Introduction 1 1

1

1.1 Background Arthur Keough Reserve (the Reserve) is a small Reserve located in the picturesque rural setting of Gleniffer within the Bellingen Shire Local Government Area (LGA). It is used as a place of passive recreation for picnicking and swimming and contains an open parkland style setting with a small number of picnic facilities, some ornamental trees and a riparian zone which is remnant riparian rainforest (Waterhousia floribunda dominant) with weed invasion (camphor laurel and privet) which fronts the Never Never River (refer to Plates 1.1, 1.2 and 1.3). The Reserve was opened by the Honourable DP Lander L.L.B. M.L.C. Minister for Planning and Environment on 17 September 1978. The Reserve was dedicated for public use by Jack Keough in memory of his father Arthur Keough (1896 – 1972) who was a member of one of the earliest pioneer families in Gleniffer. The Reserve is under the care and control of Bellingen Shire Council (BSC) who maintain the park along with its facilities. The Land is classified as community land and under the provisions of the Local Government Act 1993 (LG Act 1993). Council is required to prepare a Plan of Management (PoM) for the management of any community land. A PoM must include a range of core matters as prescribed by the provisions of Section 36 of the LG Act 1993 and these are addressed within this PoM. The Never Never Catchment Group (NNCG) is a not-for profit Landcare group based in the Gleniffer area who have been conducting river restoration works along the 8 km length of the Never Never River since 1995, including areas surrounding the reserve. NNCG have for sometime volunteered to undertake Landcare works at the Reserve and specifically have requested permission from Bellingen Shire Council to continue environmental improvements to parts of the Reserve that involve riparian rehabilitation and bush regeneration along the Never Never River as part of a general upgrade of the reserve and its facilities. The Never Never Catchment Group has set aside funds to assist BSC with the upgrade of this reserve. This Plan of Management (PoM) aims to provide direction for the future management of the Arthur Keough Reserve for the next 10 years based on current social and environmental values and legislative responsibilities. To achieve this, an integrated approach including education and vegetation management is required to manage visitors and users of the park and their interactions with the local environment.

1.2 Location Arthur Keough Reserve is located on Gleniffer Road, directly north of the intersection of Gleniffer Road, Gordonville Road and Timboon Road, Gleniffer within the Bellingen Shire Council LGA. The Reserve is bound by Gleniffer Road, privately owned farmland and the Never Never River and is in proximity to the Gleniffer Hall and Church. The total area of the reserve is 4170 square metres. The locality of the Reserve is shown in Illustration 1.1 and Illustration 1.2 shows an aerial photo of the Reserve. The Reserve is described as Lot 52 DP 589109. The land is under the care and control of Bellingen Shire Council.

1.3 Category of the Land Pursuant to Section 36 of the Local Government Act 1993 the land is categorised partially as Park and partially as a Natural Area (Watercourse and Bushland). Section 6 of this PoM provides further detail with respect to the categorisation of the Reserve.

1.4 Aim, Objectives and Performance Targets The aim of this PoM is to provide strategic guidelines for the effective management of the Reserve for the next 10 years. Specific objectives of the Reserve include:

1. to maintain and enhance the sustainability of the reserve for amenity and environmental values;

2. to maintain or enhance the Reserve as an area for passive recreation; including picnicking, swimming and relaxation;

3. to maintain or enhance the aesthetic values of the Reserve so as to provide an attractive location for visitors to and residents of the Bellingen Shire to use for passive recreation purposes;

4. to manage noxious and environmental weeds, including introduced ornamental species;

5. to provide for the rehabilitation and restoration of the riparian zone of the Never Never River including promotion and planting of endemic riparian vegetation and enhance riparian functions;

6. to formalise vehicular access to designated entry and parking areas;

7. minimise the risk of inappropriate biodiversity and human conflicts; by managing erosion and siltation and reduce impacts on downstream habitats; and by conserving and improving the environmental values of the Reserve;

8. to ensure all future works are consistent with the RE 1 Zone Public Recreation of Bellingen Local Environmental Plan 2010 which are:

to enable land to be used for public open space and recreational purposes;

to provide a range of recreational settings and activities and compatible land uses; and

to protect and enhance the natural environment for recreational purposes.

