Minutes of the April 25, 2013 Regular Meeting of the

Fayetteville Board of Education

The meeting convened at 5:00pm in the Adams Leadership Center with President Tim Hudson presiding. The Pledge of Allegiance was led by students from Butterfield Trail Elementary School. Roll Call The roll was called and board members Justin Eichmann, Steve Percival, Tim Hudson, Susan Heil, Jim Halsell, Bryn Bagwell and Traci Farrah were present. Recognition The Woodland MathCounts team received a Recognition of Outstanding Achievement Award for winning first place in 2013 Arkansas MathCounts competition. The Woodland Robotics team received a Recognition of Outstanding Achievement Award for winning first place and the Design Award at the 2013 Arkansas Technology Students Association competition. The Butterfield Trail Archery team received a Recognition of Outstanding Achievement Award for qualifying to participate in the 2013 Archery in the Schools national competition in May. The Fayetteville High School Winter Guard team received a Recognition of Outstanding Achievement Award for winning first place in the 2013 Mid Continent Color Guard Association championships. Connotations, the Fayetteville High School student literary magazine, received a Recognition of Outstanding Achievement Award for winning the 2013 Gold Crown Award from the Columbia Scholastic Press Association. Connotations received a second Recognition of Outstanding Achievement Award for winning the All-Arkansas Award at the 2013 Arkansas Scholastic Press Association convention. FHS-TV received a Recognition of Outstanding Achievement Award for winning the All-Arkansas Award at the 2013 Arkansas Scholastic Press Association convention. Consent Agenda The Board voted 7-0 to approve the consent agenda. Justin Eichmann made the motion, which was seconded by Steve Percival. Bus Bids The Board voted 7-0 to approve the purchase of two 71 passenger school buses from Diamond State Bus Company. The total cost for the two buses is $182,510.00. Steve Percival made the motion, which was seconded by Susan Heil. Fayetteville High School Construction Update Phil Jones from Nabholz Construction reported that the installation of the exterior metal panels is almost complete, as well as the glass curtain for the media center. Work on the parking lot north of the vocational/agriculture building will begin soon. Sustainability and Farm to School Update Dana Smith, sustainability coordinator, presented information regarding district initiatives including energy conservation, wildlife habitat certification, waste reduction, green teams, LEED education and the seed to student program. Ms. Smith also noted that Kevin Concannon, USDA Undersecretary, visited Owl Creek School on April 16 to learn about the district Farm to School program and other district sustainability initiatives.

Revisions to Policy 4131 (Certified Professional Development) Kay Jacoby, executive director of CIAA, introduced Marianne Hauser, director of professional development, who presented the draft professional development policy. Ms. Hauser reported that the policy changes are a result of Act 969, which was recently passed by the Arkansas General Assembly. She further noted that the policy itself is more generic. Administrative regulations, which will be presented at the May board meeting, will contain more specific procedures and requirements. The PD committee and PPC have approved the proposed PD policy. Revisions to Policy 5.13 (Privacy of Student Records) Ginny Wiseman, associate superintendent for administration, presented a revision to Policy 5.13 (Privacy of Student Records). The change corrects a wording error. Expulsion Hearing and Adjournment The Board adjourned to closed session at 6:00pm for an expulsion hearing. The Board reconvened in open session at 6:42pm. The Board voted 7-0 to uphold administration’s recommendation to expel Student A for the remainder of the school year. Steve Percival made the motion, which was seconded by Jim Halsell. Fayetteville School District Policy No. 4131

PROFESSIONAL DEVELOPMENT

The Board of Education of the Fayetteville Public Schools believes schools are learning communities where teachers and students are continually engaged in inquiry and stimulating discourse. The Board considers professional development an integral part of the school district's program and intends to budget funds accordingly.

a) Professional Development Hour Requirements In accordance with state law, the Fayetteville School District will provide a minimum of 60 hours of professional development activities within the regular school calendar based on local educational needs and state educational goals. In addition, the district will provide other PD opportunities outside of school contract hours. If the state mandates new requirements or regulations which are more stringent than local policies, the state-mandated change will go into effect. The district will ensure that all state required specific professional development activities are offered and monitored.

