Worrying and Love the RulesThe laws governing claims against a decedent are

like a house of mirrors. Counsel for fiduciaries and creditors can find themselves in a confusing and ever-

changing maze filled with obstacles and illusions. This presentation will explore the currently shifting

landscape of the law governing claims against decedents under the California Probate Code and the Code of Civil Procedure, and the distinctions between

them. The speakers will address a variety of challenges that practitioners face, including the exceptions to the creditor claims rules, insolvent estates, foreign

Discovery Best PracticesDiscovery is a powerful tool in any probate

litigation. The experienced panelists will discuss some of the ways in which discovery can be

helpful, including the proper use of third-party subpoenas and requests for consumer records.

They will consider possible defenses to discovery that attempts to sweep too broadly, including an estate planner’s options in responding to a request for the estate planning file, the scope

JERYLL S. COHEN is a member of the law firm Hoffman, Sabban & Watenmaker practicing in the areas of estate planning, litigation and dispute resolution concerning trusts and estates, conservatorships and guardianships. Her practice often involves fiduciary and inter-generational family controversies as well as trust and estate administration. Ms. Cohen often heads a team of tax, administrative and transactional specialists, frequently resolving disputes by settlement, employing creative solutions with tax-efficient strategies.

Professor Barcal assisted in writing the text Willis on Partnership Taxation and is a member of numer-ous associations, including the American Institute of Certified Public Accountants, the American Taxation Association and the American Bar Association. In addition, Professor Barcal has acted as an expert witness in tax, malpractice, and related matters. Professor Barcal is certified as a specialist in Taxation Law and Estate Planning, Trust and Probate Law by the State Bar of Califor-nia Board of Legal Specialization. Previously, he was a partner in Willis, Butler, Scheifly, Leydorf & Grant in Los Angeles. His current practice focuses on estate planning and taxation.

JEFFREY A. DENNIS-STRATHMEYER, now semi-retired from the University of California’s Continuing Education of the Bar (CEB) program, engages in private practice in Lafayette, California. BUNNI DYBNIS

BUNNI DYBNIS, M.A., M.F.T., C.M.C., is the Director of Professional Services at LivHOME, which provides professionally managed eldercare services supporting older adults, their families and professional advisors. She provides consultation, supervision, expert testimony, family meetings and conflict resolution in matters of aging and long term care. Ms. Dybnis brings over 30 years of experience as a Licensed Marriage Family Therapist and Certified Care Manager to her work. She has done pioneering work with the terminally ill and the bereaved and in the last 19 years has focused exclusively on the field of aging and dependent adults.

Ms. Dybnis is a nationally recognized educator, speaker and expert on issues of aging and geriatric care. Her knowledge and experience have led to frequent interviews and on-going speaking engagements that have appeared in print, radio, television and the Internet. Ms. Dybnis is also an instructor at Philips Graduate Institute, where she has taught a course on Aging and Long Term Care since 2006.

Ms. Dybnis received her B.A. degree, education credentials and fellowship training in Thanatology from the University of California, Los Angeles and a Master’s degree in Educational Psychology from California State University, Northridge. She completed mediation training at the Center for Mediation and Law, now known as the Center for Understanding in Conflict.

L. ANDREW GIFFORD

L. ANDREW GIFFORD is a trustee for a large private trust, a private consultant to trustees and attorneys regarding matters of trust administration and fees, an expert witness and the chief financial officer of the Corwin D. Denney Foundation.

Previously, Mr. Gifford was senior vice president and senior fiduciary manager for the West Coast at U.S. Trust Company, N.A. Prior to joining U.S. Trust, Mr. Gifford was with the Los Angeles law firm of Riordan & McKinzie, where he served as chair of the firm’s trust and estate planning practice. Mr. Gifford is a past chair of the Los Angeles County Bar Association Trusts and Estates Section, a past president of the Los Angeles Estate Planning Council, a past president of the Life Insurance and Trust Council of Los Angeles and a Fellow of The American College of Trust and Estate Counsel.

Mr. Gifford received his B.S. degree, cum laude, from Miami University, Ohio, and his J.D. degree from the University of Michigan Law School, where he served as associate editor of the Michigan Law Review.

She has spent over 10 years in private practice in Beverly Hills as a family therapist specializing in issues relating to multi-generational wealth. Her legal background in litigation, combined with her expertise in family therapy, gives her a unique ability to analyze family dynamics, anticipate problem areas, and make suggestions for creative solutions. She currently acts as a consultant for firms or individuals in the area of family dynamics in the preservation of wealth.

Ms. Rubins received her B.A. degree from the University of California, Los Angeles, her J.D. degree from Loyola Law School and her psychology degree from Antioch University.

DAVID LANE

DAVID LANE is in the private practice of law in Encino, California, emphasizing estate planning and trust law. Mr. Lane is the author of several articles dealing with economic analysis of law and evaluating deposit insurance premiums. He has taught courses in gifts, wills and trusts, and estate planning at USC Gould. He previously taught at the University of California, Berkeley, and was a Senior Research Associate at the National Bureau of Economics Research at Stanford University and at the Federal Reserve Board in Washington, D.C.

GABRIELLE A. VIDAL is a partner at the law firm of Loeb & Loeb LLP. Her practice concentrates on high net worth trust, probate and conservatorship litigation, including disputes involving interpretation and enforcement of wills and trusts, the obligations of fiduciaries such as trustees and executors, and conservatorship matters. STUART D. ZIMRING is in private practice in North Hollywood, California where he concentrates in the areas of elder law, estate and life planning, special needs trusts, and probate, conservatorship and trust litigation matters. He is certified as a specialist in Taxation Law and Estate Planning, Trust and Probate Law by the State Bar of California Board of Legal Specialization.

Mr. Zimring is a Fellow and past president of the National Academy of Elder Law Attorneys, Inc. REGISTRATION

The Conference registration fees are outlined on the inside back cover of this brochure.

Your fee includes the Conference program, luncheon, refreshment breaks, and a copy of the

Conference Syllabus in print and electronic download formats. The Conference Syllabus is a

volume of outlines, articles, forms and practical information prepared by our speakers, and

includes the Resource Guide, a Trust and Estate Professional Directory covering Los Angeles,

Orange and San Diego counties.

REFUNDS

All refund requests will be processed following the Conference and must be postmarked, faxed

or emailed to us on or before October 26, 2012. Refund requests may be mailed to: USC Gould

School of Law, CLE Trust and Estate Conference Refunds, 1149 South Hill Street, Suite 340, Los

Angeles, California 90015. Refund requests may also be faxed to (213) 821-3575 or emailed to

[email protected]. All refund requests must be accompanied by the registrant’s Social Security

Number (or Federal Identification Number if the refund is for a firm or corporation).

A processing fee of $100 ($25 for student registrations) will be deducted from all refunds.
