    “#>' EE+n the first place, arrest of anaccused is a part of the investigation and iswithin the discretion of the investigatingofficer' Section ># of the %ode of %riminalProcedure provides for arrest by a police

    officer without an order from a &agistrate andwithout a warrant' The section gives discretionto the police officer who may, without anorder from a &agistrate and even without awarrant, arrest any person in the situationsenumerated in that section' +t is open to him,in the course of investigation, to arrest any person who has been concerned with anycogni3able offence or against whomreasonable complaint has been made orcredible information has been received, or a

    reasonable suspicion exists of his having beenso concerned' 1bviously, he is not expected toact in a mechanical manner and in all cases toarrest the accused as soon as the report islodged' +n appropriate cases, after someinvestigation, the investigating officer maymake up his mind as to whether it isnecessary to arrest the accused person' 2tthat stage the court has no role to play' Sincethe power is discretionary, a police officer isnot always bound to arrest an accused even if

    is sent to the police for investigation andreport, they are to investigate in precisely thesame manner and to arrest in precisely thesame way as they would have done if their powers had been first invoked by a first report

    under S' #.>, their being only this difference,that in the one case the police embody theresult of their investigation to the &agistratein a report which the &agistrate proceeds toconsider under S'!*, while in the other casethe police embody the result of theirinvestigation in what is called a challan orcharge)sheet, but which is really a policereport under S'#7!"b$, the term challan orcharge sheet not occurring in the section, theaccused person, in any case, if arrested by the

     police, being produced before the &agistratein the ordinary way' To hold otherwise wouldbe to leave the proceedings started by the&agistrate under S'!, %riminal P'%'unfinished, and in the air; for, he would nothave, as the law contemplates, a report of theinvestigation but he would have a refusal bythe police to report as in this case, and otherand independent proceedings in the samematter initiated by them' Jut the lawcontemplates that proceedings, begun by the

    scrutinise the evidence brought on recordand may even himself put questions to thecomplainant and his witnesses to elicitanswers to find out the truthfulness of theallegations or otherwise and then examine ifany offence is prima facie committed by all orany of the accused'

    “The courts have also pointed out inthese cases that what the &agistratehas to see is whether there isevidence in support of theallegations of the complainant andnot whether the evidence issufficient to warrant a conviction'

    The learned Audges in some of thesecases have been at pains to observethat an enquiry under Section ! isnot to be likened to a trial which canonly take place after process isissued, and that there can be onlyone trial' 6o doubt, as stated in sub)section "#$ of Section ! itself, theob4ect of the enquiry is to ascertainthe truth or falsehood of thecomplaint, but the &agistrate

    “Section ! says that the&agistrate may, if he thinks fit, forreasons to be recorded in writing, postpone the issue of process for

    compelling the attendance of the person complained against anddirect an inquiry for the purpose ofascertaining the truth or falsehood ofthe complaint; in other words, thescope of an inquiry under the sectionis limited to finding out the truth orfalsehood of the complaint in orderto determine the question of theissue of process' The inquiry is forthe purpose of ascertaining the truth

    or falsehood of the complaint; thatis, for ascertaining whether there isevidence in support of the complaintso as to 4ustify the issue of processand commencement of proceedingsagainst the person concerned' Thesection does not say that a regulartrial for ad4udging the guilt orotherwise of the person complainedagainst should take place at thatstage; for the person complainedagainst can be legally called upon toanswer the accusation made againsthim only when a process has issuedand he is put on trial'
