NOTIFICATION

The 27th APril, 201 7

No. GS.R. l6tP.A.4112016/5.2312017.- ln exercise of the powers

conferred by section 23 of the Punjab Regulation of Fee of Un-aided

Educational lnstitutions Act, 2016 (Punjab Act No. 47 of20l6)' and all other

powers enabling him in this behalf, the Governor of Punjab is pleased to make

the following rules for carrying out the provisions of the said Act' namely:-

l. Shorttitie and commencement.- ( l)These rules may be called the Punjab

State Regu lation of Fee of U n-aided Educational Institutions Rules, 201 7'

(2) 't'hey shall come into ftrrce on and with effect from th€ date oll

their publication in the Official Gazette.

2. Definitions.-( l) In llrese rrrles. rrnless thc conlext olherwise requires,-

(a) 'Act'means the Punjab Regulation ofFee ofUn-aided Educational

lnstitutions Act, 2016: and

(h) 'Fonn' mcans a fornr appended to tltese rulcs'

(2) The words and expressions used in these rules, but not delined,

shall have llte same meanitrg as assigrled to them in the Act'

3. Payment of remuneration and travelling allowance to nominated

members.-A nonrinated member shall be paid one thousand rupees as

remuneration for atlending a meeting ofthe Regulatory Body' Apart fionr this,

he shall also be Paid the actual amount oftravelling allowance for attending

the meeting.

4. Procedure for scrutinizing complaints.{ l) On receipt ofacomplaint under

section I I of the Act, the Regulatory Body shall give a notice to the concemed

Un-aided Educational Institution as well as to the complainant to ascertain the

correctness and genuineness ofallegations made in the complaint'

llducation Officer, who shall send his report to the Regr latorl Body withregard to its service.

(3) The Un-aided Educational lnstitution shali be afforded anopponunity of hearing to explain its position with regard ro rhe allegationslevelled against it in the compraint. The Regulatory Body m.y arso ca fortherecoid ofthe Un-aided Educationar Institution for scrutini., ing the complaint .

and in order to asc€rtain the genuineness of the allegar ons made in thecomplaint.

(4) After verifoing the complaint and examining tlr: relevant record,the Regulatory Body shall decide the complaint.

(5) Copies ofthe decision, taken on the complainr, , hall be sent to thecomplainant, the concerned District Education O{Iicer a rd the concernedUn-aided Educational Institution.

S€ction l3(2) 5. Procedure of working of Regulatory Body._(l) .fjrere shall be five

days week of working of Regulatory Body.

(2) The office of Regulatory Body shall remain closed on everySaturday and Sunday. Apart lrom this, the Regulatory Bod,r shall follow suchCazetted holidays, as tnay be notified or declared by the Srate Governmentfrom time to tim€.

(3) Ihe Regulatory Body shall take its decision by a quorum ofrnajority.

Section | 8( I ) 6. Maintenance ofaccounts and relevant record, and pr elraration ofannualstatement of accounts.-(l) Every Un-aided Educationar Institution sharlmaintain its proper accounts offee and charges in Form ,,,.'.

(2) Similarly, every Un-aided Edueational Instituti. )n sh:rll maintainits other relevant record in Form .B'.

(3) Likewise, every Un_aided Educational Institur on sh,all prepareits annual statement ofaccounts in Forrn .C'.

Section l9 7. Preparation of annual report.-(l) Every Un_aitied Educationallnstitution shall prepare its annual report for each academ ic year in Form .D,-

and forward a copy thereof to the Regulatory Body.

(2) The said annual report shall be prepared by the 3r,th day ofApril ofEach academic year.

I . ( I ) Ihis Act ntay be called the Punjab Regulation of fee of Un-aided

l. In this Act, tlnless the conle\t otherwise reqttires'-

(a) 'academic year' tneans a period of twelve months prescribed as

' such, and ditlbrent acadenic years rnay be prescribed for different

(b) 'alliliation' tneans inclusion ofthe name ofan institution in the

apprcved list ofafliliated institutions rvith tlre Punjab School Educalion

Board or any otner such boanl orautholity' approved and authorized

(d) 'Regulatory Body'nreaus the Regulatoly Body, constituted undersection 3;

(c) 'conrplaint' rneans an allegation rnade in writing to the Regulatoryllody by a student studying in an Unaided Educational Institution orby his parents or guardians, as the case nray be, containing a

grievance ofclrarging excessive fee or ofdoing or asking to do atry

other activity with a motive to gain financial benefit or profit by theUnaided Educational Institution:

(f) 'conrmercialization or pr ofiteering or prolit or financial gain' means

an activity ofcharging f'ee by an Un-aided Educational lnstitutionliom any studenl or parents ol gtrardians in excess of the I'ee, as

ffued or increased undel section 5;

