We have your buyer or tenant surrounded. Our four computer linked offices cover the HA9, HA0, HA1, NW10, NW9, NW6, NW2, and UB6 postcode areas. Each property is actively marketed through the offices and matched to over 5000 qualified registered applicants. Once your property is listed with Daniels a link to your property will be immediately emailed and a SMS message sent to every suitable buyer or tenant prior to the commencement of the full marketing program.

choosing the right serviceWE OFFER 3 LEVELS OF SERVICES FOR LANDLORDS

Introductory Service:

This service is an ideal service for experienced Landlords and those who have the time and expertise to deal with their own management and rents. We will market your property, accompany viewings, negotiate with suitable Tenants, reference the Tenants, prepare the Tenancy and all Legal notices and arrange for them to move in. We will collect 1 month’s rent in advance and usually the equivalent of 1 month’s rent to be held as a deposit. For those less experienced we would recommend one of the services that offer you the full support of the Daniels staff and full knowledge of the latest Legislation to ensure you are always protected and in the best possible hands to deal with any issues that may arise.

Rent Processing:

For those Landlords who feel they have the time to deal with the day to day management of their property but don’t want to get involved in the event of rental arrears then this is the service for you. Clearly we will carry out all of the previous services but additionally we will ensure that we chase the Tenants as hard as legally possible should the rent be late at any time. We tend to find that most Tenants who pay their rent through an Agent are more likely to meet their obligations as they know that otherwise they will be vociferously pursued for their outstanding payment.

Management Service:

If you want to Let your property and just receive your rent each month without any of the worries then this is the service to choose. Your property will be looked after by our dedicated management team as if it was one of their own. We will prepare the inventory/schedule of condition, arrange the move in, carry out regular inspections, deal with any issues related to the property whatsoever on your behalf. We only use contractors who have proved their standard of work is good, have professional indemnity insurance and have signed a contract with us guaranteeing their work. We do this so you don’t have to worry that when something goes wrong, we’ll take care of it for you.

Our Rental Warranty Service:

We have a choice of policies available which we would recommend to you. Some of the features available are:

- Cover for the total monthly rent - 100% of the monthly rent paid for up to 6 months - A further 50% of the rent paid for up to 2 months after vacant possession has been obtained, whilst Daniels look for new Tenants - Up to £25,000 of Legal Expenses to cover eviction costs if your Tenant fails to pay the rent.

Inventory & Condition Report

It has always been essential to have an Inventory & Condition report carried out but never more so since the registration of deposits has become a Legal requirement. Under the terms of the deposit registration scheme you will only be able to make deductions from the Tenants deposit either with agreement with the Tenant, or if there is a dispute, you will need to provide documentary evidence to an independent arbitrator who will make a decision on whether any deduction is valid or not.

Professionally prepared inventories take time and experience and Landlords who try to save money by doing it themselves can sometimes find this was a false economy. Remember if you do not describe an item properly, accurately and clearly then in the event of dispute the Tenant is likely to walk away without having to pay you compensation. Even unfurnished properties need an inventory, as there will be walls and floor coverings, kitchen units, bathroom fittings etc.

SOME LEGAL INFORMATION FOR YOU

Safety Legislation & Duty of Care Explained

Landlords have a duty under British Law to ensure that the properties they rent and all of its contents are safe for Tenants, occupants and the public are not put at risk. Current Legislation places the responsibility of this on the Landlord. Failure to comply is a criminal offence and Landlords cannot only be sued but can face prison for breaches. We can arrange for the necessary safety checks to be carried out on your behalf if requested to do so.

The Gas Safety (Installation and Use) Regulations 1994 (Amended 1998)

This requires Landlords to have an annual safety check carried out by a Gas Safe registered plumber. Any faults found must be promptly rectified and it is not possible to move Tenants in without having a copy of a satisfactory Certificate.

The Electrical Equipment (Safety) Regulations 1994

Under this Legislation Landlords are required to ensure that all appliances left at the property are safe for to be used. In order to ensure this, a suitably qualified electrician needs to carry out a Portable Appliance Test on each item. Any items failing the test must be removed and or replaced immediately. You must also leave instructions for each appliance at the property. It is also recommended that you have the electrician carry out a Periodic Inspection of the installation at the same time. Appliances need to be checked annually and the installation generally should be checked every 5 years.

The Furniture & Furnishings (Fire) (Safety) Regulations 1988 (Amended 1989 & 1993)

In 1988 the Government introduced Legislation that stated that all soft furnishings, i.e sofas, beds, chairs etc, provided for rental properties must meet official fire resistant standards and that these furnishings must have a permanently affixed label stating that it complies. If there is no label then proof of purchase will be required that clearly states a description of the furniture. If any item does not comply, or you cannot prove it does, then it must be removed from the property before a Tenancy can commence.

Smoke Detectors

The Building Regulation 1991 requires that all properties built since 1992 must have mains operated smoke detectors fitted on each floor. There are no regulations regarding older properties but we would strongly recommend that a battery operated smoke detector be installed on each floor.

Energy Performance Certificate

It is a requirement to have an Energy Performance Certificate in place before marketing of the property can commence. In essence the certificate will rate just how efficient the property is in the use of gas, electric, insulation etc as well as how much C02 it contributes to the atmosphere. A registered assessor will need to be instructed and they will carry out the assessment and provide a certificate that gives the information of how good/bad the property is and how much it could improve with certain adjustments. The certificate will last 10 years and only needs to be redone earlier should you carry out any major improvements to the property.

Registration of Deposits

Under the Housing Act 1988 (amended 1996 & 2004) it is the Landlords responsibility to register any deposit taken with a Government Approved scheme. Should you decide not to allow us to register the deposit on your behalf it is your responsibility to register the Deposit with one of the Approved schemes and notify the Tenant within fourteen days of the commencement of the Tenancy of the details of the scheme.

We are aware that the above Legislation can appear daunting. That is where we really come into our own by taking this worry away from you. With our many years’ experience this is something that we do on a daily basis with every property we let and so have tried and trusted contractors to ensure that Due Diligence can be displayed should anything go wrong.
