Indigenous Procurement Policy – Needs to be reviewed in conjunction with Clause 30 of

the Tender Conditions. Different clauses apply based on the value of the tender. If the

value is under $7.5m inc GST the Tenderer will be required to use ‘best endeavours’ to

increase Indigenous Participation on the contract. If the value is over $7.5m inc GST the

Tenderer must submit an Indigenous Participation Plan as part of their submission which

will then be appended to the contract should they be successful. The successful

contractor must outline how they will achieve the mandatory minimum requirements of

their Plan throughout the life of the contract.

Federal Safety Commissioner (FSC) Accreditation Scheme - Applies for construction works

if contract >$4M inc GST. If applicable, a contract cannot be signed with a tenderer who

doesn’t have this accreditation.

Special Conditions of Tender – can vary from tender to tender and should be examined

and understood by the Tenderer

for the Works. Table must be complicated and must be in line with the Contract

Declaration of Compliance must be signed correctly AND evidence of eligibility to

lodge a tender must be attached (i.e. ABCC Letter of Compliance or Self-

declaration of eligibility depending on the Contractor’s enterprise agreements).

Workplace Relations Management Plan (WRMP)

WRMP is required for all tender submitted above $5m (including GST). WRMP

template is provided on the ABCC website at https://www.abcc.gov.au/building-

code/workplace-relations-management-plans which also provides a guide to

assessment of the plan. A contract cannot be awarded until the plan is approved

by ABCC.

Where required, the WRMP should be submitted as part of Tender Schedule J. The

tenderer does NOT submit directly to ABCC.

Tender Conditions clause 3.1 Conforming Tender, including ATM Close Date and ATM

Tenders are evaluated in three stages:

Stage 1 - an initial screening based on the compliance criteria;

Stage 2 - a detailed evaluation against the evaluation criteria;

Stage 3 - an assessment of value for money and final ranking.

The Tender Evaluation Board can choose to develop a shortlist at the end of any stage

and Tenderers that do not make the shortlist will not proceed further in the evaluation.

Alternative proposals with respect to the Design Documents are evaluated on value for

money

A few key things to remember during the tender period and when submitting your

tender….

Tenderers who have not registered for the Industry Briefing will not be allowed to take

part in the Industry Briefing.

Late Tenders or Tenders not lodged via AusTender cannot be accepted unless there is a

proven issue with AusTender.

Whilst not a requirement, the submission of tenders in parts is to be kept to a minimum.

If in multiple parts, please number each document to assist in compilation. Submitting

an excessive number of individual files, folders and zip files can be confusing.

Not completing all minimum form and content requirements resulting in Tender non-

compliant and therefore not evaluated.

Pay particular attention to Tender Particulars: Conditions of Tender. If these aren’t

followed, this will result in a non-compliance.

Consider the audience and don’t rely on implied details. Responses should be succinct,

relevant to the project, include accurate and sufficient detail and not presume the

reader knows anything about the company.

Communication during a tender – must be in writing and through the Contact Officer as

specified on AusTender

Please ensure all questions in the Schedules are answered. If you don’t answer all of

them, it makes it hard to achieve a high technical score.

Exclusion of scope for reasons unknown/not explained – submitting an alternate bid

without a complying one may be deemed non-conforming.

Tender submissions need to be specific to the project (not generic).

It is not uncommon to receive information in an altered format. Ensure that all

information conforms with the information requested in each schedule. Missing

information is likely to equate to a lower score.

The Tender Documents are designed in such a way that if a tenderer followed the

template, it would be adequate information for the Board to make a decision.

Reformatting the document generally makes it harder to evaluate.

Recommend successful tenderers request a tender debrief, as well as unsuccessful

tenderers.

Debriefs are a two-way street – feel free to give us feedback!
