Smt. Santosh Kumari, the then Joint Director, Directorate of SecondaryEducation, Haryana (now retired) was chargesheeted under Rule 7 of HaryanaCivil Services (Punishment and Appeal) Rules, 1987 vide order No. 17/54-2011Admn. (2) dated 20.01.2012 on the following charges: -

That she i.e. Smt. Santosh Kumari, the then District Education Officer,Hisar gave the statement before Hon'ble Court of Additional Court ofJudicial Magistrate, Hisar in case F.I.R. No. 74 dated 15.02.2006 thatshe has no objection if the cancellation report submitted by the police isaccepted and on the basis of her statement, the cancellation reportsubmitted by the police was accepted by the Hon'ble Court. As such, sheoverlooked the enquiry report conducted by the higher authorities andalso failed to go through the facts of the case and police report, beforegiving a statement in the Hon'ble Court. She also failed to seek anyguidelines from the competent authority before giving any statement inthis regard in the Hon'ble Court.

She replied to the said chargesheet on 10.02.2012. Thereafter, findingher reply as unsatisfactory, Shri R. K. Taneja, IAS (Retd.) was appointed asregular enquiry officer, who vide his report dated 13.06.2012 proved the saidcharges levelled against her. Therefore, in compliance of Rule 7(6) of HaryanaCivil Services (Punishment and Appeal) Rules, 1987, while agreeing with theinquiry report, a communication dated 06.08.2012 alongwith a copy of theinquiry report, was sent to the said incumbent to make a written representationwithin a period of one month. Accordingly, she made written representationdated 28.08.2012, wherein she stated that she had tried her level's best inseeking advice of higher authorities regarding cancellation of FIR in the case ofbogus experience certificate Smt. Usha Rani, Principal (dismissed). She furthersubmitted that Deputy District Attorney of Police Department gave her verbaladvice regarding cancellation of FIR prepared by the police in the light ofdirections of the High Court and it was also brought to her notice verbally thatthe police may not be able to get the accused prosecuted on the basis ofinvestigation done by it in the said FIR. Finally, she prayed that she be

absolved of the said charges in view of the observations of enquiry officer thattechnically the charges stood approved, but no malafide intention was proved.

After going through the contents of chargesheet, reply thereof, report of

regular enquiry officer, submissions made in the representation and connected

provisions of Haryana Civil Services (Punishment and Appeal) Rules, 1987, it is

clear that the charges of giving statement in the court about cancellation of FIRin the matter enunciated above, without the approval of the competentauthority, stand proved.

Taking an overall view of the matter, a penalty of cut in pension to the

tune of 2% for the whole life is inflicted upon Smt. Santosh Kumari, Joint

Director (Retd.) as provided in Rule 2.2(b) of CSR Volume II read with Rule 7(7)

of Haryana Civil Services (Punishment and Appeal) Rules, 1987. Approval of

Haryana Public Service Commission has also been obtained in the matter in

view of Rule 2.2(b)(4) of Punjab Civil Services Rules, Volume II, as applicable toHaryana.

Terms and conditions: -They are appointed purely on temporary and provisional basis.These appointments are against temporary posts and their confirmation againstsubstantive posts shall be considered on the basis of their seniority and record ofservice as and when such post is available.They shall have to take an oath of allegiance to the constitution of India.They shall produce a certificate before joining the duties to the effect that theyhave one living wife/husband in case he/she is married. If they have not morethan one living wife/ husband, shall be eligible for appointment to the postoffered unless the Government after being satisfied that there are specialgrounds for doing so, exempt them from this condition.They shall not be allowed to apply for any post outside that department for aperiod of at least five years.They shall not claim seniority on the basis of this order. Their inter- seniority willalso be decided in accordance with the department rules and instructions of theState Government later on.They shall be on probation for a period of two years, the period of probation canbe extended for a further period not exceeding one year, if considered necessary.In other matters, not specifically mentioned in this communication, they shall begoverned by the civil services Rules as applicable to Haryana GovernmentEmployees and such orders/ instructions as may be issued by the Governmentfrom time to time.

9. In case of reserved category candidates, the appointment is provisional and issubject to verification of the Scheduled Castes/ Scheduled tribes/ BackwardClass and ESM Category Certificate. If the verification reveals that the claim ofbelonging to SC/ST/BC and ESM, as the case may be is false, then their serviceswill be terminated forthwith without assigning any further reasons and withoutprejudice to such further action as may be taken under provisions of the IndianPenal Code for production of false certificate.

All the candidates who have been selected as Lecturer are hereby directed tosubmit their original certificates of academic qualification and other relevantcertificate with the concerned District Education Officer of their place of posting.DEO will ensure that the candidates duly issued by the Medical Board to theDistrict Education Officers. Only then he/she would be allowed to join asLecturer in respective schools of posting. District Education Officer will also givecharacter and antecedent verification forms to them and after filling the forms,the candidates would submit them to the DEO concerned immediately.Those candidate who are already in Government job as Class-II officers need notsubmit a fresh Medical fitness report whereas others are directed to appearbefore the Medical Board as may be constituted by the Director General HealthServices, Haryana, Panchkula and Medical fitness report is the submitted in theoffice of the concerned District Education Officer before joining the place ofposting as Lecturer in respective Government Senior Secondary School.They shall be governed by the Haryana State Education Lecturer School Cadre

(Group-B) Service Rules, 1998.If at any time during the course of their temporary appointment, any of theappointee desires to resign, they shall be required to give one month's clearnotice or forfeit, in lieu thereof, their salary including allowances etc. for onemonth or for the period by which the notice falls short of one month. Such a

notice will be given to him/her by the Government also in the case it is proposedto terminate his/her services in lieu thereof the Government will be liable to payhim/her salary, including allowances for one month or for the period by which

the notice falls short of one month.No TA/DA will be admissible to the candidates for joining as Lecturer.If he or she gets an appointment as Lecturer on the basis of his/her furnishing

false/forged or fraudulent information/ facts which are detected later on, he/she

would be liable for termination of service without any notice.If they are willing to accept this offer of appointment as Lecturer, HES-II (SchoolCadre) on the above terms and conditions, he/she should submit his/her joiningreport as per aforesaid directions.No male lecturer below the age of 50 years be allowed to join in the girls schools.
