CAN WE DO THAT? THE REAL WORLD RISKS UNDER THE FEDERAL FRAUD AND ABUSE LAWS AND

REGULATIONS

With ever-increasing enforcement efforts against healthcare providers nationwide, it is as important as ever to understand the risks inherent in even unintentional non-compliance with federal fraud and abuse laws and regulations. As a result, in making operational, business and strategic decisions, facilities need a basic understanding of the rules and how best to navigate the risks. This presentation will provide, not only a legally sound description of the relevant laws and rules, but will do so in an understandable manner for the layman and with an eye as to the real world risks, the realities of how the industry works and what the practical application of the legal analysis is on actual operations. Steven will cover the impact of the election on healthcare nationally, documentation and billing risks under the False Claims Act, risks under the Anti-Kickback and OIG guidance on topics ranging from swapping to joint ventures to relationships with hospitals and navigating the legal requirement to do voluntary refunds/disclosures under the federal 60-day rule.