b) Staff Member’s Individual Professional Development Record

The district will maintain a copy of the individual staff member’s completed professional development activities. The professional development record will be monitored by the appropriate supervising personnel.

c) District Professional Development Steering Committee The District Professional Development Steering Committee (DPDSC) will annually review the district’s professional development plan and activities by assisting the Director of Professional Development in coordinating and evaluating the district's professional development program. The DPDSC will also annually review the Administrative Guidelines and Frequently Asked Question documents.

d) Timeline: Certified staff will receive credit for professional development activities beginning June 1 of each contract year and must complete the state required 60 hours by May 31 of that school year.

e) Flex Days: Certified staff who attend Professional Development sessions outside of their

contracted time may substitute up to 12 pre-approved hours to replace two designated FlexPD Days. The District Calendar Committee will designate annually the two days which will be district-wide FlexPD Days. District leadership staff and principals have the option of requiring certified staff to attend specific sessions aligned to student need and district focus. If required on a non-contract day, additional opportunities to complete the required sessions will be offered.

f) Salary Credit: Professional development hours earned above the required sixty (60) may be

submitted for salary credit in accordance with Board Document 4131-ESD.

 

g) Contract / Licensure: Certified staff are required to attend professional development sessions on district in-service days in order to fulfill contractual obligations. Certified staff who miss any part of regularly scheduled professional development activities, for any reason (such as sickness), must make up that time in other approved professional development activities so that the 60 required hours of professional development are earned during the approved timeline. Failure to meet these requirements may result in non-renewal of a teaching license.

5.13—PRIVACY OF STUDENTS’ RECORDS/DIRECTORY INFORMATION Except when a court order regarding a student has been presented to the district to the contrary, all students’ educational records are available for inspection and copying by the parents of his/her student who is under the age of eighteen (18). At the age of eighteen (18), the right to inspect and copy a student’s records transfers to the student. A student’s parents or the student, if over the age of 18, requesting to review the student’s education records will be allowed to do so within no more than forty five (45) days of the request. The district forwards education records, including disciplinary records, to schools that have requested them and in which the student seeks or intends to enroll, or is already enrolled so long as the disclosure is for the purposes related to the student’s enrollment or transfer. The district shall receive written permission before releasing education records to any agency or individual not authorized by law to receive and/or view the education records without prior parental permission. The District shall maintain a record of requests by such agencies or individuals for access to, and each disclosure of, personally identifiable information from the education records of each student. Disclosure of education records is authorized by law to school officials with legitimate educational interests. A personal record kept by a school staff member is not considered an educational record if it meets the following tests.

it is in the sole possession of the individual who made it; it is used only as a personal memory aide; and information contained in it has never been revealed or made available to any other person, except the maker’s

temporary substitute. For the purposes of this policy, a school official is a person employed by the school as an administrator, supervisor, instructor, or support staff member (including health or medical staff and law enforcement unit personnel); a person serving on the school board; a person or company with whom the school has contracted to perform a special task (such as an attorney, auditor, medical consultant, or therapist); or a parent or student serving on an official committee, such as a disciplinary or grievance committee, or assisting another school official in performing his or her tasks. For the purposes of this policy a school official has a legitimate educational interest if the official needs to review an education record in order to fulfill his or her professional responsibility, contracted duty, or duty of elected office. The District discloses personally identifiable information from an education records to appropriate parties, including parents, in connection with an emergency if knowledge of the information is necessary to protect the health or safety of the student or other individuals. The superintendent or designee shall determine who will have access to and the responsibility for disclosing information in emergency situations. When deciding whether to release personally identifiable information in a health or safety emergency, the District may take into account the totality of the circumstances pertaining to a threat to the health or safety of a student or other individuals. If the District determines that there is an articulable and significant threat to the health or safety of a student or other individuals, it may disclose information from education records to any person whose knowledge of the information is necessary to protect the health or safety of the student or other individuals. For purposes of this policy, the Fayetteville School District does not distinguish between a custodial and noncustodial parent, or a non-parent such as a person acting in loco parentis or a foster parent with respect to gaining access to a student’s records. Unless a court order restricting such access has been presented to the district to the contrary, the fact of a person’s status as parent or guardian, alone, enables that parent or guardian to review and copy his/her child’s records. If there exists a court order which directs that a parent not have access to a student or his/her records, the parents, guardian, person acting in loco parentis, or an agent of the Department of Human Services must present a file-marked copy of such order to the building principal and the superintendent. The school will make good-faith efforts to act in

