INSTRUCTIONS FOR THE BIDDERS & SUBMISSION OF TENDER

A - INSRUCTIONS FOR THE BIDDERS

1. The tenderer shall bear all costs associated with the preparation and

submission e-Tender. Kanpur Development Authority will in no case be

responsible or liable for these costs, regardless of the conduct or

outcome of the e-Tender.

2. The tender document is available on the website

https://etender.up.nic.in to enable the tenderers to view, download the

e-Tender document and submit e-Tender online upto the last date and

Time mentioned in e-Tender notice. The tenderers shall have to pay

cost of tender document and Earnest Money Deposit (E.M.D.) as per

e-tender Invitation Notice through NEFT/RTGS only payable in favour

of F.C. Kanpur Development Authority in A/C No 100037449266 IFSC

Code : INDB0000041 INDUSIND BANK Swaroop Nagar, Kanpur.

The Scanned copy of NEFT/RTGS receipt with UTR No Certified by

the same Bank must be enclosed along with the Technical Bid. The cost

of tender document will be non-refundable, without cost of tender

document, tender will not be accepted.

3. The tenderer is expected to examine all instructions, forms, terms,

specifications in the tender document. Failure to furnish all

informations required as per the tender document or submission of

e-tender not responsive in every respect will be at the tenderer‟s risk

and may result in rejection of the said e-Teneder.

4. At any time prior to the deadline for submission of e-tender, the

department may, for any reason, whether at its own initiative or in

response to a clarification requested by a prospective tenderer, modify

the tender document by amendments. Such amendments shall be

uploaded on the e-procurement website https://etender.up.nic.in through

corrigendum and shall form an integral part of tender document. The

relevant clauses of the tender document shall be treated as amended

accordingly.

5. It shall be the sole responsibility of the prospective tenderers to check

the website https://etender.up.nic.in from time to time for any

amendment in the tender document. In case of failure to get the

amendments, if any, the department shall not be responsible for it.

6. In order to allow prospective e-tender a reasonable time to take the

amendment into account in preparing their e-tender, the department, at

his discretion, may extend the deadline for the submission of e-tender.

Such extensions shall be uploaded on the e-procurement website

https://etender.up.nic.in.

7. The bidder may furnish any additional information which he thinks is

necessary to establish his capabilities to complete the envisaged work

successfully. Bidder is however, advised not to furnish superfluous

information. No information shall be entertained after submission of

pre-qualification document unless it is called for by the Employer.

8. Any information furnished by the bidder found to be incorrect either

immediately or at a later date, would render him liable to be debarred

from tendering/taking up of work in Kanpur Development Authority. If

such applicant happens to be enlisted contractor of any class in Kanpur

Development Authority his firm shall be black listed from approved

list of contractor.

9. Conditional tender will not be considered.

10. In case of proprietorship firm, an affidavit for declaration by proprietor

should be submitted and all tender documents should be signed by the

proprietor.

11. In case of partnership firm, attested copy of partnership deed should be

submitted and all tender documents should be signed by any partner

authorized by deed.

12. In case of company or Corporation, attested copy of Incorporation

certificate with memorandum and articles of association should be

submitted and all tender documents should be signed by any director or

employee authorized by board resolution. Certified copy of such board

resolution under common seal of company should be submitted.

13. In case of any other person (Other than mentioned in 10 to 12 above as

applicable) authorized to sign the tender document, an authority letter

along with documents mentioned in 10 to 12 above, as applicable,

certifying his signature or power of attorney should be submitted.

14. Authority letter in original or attested by notary not more than Six

months old, of the firm/tenderer in favour of the person, who has to

sign the tender documents with telephone No. and complete postal

address.

B - SUBMISSION OF TENDER

The Proposal shall be submitted in Two Parts in 2 (two) separate

cover. The two parts shall be:

Part 1: Technical Bid.

Part 2: Financial Bid.

The Technical Bid shall be placed in cover “Part-1 Technical

Bid” followed by the name of the work and name/address of the

applicant firm. Similarly, the Financial Bid shall be placed in a

separate cover-2 clearly marked “Part-2: Financial Bid” followed by

the name of the work and name/address of the applicant firm.

The cover containing “Part 1: Technical Bid” shall contain :

(i) The tenderers shall have to pay the cost of Tender Document and

Earnest Money Deposit (EMD) as per N.I.T. Through NEFT/RTGS

(ii) Duly filled up Technical bid document appended with the tender.

(iii) List of works satisfactory completed during the last four financial years

and running projects. (Appendix-A)

(iv) Proof of liquid assets duly certified by banker as per pre-qualification

requirement. (Appendix-B)

(v) ITR and Audited Balance Sheet with audit report duly counter signed

by C.A. for last four financial years clearly indicating turnover, TDS,

Tangible Net worth. Form 26 AS issued by Income Tax Department

will be submitted for Turnover verification.

(vi) List of technical staff with their qualification professional experience

and length of the service with the firm . At least Two graduate

Engineers and Three Diploma Holder Engineers supported by necessary

technical supervisory staff shall be engaged at site. (Appendix-C)

(vii) Detail of machinery, Tools & Plants, centering and shuttering all in

good working condition available with the tenderer. (Appendix-D)

(viii) Original copy/Attested copy of partnership deed or sole

proprietorship declaration or company‟s registration certificate / Board

Resolution/ Memorandum & Articles of association.

(ix) Authority letter, of the firm/tenderer in favour of the person who has

signed the tender document with telephone no. and complete postal

address.

(x) Certificate of registration for G.S.T. & Other Applicable taxes

/charges .

(xi) EPF and ESIC registration certificates.

(xii) A copy of registration with CPWD/STATE PWD/PSU/Central and

State Government under taking in appropriate class, if any.