9. to incorporate all of Council’s legal responsibilities for land management into a consolidated PoM;

10. to provide a future plan to guide any planned future improvements to the Reserve; and

11. to categorise management issues associated with the reserve and address them through a consolidated Action Plan.

Performance targets for the Reserve are included in Section 7 of this PoM and include a set of actions which have been allocated specific timeframes in which to be achieved. Council proposes to work closely with the Never Never Catchment Group and allocate necessary resources to achieve the actions and performance targets within the identified timeframes. Council will assess its performance with regard to achieving these targets and actions by reviewing the PoM including the proposed actions within 10 years.

Description of the Reserve 2

2.1 Existing Environment The Reserve is located on the Never Never River and fronts Glennifer Road, Glennifer in the Bellingen Shire LGA. The topography of the Reserve consists of a gentle gradient sloping to the south to Never Never River along the southern boundary of the Reserve. The Never Never River flows into the Bellingen River approximately 4 kms south west of the Reserve. There are two minor drainage lines within the Reserve which flow south to the Never Never River.

The land is subject to flooding given its proximity to the Never Never River and elevation. The Reserve enjoys extensive views over agricultural land to the north and west to the Dorrigo Plateau and picturesque views of vegetation and the Never Never River to the south and east.

2.2 Existing Use and Facilities The Reserve is used for passive recreation (low intensity uses such as picnics, barbeques and swimming) by the local community, shire residents and visitors to the Shire. It has a high community value due to its scenic northerly outlook and its close proximity and easy access to the beautiful Never Never River. As a result it is very well utilised. The Reserve is also used as an informal car park where visitors park their vehicles whilst enjoying the Reserve facilities. Informal and unrestricted vehicle access has resulted in some vehicles accessing the flat gravel foreshores of the adjacent river, and vehicles accessing to private property which is of concern to adjoining land owners. This has created management issues and is addressed later in this PoM. Existing infrastructure within the Reserve includes:

an informal gravel access road and grid (Plate 2.4);

2 picnic tables, a barbeque and a rubbish bin (Plate 2.5);

a commemorative plaque indicating history of the Reserve and a sign indicating name of the Reserve; and

a ramp used by the Local Council to unload and load maintenance machinery. Management activities currently undertaken at the Reserve by Bellingen Shire Council include regular mowing across the open part of the Reserve, emptying rubbish bins and maintenance of picnic tables and barbeque facilities as required. The area categorised as Park and the facilities contained within this area are generally well maintained and the facilities are in good working condition. The area categorised as Natural Area (Bushland and Watercourse) is generally in poor condition as it suffers from weed infestation and as a result is in need of rehabilitation. The Reserve does not provide for camping and it is understood that the Reserve previously contained a ‘No Camping’ Sign to advise users of this restriction. A new sign advising users that camping is prohibited is recommended to be installed as part of the proposed upgrade works as there is insufficient space and facilities for provision of such an activity within the Reserve.

3.1 History 3.1.1 Indigenous History The Reserve is contained within the traditional lands of the Gumbaynggirr people. No known archaeological surveys have been carried out on the Reserve to date. There are no records of indigenous sites or places within a 1 km radius of the Reserve on the OEH Aboriginal Heritage Information Management System (AHIMS) database. 3.1.2 European History The lot that encompasses the Reserve was created on the 9 March 1977 and the Reserve was officially opened on the 17 September 1978 by the then Minister for Planning and Environment, Honourable DP Lander. The area was dedicated for public use by Jack Keough in memory of his father, Arthur Keough (1896 – 1972) who was a member of one of the earliest pioneer families of the Gleniffer valley. The original lot (Lot 5 DP578338) was, prior to the Keough Family purchasing it, owned by the McFadyn family.

