Contaminated Land It is a reguiremer or Environmentaf Protection Act 1994 that i, an owner or occupier of lend becomes aware a Notifiable Activity (as defined by Schedule 2 of the En v;ionmenfal Protection Act 799:x) is being carried out on :he land or that the land has been affected by a hazardous contaminant, they must, wilhin 30 days tiler becoming so aware, give notice to the Erw:ronmental Protection Agency.

Air When requested by the administering authority, dust end particulate monitoring must be undertaken to investigate any complaint of environmental nuisance caused by dust and/or particulate matter, and the results notified within 14 days to the administering authority following completion of monitoring. Monitoring must be carried out at a place(s) relevant to the powitiaily ail acted dust sensitive place and at upwind control sites and must Irclude: a) for a complains alleging dust nuisance, dust deposition; and b) for a complaint alleging adverse health effects caused by dust, the concentrat en per cubic metre of particulate matter with an aerodynamic diameter of lase than 10 rnicrometre (pm) (PM10) suspended in the atmospherr over a 2".hr averaging time.

Air 3: Dust Nuisance.

The release of dust endior particulate mater resulting from the ERA must not cause an am-ironmentai nuisance et any nuisance sensitive or commercal trace.

kir 4: Dust and cart outate matter must not exceed the following levels when measured at f: ny nuisance lensitive or commercial place: a) Dust deposition of 120 millirams per square metre per day, when monitored i.s accordance with Australian Standard AS 3580.10.1 of 2003 (or more recent efgtions); OR b) A concentration e particulate matter with an aerodynamic diameter of less than 10 microaletre (pm) (F1/110) suspended in the atmosphere of 150 micrograms parr cubic metre over a 24 hour averaging time, at a nuisance sensitive or commercial place downwind of the site, when monitored in accordance with: - Australian Standard AS 3580.9,6 of 2003 (or more recent editions) 'Arriblen' air - Particulate matter - Determination of suspended particulate PM10 high-voitime sampler with size-selective inlet -Gravimetric method';

- any alicrriaLve method of monitoring PM10 which may be permitted by the 'Air Quality Sampling Manuel' as published from time to time by the administering authority.

Air 5: Take reasonable and practicable measures necessary to prevent the release of windblown dust from any vehicles used for transporting sand extracted from the site. Reasonable and p;acticable measures may include but are not limited to: a) wetting down loads prior to transport: b) covering loads with tarpaulins or similar material for the duration of transport; and c) clearing of spillages from side rails, tail gates and draw bars of vehicles prior to and afer deliveries.

Air 6: Trafficabte areas must be maintained using reasonable and practicable measures necessary to minimise the release of wind blown dust or traffic generated dust to the atmosphere. Reasonable and practicable measures rna.:,? include but are not limited to: a) sealing. with suitable material; b) using water sorsys; c) adherence to spied limits; and

Land 2: Rehabilitation of disturbed areas must take place progressively es works are staged and new areas of extraction are commenced or when: a) the economic potential of the resource within a disturbed area has been exhaucted; b) a disturbed area is no longer required for the continuation of the ERA; or c) a disturbed area, including sedimentation ponds, is of no further beneficial use to the ERA.

Noise 3: Noise MoniielIg.

When requested by the administering authority, noise monitoring must be undertaken to investigate any complaint of noise nuisance, and the results noirred within 14 days to the administering authority. Monitoring must include- - LA 10, aei, 10 mins - IA 1, adj, 10 mins - the levet and frequency of occurrence of impulsive or 'anal noise; - atmospheric conditions including yt?nci speed and direction; - effects due to extraneous factors such as traffic noise; and - location, date end 'kat; of recording.

Noise 4: The method of rrisasurement and n;poning of noise levels must comply with the latest ec,itfon of the Environmental Protection Agency's Noise Measurement Manual.

The operator or the ERA must re-::ore the following details for all complaints received and provide this information to the administering authority on reouest: a) lime, date, name and contact details of the complainant; b) reasons to: the complaint; c) any investigator's undertaken;
