Electronic lodgement of training contract The AASN Provider may electronically lodge (e-lodge) the training contract when received in the approved form, and: 1. the Registered Training Organisation (RTO) has ‘accepted’ their role as Supervising Registered Training Organisation (SRTO). The AASN Provider facilitates the signing of a training contract in racing industry qualifications, e-lodges the training contract and forwards a copy of the training contract to Racing Queensland. Access to Hard Copy Training Contracts, SmartForm training contracts, paperwork and/or file notes • Where it is necessary for DET Qld staff to access either the hard copy of a training contract, the SmartForm training contract,

supporting paperwork or file notes held by an AASN Provider, the request will be forwarded to the AASN Provider from OPRA. The AASN Provider is required to provide electronic copies of all paperwork and training contracts to OPRA unless otherwise requested.

Training Contract Status When a training contract is e-lodged the contract is assessed and given a status of either:

1. Approved – if the contract meets all registration requirements and no validations are indicated, the contract is automatically registered and a registration number issued.

2. Auto-Return – if a critical error is identified, or critical data is incorrect, the contract is returned automatically to the AASN Provider with an error message. An example of an error message may be: Contract lodged prior to commencement date of training contract, or apprentice/trainee mobile number is invalid.

3. Refused – where the AASN Provider has exercised their delegation and refused to register the training contract. The refusal is identified by a note advising of reasons for refusal.

4. Returned – where the AASN Provider has identified an issue and requires the return of a training contract that has been entered in TYIMS but before the TYIMS overnight data transfer is performed, the AASN Provider contacts the DELTA Helpdesk.

5. Under Review – where an ad-hoc risk identifier has been indicated. Risk identifiers may be added to stop automatic registration to enable a manual check ensuring the training contract meets registration requirements.

IMPORTANT Provision of false or misleading information may lead to the cancellation of the training contract by DET Qld under the Further Education and Training Act 2014. Parties to the training contract may be requested to reimburse any funding or incentives to the relevant state and commonwealth authorities if it is identified that a party to a training contract or an AASN Provider has intentionally provided false or misleading information on a training contract.

Completing the Australian Apprenticeships – Training Contract SmartForm Step 1 – Employer Details Section Question/Action Guidance Notes

Employer Details Is this an existing or new employer in TYIMS?

A TYIMS ID number is required if existing employer is selected.

Business Details Enter Australian Business Number

• Employers provide their ABN in the training contract • An ABN is a number for business dealings with the Australian Taxation Office

(ATO). An ABN is needed to register for GST and other elements of the tax system.

• Employers are required to register their legal entity name on the Australian Business Register (ABR). This generates their ABN. The problem is that the employers enter their own details on the ABR and the details are not always technically correct. The ABR has the following disclaimer:

"This extract is based on information which was supplied by businesses to the Register of the Australian Business Register. Neither the registrar of the ABR nor the Commonwealth guarantees that this information is accurate, up to date or complete. You should consider verifying this information from other sources."

When a legal name and ABN change between the commencement of the apprenticeship/traineeship and when the training contract is being signed, add details in the “employer comments” box.

Legal Name • When entering data into the legal name field, (not for a trust) the data must match how the name is shown on the ABR site, including any dots and spaces. For example if the ABR site shows legal name as Fred Jones Pty. Ltd. Ensure you include the dots and the space between Pty(dot)(space)Ltd(dot)

• The correct legal entity name for the business that 'owns' the ABN must be stated in the legal name of employer section of the training contract even if the ABR is incorrectly completed. If it is ascertained that the ABR is incorrect, details of the correct name must be provided with the training contract. If no details are provided and the legal name of the employer entered in the training contract is different to the legal entity name registered in the ABR the contract will be returned to the AASN Provider with a request for the correct details to be provided. This will delay the registration process.

• The legal name is what establishes the legal existence of an organisation and only legal entities can enter into contracts.

• A legal entity is a body or person that can take legal action in its name, or have legal action taken against it in its name. This will usually be an individual person's name, the names of one or more of the persons in a stated partnership, a company name or the name of an incorporated association.

• The ABN being entered MUST match the legal name as identified on the Australian Business Register (ABR); this includes Group Training Organisations (GTOs) and Principal Employer Organisations (PEOs).

• When the details are checked automatically through electronic registration:

o If the legal name on the contract matches the ABR and the ABN exists in DELTA, but existing legal name in DELTA is different, the employer and existing apprentice/trainee records will automatically be updated to reflect the new legal name on this contract.

o If it is a new legal name and new ABN - a new record will be created. The ABR overrides any existing active legal name in DELTA.

o If the employer and apprentice/trainee have the same name, the contract will be reviewed.