(g) 'fee' means arty amount by whatever name it rnay be called, whichis charged dilectly or indir ectly by an Unaided Erlucational lnstitution

[or admission ofa student for education to any standard ofcourseofStudy;

(h) 'Furrd'rneans the Ulaided Educational lnstitution Development Fund

constituted under section 9;

(i) 'Governnrent' rneans tlre Goverrrment ofthe State ofPunjab in the

Department olSclrool Education;

(t) 'local authority' means a Municipal Corporation, MunicipalComnrittee, Notified Area Cornmittee, Town Improvetnent Trust,

Panchayat Samiti or Gram Panchayat or any other authorityentrusted with their tirnctions uuder any law for the tirne being in

(k) 'minorily institution' means an educational instihrtion established

and administered byaminority whether based on religion or language

having the right to do so under clause ( l) of article 30 of the

3. (l) There shall be collslituted a l(egulatory Body to be known as the consrirution ol'

Regulatory llody fbl t{egulating lree of tJn-aided Educational lnstitutions at Regulalorv l}od}'

the Divisioual Level in the State of Punjab to exelcise the powers conf'erred

- uporr ard perfornr the lirnctions assigred to il under this Act.

(2) l'hc RegLrlatory Eody shall consist ofthe following ttamely:-.

(a) DivisionalContrnissioner ofthe Chair-person

concelned division;

- (b) Circle Education Ollicer of the Member-

corrcerned division; Secretary

' (c) District Bducation Oflcel Member

(Secondary Educatiorr) posted at the

conierned Headquartel of the division;

(d) District Education Officer (Elernentary Member

liducation) posted at the concelned

Headquarter of the division;

(e) 1\o menrbers, to be norninated by Nominated

tlre Government from amongst tlre members

elnirrerrt educationists of the concerned

clivision;

(f) One menlber, to be nominated by the Nominated

DivisionalCommissionerfromanrongst members

(3) -l'he nonrinated rnemlrcrs rcf-errcd to in subsection (2), shall be

paid sLrch renruneration and travelling allorvance for attending the nreeting ofthe Regulatory Body, as nray be prescribed.

4. The ofllce ofthe Regulalory Body shall be located at the Fleadquarter ofthe concer ned Division.

5. An U[aided Educational lnstitution shall be conrpetent to fix its fee and it

nray also inclease tlre sarne afler taking into accotrlrt the need to generate

lirnds to run the institution and io pr ovide l'acilities necessary for the trenetit oftlre studetlts:

Provided that while tixing or incrcasing fee, the factors rnentioned in

sLrb-section ( I ) o{'section 6, shall be kept in view by the Unaided Educational

lrrstitutiorr:

Provided further that increase in fee shall not exceed eiglrt per cent ofthe fee ol'the previous year, charged by the Unaided Educational Institution.

Provided further that while fixing ol increasing lbe, an Unaided Educational

lnstitution caunot indulge in plofiteering and it cannot clrarge capitation fee.

6. (l) For fixing or increasing fee structure by an unaided educational

institution, the following factors shall be kept in view, natuely:-

(a) the infmsh ucture and lhcilities available or to be rnade available in

the Unaided F.ducalional Institution:

(b) the investment made and salaries paid to lhe teachers and slaff;

and

(c) futule plans for expansion and betterrnent of institrrtion, subject

however, to the restrictiorrs ofnon-ptofiteering and non-charging ofcapitation fee.

(2) The fee lixed under sub-section (l), shall be displayed by every

Unaided Educational Institutior at the conspicuous place in flre School prem ises.

(3) The Unaided Educational Institution shall also ensurc tlrat the t'ee or

funds charged by it fiom the parcnts or guardians, are not diverted ft'om such

institution to the society or the trust, as tlre case rnay be, which ntns suclr

inslitution or to any other institution, except as permissitrle under sub-section

(4) ofscction 10.

7. Subject to the provisions ofthis Act, the Regulatory Body shall exerciselhe porvers aud discharge the lirnctions as mentioned belorv:-

(a) to hear complainls fronl the students or their parents or guardians

rvith regard to tlre charging ofexcessive fee or lbr doing or asking

to (lo any other activity with a nlotive to gain financial benefit orprofit iu contravention ofthe provisions of this Act by any Unaided

Educational lnstitutior:,

(b) to ensu.e that the Unaided Educational lnstinrtions arc not indulgingin cornnrercialization ol'education;

(c) lo check that the lbe strrclure is being kept rvithin the limits as

provided under this Act so as to avoid protiteering;

(d) to strike a balance belween autonomy ofan Unaided Educational

Institution, and nreasurcs to be taketr in avoiding cornmercialization

rlfedrtcation:

(e) to check excessiv€ hike in fee by an Unaided Educational Institutionwith the motive to earn profit;

(l) lo ensurc that increase in the lbe undertaken by an Un-aidedEducational Institution is justified ard necessitated by thecircumstances like increase in expenditure or because of needed

developmental activities, and does not result into protiteering; and

(g) lo check that funds clrarged from the st dents are not diverted toatly otlrer purpose, except as permissitrle under sub-section (4) ofsection 10.

