotte, North Carolina. From 1994 to 1998, he was a Police Officer assigned to patrol, community police, and street crimes units. During his time in the police department, Mr. Jones was also selected as an ATF Task Force Officer in 1995, working alongside ATF Special Agents from the Charlotte Field Division. Mr. Jones studied Political Science at the University of North Carolina – Chapel Hill and graduated in 1993. Throughout his career, he has been the recipient of many awards for merit, outstanding service, and investigative excellence to include the ATF Medal of Valor, ATF Hostile Action Award, and ATF Supervisory Employee of the Year Award for his work on the ATF Chicago Crime Gun Strike Force. These cases, Hicks v. Ferreyra, in the US Court of Appeals, 4th Circuit, and District Court of Maryland, are presented mainly for the unique description of the interaction between two federal law enforcement agencies, rather than any legal standard set in the U.S. Court of Appeals case.
To the extent that the defendants were appealing the trial court’s denial of qualified immunity, the 4th Circuit found that there was no appellate jurisdiction.
“We turn now to the officers’ challenge to the district court’s rulings on qualified immunity. We conclude that we lack jurisdiction to consider this portion of the officers’ appeal, because the officers contest only the district court’s assessment of the factual record and raise no reviewable questions of law. See Davis, 165 F.3d at 268 (limiting interlocutory review of denials of qualified immunity to issues of law).”

For the foregoing reasons, we dismiss this appeal in part and otherwise affirm the district court’s order denying summary judgment. [see District Court’s opinion below for the factual background of this case].

“United States Park Police ("USPP" or "Park Police") Officer Gerald L. Ferreyra pulled over behind a parked vehicle along the side of Interstate 295 North on July 11, 2015 and, when he saw a handgun lying on the front seat, he drew his weapon.
The driver, Plaintiff Nathaniel Hicks, a Secret Service agent, showed his credentials and explained that he was on assignment waiting to lead a motorcade that was approaching, and Officer Ferreyra verified that he was indeed an on-duty Secret Service agent.
Yet, according to Agent Hicks, Officer Ferreyra continued to detain him unreasonably (by holding onto his credentials and weapons) after Officer Brian Phillips arrived to assist, and after the Park Police's supervisor, whom Officer Ferreyra had asked to report to the scene, arrived, and even after the motorcade passed.
And, within minutes after Agent Hicks left the scene, Officer Phillips pulled him over, allegedly for driving erratically and talking on a cellular phone while driving. That second stop was brief but, in Agent Hicks's opinion, still longer than necessary, because Officer Phillips knew that he was a Secret Service agent who was not prohibited from using his phone while driving and, according to Agent Hicks, he was not driving erratically.”