Delays in registration of the training contract will occur if the legal name does not match the ABR. ABR can be accessed at www.business.gov.au Companies Companies are registered with the Australian Securities and Investment Commission (ASIC) under the Corporations Act 2001 (Commonwealth) and have an Australian Company Number (ACN). Technically a company is called a body corporate or a

corporation. It will usually have Proprietary (Pty), Limited (Ltd), Pty Ltd (P/L) or Corporation in its name. Incorporated Associations Incorporated Associations are incorporated in Queensland under the Associations Incorporation Act 1981 (Qld). An association is a body, association, society, or other entity formed, for a lawful purpose. Incorporated associations have 'Inc.' in their name. Partnerships and Sole Traders A partnership is a business arrangement between two or more individual persons for the purpose of carrying on a business; however, they are not registered as such. A partnership name might be 'John and Cathy Smith'. However, 'John Smith and Company' (or 'and Co.') is NOT a company in the legal sense. It is a partnership between John Smith and a number of unnamed persons. In this case, either all of the partners would have to be named or the contract could be registered under the name of 'John Smith, a partner in the business of John Smith and Company'. Self Employed Apprentices/Trainees A person cannot be both the apprentice/trainee and the employer under the one training contract as you cannot enter into a contract with yourself. However, if the apprentice/trainee is a partner in the business, the other partner to the business is to sign.

If the apprentice/trainee is a Director or Manager of a company, they can be contracted to the legal entity as an apprentice/trainee, so long as a separate person signs and is authorised to sign. If the employer is a company, another public officer of the company should sign the training contract on behalf of the employer.

Trading Name • The trading name is the name the business is best known by or the name under which the business trades or operates.

• Trading names should be consistent with previous trading names entered. For example if entered as Ascot McDonalds for one contract – do not enter as McDonalds Ascot for the next contract. Trading names do not have to match the ABR for a Training Contract to be approved. Minor variations between TYIMS and DELTA that do not reasonably affect the identification of the business are

accepted. The AASN Provider staff can accept added or missing business descriptors (Inc, Pty Ltd, etc): changed suffixes (-ing, -al, -ly,-s); different punctuation; and variations in abbreviations. The following examples illustrate the principles that the AASN Providers’ staff should apply:

Minor variations: Johns Camping >Johns Camp Mart or Johnno's Camping World Significant variations: Johns Camping > Freds Camping or Smiths Camping Important: AASN Providers should only seek amendment of Trading Names in DELTA/TYIMS for: • significant variations, or • corrections of typographical errors, or • if it is important to and directly requested by an employer.

If the business is a trust, the name of the trustee

• If the apprentice/trainee is identified as the trustee of a trust, the contract can only be made if another trustee exists.

• If the employer is a trust, the full name of the legal entity (trustee) behind the trust must be provided even though it will not be on the ABR. Be aware that registration may be delayed by not including the legal entity (trustee). The Trustee can be an individual, a number of individuals or a company. The Deed of Trust document will provide who the trustee/s is/are. If multiple Trusts, list a trustee for each trust.

Trusts - this includes discretionary and unit trusts For legal names, Trusts must have a Trustee’s name (can be either a company or an individual) included in the legal name. This applies regardless of whether the employer is a Family Partnership or Other Partnership etc. If there is a Trust as part of the employer legal name, a Trustee must be supplied – the AASN provider should site the Trust document to verify this information. If the training contract does not include the legal entity of the Trustee, the training contract will be returned to the AASN Provider with a request for the correct details to be provided. This will delay the registration process.

If there is more than one Trust in the legal name, each Trust must have a Trustee, even if the Trustee is the same for each Trust, the Trustee’s name must be entered for each Trust. The correct format for ‘As Trustee For’ in DELTA/CAS is ‘ATF’. Exceptions to this are: For a trust to be a legal entity itself, it must be made by legislation. E.g. section 3 of the 'Salvation Army (Queensland) Property Trust Act 1930' creates a 'body corporate' called the 'Salvation Army (Queensland) Property Trust'. In these cases, the trust name can be used on the training contract because it is a legal entity. These are usually registered in the ABR as 'Other Trust'. A trust identified as a corporation will also be a legal entity and can be used on the training contract e.g. 'The Corporation of the Trustees of the Roman Catholic Archdiocese of Brisbane'. These are usually registered in the ABR as 'Other Incorporated Entity'. Correct legal names for Trusts will not match the Australian Business Register (ABR) as the ABR does not include Trustees. However, the Trustee entered by the AASN Provider MUST be entered in to DELTA along with the Trust Details. Never remove the Trustee’s name to try to make the legal name match the Australian Business Register.

Postal Address Within Australia or Overseas? If a GTO or PEO, their address should be supplied.

Contact Details Phone, Mobile, Fax & Email Business, mobile and email boxes MUST be completed. The fax number is optional but preferred.

What is the Industry or principal activity of the business?