(xiii) Joint Ventures are allowed only in case the firm fulfilling the

credentials must have no less than 50% stake/partnership in the JV

(xiv) The Joint Venture must be carrying a GSTIN for more than a year at

the time of the tender.

Cover -2 (Financial Bid)

(a) Price bid duly filled in all respects in the original tender document

online.

(b) The Tenderers must read carefully every page of the scope of works,

specifications, General Conditions and Special Conditions, Technical

and Financial Bid and quote their rates in annexed B.O.Q. . Rates

should include all taxes, Levey, Royalty, Toll Tax etc (Excluding

GST) . G.S.T is payable extra as applicable time to time.

(c) The Under taking regarding Proposal shall not be withdrawan within

90 days from the date of opening of the tender. (Annexure-I)

C . ELIGIBILITY:

“A” class contractors registered in KDA as well as contractors not

registered in KDA can participate in tenders. But once the tender

is sanctioned, the tenderer, not registered in K.D.A, shall have to

registered in KDA as per rule.

1. The tenderers shall have to pay the cost of Tender Document and

Earnest Money Deposit (EMD) as per N.I.T. Through NEFT/RTGS

2. Tenderer should be a reputed construction agency having minimum

Four Financial years experience in the field of construction of Housing

Projects in Govt./Semi Govt./Public Undertakings .

3. The Tenderers must have completed :

One project of similar nature, costing not less than 80% of estimated

amount in last Four Financial years and in current year.

Or

Two projects of similar nature, each costing not less than 60% of

estimated amount in last Four Financial and in current year.

Or

Three projects of similar nature, each costing not less than 40% of

estimated amount in last Four Financial and in current year.

4. Similar nature of works shall means Development works of

residential/Institutional/commercial scheme.

5. Experience certificate issued by the private firms & private builders

shall not be accounted for.

6. The value of completed works shall be brought to current costing level

by enhancing at a simple rate of 7% per annum.

7. The minimum cumulative financial turnover of any three years out of

last four financial years (F.Y. 14-15, 15-16, 16-17 & 17-18) should not

be less than one and half times of the bid value. The turnover will be

indexed in proportion to the Cost index. Form 26 AS issued by Income

Tax Department will be submitted for Turnover Verification.

8. The contractor should have a minimum tangible Net worth of at least

25% of the bid value. Net worth will mean value of Fixed Assets as per

last audited Balance Sheet (after providing Depreciation) Plus Net

Working Capital (current Assets minus current liabilities).

9. Liquid Assets should not be less than 15% of the Bid value, not older

than six month from the date of uploading of tender (Bank cerfificate

should be in prescribed format as per Appendix „B‟) .

10. All the above parameters have to be supported with the audited balance

sheet certified by Charted Accountant.

11. Bidder and any of its holding company, any of subsidiaries, group

company, Parent company should not have been

debarred/banned/declared ineligible or declared insolvent by any

Institution/Financial Institutions, Banks etc.

12. The Bids not fulfilling the above conditions shall be summarily

rejected and shall not be considered for any further evaluation.

D . GENRAL CONDITIONS OF WORK

All the works shall be carried out as per detailed C.P.W.D.,

U.P.P.W.D., U.P. JAL NIGAM, U.P. POWER CORPORATION LTD.,

M.O.R.T.H. (Road Wing) specifications for road and bridge works as

the case may be, latest codes, latest circulars and instructions issued

time to time as per instructions of Engineer-in-charge and other

inspecting officers.

INSPECTIONS OF THE SITE

The Bidder(s) must inspect and examine the site of work and its

surroundings and satisfy himself/ themselves before submitting his/their

tender. He/they has/have to make sure of the positions of quarries and

availability of required material from quarries mentioned in the

specifications, topography of the site, availability of labour and material and

other amenities before tendering. No claim for additional work or extra

work due to any of the above will be allowed.

ENTRIES IN TENDER

All entries by the Bidders should be in one ink and one hand/on

prescribed bill of quantity only. Erasers and overwriting are not permissible.

All corrections should be neatly written and signed by the Bidders. Rate

should be written in figures as well as in words. In case there is any

variation, lower rate shall be treated as Tender rate.

CONDITIONAL / INCOMPLETE TENDER

Conditional, incomplete, unsigned tenders will not be considered. Only

those bidders who supply necessary proof/documents of possession of the

required equipments in their bids should be considered as responsive for

further evaluation.

ADDRESS OF CONTRACTOR

The contractor shall give his full permanent postal address. The postal

receipt of the letters sent to him on this address shall be considered

sufficient proof that they have been delivered to him.

ACCEPTANCE OF TENDER

Subject to conditions of bid document, the Employer will award the

Contract to the Bidder whose Bid has been determined substantially

responsive to the bidding documents and who has offered the lowest

evaluated Bid price, provided that such Bidder has been determined to be (a)

eligible and (b) qualified in accordance with the provisions of bid document.

AWARD OF CONTRACT

The bidder whose Bid has been accepted will be notified of the award by

the department prior to expiration of the Bid validity period by cable, telex

or facsimile confirmed by registered letter. This letter (hereinafter called the

“Letter of Acceptance”) will state the sum that the Employer will pay to the

Contractor in consideration of the execution, completion by the Contractor

as prescribed by the Contract (hereinafter and in the Contract called the

“Contract Price”).

The notification of award will constitute the formation of the Contract,

subject only to the furnishing of a performance security in accordance with

the provisions of Security money.

SECURITY MONEY

The Tenderer, whose tender is accepted will be required to furnish the

amount by way of security deposit for the due fulfillment of the contract, as

10% of the Tender cost and this 10% amount shall be accepted as per

special conditions of contract.

