I grew up with this organization—my father was pre- sident in 1988—and have been so inspired by the relationships I’ve forged and lessons I’ve learned as an officer for the past six years. I look forward to being “in the arena” with you, as Teddy Roosevelt said so well, working hard and daring greatly to advance the ideals of our profession. Since I was installed, the officers and I have been busy setting up committees and preparing for what promises to be an exciting and productive year for NAPIA. One of my essential goals as president is to improve our recognition as the gold standard of the public adjusting industry, a model for others in our profession. To that end, I encourage all members to take advantage of the upcoming First Party Claims Conference (FPCC) in Warwick, Rhode Island in October. There, you’ll find many dynamic professional develop- ment programs for continuing education credit, along with a wealth of vital networking opportunities. This year we will also focus our continued efforts on enhancing the reputation of NAPIA and our profession—both within and beyond the industry. The newly formed Public Adjuster Working Group at the NAIC, focused on addressing the common issues of our profession, will be critical to this effort. I’d like to extend a big thank you to NAPIA Past Presi- dent Ron Reitz for attending the recent NAIC meeting with us; his expertise and constructive feed- back have been so helpful. She has been a Director of Lincoln Benefit Life Company since April 2014. She is also a Director of Resolution Life Holdings, Inc. and a Director of Resolution Life, Inc. Frohman is a graduate of the University of Nebraska–Kearney and the University of Nebraska College of Law in Lincoln. 2016 NAPIA ANNUAL MEETING DRAWS LARGE ATTENDANCE Nearly a hundred and forty NAPIA members and guests attended the 2016 Annual Meeting at the Montage Resort in Laguna Beach, CA. The event included education, networking activities and more, including a special one-day educa-tion program for California public adjusters to receive CE credits. Convention highlights included three mornings of professional education worth seven continuing education credits for public adjust-ers in nineteen states, election of officers and directors, and the installation of this year’s president, Diane Swerling, SPPA of Swerling Milton Winnick Public Adjusters, Inc. in Wellesley Hills, MA. A post-convention survey confirm-ed that attendees were extremely pleased with the Montage Resort as well as the Laguna Beach area. All were also complimentary of the many Annual Meeting social events and other networking opportunities.

2016 PCWA WINNER ROBERT BAKER RECOGNIZED IN JUNE The 2016 Paul Cordish Writing Award winner Robert C. Baker III was presented with a check for the first place prize of $7,500 during the banquet at the 2016 NAPIA Annual Meeting. The title of his winning paper is “The Costs of the Unlicensed Practice of Public Adjusting: A Legal and Economic Analysis.”

It has been a while since we con-vened in Laguna Beach, California at the 2016 Annual Meeting. Since that time things have been busy, as always, for NAPIA. We recently attended the summer NAIC meeting in San Diego, Cali-fornia where we had the occasion to meet with nearly a dozen state regulators regarding many issues impacting the public adjusting profession. We also had the opportunity to meet with the leaders of the Public Adjuster Working Group, which is a newly formed committee at NAIC that was created to deal with issues impacting the public adjusting profession. Off the top, this committee will be studying and making recommendations regard-ing the pervasive problem of the unauthorized practice of public adjusting (UPPA), which can only help us as we move forward. During our time in San Diego, we also furthered our outreach to, and connections with, various state regulators from all over the country. I will soon be speaking at the First Party Claims Conference and the NAPIA Mid-Year Meeting regard-ing efforts needed to assure that we practice public adjusting in a proper and ethical way. NAPIA continues to be the leader -- the gold standard, if you will -- of the industry, and we are now consulted by regulators and others for advice and input regarding the proper practice of public adjusting. This is a very positive result of NAPIA’s efforts at the national level.

As fall approaches, the legislative season is not far behind. It is imperative to get an early jump on any and all legislative and/or regulatory issues that are raised in any state. If you learn of any-thing in your state, please advise the NAPIA officers immediately so the association can get a handle on things from a national perspective. We cannot weigh in on every state issue, but if it has national impact we need to be able to decide quickly on a plan of action if it is determined that NAPIA should get involved.