accordance with such court order, but the failure to do so does not impose legal liability upon the school. The actual responsibility for enforcement of such court orders rests with the parents or guardians, their attorneys and the court which issued the order. A parent or guardian does not have the right to remove any material from a student’s records, but such parent or guardian may challenge the accuracy of a record. The right to challenge the accuracy of a record does not include the right to dispute a grade, which must be done only through the appropriate teacher and/or administrator, the decision of which is final. A challenge to the accuracy of material contained in a student’s file must be initiated with the building principal, with an appeal available to the Superintendent or his designee. The challenge shall clearly identify the part of the student’s record the parent wants changed and specify why he/she believes it is inaccurate or misleading. If the school determines not to amend the record as requested, the school will notify the requesting parent or student of the decision and inform them of their right to a hearing regarding the request for amending the record. The parent or eligible student will be provided information regarding the hearing procedure when notified of the right to a hearing. Unless the parent or guardian of a student, or the student if above the age of eighteen (18), objects directory information about a student may be made available to the public, military recruiters, post secondary educational institutions, prospective employers of those students, as well as school publications such as annual yearbooks and graduation announcements. “Directory information” includes, but is not limited to, a student’s name, address, telephone number, electronic mail address, photograph, date and place of birth, dates of attendance, his/her placement on the honor role (or the receipt of other types of honors), as well as his/her participation in school clubs and extracurricular activities, among others. If the student participates in inherently public activities (for example, basketball, football, or other interscholastic activities), the publication of such information will be beyond the control of the District. “Directory information” also includes a student identification (ID) number, user ID, or other unique personal identifier used by a student for purposes of accessing or communicating in electronic systems and a student ID number or other unique personal identifier that is displayed on a student’s ID badge provided the ID cannot be used to gain access to educational records except when used in conjunction with one or more factors that authenticate the user’s identity, such as a personal identification number (PIN), password or other factor know or possessed only by the authorized user. A student’s name and photograph will only be displayed on the district or school’s web page(s) after receiving the written permission from the student’s parent or student if over the age of 18. Each parent, legal guardian, or eligible student has the right to refuse to permit the release of the above information. If the parent, legal guardian, or eligible student wishes to restrict the release of the above information, he/she must inform the Principal’s Office in writing within thirty (30) calendar days of receipt of this notice. An eligible student is one who has reached the age of 18 or is attending any school beyond the high school level. The District is required to continue to honor any signed opt-out form for any student no longer in attendance at the district. The right to opt out of the disclosure of directory information under FERPA does not prevent the District from disclosing or requiring a student to disclose the student’s name, identifier, or institutional email address in a class in which the student is enrolled. Parents and students over the age of 18 who believe the district has failed to comply with the requirements for the lawful release of student records may file a complaint with the U. S. PROJECT UPDATE

2013 05 23 | Fayetteville High School

Commissioning STATUS UPDATE:

1. Mechanical installation has reached a point that formal pre-functional inspections have begun. Viridian staff is looking to ensure proper installation of equipment and that it is in a location that allows for long-term maintenance.

2. Equipment installation observed includes Variable Air Volume (VAV) boxes and Air Handling Units primarily.

Commissioning (Cx) is a systematic process for ensuring that all building systems perform interactively, according to design intent and the owner’s operational needs. This includes design review, pre- and post-functional testing, and coordination meetings. Leadership in Energy & Environmental Design (LEED) STATUS UPDATE:

1. To date, 39 of 55 points have been approved. Viridian has submitted the project team’s response to GBCI with clarifications to their questions. Outstanding credits are mostly made up of mechanical design questions which is typical because they represent the most complex systems in a project.

2. Phase II is still tracking at sixty points. Twenty-two of these points have been approved. With the long timeframe for final completion of Phase II this should hold steady for several months.

