Terminology is an instrument to achieve uninterrupted

communication. Without the appropriate terminology it is not possible

to establish professional communication, understand policies and

legal regulations, nor it is possible to achieve transfer of knowledge.

Participants in the process of translation and establishment of

uniformed terminology within the process of the EU integration and

adoption of the acquis communautaire (translators, experts, legal and

language editors), as well as the competent ministries and government

bodies in Macedonia which are directly involved in the process, are

faced with the challenge to achieve and provide standard level of

quality and unification of the terms used in the European Union. This

is particularly important for the process of harmonization of the

Macedonian with the EU law through the procedure of development

and adoption of the national draft-laws.

The main problem in the approach towards the EU terms are 'cultural

differences' between the countries, and not the form of state

government, level of their development, system of norms and values

they have accepted, geographic location, traits and specificities of

their legal and political systems, economic development, stakeholders

lobbying, social and economic mentality, etc.

Namely, in accordance with the cultural differences, Community acts

are many times understood, interpreted and translated in the national

language differently.

Therefore, in order to avoid these inconsistencies in Macedonia, as

authors of this publication, we used the official version of the EU

terminology in English language as a base, and we added additional

references of key importance for understanding the EU law. The

appropriate official term in German language is added next to each

term, as well as references to the total of 462 cases of court practices

of the European court of Justice, European Communities Court of

First Instance and European Court for Human Rights.

The Glossary provides terminological analysis of the terms officially

used in the EU institutions and bodies, and it is a significant tool for

the interpretation and further clarification of these terms in

Macedonian language.

The Glossary of the EU terminology is primarily intended for the

translators of the European Community Law (acquis communautaire)

from English and German into Macedonian language. Also, we

believe that the broader public in Macedonia, citizens, NGOs,

government institutions and bodies which use the EU terminology in

their everyday working shall find this Glossary very useful. Taking

into consideration the extensive corpus of legal terms found in the

primary and secondary EU legislation, we concluded that the process

of translation of most commonly used legal terms univocally and

unambiguously is essential to the process of passing laws in our

country. Univocation can be achieved solely through a consistent and

unique use of legal and technical terms contained in the Community

acts. In these terms, the final goal of the so designed Glossary is

approximation of the national law to the acquis communautaire.

This Glossary elaborates (reviews) 427 terms related to the process of

EU integration, EU legal system, institutions and activities, as well as

their policies. The Glossary includes the novelties introduced with the

Treaty of Nice and supplementary protocols, as well as the recently

signed Treaty of Lisbon. With the definitions given for the most

important legal terms, the Glossary makes reference to the

appropriate provisions of the treaties and terms with similar meaning

to terms being explained. At the same time, the Glossary reviews the

historical development of the EU, establishment of EU institutions and

their competencies, Community procedures and policies, etc. There is

also a list of 134 most commonly used abbreviations, overview of the

competences of the EU institutions, and access to the official web sites

of 17 EU agencies at the end of the Glossary.

GTZ hopes that, through the project for Economic Legal Reform and

their financial contribution to the development, translation and

publishing of this Glossary, it shall contribute greatly to better

understanding of the criteria for EU membership of Macedonia. The

Glossary should also be used in the direction of deepening knowledge

and raising awareness of the students, experts, civil servants,

practitioners, and other stakeholders in the process of EU integration

of Macedonia, as well as the need for the harmonization of the

national law to the acquis communautaire and the relevant common

policies.

Die Fachterminologie stellt ein Instrument zur Erreichung einer

vereinfachten und reibungslosen Kommunikation dar. Ohne die

entsprechende Terminologie ist weder eine professionelle

Kommunikation noch ein Politik- oder Rechtsverstndnis oder ein

Wissenstransfer mglich.

Alle Akteure, sowohl die am bersetzungsprozess beteiligten als auch

diejenigen, die im Bezug auf die EU-Integration mit der Schaffung

einer einheitlichen Terminologie und diejenigen, die mit der

bertragung des EU-Rechts betraut sind (bersetzer, Experten,

juristische und sprachliche Lektoren) als auch die zustndigen

Ministerien, Regierungsorgane und -gremien Mazedoniens, die

unmittelbar im Integrationsprozess eingebunden sind, stehen

einerseits vor der Herausforderung, eine Begriffsstandardisierung

und Qualittssicherung gewhrleisten zu mssen, andererseits, die

Vereinheitlichung der in der EU verwendeten Fachtermini

sicherzustellen. Dies ist insbesondere im Rahmen der Anpassung des

mazedonischen an das EU-Recht von Bedeutung, was mithilfe des

Verfahrens fr die Vorbereitung und Umsetzung der nationalen

Gesetzesentwrfe geschieht.