EXECUTION OF AGREEMENT

Successful bidder shall have to execute an agreement on stamp paper of

value as applicable, through its authorized representative within a week

from date of receipt of acceptance letter / work order. The Agreement will

incorporate all agreements between the Employer and the successful Bidder.

It will be signed by the Employer and the successful Bidder . Required

stamp duty for the contract deed will be borne by the contractor.

ADVANCE PAYMENTS

Mobilization advance :

(1) Mobilization advance limited to 10 % of the contract price at 10 %

simple interest, can be sanctioned to the contractors on specific request as

per term of the contract.

(2) The mobilization advance shall be released only after obtaining a bank

Guarantee bond from a Nationalised bank for the amount of advance to be

released and valid for the contract period. This shall be kept renewed time to

time to cover the balance amount and likely period to complete recovery

together with interest. The advance should be released in not less than two

instalments. the interest on the advance shall be calculated from the date of

payment to the date of recovery, both days inclusive.

(3) It shall be ensured that at any point of time, Bank Guarantee is

available for the amount of outstanding advance.

(4) The recovery should be commenced after 10% of work is completed

and the entire amount together with interest shall be recovered Pro-rata basis

by the time 80% of the work is completed.

RUNNING PAYMENTS

Contractor shall be entitled for payment running bills on monthly basis or

a lesser period, if required, but not less than 10% of value of contract.

COPY OF CONTRACT

On request, the Executive Engineer may furnish the contractor with a

copy of the contract.

EMPLOYMENT OF LABOUR

The contractor shall submit a daily report to the Engineer-in-charge

regarding the total labour employed by him for the work and shall be bound

to pay wages which shall not be less than the wages fixed under Minimum

Wages Act.

LINE AND LEVELS

The contractor shall be solely responsible for setting out the works and

for the correctness of the position, levels, dimensions and alignment

according to the specification and shall provide all necessary assistance,

instruments, pegs, sticks, poles and other materials, required for the purpose.

The tender rates shall be deemed to include all this.

PROGRAMME AND RETURNS TO BE FURNISHED

(i) The contractor shall submit a detailed programme of

execution of work showing activities distinctly along with Bar-Chart as per

PERT Chart, with details of manpower, equipment and machinery required

for the fulfillment of the programme within the stipulated period for

approval of Engineer-in-charge within two weeks from the date of award of

work.

(ii) If at any time, it appears to the Engineer-in-Charge that the actual

progress of work does not conform to the approved programme referred

above, the contractor shall produce a revised programme showing the

modifications to the approved programme by additional inputs to ensure

completion of the work within the stipulated time.

(iii) The submission for approval by the Engineer-in-Charge of such

programme or the furnishing of such particulars shall not relieve the

contractor of any of his duties or responsibilities under the contract. This is

without prejudice to the right of Engineer-in-Charge to take action against

the contractor as per terms and conditions of the agreement.

EXECUTION

The contractor shall have to execute various item of works strictly

according to the order and time schedule approved by the Executive

Engineer. Materials will also be tested as per required frequency of tests.

TECHNICAL STAFF AT SITE OF WORK

The contractor shall have to employ full time technical staff and other

supporting staff for supervision of the work. Name of the technical staff

employed by the contractor shall be intimated in writing to the Engineer-in-

charge. Any change of technical staff during the execution of work should

be intimated immediately in writing to the Engineer-in-charge.

SITE OFFICE

The contractor shall establish and maintain a site office under his

authorized representative/technical staff. All relevant documents shall be

kept in the site office.

SITE ORDER BOOK

A site order book shall be maintained at the site of work in which

instructions shall be given to the contractor as and when necessary. These

instruction/orders, shall have to be signed and complied by the Contractor or

his authorized representative. The entries in 'Site Order Book' shall be

treated as proper notice serving upon the contractor in terms of his contract.

LIGHTING ARRANGEMENT

The contractor shall make his own arrangement for lights during the end

of the day in case the work is likely to be delayed due to unavoidable

circumstances.

TRAFFIC CONTROL

The contractor shall take all measures necessary for the safety of traffic

during execution of work and shall provide, erect and maintain such

barricades, reflective signs and caution boards, making flags, lights, flagmen

as necessary or as directed by the Engineer-in-charge for smooth and safe

flow of traffic during execution or work. The contractor shall ensure to

proper maintenance of work‟s site. In case of any causality taking place at

the work site, the contractor shall be solely responsible for payment of any

compensation etc. to the aggrieved party.

SUSPENSION OF WORK

The contractor on the written order of the Executive Engineer/Assistant

Engineer shall suspend the progress of the works or any part thereof, for

such time and in such manner as may be considered necessary and during

such suspension shall properly protect and secure the work as far as

necessary in the opinion of the Executive Engineer. Nothing extra shall be

paid to the contractor if such a suspension is necessary for proper execution

of the work by reason of weather or by some default or the contractor or

necessary for safety of the work or any part thereof.

SAMPLES

Contractor shall establish laboratory with sufficient arrangement of

testing facilities, appliances and laboratory technicians etc. at site and shall

always compulsorily Co-operate in procurement of samples, conduction of

tests, as may be directed and no extra payment shall be made for them. Test

samples shall be taken carefully in accordance with the I.S.I. method of

sampling, no plea shall be entertained on this account. Job Mix Formula for

Concrete, B.M. and S.D.C. shall be designed from any reputed authority by

the contractor on his cost. In case it is designed by the agency itself it should

be checked by third party/ an independent agency approved by Kanpur

Development Authority.

