Regulation1698/2005 - FEADR (ELER)The support granted through Axis 2 will be targeted on the measures indicated in Article 36 :

(a) Measures regarding the sustainable use of the agricultural surface through:i. payments for naturally handicapped areas for farmers of mountainous regionsii. payments for farmers from areas with a natural handicap, other than those from

mountainous regions; iii. Payments for Natura 2000 and payments related to WFD (Directive 2000/60/EC)iv. Payments for agro-environmental measuresv. payments for the welfare of animalsvi. support for the unprofitable investments

(b) Measures targeting at the sustainable exploitation of forest areas through:i. First afforestation of agricultural landii. First installment of agro-forestry systems on agricultural landiii. First afforestation of non-agricultural landiv. Natura 2000 paymentsv. payments for woodlands and environmentvi. reconstruction of the woodland potential and implementation of some prevention actions;vii. support for the unprofitable investments.

Conditions for the measures targeting at the sustainable use of agricultural land

Article 38 –Natura 2000 and Directive 2000/60/EC related payments

The support stipulated in Article 36(a) (iii) will be granted yearly and for each hectare of agricultural land to the farmers in order to compensate the assumed costs and the lost income as a result of the disadvantages from the areas stipulated in the directives 79/409/EEC, 92/43/EEC and 2000/60/EC.The support will be restricted to the maximum amount of money stipulated in the Annex. For the payments related to Directive 2000/60/EC, further detailed rules will be established, stipulating also the maximum amount of money that can be granted, according to the procedure from Article 90 (2).

Conditions for measures targeting at the sustainable exploitation of forests Article 46 –Natura 2000 payments

The support envisaged in Article 36(b)(iv)will be ensured yearly for each hectare of woodland, to the private owners or their associations, in order to compensate the costs and the income lost as a consequence of the restrictions resulted from implementing the Directive 79/409/EEC and 92/43/EEC in the respective area. The support will be established between the minimum and the maximum amount provided in the Annex.

Conditions for the measures targeting at the sustainable use of agricultural land

Article 50 – Eligible sites

Agricultural zones within designated Natura 2000 sites according to the Directives 79/409/EEC and 92/43/EEC and (agricultural) areas within the catchment area of management plans of river basin areas according to the Directive 2000/60/EC will be eligible for payments according to Article 36 (a) (iii).

Designated Natura 2000 sites in forest areas according to the Directives 79/409/EEC and 92/43/EEC will be eligible for compensation payments as stipulated in in Article 36(b) (iv).

Eligibility conditions

The eligibility conditions for a farm The eligibility conditions for a farm : : Use of an agricultural land with a surface equal or larger than 1 hectare. This surface cannot be formed of plots of land smaller than 0,3 hectares. Maintaining the above mentioned agricultural land in a good agricultural and

environmental condition (GAEC)

the arable lands;3. elimination of the unwanted vegetation, of the shrubs and bushes from the

permanent pastures;4. protection of permanent pastures – maintaining the areas covered with permanent

pastures at the level registered on 1st of January 2007.””

Modifications within the LIFE programme

- LIFE Environment will be continued within the pilot eco-innovations of the CIP (Competitiveness + Innovation Programme for entrepreneurs)

- LIFE Third Countries will be continued within the framework of the European Neighbourhood Policy Programme

- LIFE+ will be focussed on nature conservation, technological innovations will be eligible only in exceptional cases

- Programme period will be adapted to Structural Funds Period 2007-2013

- Programme will be delegated mainly to the (New) Member States – who will be responsible for it in Romania?

- Former LIFE – themes will be eligible also under the 7th RFP and EAFRD
