I want to personally congratulate Mick McHale, president of the PBA inSouthwest Florida (Sarasota) for being appointed to the CJST.

The CJST, for those who do not know, is a commission that decides whether ornot an individual continues to be a police officer in the state of Florida. Over theyears the makeup of the commission has changed drastically. When ErnieGeorge (of the Florida PBA) was appointed, he noticed that the CJST washeavily weighted toward management types (chiefs, sheriffs and administrators),who we felt were going overboard with the discipline they were handing out.Ernie continued to argue and fight for the “little guy,” but it seemed he wasalone in his fight. The PBA appealed to the governor and legislature to placemore rank and file officers on the commission and, more importantly, to havethe appointees recommended by the police union.

What a change. In the past the 19-member commission had just three rank andfile positions. Today, with the appointment of Mick McHale, there are seven. Atleast now members who must go in front of the CJST have a chance for a fairand impartial hearing.

Bisbee, Ariz. – A U.S. BorderPatrol agent who fatally shot a Mexi-can illegal entrant has been chargedwith murder by the Cochise CountyAttorney who claims the shooting wasnot justified.

Agent Nicholas Corbett has beencharged with four counts of homicide:first- and second-degree murder,manslaughter and negligent homicide.Corbett shot and killed FranciscoJavier Dominguez Rivera on January12 about 150 yards north of the U.S./Mexican border. The incident oc-curred while the agent was attemptingto catch the man and three otherstrying to enter the country illegally.

According to a statement from theCochise County Attorney, “Theevidence shows that at the time hewas shot, Mr. Dominguez Riverapresented no threat to agent Corbettand agent Corbett did not act inreasonable apprehension of imminentdeath or serious physical injury.”

Brandon Judd, vice president of Local2544, the Arizona Chapter of theNational Border Patrol Council, saysthe decision is part of a pattern ofpolitically motivated prosecutionsagainst Border Patrol agents. Accord-ing to Judd, the matching testimonyfrom the three witnesses (those whowere with Dominguez Rivera at thetime) has more to do with their bloodties and influence from the MexicanConsulate that what actually hap-pened.

Several days after the shooting,Mexican President Felipe Calderoncondemned the shooting, and theMexican Embassy in Washington senta diplomatic note to the U.S. Depart-ment of State demanding an exhaus-tive investigation. A month later, the

National Border Patrol Council claimedthat the Mexican Consulate was al-lowed to interview some of the sixwitnesses before U.S. investigators.Both the Cochise County Sheriff’sOffice, who investigated this case, andthe Mexican Consulate deny theseclaims.Source: The Arizona Daily Star

Washington, D.C. – The SupremeCourt has given cops protection fromlawsuits stemming from high-speed carchases by ruling against a teenager whowas paralyzed after his car was run offthe road.

In the 8-1 decision, Justice AntoninScalia said law enforcement officers donot have to call off pursuit of a fleeingmotorist when they reasonably expectthat other people could be hurt. Hesuggested that officers can take mea-sures to stop the car without puttingthemselves at risk of civil rights law-suits.

Former Coweta County sheriff’s deputyTimothy Scott rammed a fleeing blackCadillac on a two-lane, rain-slickedroad in March 2001. Victor Harris, the19-year-old driver, lost control andwent over an embankment at 90 milesan hour. Harris was paralyzed in theaccident and sued Deputy Scott.Source: Associated Press

Little Rock, Ark. – Arkansaspolice have discovered the latestversion of methamphetamine in theirstate: “Strawberry Quick.”

Meth has been cut with a variety ofsubstances, from lollipops to high-sugar sodas, in order to make the druggo down easier for first-time users.“Strawberry Quick” first came to lightin January, after the Nevada Depart-ment of Public Safety issued a bulletindescribing this kind of meth there.DEA agents have since heard reportsof flavored meth in Missouri, Texas,Washington state and Wisconsin.

“Strawberry Quick” uses powdereddrink mix to give the drug a pink colorand impart a sweet taste that makesthe meth more palatable and partiallymasks its harsh taste.Source: Associated Press

The Florida House of Representatives has passed ameasure calling for the divestment of the statepension fund from Iran and Sudan. The bill, SB

2124 has previously passed the Senate and is now in thegovernor’s hands.

The measure requires the state to review the Florida statepension system and remove any investments in compa-nies doing business in Iran’s petroleum-energy sector orwith the Sudanese government. The billdirects the State’s investors to avoidinvestments in potentially sanctionablecompanies.

“The best way to shut down terrorregimes, short of military attack is toexert economic pressure. No Floridaretirement dollars shall be used to feedour enemies the bullets for their guns,”said Rep. Ari Porth, house sponsor of thelegislation.

Detective Joe Kessling was awarded BSO’s Detective ofthe Year Award in April. Joe earned this honorthrough his commitment and tenacity in seeing cases

through to the end.

Kessling is a 27-year law enforcement vet, with most of thattime spent as a detective. But, as Sgt. Steve Feeley, who nomi-nated him, says, “Joe… works with the vigor of a rookiedetective. His tenacity and determination are incredible.”Sgt. Feeley cited severalcases over the past yearwhere Joe’s tenacity anddetermination got the jobdone. These include theinvestigation of a gangshooting that resulted inthe arrests of four differentmembers of the LatinKings gang and the identi-fication of at least 24others.

Kessling was also recog-nized for his work making emergency repairs to other BSOemployee’s homes so that those employees could focus onhelping the citizens of Broward County,

Joe received employee of the month twice last year for hiswork in Regional Investigations.

Legislative News

Dear Members,Overall, the 2007 Legislative Session was a disappointment. That was due to the short-

fall in the State’s budget. Consequently, the bills we introduced to enhance FRS did not

pass. Those included allowing for the purchase of Special Risk credit for certain acad-

emy time, changing the Special Risk upgraded credit from two to three percent and

increasing the subsidy paid to FRS retirees. That being said, the PBA was successful in

passing some of our non-economic bills. Of those bills that passed, the one that affects

us here in Broward County is HB 723HB 723HB 723HB 723HB 723, which strengthens the penalties for violations of

the Law Enforcement Officers’ Bill of Rights during internal investigations. This

legislation will require that an officer under investigation and the investigator con-

ducting the investigation tell the truth in both statements and reports while adhering

to the Law Enforcement Officers’ Bill of Rights through the course of the investigation.As always, I would like to thank all of the Executive Board members as well as the

PBA Representatives who took their valuable time to go to Tallahassee in order to

lobby on your behalf. but enough people skipout on their civic duty,that a new and ominouskind of scam has surfaced.Fall for it and your iden-tity could be stolen,reports CBS.

In this con, someone callspretending to be a courtofficial who threateninglysays a warrant has beenissued for your arrestbecause you didn’t showup for jury duty. Thecaller claims to be a jury coordinator.

If you protest that younever received asummons for jury duty,the scammer asks youfor your Social Securitynumber and date ofbirth so he or she canverify the informationand cancel the arrestwarrant. Sometimesthey even ask for creditcard numbers.

Give out any of thisinformation and....Bingo! Your identityhas just been stolen.The scam has been

reported so far in 11 states. This scam

On January 2, Paul noticed that fellow Court Deputy(and PBA member) Joseph SafonteJoseph SafonteJoseph SafonteJoseph SafonteJoseph Safonte appeared to be ill andrecognized the symptoms as that of a heart attack. Weissmade sure that EMS was called so that Safonte could getimmediate medical attention.

Safonte survived, and his doctor believes that had he notreceived prompt treatment he would not have survived.Well done, Paul!
