SECTION 2604en. 125.29 (7) of th e sta tu tes is creat ed to read:

125.29 (7 ) SMALL BREWERS. (a) In th is subsection, sma ll brewer mea ns a

brewer th at m an ufactur es less tha n 300,000 bar rels of ferm ent ed malt beverages in

a calenda r year from a ll locat ions.

(b) Subsections (2), (3), (3m), an d (6) do not apply to a sm all brewer. In st ead ,

th e provisions of th is subsection a nd s . 125.31 apply to a sm all brewer.

(c) Except a s provided in s. 125.31, no person t ha t h olds a Cla ss B license or

perm it issued under th is chapt er an d tha t is a sma ll brewer m ay register as a brewer.

(d) Subject t o s. 125.34 (2), a small brewer m ay ma nu factu re, possess, an d store

fermented malt beverages on the brewery premises and transport fermented malt

beverages between t he brewery premises and a ny depot or war ehouse ma inta ined

by the brewer for which t he brewer h as a wholesaler s perm it issued un der s. 125.28.

A brewer or individual representing a brewer may also provide taste samples as

au th orized un der s. 125.33 (12).

(e) A sma ll brewer m ay hold a wholesaler s perm it issued un der s. 125.28 and

a Class B license as pr ovided un der s. 125.31. The sma ll brewer m ay hold th e

(c) Any Class B license n ecessar y in conn ection with th is subsection shall be

issued to the sm all brewer.

(d) Notwithsta nding s. 125.33 (1), a small brewer ma y own th e fur nitu re,

fixtures, fittings, furnishings and equipment on such premises and shall pay any

license fee or t ax r equired for t he opera tion of th e prem ises.

(2 ) Subject t o s. 125.34, a sm all brewer m ay own, ma int ain or operat e depots

an d wa rehouses from which sales of fermen ted ma lt beverages, not for consu mpt ion

in or about th e premises where sold, may be ma de in origina l packages to reta ilers

an d wholesaler s. A separ at e wholesaler s license is required for each depot or

wareh ouse owned, ma inta ined or operated.

(bm) Notwith sta nding par. (a), a sma ll brewer th at , together with its brewer

group, manufactures more than 50,000 barrels of fermented malt beverages in a

calend ar year in an y locat ion m ay be issued a wholesaler s license per mit for

wholesale prem ises locat ed on br ewery premises but ma y not sell or sh ip more tha n

a total of 1,000 barr els of fermen ted m alt beverages in an y calendar year t o retailers

from these wholesale premises. Ferm ented ma lt beverages provided by a sma ll

brewer t o an y retail premises for which the small brewer holds th e reta il license sha ll

not be included in any calculation of the 1,000 barrel limitation under this

paragraph.

(c)1. Except as provided in par. (bm) and notwith st an ding par. (a), a sm all

brewer ma y be issued a wholesaler s license for wholesale prem ises locat ed on

brewery pr emises if, from th ese wholesale prem ises, the sm all brewer sells or sh ips

fermen ted ma lt beverages only to other wholesalers.

2. Notwith sta ndin g subd. 1., a sma ll brewer issued a wholesaler s license

permit under subd. 1. may, from the wholesale premises located on brewery

prem ises, sell or sh ip any bra nd of ferm ent ed ma lt beverages to reta ilers locat ed in

a designat ed sales terr itory for t he bra nd if the wholesaler to which t he sma ll brewer

has granted distribution rights for the brand in this designated sales territory is

un able to service th e designa ted sa les terr itory for a ny rea son, including becau se of

discont inu an ce of th e wholesaler s distr ibution right s. A sma ll brewer m ay sell or

ship ferm ent ed malt beverages to retailers un der t his subdivision for n ot m ore t ha n

12 month s after t he wh olesaler becomes u na ble to service th e wholesaler s
