Construction Manager’s Check List HOW DO YOU KNOW IF YOU NEED PROFESSIONAL LIABILITY INSURANCE? ANSWER THE FOLLOWING QUESTIONS: Do you provide services that include the arranging for permits and approvals? YES NO Construction Managers may assist owners/clients in obtaining building and other permits for permanent improvements. Y ou can be held responsible if the correct permits are not obtained. Do you obtain and evaluate bids for the owner? YES NO  Y ou can be held responsible if the bids are not properly solicited or reviewed. Do you prepare contracts? YES NO  Y ou may be responsible for addressing the contractual responsibilities for the design team and contractors of the project. Do you act as the owner’ s agent during construction? YES NO  Y ou may be responsible to the owner for managing the planning, design, construction and post construction phases of the project. Do you provide services such as cost estimating or value engineering? YES NO Y ou may be held liable to the owner if the actual cost of a project exceeds the estimated cost or when value engineering fails to meet specic requirements.  Do you perform design services in conjunction with construction management, or in a joint venture with a design rm? YES NO  Design services must be performed by a p roperly licensed design professional. You may be held liable if the design does not meet the required standard of care. Do you perform services under AIA/B801/CMa, AGC-510 (Consensus DOCS 510), or CMAA A-1 contracts? YES NO  If you sign these contracts, you are contractually taking on responsibilities for construction management services. Each service outlined in the contract creates exposures that could lead to a professional negligence claim against the construction manager . Are you responsible for project coordination or scheduling?