For example - If the AASN Provider is signing up someone in Certificate II in Business who is working at a manufacturing company - the main function of the business is manufacturing.

Workplace Workplace name & Physical address

Enter details of the name and address of the actual site of employment where the apprentice/trainee will be working. • In most cases, the name of the workplace will be the same as the trading name. • In the case of various workplace localities for example ‘site-work’ in the building

industry, the workplace address can be taken as the registered office of the employer. A post office box address is NOT acceptable.

• The workplace address MUST be in Queensland – a contract with a workplace outside Queensland cannot be registered.

• If the apprentice/trainee is employed through a GTO or PEO then provide the GTO or PEO details.

• Occasionally there may be occurrences where names are not conventional. o If it is identified that a person only has the one name, confirm by viewing

a legal document and add the provided name in both Surname and Given Name areas, or

o If a name exceeds the character limitations for the field; contact the DELTA Helpdesk for assistance.

Where the person has had a previous training contract in Queensland and they have changed their name since cancelling or completing, the details of name change are verified. When e-lodging the training contract, a note is added advising DET Qld.

Date of Birth • There are no age restrictions on entry into apprenticeships and traineeships under the Further Education and Training Act 2014.

• However, age limits apply to individual apprenticeships and traineeships where

legislative requirements under other Acts exist, which are enforceable in Queensland.

• The AASN Provider must ensure when signing up apprentices and trainees, that they refer to the minimum entry age requirements and program specific information on QTIS.

• Contracts where the age of the apprentice/trainee is below a legislative requirement will be Auto-returned to the AASN Provider for rectification.

• If the person to be trained as an apprentice/trainee is under 18, please ensure parent/legal guardian details are completed.

Unique Student Identifier (USI) Complete as per Commonwealth Government requirements

Address Physical Address • The address should reflect where the apprentice/trainee resides and must be completed in full. This includes when the physical address is a property name. For example “property name” followed by a name of road and the nearest town.

• A post office box address is not accepted as a current physical address. • If the employer and apprentice/trainee address are legitimately the same, the

AASN Provider will be required to have sufficient evidence on file indicating why the address for the employer and apprentice/trainee are the same.

Instances where the addresses may be the same are: o where the employer and apprentice/trainee are related, for example:

father, son o where the employer is a small business and their place of residence is

also their registered workplace address and the apprentice/trainee lives with the employer

o where the employer is a small business and structured as a company and there are 2 business partners who live and work at the same residential address.

• Apprentices/trainees may have a residential address located across the Queensland border, so long as the employer’s workplace address is based in Queensland and work is predominantly undertaken in Queensland.

Postal Address • The postal address is used for correspondence and must be completed in full. In rural and remote areas this may be a mail service.

Contact Details Phone, Mobile and Email • Where possible a home contact number should be provided, however, a mobile number is acceptable as the home contact number.

• It is preferable that an email address is included; however, the email address MUST be that of the apprentice/trainee and not the employers email.

• The email address must be valid and is the email address that the apprentice/trainee will use to access myApprenticeship Portal.

• The AASN Provider is to explain the benefits of apprentices/trainees having access to myApprenticeship Portal to manage their apprenticeship and traineeship online. The benefits include:

• update your personal details at any time • obtain pre-populated forms and submit those forms to DET Qld • apply for travel and accommodation subsidies • view results and monitor the progress of your apprenticeship/traineeship • correspond with DET Qld

Important: If a previous email address exists in DELTA prior to this registration being e-lodged, the email address recorded on this training contract will override any previous email address already recorded in DELTA. This also includes if no email address is recorded on this training contract, any email address that is recorded in DELTA will be erased.

Personal Details Citizenship Provision of false or misleading information may lead to the cancellation of the training contract by DET Qld under the Further Education and Training Act 2014. Parties to the training contract may be requested to reimburse any funding or incentives to the relevant state and commonwealth authorities if it is identified that a party to a training contract or an AASN Provider has intentionally provided false or misleading information on a training contract. A person wanting to undertake an apprenticeship/traineeship in Queensland must be: • an Australian or permanent resident, • A New Zealand passport holder citizen (being a resident in Australia for more than

6 months is a commonwealth requirement), or • ‘Other’, where they hold a valid Visa that allows them to work in Australia.

o Employers are responsible for ensuring a workers right to work in Australia. The AASN Provider must obtain a signed declaration (template provided) from the employer stating the employer:

1. has verified that the person to become the apprentice or trainee holds the

appropriate Visa and is not prohibited from undertaking this paid employment or training, and

2. Is aware of and has discussed any conditions the visa may be subject to. If the employer is unaware of their responsibility to confirm the Visa, direct the employer to check the Visa details and conditions online via the Visa Entitlement Verification Online (VEVO) service available through the Department of Immigration and Border Protection web site at https://www.border.gov.au/Busi/Visa/VEVO or by contacting the Department of Immigration and Border Protection on Telephone 131 881. Important: If a condition on a Visa is ‘no access to government funding’, this condition relates to Centrelink payment and not State Based User Choice funding. Where it is identified that a person’s Visa does NOT entitle them to work in Australia, the AASN Provider MUST NOT continue to sign the person into an apprenticeship or traineeship. Important: Apprenticeships and traineeships in Queensland are competency based; therefore the duration of the Visa for eligible persons is not an issue. That is, if a Visa allows a person to work in Australia for 12 months and the traineeship that the person will be signed into has a nominal term of 24 months, the person may be able to complete the requirements due to previous experience etc.