8. Notwithstanding anyhing co tained in this Act, the Regulatory Body may,

if on infornration is satisfied that an Un-aided Educational lnstitution has

contravened or is contravenirrg any ofthe provisions ofthis Act, it may call forthe relevant record ofsuch Unaided Educational lnstitution in order to verifithe inlormatiorr.

9. (l) Every Unaided Educational lnstitution shall constitute a Fund, tobe called the Unaided Educational Institution Developrnent Fund.

(2) Tlre Fund or any prollt accrued therelionr slrall not bc used fbr any

personal gains of business or eDterprisc bythe tJn-aided IJducatioDal l|lstitution.

(l) The l:rrud can be used by the Un-aided lldLtcatiottal h)stitution lor the

activities, which are beueficial ttl the siudellts.

(4) No arlount rvhatsoevel shall be diverled lionr the liLrnd by the Unaided

llducat i(nral Inslinrtion to the Socicty or the'fnlsl orany olher institulion, except

rrnder the nranagenrent oflhe same Society or -ftust-

| | . ( I ) Any student studying irr arr Unaided Educatiorral Institution or his

parents or guardians, as the case ruay be, rnay ntake contplaint to the Regulalory

Botly rvith regard to any excessive f'ee or charge being charged or lordoing or

askingtodo any olher activ ities rvith a motive lo gain finalrcialbenefit orprofitby the said irsl illrlion.

(2) The conrplaint ret'erred to in sub-section ( | ), shall be accompatried

by a self attested allldavil disclosing particulam ol'the concerned Un-aided

Educational Institution tlongwith tlre nanre and address ofthe complainant.

(l) Any cor plaint reccived underthisAct, shall be scrutinized by the

Regulatory llody rvithin a period ofIitieen days fionr llte date of its receipt in

accordance rvith the prescribed procedure, and it shall be {inally decided within

sixty days.

(4) lfaliel scrutinizing a contplaint under sttb-section (3 ), the Regulatory

Body finds any subs(ance in it, the Regulatory Body shall give an opportttnify

ofbeing heard to the concerned Un-aided Educational lnstilution before taking

any final decision on sLrclr complaint.

12. The ltegulatory Body shall, for the purpose <lfany enquiry under this

Act, have the same powers as are vested in a civil cotltl wllile trying a suit

under the Code ol'Civil Procedure, 1908 in lespect oflhe following mafters,

nanrely;

(a) enforcing the atteudance ofany person or examinitrg him on oath;

(b) requiring the discovery atid produclion ol'documents;

(c) receiving evidence on oath by rvay ofal'fidavits; and

(d) issuing conlnission lbl the exanrination ofwitnesses.

13. (l) The Regulatory Body shall nteet at such time and place as the

Chairpersorr rnay decide.

(2) 1'he Regulatory Body shall lbllow sLrch procedtrle ofworking, as

nray be prescribed

(3) All orders and decisions of the Regrrlatory lJody shall be

autherticated by the Mernber- Secretary or any other otlicer, authorized by

hirn.

14. (t) ll'any Un-aided Educational lnstitution corltravenes the provisions

ofthis Act or the nrles nrade thereunder, it shall be ptrnishable with fine, which

may extend to thirty thousand rupees in the case ofan tJn-aided Educational

Institution of Primary Level, rupees fifly thousand in the case ofan Un-aided

Educational Institution of Middle Level, and rupees otre lac in the case ol'an

Un-aided Educational lnstitution of Secondary and Senior Secondary Level

lbr eaclr contravention.

(2) lfan Un-aided Educatiotral lnstitution contravenes the provisions

of thisAct or the rules Drade thereunder fbrthe second time, it shall be punishable

witlr tine, rvhich shall be sixty thousand rupees in tlre case of an Un-aided

EdLrcational lnstitution of Primary Level, rupees one lac in tlre case ofan Un-

aided Educational lnstitution ofM iddle level, and rupees two lac in the case ofan Un-aided Educational Institution of Secondary and Senior Secondary Level

for each contravention.

(3) ll'an Un-aided Educational Instilution contravenes the provisions

ofthisActorthe rules made thereunder for the third tinre, then besides imposing

penalty as mentioned in sub-section (2), the Regrrlatory Body shall direct the

concerned authority to withdmw recognition or affiliation of strch Un-aided

Educational lnstitution.

(4) The Regulatory Body may direct the Un-Aided Educational
