    Ouropposition[toEPA'spermitreviews]hasbeenmoreabouttheprocessthanithasbeenaboutthescience.Thereisalotofvaliditytotheconcernsaboutthedownstreamimpacts.

    Ithinkthatsthechangeindirectioneveryoneisgoingtohavetomaketomeetthedownstreamwaterqualityrequirements.Idontseeanychoicebuttoreducetheimpacts.

    Well,fourmonthswentby,andWVDEPhadntreleasedanynewpolicies,rulesorwaterquality

    guidelines.EPAwentaheadwithitsownactions,proposingatoughguidelineforconductivity,aimedataddressingincreasingconcernsaboutwhatmountaintopremovalisdoingtowaterqualitydownstream.AsfarasIknow,WVDEPstillhasntpubliclyreleasedanynewrulesitself,thoughRandytoldmelastweekthattheyweregoingtodososometimesoon.

    Butgosh,whatdowehavetoday,inareportfromVickiSmithofTheAssociatedPress?Checkitout:

    WestVirginiastopenvironmentalofficialsayssurface-minepermittinginhisstateisgettingtougherfederalscrutinythaninanyoftheotherfivestatestheEnvironmentalProtectionAgencyhastargeted,andthecontinuingconflictovernewstandardswilllikelyendupinlitigation.

    Weareeithergoingtobeaplaintiff,adefendantoranintervener,DepartmentofEnvironmentalProtectionSecretaryRandyHuffmantoldTheAssociatedPress.Icantpredictrightnowwhichonewellbe.

    SeveralDEPemployeesareattendingameetingwithEPAstaffinPittsburghonWednesdayandThursdayovernewwater-qualitystandardsimposedApril1onsixstates:WestVirginia,Kentucky,Pennsylvania,Ohio,VirginiaandTennessee.Huffmanarguesthestandardsarenotonlyunattainable,butalsobeingunfairlyenforced.

    Theyarewrongonalotoflevels,Huffmansaidoffederalregulators.IfwhatEPAisdoingisillegal,theywillpaytheprice.

    Withoutevidenceofanysignificantimpactontherestoftheecosystembeyondthediminishednumbersofcertaingenusofmayflies,theStatecannotsaythattherehasbeenaviolationofitsnarrativestandard.

    ThegreaterconcernfortheDepartmentofEnvironmentalProtection,however,asprotectoroftheStateswaterresources,istheunintendedconsequencesoftheEnvironmentalProtectionAgencysrecentactionsthathavethepotentialtosignificantlylimitalltypesofmining.