Applicants with a disability may apply for part-time apprenticeships or traineeships and work less than the 15 hours per week averaged over a four week period if they are on a disability pension and hold a Pension Concession Card.

The AASN Provider is required to sight the evidence and include a file note of the evidence sighted.

What is your highest COMPLETED school level?

If an apprentice/trainee is currently in year 10 and has 3 days left before finishing school for that year, the highest completed level is year 9, as they have not fully completed year 10.

When did you complete that school level?

If the apprentice/trainee is signing the training contract during the Christmas school holidays but is intending to return to school the following year, the answer must be the school year that the student has just completed. QTIS provides information on mandatory minimum education provisions.

Prior Qualifications Have you successfully completed a qualification?

• Required for assessment of Commonwealth employer incentive. • If answer is “Yes”, please ensure the qualification details and additional information

is entered as required.

Prior Apprenticeships

Have you previously worked as an apprentice or trainee?

Important: The AASN Provider must be aware of the DET (Qld) requirement that an apprenticeship/traineeship cannot be entered into where a person has been issued a completion certificate in the same occupation and where the qualification for the apprenticeship/traineeship was for the same AQF level (note – occupational outcome has the same meaning as apprenticeship/traineeship name or occupational name).

• If answer is “Yes”, please ensure the prior apprenticeship/traineeship details, including year of commencement and where possible, the apprentice/trainee number and additional information as required is provided.

• If a recommencement, ensure details are entered into TYIMS according to the Australian Apprenticeship Incentive Program (AAIP) Guideline 11.B.

Where an apprentice/trainee has indicated they previously worked as an apprentice/trainee, the AASN Provider should check DETConnect for the status of the

previous record and MUST action any previous training contract. For example: SCENARIO 1: The apprentice or trainee has a previous training contract which has not been cancelled. Procedure: If a cancellation of the previous active DELTA record is required and you are the AASN Provider for the previous contract, refer to the procedures (or work instructions) for Cancel registered training contract by the chief executive and/or Cancel registered training contract by all parties for the most appropriate cancellation procedure for the circumstance. The AASN Provider must hold the training contract awaiting resolution of the cancellation process. When resolved, the current training contract may be submitted. Where a cancellation is required and you are not the AASN Provider for the training contract to be cancelled, you may be able to resolve the issue of a current contract by obtaining a notification that employment has ceased, signed by the apprentice/trainee and submit to [email protected] to process. SCENARIO 2: The apprentice or trainee may be entering into a part-time apprenticeship or traineeship in the same calling as an existing part-time apprenticeship or traineeship. Procedure: In Queensland an apprentice/trainee may have more than one active training contract. Apprentices/trainees may have one part-time training contract and seek to commence a second part-time training contract; consequently this scenario would not require cancellation action, however, it is up to the parties to ensure suitable arrangements exist. SCENARIO 3: The apprentice or trainee may be entering into a part-time apprenticeship or traineeship in a different calling to an existing part-time apprenticeship or traineeship.

Procedure: Concurrent part-time apprenticeships and traineeships in different callings are allowable and would not require any cancellation action. In these cases,

no action is required as the training contract will be Automatically Registered if no other validations exist.

Parent/Guardian Details

Entering a date of birth for an apprentice/trainee under the age of 18 requires the parent/guardian fields to be completed and signed consent provided in “Section 5 – Confirm Details”.

If the person to be trained as an apprentice or trainee is under 18 years of age and indicates they are under the care and control of the parent/legal guardian at date of signing the contract, the training contract must include details of the parent/legal guardian.

However, if it would be inappropriate in all circumstances for a parent/legal guardian to give consent, for example, the apprentice/trainee may be living independently, the “No parent/legal guardian” tick box is selected. There is no need for proof of the person’s independence.

If the apprentice/trainee turns 18 between the commencement date and the date the contract is signed, the AASN Provider ticks the “No parent/legal guardian” tick box on the SmartForm and adds a Note: “apprentice/trainee was 18 at date of signing” in the comments box in the SmartForm. If the employer is also the parent/legal guardian of the apprentice or trainee, the person may sign as both the employer/legal guardian.