LEED Fact: 31.75% of Phase I is made up of materials that were extracted and manufactured within 500 miles of the project site in Fayetteville. This earned the project two points with the idea that it supports regional companies and reduces energy consumption associated with delivery of products. 9-12 Health & 6-7 Math Textbook Adoption

TO: Board of Education FROM: Kay Jacoby I will report on the textbook recommendation for the semester Health course, 9 – 12, that is a requirement for high school graduation. The textbook choice is Prentice Hall Health published by Pearson. Additionally, I will report on the textbook recommendation for math, 6th grade, which is GO MATH published by Houghton Mifflin Harcourt. GO MATH is the series adopted by K-5. Finally, with one more meeting scheduled for 7th grade teachers, I expect to be able to present the textbook recommendation for math, 7th grade, at the May 23rd meeting.

EVALUATION OF TEACHERS/CERTIFIED STAFF

The Arkansas Teacher Excellence and Support System (TESS) is the statewide teacher evaluation system that provides support, collaboration, feedback and targeted professional development opportunities aimed at ensuring effective teaching and improving student learning. In accordance with the Arkansas Laws and Arkansas Department of Education Rules, each teacher employed by the Fayetteville School District shall be evaluated, at least annually, in writing, under TESS. The Board of Education of the Fayetteville Public School System hereby authorizes the Administration to adopt Administrative Regulations, which define procedures, to carry out this policy. Definition: As stated in ADE Rules Governing the Teacher Excellence and Support System,

Teacher means a person who is: Required to hold and holds a teaching license from the State Board of Education as 

a condition of employment; and  

Employed in a public school as a: 

o Classroom teacher engaged directly in instruction with students in a 

classroom setting; 

o Guidance counselor; 

o Library media specialist; 

o Special education teacher; or  

o The following teachers who instruct public school students: 

Distance learning teachers 

Virtual charter school teachers 

Teachers at the Arkansas School for the Deaf 

Teachers at the Arkansas Correctional School 

Instructional facilitators and instructional coaches; and 

Teachers employed by education service cooperatives who instruct 

public school students.

Administrative Regulation to Evaluation of Teachers/Certified Staff

1. Purpose Certified employee evaluation in the Fayetteville School District is based on the premise that professional

growth is essential for the improvement of employee performance and instruction. Evaluation should be

continuous and constructive and should take place in an atmosphere of mutual trust, support, and

respect. The process is a cooperative effort designed to encourage productive dialogue and action

between and among staff and supervisors. This evaluation program recognizes the individual

differences of each person and utilizes an approach that provides maximum opportunities for

improvement and growth. Its purpose is to:

a. improve delivery of instruction for optimal student achievement. b. develop and maintain a climate conducive to learning, and c. guide the professional development of each employee.

2. Notification By August 31 of each school year, or within one month of later employment, the supervisor will inform each employee in writing of his/her evaluator and Evaluation Track (see section 5)for that particular school year. Additionally, the evaluator will inform the employee of the details of the evaluation process including but not limited to forms to be used and number of observations. The district Notice of Evaluation form will be used for documentation. The evaluator shall be the supervisor of the employee. The supervisor may appoint an alternative evaluator with the approval of the employee.

3. Observations Observations may occur at any time after notification of evaluation. However, the first formal observation should be completed by the end of the fall semester and all observations will be completed by March 1. Formal classroom observations will be for no less than 45 minutes and informal classroom observations will be for no less than 15 minutes.

4. Evaluation Plans The district will conduct a summative evaluation for every teacher who is a probationary teacher, a novice teacher, or a teacher who successfully completed intensive support status within the current

or immediately preceding school year. For those teachers on a summative evaluation, there must be at least one (1) formal observation and two (2) informal observations.

Once the above requirements have been satisfied, a summative evaluation shall only be required one (1) time every three (3) school years. Nothing shall prevent an evaluator from conducting a summative evaluation of a teacher more often than one time every three (3) school years. In a school year in which a summative evaluation is not required for a teacher, the teacher shall focus on elements of the teacher’s professional growth plan (PGP), as approved by the evaluator, that are designed to help the teacher improve his or her teaching practices.