3.2 Surrounding land uses The Reserve is located in Gleniffer adjacent to the Never Never River and in proximity to the Gleniffer Community Hall and Church. Aside from these uses and features the Reserve is surrounded by privately owned farmland. The Reserve is also in proximity to the crossroads of Gleniffer Road, Timboon Road and Gordonville Road.

4.1 Local Government Act 1993 Under the provisions of the Local Government Act 1993, Council is required to prepare a Plan of Management (PoM) for the management of any community land. Clause 36 of the Act sets out what is to be included within a PoM. Table 4.1 outlines these requirements and identifies where they are specifically addressed within the PoM. 4.2 Bellingen Local Environmental Plan 2010 The Reserve is located within the Bellingen LGA and covered under the Bellingen Local Environmental Plan (LEP) 2010. The Reserve is zoned RE1 Public Recreation (refer to Illustration 4.1). Objectives of this zoning are:

to enable land to be used for public open space and recreational purposes;

to provide a range of recreational settings and activities and compatible land uses; and

to protect and enhance the natural environment for recreational purposes.

Environmental protection works are the only use permissible with consent in the RE1 zone. All other uses are

either Permissible with Consent or prohibited.

4.3 State Environmental Planning Policy (Infrastructure) 2007 The aim of State Environmental Planning Policy (Infrastructure) 2007 (Infrastructure SEPP) is to facilitate the effective delivery of infrastructure across the State by:

improving regulatory certainty and efficiency through a consistent planning regime for infrastructure and the provision of services;

provide greater flexibility in the location of infrastructure and service facilities;

aim for efficient development ?, redevelopment or disposal of surplus government owned land;

identifying the environmental assessment category into which different types of infrastructure and services development;

identifying matters to be considered in the assessment of the development adjacent to particular types of infrastructure development ; and

providing for consultation with relevant public authorities about certain developments during the assessment process or prior to development commencing.

SEPP Infrastructure specifically deals with parks and other reserves under Division 12 of the SEPP. Clause 65 of the SEPP states that development for any of the following purposes may be carried out on behalf of a local council without consent of a public reserve under the control or vested in the council:

a) roads, cycleways, single storey car parks, ticketing facilities and viewing platforms;

b) outdoor recreational facilities, including playing fields, but not including grandstands;

c) information facilities such as visitors’ centres and information boards;

d) lighting, if light spill and artificial sky glow is minimised in accordance with AS/NZS 1158: 2007, Lighting for Roads and Public Spaces;

e) landscaping, including irrigation schemes (whether they use recycled or other water);

f) amenity facilities;

g) maintenance depots; and

h) environmental management works.

Clause 66 of the SEPP Infrastructure states that development for any of the following purposes is exempt development if it is carried out by or on behalf of a public authority in connection with a public reserve or on land referred to in clause 65 (1), and if it complies with clause 20:

a) construction, maintenance and repair of:

i. walking tracks, boardwalks and raised walking paths, ramps, minor pedestrian bridges, stairways, gates, seats, barbecues, shelters and shade structures;

ii. viewing platforms with an area not exceeding 100 m2, or

iii. sporting facilities, including goal posts, sight screens and fences, if the visual impact of the development on surrounding land uses is minimal, or

iv. play equipment where adequate safety provisions (including soft landing surfaces) are provided, but only if any structure is at least 1.2m away from any fence.

b) routine maintenance (including earthworks associated with playing field regrading or landscaping and maintenance of existing access roads).

Development is exempt if it:

a) complies with clause 20 of the SEPP, and

b) involves no greater disturbance of native vegetation than necessary, and

c) does not result in an increase in stormwater run-off or erosion, and

d) for the purposes of implementing a plan of management. It is therefore considered that, pursuant to the provisions of the Infrastructure SEPP, the works likely to occur at the Arthur Keough Reserve would be either development not requiring consent or exempt development and therefore would not require a development application to be lodged with Bellingen Shire Council.

5

5.1 Design The Reserve lacks a current Plan of Management to guide necessary maintenance and improvement works. This has led to continuing degradation of the reserve and its facilities over recent years. Both Council and local residents are keen to see a PoM approved so that improvements to the reserve facilities, amenity and environment can be made.

