But if they thinks your car is evidence of a crime, it can be searched without your consent. Drivers and passengers have the right to remain silent. If you are questioned about their legal status: • You have the right to remain silent and not talk about your immigration status to any police ocial. But if you are not a U.S. citizen and an immigration ocer asks for your papers, you must show them if you have them with you. If you do not have immigration documents, you are required to remain silent. • Do not lie about your immigration status or provide false documents.

What to do if you are stopped by the police or an immigration officer

You must remain calm

Do not argue or fight with a government official. Ask if you are allowed to go free. If the officer says yes, calmly and quietly leave the area. If instead you are under arrest, you have the right to know why, and also have the right to remain silent. You may not consent to a search, but the officer may ignore your request, if you suspect you are carrying a weapon.

Even if you give your consent, this can affect you in court.

If an agent comes to your home:

• You do not have to let them in unless they have a Court order. If the officer has, have it go under the door or keep it through the window so you can inspect it. An arrest warrant allows police to enter the house of the person named in the warrant if they

believe that is within the home, but allows agents to enter without his consent. You have the right to remain silent. If you choose to speak with the officers, exit and close the door

If you are arrested:

• Do not resist arrest. Say you want to remain silent and request a lawyer immediately.

• Do not give explanations or excuses, do not say anything, sign or make any decisions without a lawyer. • You have the right to make a local phone call. Do not discuss your immigration status with anyone except his lawyer. • While in prison, an immigration officer can visit. Do not answer questions or sign anything before talking to a lawyer. • Do not sign anything, as a voluntary departure (Voluntary Departure) or retirement provisions (Stipulated Removal), without talking to a lawyer.

If you sign one of these documents you may lose the opportunity to stay in the U.S. or to appear before a judge.

It is essential that you understand the severity, consequences, and possible defenses to the charges against you. It is unlikely that the average person can represent themselves effectively in court against an experienced prosecutor. The

prosecutor knows the law and has experience in handling such matters. If you choose to represent yourself, you are putting yourself at a considerable disadvantage.

A criminal arrest can negatively affect the rest of his life. If you want to minimize the consequences and long-term effects of a criminal case will have on its future. It is essential to be represented by a legal counsel.

What is BAC? BAC stands for alcohol content or blood alcohol concentration in the blood and determines a level of police officer intoxication. El individuals measured BAC, if your BAC is over 0.08% will be arrested and submit charges for driving under influence of alcohol or drugs (DUI).