The parent/legal guardian's involvement in a process related to the training contract will cease when the apprentice/trainee turns 18 years of age.

Important: The parent who signs the training contract is the parent who must sign other transactions during the life of the training contract. The apprentice or trainee may provide access to a nominated person or an additional parent via myApprenticeship Portal, completing ATF-008 Authority to release information or by contacting Apprenticeships Info on 1800 210 210.

Important: The Employment and Training Details section relates to supervision obligations. The role of the AASN Provider is to provide sufficient information to the employer so they understand their obligations under Section 56 of the Act regarding supervision and can make informed decisions.

Note: Employers who actively employ more than 25 or more apprentices/trainees in hosting arrangements for a fee must be a registered GTO or PEO. If the registration of this training contract places an employer in the position of operating as a GTO or PEO and is not registered, the contract cannot be registered. Please refer the employer to the Stakeholder Industry and Relations Team (SIRT) at [email protected].

The statistical standard AVETMISS for New Apprenticeships’ describes this number as ‘people employed by the organisation’, not just at that particular workplace. For example if it’s a national company then it’s the number Australia wide. The organisation relates directly to the ‘legal entity’ as listed in question 28. Where a GTO or PEO is the nominated employer, the GTO/PEO must answer this question as the employer and not provide host employer figures.

The number to be inserted into this field is the total number of apprentices/trainees in the workplace undertaking the qualification that the apprentice/trainee is being signed into. • A tradesperson in the apprentice's calling, as defined under a specific industrial instrument, or

• A person who holds a tradesperson’s certificate or certificate of recognition as a recognised tradesperson issued under the Tradespersons’ Rights Regulation Act 1946 in the apprenticeship calling, or

• A person who holds a relevant qualification in the apprenticeship calling, or • A person individually, or persons collectively, who has/have documented

competence (i.e. a testamur/qualification and associated record of results or a statement of attainment as recognised under the Australian Qualifications Framework, achieved through an RPL or training pathway) in all the competencies the employer is required to provide training for under the apprentice's training plan.

• And, where a licence to practice the calling is required, the qualified person holds a current licence.

Definition of ‘Qualified Person’ for traineeships

• A person who has satisfactorily completed a traineeship in the trainee's calling, and is the holder of a completion certificate issued under an Act, or

• A tradesperson in the trainee's calling, as defined under a specific industrial instrument, or

School-based apprenticeship?

Parties to the training contract may be requested to reimburse any funding or incentives to the relevant state and commonwealth authorities if it is identified that a party to a training contract or an AASN Provider has intentionally provided false or misleading information on a training contract.

If the answer is “yes” the question “Has the school principal signed the Training Plan” is not required for Queensland, however, the following eligibility requirements MUST be met: • The apprentice or trainee must be enrolled at, and attending, a registered

government school or an accredited non-government school, or registered with the Home Education Unit of DET Qld as a home-schooled student, and be progressing towards the attainment of a Queensland Certificate of Education or equivalent and/or a vocational qualification.

• The AASN Provider must gain the school’s support for the SAT arrangement. The school may decide to withhold their support if they consider the SAT arrangement is inappropriate. When seeking school approval, verbal confirmation is acceptable, however, the details must be recorded against the SAT file.

• The contract must also have the support of the employer, RTO, and their parent. • Where the student has a previously cancelled school-based traineeship (ONLY

applies to school-based traineeships) and is recommencing a school-based traineeship in the same traineeship as the previous cancelled training contract, the AASN Provider is to seek confirmation from the student and parent/legal guardian of the number of days the student completed with the previous employer. This amount may be deducted from the required minimum of 50 days and the new employer advised of the minimum required number of days which remain to meet the minimum paid work days requirement.

For example: A student has a cancelled training contract in Certificate III in Business and has completed 28 days with the previous employer. The student is recommencing their school-based training contract with a new employer in Certificate III in Business. As a minimum requirement, the student has 22 days to complete (50 days minus the 28 days already completed) with the new employer along with completing all the requirements under the SATs training plan.

• Where a student not in years 10, 11 or 12 seeks to undertake a school based apprenticeship or traineeship a business case is required. Responsibility for developing a business case lies with the parties proposing to enter the training contract. The business case must be approved by The Director, Training and Skills in the applicable region prior to the signing of a training contract. The AASN Provider seeks confirmation of the approval of a business case.

The business case will include the following evidence to support the application: o the range of other options that have been considered by the school prior to

supporting the engagement of the student in a SAT – for example, work experience

o how the school will accommodate the SAT arrangement within the existing curriculum

o how well the student is handling school and whether or not they have the capacity to take on the additional study load necessary to achieve the outcome of the SAT

o any additional learning or support to be provided by the school and/or SRTO, which will be available to support progress through the qualification

o the level of support, training and supervision that will be provided in the workplace

o any potential exposure to workplace risks associated with the particular employment arrangement.