5.2 Vehicular Access At present vehicular access is unrestricted and as a result cars park all over the Reserve including on the riverbank which damages vegetation and creates a safety risk and loss of amenity to other users of the Reserve. Any future works to the Reserve should seek to limit vehicular access to a defined access and carparking area except for emergency and service vehicles.

5.3 Flooding The site is subject to flooding and any additional works on the site must have regard to this impact. All works should be designed to ensure flow of flood waters is not impeded and also are able to withstand the forces of flood waters to ensure maintenance requirements for Bellingen Shire Council are minimised.

5.4 Vegetation Parts of the Reserve, especially the riparian zone have been degraded and infested by weeds. The Never Never Catchment Plan (Northern Rivers Catchment Authority) has identified Keough Reserve as a priority area which would benefit from environmental restoration works. The Never Never Catchment Group have volunteered to undertake the environmental restoration of the site, subject to issues such as site access and parking controls being adequately upgraded. It is therefore understood that the rehabilitation works of the riparian zone will be designed and carried out on behalf of the Council by the Never Never Catchment Group in accordance with this management plan.

5.5 Ongoing Maintenance Any proposed works to be carried out as part of the Reserve upgrade will be required to be low maintenance and to ensure that Councils maintenance obligations are not significantly increased.

A Concept Plan for the proposed future redevelopment of Arthur Keough Reserve has been prepared by GeoLINK for Bellingen Shire Council to assist it in the future management of the Reserve. The Concept Plan is shown as Illustration 6.1, 6.2 and 6.2. The Concept Plan has been prepared to show how the Reserve should generally be developed and managed in the future. It should be noted that it is not a detailed design and would be subject to modification subject to future requirements of Council and the Community. Illustration 6.1 shows the overall concept plan Illustration 6.2 shows a cross section of the proposed future works and Illustration 6.3 shows the different activity zones proposed for the Reserve. Illustration 6.1and 6.2 show the proposed future works within the Reserve which include:

environmental restoration of the riparian zone and other areas within the Reserve including removal / control of weeds and replanting of native endemic vegetation;

formalising the access road and carparking area;

restricting traffic (except for emergency and service vehicles) to the access road and carparking area through vegetation plantings and rock placement and timber bollards;

construction of a new pathway to improve the pedestrian link between the Reserve and the adjacent Glennifer Hall and Church;

installation of additional picnic tables to cater for the high usage rates; and

increased vegetation to augment existing plantings to improve shade and amenity within the reserve. For the purposes of Section 36 (4) and (5) of the Local Government Act 1993, the areas identified as in Illustration 6.2 as Picnic and Open Space and Car Park and Vehicle Access are categorised as the Park area of the reserve and the area identified as Rehabilitation Area is categorised as a Natural Area. It should be noted that the Concept Plan has been prepared without a detailed survey of the site and is subject to change if and when any future survey is carried out for the site. The Concept Plan should not be used to dimension proposed works. The Reserve will still continue to function as it currently does which will be for passive recreation (low intensity uses such as picnics, barbeques and swimming). Purposes for which the land and improvements will be permitted to be used include:

passive and active informal play and recreation;

any works identified in Illustration 6.1 of this PoM; and

any activity permitted without consent, or permitted as exempt development, under the provisions of Bellingen Local Environmental Plan 2010, State Environmental Planning Policy (Infrastructure) 2007 or State Environmental Planning Policy (Exempt & Complying Development Codes) 2008.

The following section outlines the management actions to achieve the core objectives of the PoM as detailed in Section 1.4. The life of the PoM is 10 years with a review recommended at 5 years in consultation with interest groups. An adaptive management approach would be incorporated as required particularly in response to the timing of future works. Timeframes for actions recommended are:

short: < 2 years

medium: 2-8 years

long: > 8 years Responsibility (refer to Table 7.1) refers to the organisation or authority that will have the most influence over actually implementing the proposed management options. It does not necessarily indicate that this organisation or authority is required to fund the management action.