DONATE TO NAPIA CHARITABLE FUNDS

Named after William Goodman, the first president and founding father of NAPIA, the Will Good-man Foundation was created to serve as a resource for public adjuster education and training. The Paul Cordish Memorial Foundation was established in memory of NAPIA Executive Director and Counsel Paul L. Cordish, Esq. The Foundation funds an award for students at the University of Maryland School of Law who compete in a writing competition addressing matters related to public adjusting. Contributions made to either fund in the name of a loved one or colleague will be acknowledged with a letter to the deceased’s family. Donations are tax deduc-tible and are restricted for use as noted above. Checks are payable to the Will Goodman Foundation or the Paul Cordish Memorial Foundation and can be mailed to:

RULES OF PROFESSIONAL CONDUCT AND ETHICS The NAPIA rules of professional conduct and ethics are posted on www.napia.com. The following Rules of Profes-sional Conduct and Ethics are applicable to all members of the Association: 1. The members shall conduct

themselves in a spirit of fair-ness and justice to their clients, the Insurance Companies, and the public.

2. Members shall refrain from improper solicitation.

3. No misrepresentation of any kind shall be made to an assured or to the Insurance Companies.

4. Commission rates shall be fair and equitable, and strictly in accordance with the pre-vailing custom in the locality, and must, where laws or regulations of insurance departments exist, comply fully with such laws or regulations.

5. Members shall conduct them-selves so as to command respect and confidence. They shall work in harmony with one another, with their clients, and the Insurance Companies' representatives, so as to foster a cordial and harmonious relationship with all branches of the insurance business,

and with the general public.

6. Members must be fitted, by knowledge and experience, for the work they undertake. They must not endanger the interests of the public adjust-ing profession, or risk injus-tice to assureds or to the Insurance Companies, by attempting to handle losses or claims for which they are not qualified, and for which they cannot find competent technical assistance.

7. Members shall not engage in

the unauthorized practice of law.

8. Public adjuster members shall not act as a contractor in the mitigation, repair, restora-tion of, or act as a salvor of damaged property (as related to First Party Property Insur-ance Losses).

9. Members shall be cooper-

ative and assist one another in every possible way.

10. Members shall not dissemi-

nate or use any form of agreement, advertising, or any printed matter that is harmful to the profession of public adjusting, or which does not comply with the rules and regulations of the Insurance Department of the state in which such member is professionally engaged, or which might subject public adjusting and public adjusters to criticism or disrespect.

NEW LEADERSHIP ELECTED AT 2016 NAPIA ANNUAL MEETING The National Association of Public Insurance Adjusters elected new leadership at its 2016 Annual Meeting last June. Voted in as President was Diane Swerling, SPPA, Vice President and Principal of Swerling Milton Winnick Public Insurance Adjust-ers, Inc. (SMW), Wellesley Hills, Massachusetts. She succeeds outgoing President Scott deLuise, SPPA of Adjusters International/ Matrix Business Consulting, Broomfield, Colorado. Since becoming active in NAPIA, Swerling has served on many committees and has been involved in leadership roles as a director and officer. As president, she has pledged to be engaged in all facets of the association, including education, membership and legislative/regulatory advocacy. In addition to her post as SMW vice president, Swerling focuses on her firm’s most complex and significant cases, including major residential, business and personal property losses, and business in-terruption claims. In addition to representing clients, she manages all internal operations at the firm. She attained her Senior Profes-sional Public Adjuster (SPPA) designation in 2009. "I am pleased to be voted president of NAPIA," said Swerling. "This is a very high honor, especially since I have been elected by my peers. I look forward to working with our members and the NAPIA leader-ship to meet whatever challenges are presented to our association and the public adjusting profession during my term."
