1.0 INTRODUCTION AND DISCUSSION This Baseline Environmental Assessment has been completed as part of a transaction of known contaminated property whose address is 505 East Alcott Street, Kalamazoo, Kalamazoo County, Michigan (Property). Kalamazoo County intends to use the Property for commercial purposes in the future.

Fleis & VandenBrink Engineering, Inc. (F&V) conducted a Phase I Environmental Site Assessment (ESA) on the Property in December 2015. The Phase I ESA was conducted in conformance with All Appropriate Inquiry (40 CFR 312) and ASTM Standard Practice E 1527-13 and is summarized below:

1.1 PHASE I ESA 1.1.1 Phase I ESA Findings This section summarizes the “findings.” Generally defined as known or suspect environmental conditions associated with the property, as determined by the environmental professionals conducting this environmental site assessment, findings may include recognized environmental conditions (RECs), historical RECs and de minimis conditions, among other environmental conditions. The following is a list of the findings from the Phase I ESA conducted for the Property:

1. Historical use of the Property as a portion of the former Performance Paper Company and listing as a portion of the Allied Paper/Portage Creek/Kalamazoo River Superfund Site.

2. Coal was delivered and stored on the Property for use as fuel for several coal-fired boilers and engines.

3. Soils contaminated with metals and PNAs at concentrations above Part 201 GRCC were documented to be present at the Property.

4. Groundwater contaminated with metals at concentrations above Part 201 GRCC was documented to be present beneath the Property.

5. The basements of Mill C were formerly used to store 55-gallon drums of petroleum solvents, lubricants, oils, caustics, degreasers and paints. The entire basement floor was reported to have been stained by chemical releases

6. Trench drains “open sewers” were present throughout the Mill C basement which discharged wastewater into a large sump in the Building 34 basement. The sump was pumped to the wastewater treatment system. Spilled chemicals were observed in the trench drains and an oily sheen was observed in the sump during earlier assessments.

1.1.2 Phase I ESA Opinions This section contains the environmental professional’s opinion of the impact on the property of environmental conditions identified in the findings section. The logic and reasoning used by the environmental professional in evaluating information collected during the course of the investigation is presented for each finding in detail below. The goal of this ESA is to use a standard practice to identify RECs. ASTM defines REC as the presence or likely presence of any hazardous substances or petroleum products on a property under conditions that indicate an existing release, a past release, or a material threat of a release of any hazardous substances or petroleum products into structures on the property or into the ground, groundwater, or surface water of the property. This includes releases in compliance with laws. This is not meant to include de minimis conditions that generally do not present a material risk of harm to public health or the environment and that generally would not be the subject of an enforcement action if brought to the attention of appropriate governmental agencies. ASTM also defines Material Threat as a physically observable or obvious threat, which is reasonably likely to lead to a release that, in the opinion of the Environmental Professional, is threatening and might result in impact to public health or the environment.

ASTM also defines Historical RECs (HREC), as environmental conditions which in the past would have been considered a REC, but which may or may not be considered a REC currently. For example, if a past release of any hazardous substances or petroleum products has occurred in connection with the property and has been remediated, with remediation accepted by the responsible regulatory party; this condition shall be considered an HREC.

1. Historical use of the Property as a portion of the former Performance Paper Company and listing as a portion of the Allied Paper/Portage Creek/Kalamazoo River Superfund Site. This is a REC. The historical use of the Property included the use, storage and disposal of significant quantities of petroleum products and hazardous substances with documented releases and known historical soil and groundwater contamination.

2. Coal was delivered and stored on the Property for use as fuel for several coal-fired boilers

and engines. This is a REC. Residual coal and coal ash has been documented to exist on the Property.

3. Soils contaminated with metals and PNAs at concentrations above Part 201 GRCC were

documented to be present at the Property. This is a REC. The available data indicates the potential for widespread contamination in shallow soils at the Property, likely from the historical use of coal to generate power and steam on the Property.

4. Groundwater contaminated with metals at concentrations above Part 201 GRCC was

documented to be present beneath the Property. This is a REC. The available data indicates the potential for widespread contamination in groundwater at the Property, likely from the historical use of coal to generate power and steam on the Property.

5. The basements of Mill C were formerly used to store 55-gallon drums of petroleum

The presence of the stained floor indicates that releases of hazardous substances and petroleum products occurred inside the building, creating a material threat of a release to underlying soils.

discharged wastewater into a large sump in the Building 34 basement. The sump was pumped to the wastewater treatment system. Spilled chemicals were observed in the trench drains and an oily sheen was observed in the sump during earlier assessments. This is a REC. The presence of chemicals and oily sheen in wastewater in the concrete trenches and sump indicates that hazardous substances and petroleum products were released inside the building, creating a material threat of a release to underlying soils.