TESTING OF MATERIALS

All materials and workmanship shall be of the respective kind

described in the contract and in the accordance with Engineer-in-charge

instructions and shall be subjected from time to time to the tests mentioned

under specifications. The contractor shall provide such assistance, labour

and materials as are normally required for examining measuring and testing

of the works and quantity weight or quality of materials used and shall

supply materials, sufficiently in advance for testing as mentioned under

specifications. The materials used subsequently for execution of the work

shall strictly conform to the quality and sample approved. Necessary test for

which facilities are not available locally or at site shall be conducted in the

nearest available government controlled Laboratories/Research Institute,

Kanpur or any other reputed technical institution. Cost of such testing and

forwarding of sample to the laboratory etc. shall be borne by the contractor

and nothing extra shall be paid on this account. Regular quality control test

registers shall be maintained by the contractor.

TAXES

GST shall be paid to the Contractor as applicable. Nothing extra shall

be paid due to fluctuations in the cost of materials, machines, bitumen, POL,

Labour etc.

COMPLIANCE WITH LOCAL BYE LAWS

The contractor shall throughout the continuance of the contract and in

respect of all matters arising out of performance thereof, confirm with all

required regulations and bye-laws of the local or other authorities which

may be applicable to the works.

ROAD TRANSPORT

The contractor employing motor vehicles for transport of material shall

abide by provisions of the Motor Vehicles Act.

SAFETY CODE

The contractor must ensure to arrange rigid Scaffolding or staging, working

platforms, gangways and stairway with Safe means of access shall provide

to all working places including Hoisting Machines with proper attachments

and regular maintenance with all Other Safety Measures.

All necessary personal safety equipment as considered adequate by the

Engineer should be kept available for the use of the person employed on the

side and maintained in a condition suitable for immediate use, and the

contractor should take adequate steps to ensure proper use of equipment by

those concerned.

FIRST AID

At every work place there shall be maintained, in readily accessible place,

first aid appliance including an adequate supply of sterilised dressings and

sterilised cotton wool. The appliance shall be kept in good order and in

large work place they shall be readily available during working hours.

DAMAGES BY RAINS, ACCIDENTS OR NATURAL CALAMITIES

No payment will be made to the contractor for damage caused by rains,

accidents or other natural calamities during the progress of work. No claim

whatsoever shall be entertained on this account.

The contractor shall be responsible for all injury to the work or workmen, to

persons or things and for all damages to the structure.

The contractor shall reinstate all damage of every sort mentioned in this

clause, so as to deliver the whole of the contract works complete and perfect

in every respect and so as to make good or otherwise satisfy all claims for

damages to the property or third parties.

The contractor shall affect the insurance necessary and indemnify the

Employer entirely from all responsibility in this respect. The insurance must

be placed with a company of repute with scope of insurance to include all

damages or loss.

DEFAULT OF CONTACTOR IN COMPLIANCE

Constant defiance of the instructions of Engineer-in-charge on the part of the

contractor or his authorized agent will make the contract liable to be

terminated.

CLEARANCE OF SITE ON COMPLETION

The contractor shall at all times keep the premises free from accumulated

waste materials or rubbish caused by his employees on the works and on

completion of the work, he shall clear away and remove from site all surplus

materials, rubbish and temporary work of any kind and fill up borrow pits

dug by him. He shall leave whole of the site and work clean and in a

workmanlike condition to the entire satisfaction of the Engineer-in-charge.

ARBITRATION

All disputes or differences of any kind whatsoever which shall at any

time arise between the parties shall after written notice by either party to the

contract to the other of them and to the Employer hereinafter mentioned be

referred for adjudication to a sole Arbitrator to be appointed as hereinafter

provided

For the purpose of appointing the sole Arbitrator referred to above, the

Employer will send within thirty days of receipt of the notice, to the

contractor a panel of three names of persons who shall be presently

unconnected with the organization for which the work is executed.

The contractor shall on receipt of the names as aforesaid, select any

one of the persons named to be appointed, as a sole Arbitrator and

communicate his name to the Employer within thirty days of receipt of the

name. The Employer shall thereupon without any delay appoint the said

person as the Sole Arbitrator. If the contractor fails to communicate such

selection as provided above within the period specified, the competent

authority shall make the selection and appoint the selected person as the

Sole Arbitrator.

The award of the Arbitrator shall be final and binding on both the

parties. The fees and other costs , if any, of the Arbitrator shall, if required

to be paid before the award is made and published, be paid half and half by

each of the parties.

DEFECTS AFTER COMPLETION

The contractor shall make good at his own cost and to the satisfaction

of the Employer all defects, shrinkage, settlements or other faults which

may appear within 12 months after completion of the work.

SUB-LETTING

Sub-letting of work shall not be permitted.

ESCALATION

The rate quoted shall be FIRM throughout the tenure of the contract

(including extension of time, if any, granted) and will not be subject to any

fluctuation due to increase in cost of materials, labour, tax, octroi etc.

SPECIAL CONDITIONS OF CONTRACT

GENERAL

1. These special conditions shall be read in conjunctions with the General

Conditions of the contract. Where the provisions of these Special Conditions

are at Variance with the provisions of the General Conditions of the contract

the provisions of these special conditions shall take precedence.

2. The Contractor is expected to be well conversant with the General

Conditions of the contract approved by Govt. of U.P. applicable KDA,

works which shall be part of the agreement.

3. The tenderer are advised to see carefully the site of work before actually

submitting their tender. Any enquiry regarding this tender such as scope of

works. Specifications etc. can be seen in the office of the E.E. /S.E./C.E.

Kanpur Development Authority, Kanpur on any working day between 10:00

A.M. to 5:00 P.M.

TENDERER TO ENSURE AND NOTE

4. The tender should be submitted with the name of the work written on the

prescribed cover as per directions given in instructions to the tenderers.

