Journée du droit 2009

Bonjour tout le monde,

Les activités de la Journée du droit ont eu lieu cette année le 16 avril sous le thème de « L’accès à la justice ». La Journée du droit

a pour but de sensibiliser le public au droit et à la profession juridique. Cette journée est célébrée partout au pays. Au Nouveau-

Brunswick, l’Association du Barreau canadien a invité les écoles à participer à différents concours. Il nous fait plaisir d’annoncer

qu’Alex Beals, de l’école Forest Hills, a gagné le concours d’affiches; que Candace Mosher et Caitlin Hicks de l’école intermédiaire

St. Stephen ont gagné le concours de photographie; et que Michelle Côté, de l’école secondaire Harrison Trimble, a gagné le con-

cours de dissertation. Chaque gagnant a reçu une médaille et un prix en argent. Les écoles conserveront un trophée jusqu’à l’an

prochain. Le comité de la Journée du droit a travaillé en étroite collaboration avec les écoles à la coordination des conférenciers

invités. Nous voulons remercier tous les avocats et avocates qui ont participé bénévolement à des présentations. Dans différentes

régions de la province, des écoles ont également prévu des simulations de procès.

À Fredericton, nous avons invité d’autres membres de la communauté juridique à organiser des stands d’information pour le public.

Le comité de la Journée du droit espère élargir les séances d’information à l’ensemble de la province, l’an prochain.

Cette année, dans le cadre des activités de la Journée du droit, la Division du Nouveau-Brunswick de l’Association du Barreau

canadien a parrainé des cliniques juridiques pro bono à différents endroits. Nous avions espéré de meilleurs résultats, mais nous

nous reprendrons l’an prochain. Le comité de la Journée du droit tient à remercier tous les avocats et toutes les avocates qui ont

œuvré bénévolement dans les cliniques. Sans bénévoles, la Journée du droit n’aurait pas lieu.

Auto Insurance Update

Since the April 22nd press conference on the release of the CBA economic report on auto

insurance in NB (New Brunswick’s Injury Regulation: Automobile Insurance Profits, Premi-

ums, and Costs), two meetings have been held with the Minister of Justice. These meetings

and press comments from the Minister indicated an openness to the idea of amending the

definition of “minor personal injury” to reflect the original intent of the government in 2003.

Despite positive meetings with the Minister of Justice, and uncontroverted evidence that the

regulation is impacting victims well beyond the stated intention, it appears that the idea of

amending the definition is being vetoed by the Office of the Premier for reasons undisclosed.

Media comments by the Premier show an unwillingness by him to entertain any amend-

ments. Several attempts to meet with the Premier and his key advisors to explore this

unwillingness have been denied.

The CBA is exploring other avenues to force the current government to do what is equitable

for the people of NB. Any assistance from the membership at getting responses from the

Office of the Premier would be appreciated. Obviously with an election looming, it seems

that the government’s attention is now focused elsewhere. A resurgence of the public debate

on the question of auto insurance will certainly resurface in the weeks to come, and until the

election date. Stay tuned …

CBA NB and PLEIS-NB work together

to offer a Legal Speakers’ Bureau

The CBA NB Branch and Public Legal Education and Information Service of New Brunswick

(PLEIS-NB) are pleased to announce that we have joined forces to create an expanded Le-

gal Speakers’ Bureau in the province. Any community group, service organization or special

interest group, as well as the media, can ask us to help them find a free speaker on the law.

Groups can send their request to PLEIS-NB for a speaker to address a monthly meeting, an

annual general meeting, a special event or a workshop. PLEIS-NB will forward the request to

the CBA, which maintains a list of interested members who might be willing to speak on vari-

ous topics. PLEIS-NB is usually able to provide the speaker with handout materials related

to the law information topics requests in English and French. Lawyers interested in being a

speaker, please contact the CBA NB Branch at [email protected] or 506-452-7818.