• Students in years 11 and 12 may be considered eligible to enter school-based apprenticeships in Electrotechnology qualifications. For eligible students to have their training contract registered, they must complete the industry recognised minimum educational requirement, which constitutes the equivalent of year 10 with passes in a recognised course in English, Maths and Science. The student must provide evidence of year 10 pass in English, Maths and Science to the AASN Provider. The AASN provider is required to retain the evidence. The AASN Provider must verify that legitimate SAT arrangements exist, including the employer being able to provide the minimum paid work requirement of 375 hours (50 days) or 600 (80 days) if the SAT is entering the electrotechnology industry, and the paid work and/or training impacts the school timetable.

• Refer to the Guide to school-based apprenticeships and traineeships for all SAT

specific requirements.

A training contract cannot be registered without school approval. The AASN Provider should implement measures to ensure the school approval can be obtained, particularly over school holidays.

Note: Due to data entry limitations in TYIMS, the AASN provider has no choice but to select “part-time” and enter “hours of training and employment per week” for school-based. The DELTA In-tray will show both “school-based” and “part-time” modes. However, DELTA will register the contract as “school-based”. If DELTA identifies that school-based is “Yes”, it will ignore any data related to “part-time” and “full-time”.

Is the apprentice/trainee seeking credit to reduce the term of the Training Contract?

• Check QTIS and discuss with the parties whether credit may apply. • If the answer is “yes” the AASN Provider must enter the “months” the parties are

seeking. Refer to the clue card for appropriate Note to add for the circumstance to e-lodge.

Time Credit: • DELTA should automatically apply previous service at time of e-lodging where a

previous cancelled/withdrawn record is for the same qualification (including superseded) and occupational model and the cancellation/withdrawn date is prior to the commencement date of the new contract. However, due to the occasional change in the details of qualifications etc, DELTA may be unable to match previous history; consequently, the AASN Provider MUST enter the months.

• If the time credit has been acquired under a training contract outside Queensland an “Extract of Service” from the relevant state training authority MUST be provided by the apprentice/trainee to the AASN Provider prior to e-lodging, EXCEPT where previous service was in NSW or Victoria.

• If the previous service was in NSW or Victoria, the AASN Provider can obtain the

“Extract of Service” by: o completing either the “Request for extract – NSW” or ”Request for

extract - Victoria” form and email to [email protected] to obtain as agreement exists between Queensland, NSW and Victoria State Training Authorities to provide these details when requested, or

o by the AASN Provider accessing interstate databases to obtain an extract of service. A copy of the printout must be kept on file as evidence.

• Some Institutional qualifications provide time credit towards apprenticeships. The

requested credit MUST be supported by a qualification. The AASN Provider must obtain a copy of the qualification. The AASN Provider must refer to QTIS for the applicable time credit to be entered.

Reduction/Exemption of Time Credit • Any request for a reduction or exemption of time credit which would otherwise be

applicable for time served under previous training contract/s MUST be agreed to by ALL parties. The signing of the training contract is notification of that agreement. The AASN Provider enters the agreed months, and ensures the credit box is ticked and the appropriate note is added.

No Evidence • If the AASN Provider adds a note to state the contract is registered without an

extract of service, any credit amount entered will NOT be deducted from the nominal term.

Evidence provided post registration • If the apprentice/trainee provides an Extract of Service AFTER the training contract

has been registered, the request must include the employer’s approval in writing and is submitted directly to DET Qld. Contact Apprenticeships Info on 1800 210 210 for assistance.

It is important to be aware of potential wage implications when time credit is applied to a training contract. Parties should check with their relevant employer organisation, union or Fair Work on 13 13 94 or visit www.fairwork.gov.au

• The AASN Provider must ensure that the qualification being undertaken is appropriate to the workplace.

o For example, if a training contract is being signed up in a Certificate III in Automotive Electrical Technology (Automotive Electrician) and the environment is a retail environment, this may lead the AASN provider to seek further information to ensure the employer is aware of their obligations, such as:

o Is the employer able to provide a suitable workplace environment for the qualification, for example, is there a range of tools and equipment, workshop, etc. Does the employer offer work/repairs associated to the qualification/industry? For example, does the mechanical workshop actually do auto electrical work?

o if the employer advises they are expanding their business to add this type of work, the AASN Provider should consider when this is expected to occur. If more than 3 to 6 months the employer should be advised to wait until closer to the time.

If the answers provided to the above questions are NO, then the qualification may NOT be suitable. If clarification is required, the AASN Provider may request additional documents/information from the employer. The request must be in writing. A template has been provided to the AASN Provider.