5. No page for the tender shall be removed and the entire set must be

submitted, as it is, Failure to comply the instructions may result in the

rejection of the tender.

6. No additions and alternations are permitted in the tender documents. If

tenderer does so, the same shall not be considered and such tender is liable

to be rejected.

7. Any tenderer no fulfilling all the conditions is likely to be rejected.

8. No refund of the cost of tender is claimable for tenders not accepted or for

tenders not, submitted.

9. Contractor has to sign the agreement after submission of stamp paper within

07 days from the date of award of the work. In case of delay on the part of

the contractor beyond 7 days, a penalty of Rs.5000/ per day will be imposed

and shall be recoverable from contractor and will be deducted from any dues

of Contractor.

EARNEST MONEY AND SECURITY DEPOSIT

10. The contractor shall have to deposit the required earnest money before the

time of tender as mentioned in N.I.T.

11. If the contractor withdraws his offer/tender, or modified his offer/tender,

before acceptance of the tender, his entire earnest money deposited at the

time of tender, will be forfeited by Authority.

12. The contractor, whose tender is accepted, will be required to furnish the

amount by way of security deposit for the fulfillment of the contract, as 10%

of the tendered cost. Out of above 10% amount, 2% shall be deposit by way

of NEFT/RTGS in favour of FC KDA, Rest 8% amount shall be deducted

from the running bills. This amount can also be pledged with Kanpur

Development Authority in the form of FDR/other applicable Government

Security/Bank Guarantee with the condition that the Bank Guarantee would

the valid till scheduled completion period+ 1 years defect liability period+ 3

months and the Bank Guarantee is issued by Nationalized/ Scheduled Bank

of Kanpur Branch would only be acceptable.

This 10% amount shall be accepted as follows:-

12.1 2% Earnest Money Deposit (EMD) deposited by the way of RTGS can be

retained as part of Security Deposit. Contractor has liberty to replace this

Earnest Money Deposit (EMD) deposited vide RTGS.

12.2 Balance 8% deduction will be made and held by the KDA by way of security

deposit unless he/they have deposited the amount of security at the rate

mentioned above in case or in the form of securities or Fixed Deposit Receipt

of any „Scheduled Bank/Nationalized bank‟ in India if the security is

furnished in the form of Guarantee Bonds the Contractor undertakes to review

and to furnish fresh guarantee to cover the period of time of extension. If any,

failure on his part to do shall be considered as breach of contract and without

prejudice to any other remedy provide in these conditions, the Engineer-in-

charge shall have the right to withheld payments and deduct entire security

amount from any money becoming payable to the contractor under this or any

other contract the KDA. The bank guarantee shall be acceptable only if its

validity is for completion period plus maintenance period+2 months as

stipulated in contract and Bank Guarantee is issued by

Nationalized/Scheduled bank issued for local branch of Kanpur.

The amount of the security money shall be refunded after twelve month of

the date of completion of the work or after payment of the final bill, whichever is

later provided that in case the payment of final bill, is not made within twelve

months of completion of the work 75% of the amount of the security money can be

refunded with the prior approval of the authority next higher to the person

accepting the contract on behalf of KDA.

All compensation or other sum of money payable by the contractor to KDA

under the terms of this contract may be deducted from the sale of sufficient part of

his security deposit, or from the interest arising therefore of from any sums which

may be due to, or may become due to contractor by KDA on any account

whatsoever, and in the event of his security deposit being reduced by reason of any

such deduction of sale as aforesaid the contractor shall within ten days thereafter

make good in cash or Government securities endorsed as aforesaid, any sum or

sums may have been deducted from or raised by sale of his security deposit or any

part thereof.

13. The successful tenderer shall submit Non-Judicial Stamp Paper Purchased

only from treasury (as per stamp act and GO. dated -14-08-2002) of required

value as per direction of E/I. for the execution of Contract Bond.

14. The earnest money deposited by the unsuccessful tenderer shall be returned

only after the acceptance of the tender.

15. After the acceptance of the tender, the earnest money of the successful

tenderer shall be converted into the Security Deposit.

16. The Security deposited shall be refunded to the contractor after expiry of

twelve months from the actual date of completion of work only if no

imperfections become apparent in the work during defect liability period.

REGARDING MATERIALS

17. All the materials for the works shall be arranged by the contractor at his own

cost.

18. All the material collected by the contractor during execution of work or

otherwise shall be properly stacked and arranged as directed by the

Engineer-in-Charge.

19. Contractor shall have to make their own arrangement for water and

electricity at the site of work. The water should fit for drinking in case the

authority supplies the water, the contractor shall have to pay charges at rate

fixed by Authority.

20. K.D.A shall give necessary recommendation letter to the concerned

authority for giving water and power connection to the contractor. However

any delay in getting water, or power connection shall not entitle the

contractor for any compensation or extension in completion period.

21. The stone ballast and grit will be blue textured and free of soft pieces the

gauge of the ballast shall be as per detailed latest specifications of CPWD /

PWD including all correction Slips till date.

22. The contractors is to stack the material at the road sides according to the size

of material with stack number as directed by the E/I and no material shall be

stacked on road embankment. The material shall be allowed to spread for

consolidation only after recording of measurements and taken into road

material account register.

23. A deduction @ 7.5% shall be made from stack measurements of stone metal

to arrive at net quantity for the purpose of payment.

24. Cement and steel shall have to be arranged by the contractor only from the

approved manufacture who hold ISI license only. Cement and steel should

be ISI marked and to the entire satisfaction of the E/I. Test Certificate for

steel and cement will have to submitted by the contractor at the time when

steel and cement will be supplied at site.

