No. INS. 205/78/213-4, the 21st September, 1983. Whereas an order placing Shri C. Ngunchunga, Industries Officer, Saiha under suspension was made by the Lt. Governor (Administrator) of Mizoram on 10th March, 1975 vide letter No. DEV/C/508/75-IND dated 10.3.1975.

And whereas the Disciplinary authority was satisfied that the Officer viola ted the provision of Rule 3 (I) of the Central Civil Services (Conduct) Rules, 1964 and the Lt. Governor (Administrator) of Mizoram in exercise of the po\Vers con� ferred by Rule 12 read with Rule 16 of the Central Civil Service (Classification

�Control and Appeal) Rules 1965 awarded a penalty of wi,h holding one year's lllcrement of pay without cumulative effect on Shri C. Ngunchunga Industries Officer, Saiha.

And the Lt. Governor was further pleased to revoke the order of smpens; on in exercise of the powers conferred by clause (c) of Sub-rule (i) of Rule 10 of the C.C.S. (Classification Control and Appeal) Rules, 1965 and to further order that no pay and allowances other than subsistence allowances already received by him be admissible to him during the period of suspension vide letter No. INS. 173/77 /103 dated 24.6.1977.

Shri C. Ngunchunga submitted a writ petition to the High Court against the penalty imposed upon him and for quashing order No. INS. 173/77/103 dt. 24.6. 1977. In its judgement, the High Court enjoined that payment of pay and al­lowances should be made during the period of suspension to Shri C. Ngunchunga.

Payment of pay and allowances not paid during the period of su&pens-ion including one year increment should be immediately made to Shri C. Ngllnchunga.
