Collective Bargaining Agreement: Textile Industry

ITisherebynotifiedthattheMinisterofPublicService,LabourandSocialWelfarehas,intermsofsection80(1)oftheLabourAct[Chapter 28:01],approvedthepublicationoftheCollectiveBargainingAgreement set out in the schedule which is registered in terms of section 79 of the Act.

Further Agreement This further agreement made and entered into in accordance with theprovisionsoftheLabourAct[Chapter 28.01],asamended,betweentheZimbabweTextileManufacturersAssociation(hereafterreferredtoas“theemployer”ortheemployersorganisation”),oftheonepart,andtheZimbabweTextileWorkersUnion(hereafterreferredtoas“theemployee”or“thetradeunion”),oftheotherpart,beingpartiestotheNationalEmploymentCouncilfortheTextileManufacturingIndustry,shallbereadasonewiththeagreementpublishedinStatutoryInstrument147of2018,asamendedbyStatutoryInstrument111of2019andStatutoryInstrument233of2019(hereafterreferredtoas“theprincipalagreement”). 1.Clause7sub-clause(3)isamendedbythedeletionofthewholesub-clause7(3)andsubstitutedbythefollowing— “(3)Onorbeforethe1stdayofeachmonth,everyemployershalltransferordeposittotheCouncil’sBankAccounttheNECLevyandEmployerContributionspayableinaccordancewiththeprovisionsofsub-clauses7(1)and(2)andshallforwardtheremittancestotheCouncilSecretaryinrespectofthepreviousmonth’scontributionsanddeductionscompletedonaprescribedformoftheFirstSchedule.”.

2.Clause9oftheprincipalagreementisamendedbythedeletionofthewholeofsubclause(3)andthesubstitutionof—

“(3)Acostoflivingadjustmentof30%wasawardedonthebasicminimumwageseffectivefromthe1stofJuly,2019across

theboardandafurthercostoflivingadjustmentof30%onthebasic rateswasalsoawardedeffective from the9thofAugust,2019,acrosstheboardaswell.

AhardshipallowanceofRTGS$150.00anda20%costof living allowance was awarded across the board as standalone fromthebasicminimumwageseffectivefromthe18thofOctober,2019.

The minimum wage/salary was further reviewed to RTGS$767,23permontheffectivefrom1stofJanuary,2020,andafurtherincreaseof186.7458%waseffectedfrom19thMarch,2020whichwasfurtheradjustedbyanincreaseof15.8973%effectivefromthe1stofApril,2020,toalignwiththenationalminimumwage.

Acostoflivingallowanceof80%ofthebasicminimumperlevelwasawardedacrosstheboardeffectivefrom1stofJuly,2020,andshallbereviewedbasedonthechangedcircumstances.

The minimum wage/salary agreement is inclusive of HousingandTransportandisapplicableasfollows—

Skilled worker category

Skilledworkersasdefinedinthisagreementshallbegradedaspertheprevailingparentindustryagreement.

Learners

Onpromotionwithinthecompany Notlessthanthewageearnedpriortothepromotion.

Onfirstemploymentfromoutside Notlessthanthewageapplicableto the level immediately below the Classification of the jobbeing learned.

In addition to the foregoing rates of pay,Alternating-shiftworkersshallbepaidapremiumofnotlessthan4xsabove thecurrentminimumspecifiedfortheiroccupation.Itshouldbenoted thatallemployeescurrentlyreceivingwage/salaryabovethe minimum for their level should maintain their actual dollar difference.

Notwithstandingtheaboverequirements,employersmayapply the new increase on the actualweekly ormonthly basicearningsoftheindividualemployee,andtheprovisionsofClause3oftheprincipalagreementshall,mutatis mutandis,applythroughoutthelifeofthisagreement.”.

Declaration

The employers and the employees, having arrived at theagreementsetforthherein,theundersignedherebydeclarethattheforgoingistheagreementarrivedat,andaffixtheirsignatureshereto.