25. With each lot of material arranged by the contractor for construction work

he shall produce proper receipt of purchase from the manufacture.

26. The contractor has to arrange the test certificates of each lot from an

approved test laboratory. Engineer-in-charge, KDA shall have the right to

take sample for testing as per U.P.P.W.D./C.P.W.D. / ISI norms or directed

by the Engineer in charge and get it tested, The contractor shall bear all

charges of sampling, carriage and testing etc.

27. The cement shall be stored at site of work as per BIS requirement and shall

be kept under double lock and key system by the contractor at his own cost.

28. The Contractor in a register at site shall keep complete accounting of

material purchased and consumed. All register at site shall have machine

numbered pages.

29. The contractor shall provide at his own cost proper storage facility for the

materials brought by him to prevent any loss, damage or deterioration of the

same.

30. The contractor shall confine his equipment storage of materials operation of

his works and people to the limits as directed by the E/l and shall not

unnecessary spread over the premises with his materials and hutment.

31. The Contractor shall make arrangement for watch and ward of the material

at his own cost,

32. All the materials and workmanship shall be as per specifications described

in the contract and in cases not covered in the contract, these shall be in

accordance with the E/I instructions and shall be subjected from time to time

as the E/I may direct at places of manufacturer at the work site or in the

KDA Laboratory or recognized laboratory of the city. The contractor shall

provide conveyances, labours and materials required for examining

measuring and testing of the work and a quality materials, used contractor

shall supply sample of the materials get them approved before using in the

work. The cost of such conveyance, labours and materials, provided for

testing purpose; testing charges and for examining the work and for proper

completion of the same shall be borne by the contractor and no extra

payment shall be made for the same:

33. Samples makes of materials / equipment (Civil/Mechanical/Electrical) and

item of work shall have to be got approved by the contractor from E/I before

execution.

34. The contractor shall ensure to consume the material within its expiry date.

The material if consumed after the expiry date the affected work will have to

be dismantled or the recovery shall be made by the Authority at the rate of

double the cost of work in which such materials are consumed.

LABOUR REGULATIONS

35. The contractor will have to follows all existing rules and regulations of the

Govt. and labour department regarding the labour employed by him without

entitling him for any extra claim on this account.

36. The contractor shall be responsible for the damages done to any property of

injury to any person whatsoever caused by him or any body in his

employment or caused in consequence of his work. He will indemnify and

keep the Govt. indemnified against claims, demands, proceedings charges,

Cost charges and expenses whatsoever in respect of or in relation to any

such injuries or damage. The contractor shall take a necessary precautions

for the safety of his employees on the work and shall comply with all

applicable provision of safety laws and building codes to prevent accident or

injuries to persons oh the work.

EXECUTION OF WORK

37. All drawings and designs will be supplied to the contractor according to the

necessity of the particular work by the department .

38. For carrying out the work the contractor shall be provided with one set of

working drawing. Additional copies if required will be supplied to him on

payment of additional charges as decided by Engineer-in-Charge.

39. The contractor shall be wholly responsible for setting out the works and for

the corrections of the positions, levels, dimensions and alignment according

to the plan/drawings including all necessary instruments etc. and other

material required for the purpose to the satisfaction of E/I.

40. The work shall be executed as per program drawn and approved by the E/I.

41. If the Engineer-in-charge, KDA shall find that the work progress is slow and

feels that the work will not be completed in the time specified then the

Engineer-in-Charge, Kanpur Development Authority shall order the

contractor to work day and night and / or on holidays and the contractor

shall obey these orders without objection or request for compensation. No

compensation whatsoever shall be paid on this account.

42. In the event of working at night, the contractor shall provide sufficient

lighting; safety arrangements for working staff to the satisfaction of the

Engineer-in-charge KDA. Any order or approval issued under this clause by

the Engineer-in-charge, KDA shall not relieve the contractor from of

diminish his obligation under the contract.

CONTRACTORS SUPERVISORY STAFF

43. Within fifteen days of the execution of the contract bond, the contractor

shall have to notify in writing the names of his two authorized

Representatives. One of them will always be available at the site of work to

receive technical orders; instructions for issue of materials and other

miscellaneous works. The contractor shall be fully responsible for the order

received by his representative or the materials received by his representative.

44. The contractor shall provide sufficient supervision to the work using the

skill and attention. He shall deploy following experienced engineer on the

work throughout its currency of work :-

Works costing between Rs. 50.00 Lacs One Graduate Engineer

Works costing above Rs. 500.00 Lacs Two Graduate Egnineer

Three Diploma Engineer

The Engineers deployed by contractor shall be got approved in writing from

the Engineer-in-charge (whose approval at any time can be withdrawn) for

supervision of the work and to receive directions and instructions of the work from

E/I on behalf of contractor. The supervisory staff of the contractor shall not be

changed without obtaining the approval of E/I. In the event of non presence of

these Engineers, Authority will deduct Rs 20,000.00 Per Month per graduate

Engineer and @ Rs. 12,000.00 Per Month per diploma Engineer which will be non

refundable. The decision of E/I in regards to presence and / or absence of such

engineer from the work shall be final and binding upon the contractor. The

contractor will have to remove and person employed on the work if ordered by the

E/I for any reason.

45. If the contractor does not use at site the T&P as mentioned in the Appendix

D‟ the same shall be arranged by the authority and the necessary deductions

for the rental of machinery and T&P shall be made from contractors bills or

penalty as deemed fit shall be imposed for which no claim shall be

entertained.

