Right and Responsibilities
By Steafan Twomey(Cracked fb screen, 2013)
Do you have a Facebook page?
• If you do, then you agreed to their terms of use(Thumbs up question mark, 2013)
Terms of Use
• control how you may access a website and how content may be used
• On Facebook is called the statement of Rights and Responsibilities
• Facebook has two supplementary documents called the Data Use Policy, and the Facebook Community Standards
Facebook terms and policies, 2013
It looks like this…
(statement of rights and responsibilities, 2011)
Never seen it before?
• Most people never read these terms but they ultimately control how Facebook operates
By using or accessing Facebook you agree to their terms
(Statement of Rights and Responsibilities, 2012) (confusion sign, n.d.)
Luckily
• All content you post is owned by you and can be controlled through the privacy settings
(Privacy settings, 2013) (Statement of Rights and Responsibilities, 2012)
Fortunately Unfortunately
• Most users are not concerned/unaware of privacy settings in Facebook
• Facebook limits global searches
• Has accessible and easy to use privacy settings
(Goettke & Christiana, 2007)
(Facebook thumbs, n.d.)
However…• Intellectual property
unless specifically altered by privacy settings is under license to Facebook for use, transfer or sublicense world wide without royalties paid to the owner or having to let you know
(Privacy should be easy, 2012) (Statement of Rights and Responsibilities, 2012)
• The intellectual property (IP) license exists until the IP or account is deleted, unless the content had been shared with others
• Which it probably has
(Statement of Rights and Responsibilities, 2012) (Share, n.d.)
This includes
• Photos
• Videos
• Anything you post onto Facebook
(Old Camera, n.d.)
But…
• Some content will always be publically available regardless of privacy settings
• These include:• Name• Profile pictures• Cover photos• Networks • Gender• Username
(Data Use Policy, 2012) (Facebook Profile Picture, 2013)
• Facebook can use information provided by you for their own purposes without having to let you know
• Or pay you
• Or credit you in any way
(Statement of Rights and Responsibilities, 2012) (Facebook Profile Picture, 2013)
• This means you should think twice before publishing anything private or confidential onto Facebook
• Just because it is owned by you does not mean it is exclusive to you
• User awareness is key to avoiding privacy concerns
(Goettke & Christiana, 2007)
Facebook uses and stores information to:
• Provide better service
• Protect Facebook’s and user’s rights and property
• But most alarmingly, For internal operations including troubleshooting, data analysis, testing, research and service improvement
(Data Use policy, 2012) (Mad scientist, 2013)
Which means
• Facebook uses your information for better services and promises that all information used in internal operation is anonymous
• But, this can still leave a trail and be used to gain personal information about a person by following the data trail
(Barbaro & Zeller, 2006) (Data Use Policy, 2012)
EVERYTHING YOU POST ON FACEBOOK IS MONITORED
(donecamera, n.d.)
Remember!
• ‘Many people besides friends and acquaintances are interested in the information people post on social networks. Identity thieves, scam artists, debt collectors, stalkers, and corporations looking for a market advantage are using social networks to gather information about consumers.’
(Privacy Rights Clearinghouse, 2008).
What can’t I post?
• All content posted to Facebook must not violate another persons rights or the law
(Rights ad Responsibilities 2012) (breakinglaw, 2013)
This includes
• Intellectual property• Violence and threats• Self harm (incitement and promotion)• Bullying and harassment• Hate speech• Graphic content • Pornography and nudity• Identity and privacy
(Facebook Community Standards, 2013)
What if I do?
• Depending on the nature and frequency of the post– Your post will be deleted
– You will be blocked from part or all of Facebook
– Your account may be deleted
– The information in the post will be given to police to aid their investigation
(Rights and Responsibilities, 2012)
Conclusion
• Facebook is a relatively secure social networking site, with controls in place to protect privacy and appropriate content
• Users should be aware of what they post in terms of privacy and the intent and purpose of Facebook
