As educators we need to engage our students through multimedia technology.

Where do we begin? By knowing the copyright law and code of fair use!

The purpose of copyright is to promote the advancement of knowledge through balancing the rights of owners and users.

Unfortunately, many educators fear using copyrighted material because they are afraid to get into trouble for copyright infringement.

The Code of Best Practices in Fair Use for Media Literacy Education helps educators interpret the copyright doctrine.

Fair use is the right to use copyrighted material without permission or payment under some circumstances—especially when the cultural or social benefits of the use are predominant.

Created by 150 members of leading educational associations across the United States and was coordinated by scholars Renee Hobbs, Peter Jaszi, and Patricia Aufderheide.

It was reviewed by a committee of legal scholars and lawyers that are experts in copyright use.

Media literacy is the capacity to access, analyze, evaluate, and communicate messages in a wide variety of forms.

It applies everywhere including reading a newspaper, watching television, or posting a commentary on a blog.

It helps people of all ages be critical thinkers, effective communicators, and active citizens.

Media literacy can be taught and learned.

Media literacy can be taught as a course but is usually embedded within other subject areas.

Does NOT tell you limits of fair use rights

It is NOT a guide to material that is already free to use without considering copyright such as government publications.

It is NOT a guide for “orphan works” (works that do not trace back to an owner)

Uses of copyrighted material are reasonable and appropriate for the purposes of teaching and learning.

Keeps copyright from violating the First Amendment.

One does not need to be a member of a professional group to benefit from their copyright code interpretations.

The issue of fairness depends in part on whether the user took more than was needed to accomplish his or her legitimate purpose, also known as the “rule of proportionality.”

The “Four Factors” judges consider in analyzing the copyright law: the nature of the use, the nature of the work used, the extent of the use, and its economic effect.

Non-profit organization that provides licences that work alongside copyright

They help creators have freedom to choose anywhere from “all rights reserved”, “some rights reserved”, or “no rights reserved.”

This license allows users to do practically anything with your work (tweak or remix), even commercially, as long as they give you credit for the original creation.