• An apprenticeship or traineeship cannot be entered into where a person has been issued a completion certificate in the same occupation and where the qualification for the apprenticeship or traineeship was for the same AQF level (note – occupational outcome has the same meaning as Apprenticeship/Traineeship name or occupational name). For example:

o Where a person completes a Certificate IV in Engineering through an apprenticeship pathway and is issued a completion certificate, they are not eligible to undertake the Certificate IV in Engineering again through an apprenticeship pathway.

• A person who has achieved a qualification through an institutional pathway, but has not completed an apprenticeship or traineeship in the associated

apprenticeship or traineeship occupation is eligible to undertake an apprenticeship or traineeship. Refer to the Declaration of Apprenticeships and Traineeships in Queensland Policy for further information. For example, if a person has completed a Certificate III in Business through an institutional pathway with a training provider, they may be offered employment with an employer undertaking a Certificate III in Business traineeship. The traineeship will provide on-the-job experience that may not be accessible through an institutional pathway.

• Check QTIS for any additional requirements or restrictions that may be placed on a person wanting to undertake the apprenticeship/traineeship.

Provision of false or misleading information may lead to the cancellation of the training contract by DET Qld under the Further Education and Training Act 2014. Parties to the training contract may be requested to reimburse any funding or incentives to the relevant state and commonwealth authorities if it is identified that a party to a training contract or an AASN Provider has intentionally provided false or misleading information on a training contract.

• Section 9 of the FET Act states an apprenticeship or traineeship starts on the day agreed to by the employer and the apprentice or trainee. The training contract must reflect that date.

• Employers are expected to meet the timeframes stated in the Further Education and Training Act 2014 for the signing and lodging of training contracts. It is expected that the AASN Providers will educate employers on the timeframes to ensure employers are meeting their obligations under the Further Education and Training Act.

• Under Section 15 of the Act, the employer must ensure a training contract is signed by the parties within 14 days after the apprenticeship/traineeship starts.

• Under Section 16 of the Act, the employer must take all reasonable steps to ensure the signed training contract is given to an AASN Provider within 28 days after the apprenticeship or traineeship starts.

• Where it is identified that the commencement date has been back dated, the AASN Provider will need to ascertain why there has been a delay in the employer contacting the AASN Provider.

• DET Qld will run reports identifying whether it is an employer or an AASN Provider issue for delays in lodgement and will address these through regional visits to employers or audits of the AASN Provider.

• Where there is any concern regarding the commencement date, the AASN Provider may request further information from an employer or apprentice/trainee to substantiate the actual commencement date. Information requested will assist the AASN Provider to determine when an employer offered a person an opportunity to undertake an apprenticeship or traineeship and when the person accepted the offer.

o For new workers, proof of employment may be in the form of wage and record statements that an employer may provide.

o For existing workers, this may be more difficult and could rely upon the parties and information supplied by a training organisation to determine when training commenced.

• The AASN provider may determine that the apprenticeship/traineeship actually started on a later or earlier date to that originally advised based on evidence presented.

• Enter the date the apprentice/trainee and employer agree to or a date determined by the AASN Provider.

The apprentice/trainee: • understands that signing the training contract is verification they have been

informed of and understand their obligations as listed under “Training Contract Declaration” and “Training Contract Obligations”,

• is aware that a person cannot be both the employer and the apprentice/trainee under the one training contract, and

• if under 18 years of age, the training contract must also include the signed consent of a parent, unless the “No parent/guardian” has been indicated.

The Parent/Guardian:

• signature is verification of agreement to uphold responsibilities as listed under “Training Contract Declaration” and “Training Contract Obligations” until the person is 18 years of age. The parent who signs the training contract is the parent who must sign other transactions during the life of the training contract. The apprentice or trainee may provide access to a nominated person or an additional parent via myApprenticeship Portal, completing ATF-008 Authority to release information or by contacting Apprenticeships Info on 1800 210 210.

Name of apprenticeship/traineeship: • enter the name of apprenticeship/traineeship as listed in Step 3.2 The AASN Provider Declaration: • is verification the AASN Provider understands their obligations.

Does not meet registration requirements - for the purpose of the Apprenticeship/Traineeship Training Contract, does not meet registration requirements means the information necessary to satisfy the registration requirements is incomplete and/or missing. In the approved form - for the purpose of the Apprenticeship/Traineeship Training Contract, in the approved form means sufficient responses have been provided by the parties to a training contract to enable a delegated officer to make a decision to register or refuse to register as set out in Section 17 of the FET Act. Delegation – means appropriately qualified officers, who are holders of specified positions, are delegated to carry out functions and are accountable for decisions and actions taken under specific legislative provisions, such as, a decision made under Section 17 of the FET Act the decision to register or refuse to register a training contract.

Guide to ‘Tick’ Boxes and adding ‘Notes’ (Clue Card)

The AASN Provider should:

• enter ‘Notes’ as requested in the below instructions, or where the AASN Provider considers information MUST be supplied to register a training contract.