1.1.3 Phase I ESA Data Gap Analysis Compilation of ESAs often result in data gaps, which may be defined as a lack of, or inability to obtain information required by the ASTM standard despite good faith efforts by the User or environmental professional to gather such information. ASTM specifies that only data gaps that affect the ability of the environmental professional to identify RECs and identify the sources of information that were consulted to address the data gaps need to be addressed. A data gap by itself is not inherently significant. Data gaps associated with this ESA and our professional opinion follow:

1. Portions of the Property’s obvious past uses could not be identified from the present time

back to 1940 or the Property’s first developed use in 5 year intervals because of data failure.

This data gap by itself is not considered significant as we are of the opinion that use of the eastern portion of the Property prior to the development of the paper mill in the late 1800s was either residential or undeveloped.

1.1.4 Phase I ESA Conclusions

1. Historical use of the Property as a portion of the former Performance Paper Company and listing as a portion of the Allied Paper/Portage Creek/Kalamazoo River Superfund Site.

2. The historical use and storage of coal on the Property. 3. The documented presence of soil contaminated with metals and PNAs above Part 201

GRCC. 4. The documented presence of groundwater contaminated with metals above Part 201

GRCC. 5. The documented releases of hazardous substances and petroleum products onto the

basement floor of Mill C. 6. The documented releases of hazardous substances and petroleum products into the Mill C

trench drains and sump in Building 34. These conclusions are based upon information presented within the complete F&V Phase I ESA report which is provided as Attachment A. 1.2 PHASE II ESA 1.2.1 Phase II ESA Findings F&V conducted a Phase II ESA to evaluate the RECs identified in the December 2015 Phase I ESA. The hazardous substances carbon tetrachloride, naphthalene, tetrachloroethylene, trichloroethylene, xylenes, arsenic and mercury have been identified in the Property’s soil; and the hazardous substance tetrachloroethylene has been identified in the Property’s groundwater at concentrations exceeding their respective GRCC, as defined in R299.5744 and R299.5746 of the NREPA.

1.2.2 Phase II ESA Conclusions F&V conducted a Phase II ESA in January 2016 to evaluate the RECs identified in the December 2015 Phase I ESA. Based on the data collected during the Phase II, the Property is a facility, as defined in Part 201 of the Natural Resources and Environmental Protection Act, P.A. 451 of 1994, as amended (NREPA), due to the presence of: carbon tetrachloride, naphthalene, tetrachloroethylene, trichloroethylene, xylenes, arsenic and mercury in soils; and tetrachloroethylene in groundwater at concentrations, exceeding their respective Part 201 GRCC. These conclusions are based upon information presented within the complete F&V Phase II ESA report which is provided as Attachment C.

2.0 PROPERTY INFORMATION

2.1 Property Description and Tax Identification Number The Property is located at 505 East Alcott Street, Kalamazoo, Kalamazoo County, Michigan. The Property consists of approximately 3 acres of undeveloped land. The tax identification number is 06-27-224-001. The legal description for the Property, as provided to F&V by Kalamazoo County, is included in Attachment B.

2.2 Site Location Map A scaled Site Location Map that shows the Property in relation to the surrounding area is provided as Figure 1. 2.3 Site Plan A scaled Site Plan that depicts the site, sample locations and depths and detected contaminant concentrations is provided as Figure 2. 2.4 Site Survey A survey of the Property is provided as Figure 3.

3.0 FACILITY STATUS The hazardous substances and CAS Numbers, maximum concentrations, sample locations and depths, and media affected are summarized and compared to Part 201 GRCC on Table 1. The laboratory analytical data sheets and chain of custody documentation for the samples collected during the Phase II ESA are provided in Attachment C. 4.0 IDENTIFICATION OF BEA AUTHOR The data assembly, interpretation, and technical conclusions for this Baseline Environmental Assessment (BEA) were developed by Fleis & VandenBrink Engineering Inc. (F&V). Mr. Steven M. Kimm of F&V was the primary Environmental Professional overseeing the BEA process. 5.0 ALL APPROPRIATE INQUIRY REPORT OR ASTM PHASE I ENVIRONMENTAL SITE

ASSESSMENT An ASTM Standard Phase I ESA was conducted on the Property by F&V and is provided in Attachment A. The report considered hazardous substances as defined by Section 20101(1)(r). 6.0 REFERENCES
