Sieur de La Soudraye, being indebted to Dame Petitde Coulange, now wife of Sieur Dauberville, inthe sum of 3200 livres evidenced by two promissorynotes: one of 3000 livres in piastres dated June15, 1748, and the other for 200 liYres datedAugust 9, 1749; his late wife (Sr. de La Soudraye's)being a co-heir in the suocession of Etienne Langloisand his wife Dame Gervais, Sieur Dauberville,after an unsuocessful attempt to recover, the suo­cession being settled, petitioned the SuperiorCouncil to have all funds belonging to said suo­cession, now in custody of Sieur Fortier, seizedup to the amount of 3200 livres, interest and costs.

Sieur Jaoques Yassioot, baker, having purohasedfrom Sieur Fauohe, Captain of the Vessel "LaPallas", a oonsignment of flour amounting to7150 livres, pet i t i oned the Superior Counoil tocompel Sieur Fauche to retake said flour and re­fund the said amount of 7150 livres, claimingsaid flour to be in a damaged condition and un­fit to make good bread.

In his ansvrer, Captain Fauche admits that i twas not Ner a o ' s flour, but neither was it soldas such, the prioe paid by plaintiff, proves it.

Sieur Yassicot gav e the flour a thorough examina­tion and had an expert baker to assist him beforepurohasing it; said baker stating that the flourwas not condemnable but was not fit to make firstolass bread; said deolaration condemns plaintiff.

Sieur J.!assioot agreed on the prioe, only afterfull satisfaotion of its quality.

The flour delivered on July 29th was paid onAugust 15th, but the complaint was only madethirty-two days after delivery, during whiohtime said flour had ample time to deterioratein plaintiff 's warehouse.

In a shortwhile he had enougn timber, good and marketabloin all respects, ready for the cargo and more be­side.Captain Melinesu I s vessel, who acoording to SieurGoUdeau, was due in a few days, only arrived onthe 15th of September.During that time there were heavy rains and hotwaather, engendering swarms of flies which pri ekedthe timbers but DOt damaging the heart nor thequality of them.Captain Melineau on his arrival was invited severaltimes to call at the plantation and inspect thetimber, but always declined the offer withoutstating any reasons.On October the 24th, the vessel oommanded by thesecond officer arrived at the plantation, but theoffioer, 'on being shown the timber, refused totake the responsibility of loading same aboardhis vessel and returned to the city with aletter of Mr. Daunois addressed to Captain
