Approaching Baltimore from the West, 1802

altimore, as seen in the distance in this 1802 view from the west, was the third largest city in America. The vantage point here may be from what is now Mt. Olivet Cemetery on Frederick Avenue. Actually a conglomerate of three settlements, Baltimore Town, Jones Town, and Fells Point united into one in 1797, the young city of c. 27,000 people had just witnessed its fi rst major wave of non-English speaking immigrants. Wealthy French-speaking émigrés and their slaves from 1790s strife-torn Haiti added a cosmopolitan air to the bustling thoroughfares fi lled with commerce and roaming pigs that helped dispose of the urban waste.

The Heavy Vehicle Use TaxFunding Our Nation’s Highway Programs and Leveling the Playing Field

Groups Exempted from the HVUTThere are a number of groups that receive exemptions from the HVUT, including:

● The Federal Government

● State or local governments, including the District of Columbia

● The American Red Cross

● Nonprofit volunteer fire departments, ambulance associations or rescue squads

● Indian tribal governments (for vehicles used in essential tribal government functions)

● Mass transportation authorities (under certain conditions)

Vehicles Exempted from the HVUT● Commercial vehicles traveling fewer than 5,000 miles annually

● Agriculture vehicles traveling fewer than 7,500 miles annually

● Vehicles not considered highway motor vehicles – e.g., mobile machinery for non-transportation functions, vehicles specifically designed for off- highway transportation, and non-transportation trailers and semi-trailers

● Qualified blood collector vehicles used by qualified blood collector organizations

Exempt carriers may be required to file tax forms with the IRS or notify the local department of motor vehicles of the exempt status being claimed.

The Heavy Vehicle Use Tax and Who Pays ItThe heavy vehicle use tax or HVUT is a fee assessed annually on heavy vehicles operating on public highways at registered gross weights equal to or exceeding 55,000 pounds. The gross taxable weight of a vehicle is determined by adding the unloaded weight of the motor vehicle and any trailers together with the maximum load customarily carried on-road by the truck-trailer combination. The maximum HVUT is $550 per year.

How It Is PaidIRS Form 2290 is used when paying the HVUT. The Internal Revenue Service (IRS) is responsible for collecting the tax, so all payments are made to the IRS. Payments made in 2007 cover the period from July 1, 2007 to June 30, 2008. For new vehicles, IRS Form 2290 must be filed by the last day of the month following the month of first use.

Once the carrier has paid the tax, proof of payment must be submittedwith their registration renewal to relevant state authorities. Proof of payment may generally be provided either in the form of a receipted and stamped Schedule 1 from IRS Form 2290 or a copy of a completedIRS Form 2290 with a front and back copy of the cancelled check used to make the payment.

For large carriers with 25 or more vehicles, electronic filing is accom-plished using a credit card or other means of electronic payment. When presenting proof of payment, the taxpayer must have the original electronic receipt or a copy of the receipt and a credit card or other bank statement showing evidence of the transaction.

What Is the Heavy Vehicle Use Tax?

The code of federal regulations establishes a framework for HVUT enforcement in 23 CFR 669 and assigns responsibilities to multiple federal and state agencies.

Internal Revenue ServiceThe IRS is responsible for HVUT collections and taxpayer audits.

StatesStates are required to obtain proof of HVUT payments when registering heavy trucks subject to the tax. Further, 23 CFR 669.11 requires that the Governor of each state certify HVUT compliance prior to July 1 of each year. In so doing, the Governor or his or her designee must submit a letter with text prescribed in 23 CFR 669.9 and contained within Form FHWA-1563 certifying that the state is obtaining proof of payment as a condition of registering heavy trucks subject to the HVUT.

Federal Highway AdministrationThe FHWA is required under 23 U.S.C. 669.21 to periodically review the state’s procedures for complying with HVUT requirements. This review must include the inspection of registration records and other supporting documentation. Part 699 of the Federal-aid Policy Guide requires FHWA to conduct HVUT compliance reviews at least once every three years for each state in the nation. Responsibility for conducting these reviews falls to the division offices.

If a state fails one of the periodic compliance reviews, the Secretary of Transportation has the authority to withhold up to 25 percent of the state’s Interstate Maintenance funds. A finding of non-compliance could, therefore, cost the state millions in lost highway funding. Thus, it is imperative that states take measures to ensure HVUT compliance.

coastal resources contribute

to its economy, environment

and quality of life.

With these remarkable resources comes

great responsibility. Coastal resources

must be protected and conserved, yet

communities must be able to thrive

economically. A balance is needed

between human demands and

conservation of the resources that make

Maryland such a unique place to live,

work and play. Maryland’s Chesapeake

and Coastal Program strives to achieve

that balance.

National Issues, Local Solutions In 1972, Congress responded to the rapid

deterioration of coastal areas throughout

the nation by passing the Coastal Zone

Management Act, or CZMA. The main

objectives of CZMA are to “preserve,

protect, develop, and where possible,

restore or enhance the resources of

the nation’s coastal zone.” The key

feature of CZMA was the creation of a

partnership among federal, state, and

local governments. CZMA’s success is a

direct result of the ability of states to

work with local communities to design

coastal management programs that

address specific issues and priorities

affecting local areas.

How the Maryland Chesapeake and Coastal Program is OrganizedThe Maryland Chesapeake and Coastal

Program, administered by the Maryland

Department of Natural Resources, is a

partnership among local, regional and

state agencies. The Program collaborates

with many private organizations, such

as local land trusts and economic

development groups. Through this

networked approach, no one agency or

department is responsible for Maryland’s

entire coast. Rather, all partners help to

ensure its proper management.

Building on Success: The Chesapeake and Coastal Program at WorkOver the past three decades, this

partnership has helped Maryland work

to reduce the environmental impacts of

coastal development, resolve significant

conflicts between competing coastal

uses and provide critical assistance to

local governments in coastal planning

Established in 2007, our vineyards are situated on rolling hills just south of

Davidsonville, Maryland. When we began our first experiments with 150

vines, the goal was clear: to practice sustainable agriculture and produce

exceptional wines. As ninth generation custodians of this historic farmland,

and as demanding winemakers, we are committed to using viticultural

practices and winemaking techniques that permit full expression of the

unique deep sandy loam ‘Dodon Series Soils’ that lend our wines distinctive

aromatics and subtle minerality. Now, five years later, we have selected the

best varietals to grow on our land, planted our vines with the enthusiastic

help of our family, friends, and neighbors, and often celebrated with a good

party after a hard day’s work. Merlot, Cabernet Franc, Petit Verdot and

Cabernet Sauvignon cover the southern facing hills, while Sauvignon Blanc

and Chardonnay are planted on the north facing slopes.

Using only grapes grown on our farm, our vineyard and winemaking

techniques emphasize individual attention to each cluster and protect the

quality of the fruit. We believe that our deep soils and abundance of

Southern Maryland sun are the keys to producing rich, balanced, aromatic

wines. In other words, it is the unique qualities of the site that determine

the product (“vins de terroir”), not a winemaker with a strong stylistic vision

(“vins d’effort”). The result is a combination of old world and new world style

that is particular to this area of Southern Maryland.
