NEW DELHI, May 7:
Former Chief Ministers ofUttar Pradesh cannot retainGovernment accommodation afterdemitting office, the SupremeCourt held today, saying a ChiefMinister was at par with a commonman once his or her term ends.
Observing that a ChiefMinister cannot continue to occu-py public property like govern-ment bungalows which belong topeople of the country, a benchheaded by Justice Ranjan Gogoistruck down an amendment in astate legislation allowing them toretain government accommoda-tion even after demitting office.
The bench said the provi-sion, which was struck down,has the effect of creating a sepa-rate class of citizens for confer-ment of benefits by way of dis-tribution of public property onthe basis of the previous publicoffice held by them.
"Natural resources, publiclands and the public goods likegovernment bungalows/ officialresidence are public property thatbelongs to the people of the coun-try. The ‘Doctrine of Equality'
which emerges from the conceptsof justice, fairness must guide theState in the distribution/allocationof the same," the bench, whichalso comprised Justice RBanumathi said.
"The Chief Minister, oncehe/she demits the office, is at parwith the common citizen, thoughby virtue of the office held, he/shemay be entitled to security andother protocols. But allotment ofgovernment bungalow, to beoccupied during his/her lifetime,would not be guided by the con-stitutional principle of equality,"the bench observed.
The top court was hearing apetition filed by an NGO LokPrahari challenging the amend-
ments made by the erstwhileAkhilesh Yadav government tothe 'UP Ministers (Salaries,Allowances and MiscellaneousProvisions) Act, 1981'.
The court, in its 29-pageorder, said once such personsdemit public office held by them,there is nothing to distinguishthem from the common man.
The Apex Court also said itwas a legislative exercise basedon irrelevant and legally unac-ceptable considerations, unsup-ported by any constitutionalsanctity.(PTI)
SC strikes down law allowing ex-UPCMs to retain Govt bungalows

The India MeteorologicalDepartment (IMD) today issuedan alert forecasting that severalparts of north India could wit-ness thunderstorm and squalltomorrow with winds gusting upto 50-70 kilometers per hour.
The IMD issued an amber-coloured alert, indicating severeweather, for parts of Jammu andKashmir, Uttarkhand, HimachalPradesh, Haryana, Delhi,Chandigarh, western UttarPradesh, Sikkim and WestBengal.
Several parts of these statescould witness thunderstorm andsquall with winds gusting up to50-70 kilometers per hour, thealert said.
There are four types ofcolour codes signifying the levelof caution -- green (whichmeans no action), yellow (situa-tion to be watched), amber(Government agencies to be pre-pared for severe weather) andred (action needed by the agen-cies).
A western disturbance runsover Jammu and Kashmir andHimachal Pradesh, while thereis a cyclonic circulation overnortheast Rajasthan, westMadhya Pradesh and Haryana,and this will bring light to mod-erate rainfall in north India,Mritunjay Mohapatra,Additional Director General,IMD, said.
He, however, said, "Theintensity is expected to be less in
comparison to the thunderstormthat occurred on May 2."
A deadly thunderstorm withwinds gusting up to 100 kmphhad hit Rajasthan and west UttarPradesh on May 2, killing over100 people.
"Thunderstorm accompaniedwith gusty winds very likely atisolated places over Punjab,Assam , Meghalaya , Nagaland,Manipur, Mizoram, Tripura,west Madhya Pradesh, eastUttar Pradesh, east Rajasthan,coastal and south interiorKarnataka and Kerela," the IMDsaid in its alert today.
A yellow coloured alert hasbeen issued for these states.
"Thunderstorm accompaniedwith squall (wind speed reach-ing 50-70 kmph) are very likely
at isolated places over Jammuand Kashmir, Haryana,Himachal Pradesh, Chandigarhand Delhi, west Uttar Pradeshand sub-Himalayan West Bengal
and Sikkim," it said.Heat wave conditions were
also likely at one or two pocketsover Vidarbha in Maharashtra,the alert said. (PTI)