• only use tick boxes that are listed below as all other tick boxes are de-activated. Tick Box - Parent Declined Tick if apprentice/trainee is under the age of 18 at date of signing & declines the parent option.

No Note is required.

Tick Box - Residency Status If “other” is selected at Q13, tick the Residency tick box to notify the AASN provider has obtained a declaration from the employer that the apprentice or trainee is permitted to undertake this paid employment and is aware of conditions the visa may be subject to. No Note is required

Tick Box – Cancellation Tick the cancellation tick box where a contract meets all requirements but the contract cancelled prior to e-lodging. A Note is required to be added stating: “Training contract meets registration requirements, but employment ceased on (insert date). The contract is cancelled as (insert either mutual agreement, withdrawn in probation, or one of the grounds under section 36, such as 36i).

Tick Box - Credit

Important Information

• If TYIMS does not permit entering an amount because it is more than the duration of the qualification, enter the full-time months and ensure the note reflects the credit amount represented at Q24 is full-time.

• The AASN Provider must ensure the correct recommencement is selected according to the AAIP Guideline 11.B – TYIMS Entry. • A copy of the qualification MUST be obtained by the AASN provider. • The AASN Provider must refer to QTIS to obtain the applicable time credit.

Credit for previous service in Queensland DELTA calculates time credit for previous service when a previous cancelled/withdrawn record in DELTA is for the same qualification, (including superseded) and occupational model, and the cancellation/withdrawn date is prior to the commencement date of the new contract. Adding a note is not required, but AASN MUST enter the months the parties are seeking.

Credit for a combination of previous Queensland and Interstate service

Credit will be granted so long as the apprentice or trainee is entering the same occupational model and evidence (interstate extract of service) is provided.

Tick the credit tick box, enter the applicable months at Q24 and add note:

“Applicable credit of (insert months) is due to a combination of Queensland and interstate service”.

If converting to/from part time or SAT training contract, add the words “Credit represented in field is full time” or “Credit represented in field is part-time”.

Credit where a reduction or exemption is agreed to.

FYI - If the AASN Provider enters Zero, then zero will be accepted.

If parties have agreed to reduce or exempt the term of previous service, tick the credit tick box, enter the agreed “months” listed at Q24 and add note:

“Parties have agreed to credit of (insert months).

If converting to/from part time or SAT training contract, add the words “Credit represented in field is full time” or “Credit represented in field is part-time”.

Credit for previous interstate service

(must obtain evidence (interstate extract of service)

Circumstance Relevant Note to add

When an extension to probation period is applied for at sign-up.

Add Note: “All parties agree to extend the probationary period by (insert agreed months).

For an existing worker when the AASN Provider is aware the apprentice/trainee undertook some of their previous work with the employer whilst still at school – this is NOT required for a SAT

Add Note: “Student worked with employer from (insert dates) whilst still at school”.

When a change of name occurs between contracts

Add note: “Apprentice/trainee has a previous training contract in the name of (insert previous name), registration number (insert if known) in the trade calling of (insert relevant calling). The appropriate original evidence has been sighted confirming both the previous and new name”.

When registering a part-time contract for an apprentice/trainee with a disability and works fewer than 15 hours per week, the AASN Provider sights the apprentice/trainee's Income Statement.

Add Note: “Apprentice/trainee has a disability - Pensioner Concession Card and income statement confirming the applicant apprentice/trainee is currently receiving the Disability Support Pension has been sighted.

When registering a training contract for electrical UEE30811 or UEE40611 where the employer does not hold a contractor’s license and approval to submit training contract has been provided by DET Qld.

Add Note: “Approval provided by DET Qld on (insert date) to submit this training contract for an electrical apprenticeship where the (insert employer name) does not hold an electrical contractor’s licence”

When the apprentice/trainee turns 18 after commencement but before the date the contract is signed.

Add Note: “Apprentice/trainee was 18 at date of signing”.

When the decision is to Refuse to register the training contract.

Add note: “Training contract does NOT meet registration requirements, and is refused due to (select one of the examples below). Decision made on (insert date).”

• the RTO has not accepted the nomination to be the SRTO (depending on the circumstances relating to the non-acceptance of the nomination, it might be an option to contact the employer and apprentice/trainee to select another RTO rather than refusing the contract)

• the school has not supported the training contract • a business case for the student who is outside Years 10, 11 or 12 has not been approved • the parent has not provided their signed consent • the apprentice/trainee does not hold a visa that permits them to work while in Australia • the apprentice does not meet the minimum requirements for electrotechnology • the apprentice/trainee does not meet an industry stipulated/legislated minimum age requirement • the apprentice/trainee has already been issued with a completion certificate for this occupational

outcome • the employer is unable to provide a part-time apprentice/trainee a minimum of 15 hours of paid

employment per week