Die Hauptschwierigkeit im Umgang mit den EU-Termini ist primr

auf die kulturellen Unterschiede der Lnder zurckzufhren und

nicht etwa in der Regierungsform eines Staates, seiner

Entwicklungsstufe, des bernommenen Werte- und Normensystems,

der geografischen Lage, der Eigenschaften und Besonderheiten des

gesetzlichen und politischen Systems, der Wirtschaftsentwicklung, des

Einflusses der Interessengruppen, der sozialen und wirtschaftlichen

Einstellung usw. zu suchen.

Beispielsweise werden die Gemeinschaftsakten aufgrund der

kulturellen Unterschiede der Lnder des fteren in einer

unterschiedlichen Art und Weise verstanden und demzufolge auch

unterschiedlich in die nationalen Sprachen bertragen und ausgelegt.

Um eben solche Unstimmigkeiten in Mazedonien zu vermeiden, haben

wir als Autoren, die offizielle englische Fassung der Terminologie der

Europischen Union als Grundlage unserer Publikation genommen,

aber ebenso zustzliche Referenzen, die fr das Verstndnis des

europischen Rechts unabdingbar sind, bei unserer Auswahl

bercksichtigt. Fr jeden Fachterminus wird auch die entsprechende

offizielle deutsche Bezeichnung genannt. Darber hinaus wird auf die

insgesamt 462 Flle der gerichtlichen Praktiken des Europischen

Gerichtshofes, des Gerichtes erster Instanz der Europischen

Gemeinschaften und des Europischen Gerichtshofes fr

Menschenrechte Bezug genommen.

Das Glossar bietet eine terminologische Analyse der Begrifflichkeiten,

die in den offiziellen Gebrauch der Institutionen und Gremien der EU

aufgenommen sind und stellt gleichzeitig ein wesentliches

Hilfsinstrument fr die Auslegung und Erklrung dieser Begriffe auf

Mazedonisch dar.

Das Glossar der Terminologie der Europischen Union ist in erster

Linie fr die bersetzer des Rechts der Europischen Gemeinschaft

(acquis communautaire) vom Englischen und Deutschen ins

Mazedonische konzipiert.

Wir sind jedoch der festen berzeugung, dass das Glossar auch im

greren Rahmen und von einem Groteil der ffentlichkeit in

Mazedonien: der Brger, der Nichtregierungsorganisationen, der

Regierungsinstitutionen und gremien, die die europische

Terminologie in ihrer alltglichen Arbeit verwenden, genutzt werden

kann. In Anbetracht dessen, dass es sich hierbei um einen gewaltigen

Korpus juristischer Begriffe handelt, die in der primren und

sekundren Gesetzgebung der Europischen Union vorzufinden sind,

sind wir davon berzeugt, dass der bersetzungsprozess der

meistverwendeten juristischen Begriffe zweifelsohne von enormer

Bedeutung fr die Gesetzgebungsverfahren in unserem Land ist. Eine

Eindeutigkeit in der Auslegung ist schlielich nur durch eine

konsequente und einheitliche Anwendung der juristischen und

fachlichen Begriffe zu erreichen, die in den Akten der Gemeinschaft

eingeschlossen sind. Diesbezglich ist das Ziel des vorliegenden

Glossars, die Annherung der nationalen Gesetzgebung an das Recht

der Europischen Union.

Dieses Glossar enthlt eine Ausarbeitung (einen berblick) von

insgesamt 427 Begriffen, die mit dem Prozess der europischen

Integration, dem Rechtssystem der Union, den Aktivitten, den

Institutionen und deren Politik verbunden sind. Es unfasst auch die

mit dem Vertrag von Nizza eingefhrten nderungen und die

Zusatzprotokolle, sowie die mit dem krzlich unterzeichneten Vertrag

von Lissabon eingefhrten Erneuerungen. Neben der Przisierung

der wichtigsten juristischen Begriffe, weist das Glossar auch auf

entsprechende Vertragsbestimmungen hin, sowie auf Begriffe, die

hnlichkeiten mit den erklrten Begriffen aufweisen. Das Glossar gibt

zudem einen berblick der Geschichte der EU, der Schaffung der EU-

Institutionen und ihren Aufgaben, der Gemeinschaftsverfahren, EU-

Politiken usw. Am Ende des Glassars findet der Leser eine Liste mit

den 134 meistverwendeten Abkrzungen der Europischen Union

sowie eine bersicht ber die Zustndigkeiten der EU-Institutionen.

Darber hinaus wird ein berblick der offiziellen Webseiten von 17

Agenturen der EU gegeben.

Die deutsche Gesellschaft fr technische Zusammenarbeit hofft, dass

sie durch die finanzielle Untersttzung des Projektes der Wirtschafts-

und Rechtsreform einerseits, als auch durch ihre Untersttzung fr die

Vorbereitung, bersetzung und Verffentlichung dieses Glossars

andererseits, einen wesentlichen Beitrag fr ein besseres Verstndnis

der Kriterien fr die EU-Mitgliedschaft Mazedoniens geleistet hat.

Das vorliegende Glossar soll darber hinaus der Wissensvertiefung

dienen und ein verstrktes Bewusstsein fr Studenten, Experten,