WORK TO BE DONE AS PER SPECIFICATIONS

46. The specification to be follows for the execution of the works shall be:

a. The, latest MORT&H/CPWD/PWD specifications for works with

correction slips up to date of receipt of tender :-

b. Relevant ISI standards for work not covered by the above,

c. Material bearing ISI Mark shall be given first preference for use in works

for all articles without ISI marks the quality shall be judged by the

relevant ISI specifications,

47. The Bill of Quantities is to be read in conjunction with the Form of tender,

drawings, conditions of contract, specifications as these documents are

jointly explanatory and descriptive of the works included in contract. In case

of contract amongst description of the items specifications, conditions and

drawings, the following order of precedence shall be followed :-

a. Provision as per direction of items

b. Provision in special conditions of contract.

c. Provision in specifications

d. In absence of above the decision of Engineer-in-charge shall be final

& binding.

48. All works under or in course of execution or executed in pursuance of the

contract shall at all times be open to the inspection and supervision of the E/I

and other authority officials at all times during the usual working hours all

other times. If notice for the inspection of site by the E/I or any other official

is given to the contractor should either himself be present to receive orders

and instructions or contractors agent shall be considered to have the same

force as if they had been given to the contractor himself. The contractor shall

also provide all facilities necessary for inspection of the work by the E/I or

their official for which no payment shall be made to the contractor.

Engineer-in-charge KDA shall have the right to inspect the work and related

documents either through their authorized officers or any agencies appointed

for such purpose as and when the need is felt in order to assess the work

progress, the quality of materials used in the constructions issued in

pursuance of the above inspections.

49. SITE ORDER BOOK shall be maintained at the site of the work in which

instructions shall be given to the contractor or in his absence by his

authorized representative or agent and in such case it will be presumed the

same have been conveyed to him in time.

50. In giving their rates the tenderer should take in to account all fluctuations of

the market. As no claim shall be entertained on this account during the

acceptance of the tender and currency of the contract.

51. The tendered rates shall be for all completed items of the work and shall

include all quarry, royalties, testing, screening, tools and plants, railway

freight; carriage of materials to site, stacking and removal charges of any

rejected materials and municipal taxes, octori etc. and all other taxes in force

from time to time.

52. Tendered rates are inclusive of all taxes and levies payable under the

respective statutes. However pursuant to the constitution (Forty Sixth

Amendment) Act-1982 if any further tax or levy is imposed by state, after

the date of receipt of tenders, and the Contractors there upon necessarily and

properly pay such taxes / levies, the contractor shall be reimbursed the

amount so paid provided such payment, If any, is not in the opinion of CE,

(whose decision shall be final and binding) attributable to delay in executing

of work within the control of the contractor.

a. The contractor shall keep necessary books of accounts and other

documents for the purpose of this condition as may be necessary and

shall allows inspection of the same by a duly authorized

representative or as the Engineer in-charge may require.

b. The contractor shall within a period of 30 days of imposition of any

further tax of levy Pursuant to the constitution (Forty Sixth

Amendment) Act 1982 gives a written notice thereof to the Engineer-

in-charge may require.

c. No escalation on any account shall be paid.

53. Rates quoted shall be considered to be for all height unless specified

otherwise.

55. Any claim, during the period of contract will be submitted in writing within

the currency of the contract bond failing which the claim shall not be

entertained,

56. The contractor shall sign “No claim certificate” on running bills and in case

of any claims or extra item he must mention the item and rate and Qty.

specifically otherwise no claim shall be entertained later on. Payment of

claim shall only be made as within decided by the competent authority in

KDA

57. The contractor shall submit a certificate along with each bill that full labour

payment has been made by the contractor till the end of the preceding

month.

58. The provision of an item in the bill of quantities will not entitle payment for

the same in case if forms part of any other item as per specifications, Special

conditions of contract through the same may have not been specifically in

the description of the item(s).

59. The contractor shall have to sign FARKHATI at the time of final bill.

60. Secured Advance on Materials

The Contractor on signing an indenture in the form to be specified by the

Engineer-in-charge, Kanpur Development Authority by allowed “Secured

Advance” on the security on materials to the extent of 75% of the estimate

value of major materials which in the opinion of the Engineer-in-charge,

Kanpur Development Authority are non perishable and are in accordance

with the contract and which have been brought on the site in connection

therewith and are adequately stored and/or protected against damage by

weather or other causes but which have not at the time of advance been

incorporated in the work, When materials on account of which an advance

has been made under this sub-clause are incorporated in the works, the

amount of such advance shall be deducted from the last payment made under

any of the clauses of the contract. An indenture bond on Rs.100.00 non-

judicial stamp prepared and submitted by the contractor.

ABNORMALLY HIGH / LOW RATES

61. In the case of abnormally low rated items, the minimum quantity stipulated

in the agreement must be executed and no reduction in, quantity shall be

allowed without prior approval of the competent authority.

CO-OPERATION WITH OTHER AGENCIES

62. The contractor shall not put hindrance to any person or to other Contractors

authorized by the department to carry out works of any nature entrusted to

them. The Contractor shall have to allow the other party to work and adjust

his work accordingly and no claim shall be entertained on this account. In

case of any dispute the decision of the E/l shall be final and binding upon all

the parties concerned.

63. The contractor shall do his work in such a way that the work of other

contractor is not hampered.

MISCELLANEOUS

64. The contractor shall treat all materials obtained during dismantling of a

structure, excavation of the site of work etc. as Governments property and

such materials shall be disposed of to the instructions in writing issued by

the Engineer-in-charge.

65. The normal working hours shall be from 8.30 AM. to 5.30 PM, and no work

shall, be carried out on Sunday and on gazetted holidays without specific

permission of the E/I. No claim whatsoever shall be entertained on this

account.

66. The contractor shall at all times keep the premises free from accumulated

waste materials or rubbish caused by his employees on the work and on

completion of the work he shall clear away whole site of such materials and

fill up the borrow pits made by him. He will leave whole of the site and

works clear in a workman manner. Nothing extra shall be paid to the

contractor for this clearing up. The contractor shall maintain and keep the

area in agreed sanitary condition, which is used by men engaged in the work

by him. He shall remove and clear all structures etc. Which may have been

set up by the Contractor for accommodating his labour on the completion of

the work to the satisfaction of the Engineer-in-charge Kanpur Development

Authority.

67. In case of any dispute the decision at SE/CE Kanpur Development Authority

shall be final and binding on the contractor.

68. No Claim for the interest wilI be entertained by the Kanpur Development

Authority in respect of the deposits mentioned in the contract or in respect of

any money or balance which may be in their hands owing to any disputes

69. The contractor shall have to make arrangements at his own cost for

temporary accommodation for the office staff and the labourers residence at

the site of work. Suitable area of land shall be earmarked to contractor to put

the labour camp. Contractor shall however be responsible to hand over the

site to Kanpur Development Authority duly cleared from alI encumbrance

immediately after completion of work failing which completion certificate

of the contract shall not be issued.

ADDITIONAL SPECIAL CONDITIONS FOR EXTERNAL ELECTRICAL

WORKS

1. For Electrical works, approved “A" category certificate of electrical safety

directorate shall be necessary.

2. No extra cost for claim will be admissible for adopt in those special

conditions/instructions mentioned in the following Paras. These conditions

should be thoroughly studied and taken into account by the contractor while

tendering and signing the contract agreement.

3. All works should be carried out as per latest U.P.P.W.D.,/

C.P.P.W.D./U.P.P.C.L./KESCO specifications and relevant BIS standards

laid down for external electrical works.

4. All the items, fixtures to be used on the work shall be as per drawings and

by the E/I. Necessary drawings may be made available U.P.

P.W.D./C.P.P.W.D./U.P.P.C.L./KESCO specifications as mentioned and

sample shall to be got approved by the E/I. Necessary drawings may be

made available E/I.

5. The Contractor must visit the site and office and understand the

specifications of materials of the works.

6. The contractor shall only store such materials at site, which are to be used in

the work. Materials which are not to be used in the work or material of

inferior quality shall not be stored at site without the written permission of

the E/I. KDA is not bound to provide free storage or place to the contractor.

The Contractor shall have to make his own arrangement at his own cost.

7. The contractor shall remove all the defects till the works is handed over to

Utter Pradesh Power Corporation Ltd./ KESCO and he will cooperate and

help him handing over the work.

8. The work shall be opened for inspection by the Technical Audit Cell or any

inspecting authority constituted by the KDA and defects pointed out by

them will have to be removed by the contractor at his own cost within

maintenance period after the finalization of the bond, in case the contractor

fails to rectify those defects, actions for recovery of amount required for

rectification of these defects shall however be taken by the Authority.

9. The contractor may have to produce on demand by the KDA purchase

vouchers, challans etc. from the principal manufacture or authorized dealer

for verification of correct supply of material. The contractor will have to

submit on demand the satisfactory. Test certificate of materials used in the

works which shall be issued from the Principal manufacturer or dealer.

10. The Authority is not responsible for arranging any material whatsoever and

the contractor will have to complete the work within specified time with

specified material. The reason of non-availability of materials or delay in

arrival of the consignment shall not be entertained is an excuse for extension

of time for completion of work.

11. The contractor shall submit drawing of the electrification work execute by

him in detail on the layout plan in four copies before submission of the final

bill.

12. The contractor shall take care that while constructing the lines and Sub-

station, the Indian Electricity Rules with latest amendment are following in

genral an especially in respect of clearances, sag and safety etc. The sagging

shall be strictly as per ISI and to the entire satisfaction of the E/I.

13. Mode of measurement of conductor and earth wire shall be by weight and

will be calculated by measuring the distance from center to center of the pole

and computing the weight of the conductor of that size and length by using

standrard table adding three percent (3%) extra which shall be allowed for

wastage, sag, jointing, binding and Jumpering etc.

14. The portion of the building, road, sewers, water lines etc. damaged during

execution of the work shall be repaired properly to original finish by the contractor

at his own cost the entire satisfaction of the E/I.

15. The successful tenderer / contractor will be fully responsible for any damage /

accident caused by their labour any damage to third party or their property or KDA

property during execution of work.

16. In case of any dispute arising in execution of the agreement the matter will be

referred to the concerning SE/CE of the KDA for decision which will be final

binding on the contractor.

17. The contractor will be responsible to obtain and submit necessary approval of the

works executed by him from the concerned Electrical Inspector to U.P. Govt. and

ask to get the work energized and handed over to the U.P. power Corporation

Ltd./KESCO. Necessary fee or charges as required will be paid by the KDA on

production of original receipt.

18. The contractor shall not without the consent in writing of the concerned Executive

Engineer of KDA sublet his contract than the raw materials.

19. The contractor shall at all provide sufficient notice and caution board, lights and

watchman etc. protect, warn the public and guard the work at his own cost. Any

damage or theft of line / substation material shall be the liability of the contractor

who will replace, rectify all such items at his own cost till the works executed by

him are handed over to U.P.P.C.L./KESCO irrespective of payment has been made

or not.

20. (a) 80% payment of the works executed may be paid to the contractor as running

payment.

(b) 10% payment may however be released to the contractor after proper

completion of the works to the satisfaction of the E/I.

(c) Balance 10% payment may be released to the contractor after one month from

the date of handing over works to U.P. Power Corporation Ltd/ KESCO.

21. The contractor will also maintain first aid box etc. at the site of the work and also

fallow the relevant regulations of the labour laws
