II BACKGROUND II On April 10, 2006 Municipal Council approved the Terms-of-Referencefor the 2006 Official Plan Review. The Terms-of-Reference identified six (6) primary issues to be addressed through the review process: 0 0 Commercial Policies Review 0 Residential lnfill and Intensification Affordable Housing 0 Transportation Policies Review Growth Forecasts & Land Needs Urban DesignlCreative Cities Task Force In addition to these six primary issues, several other matters will be addressed in the Official Plan Review, including: policy modifications that may be required to implement the 2005 Provincial Policy Statement (PPS); environmental policy and mapping edits that were initiated after the last five year Official Plan update in 2001; revisions to the Significant Woodland Policies, previously recommended for consolidation with the OP Review (File 0-7081); and, recently approved amendments to the Ontario PlanningAct. These matters are being addressed in a series of issues summary reports, which provide preliminary recommendations for circulation and review by Ofticial Plan Working Groups and the general public. The attached table provides a summary of Official Plan modifications that may be required to implement the Planning and Conservation Land Statute Law Amendment Act, 2006 (Bill 51). 1

II BACKGROUND II On April 10, 2006 Municipal Council approved the Terms-of-Reference for the 2006 Official Plan Review. The Terms-of-Reference identified six (6) primary issues to be addressed through the review process:

In addition to these six primary issues, several other matters will be addressed in the Official Plan Review, including: policy modifications that may be required to implement the 2005 Provincial Policy Statement (PPS); environmental policy and mapping edits that were initiated after the last five year Official Plan update in 2001; revisions to the Significant Woodland Policies, previously recommended for consolidation with the OP Review (File 0-7081); and, recently approved amendments to the Ontario Planning Act. which amends several provisions of the Planning Act and related Provincial Statutes. Bill 51 received Third Reading on October 12th and Royal Assent on October 19th, 2006. It is expected that the legislation will be proclaimed into law by the end of this year. The changes being enacted through Bill 51 include:

Enhanced requirements for public notice, information and consultation; Providing municipalities with powers to establish local appeal bodies to deal with minor variances and consents; Adding to the significance of the process for five-year Official Plan updates;

0 Tightening the requirements for municipal Official Plans and Zoning By-laws to be consistent with Provincial policies and plans; Tightening the prerequisites for the entitlement to appeal the decision of a municipal Council or other local approval authority; Providing for the regulation of minimum as well as maximum densities and building heights in the Zoning By-law; Promoting intensification and brownfield redevelopment; and Increasing the ability of local jurisdictions to influence urban design.

The attached table identifies new andlor revised sections of the Planning Act that are proposed in Bill 51, together with a list of the associated Official Plan policies that are currently in effect. The third column provides a brief synopsis and recommended response from staff on the need for policy modifications to be considered within the context of the OP Review. Components of Bill 51 that do not substantively affect the Official Plan policy framework have not been identified in the Table since they are administrative in nature, or implemented through other mechanisms.

The attached table should be considered as a preliminary response that will be circulated for public review. Afler feedback is received and considered, staff will prepare a more detailed document with the specific policy modifications that are being recommended to implement the relevant components of Bill 51.

CONCLUSION 1 This report provides a preliminary evaluation and recommended course of action to implement relevant components of the Planning and Conservation Land Statute Law Amendment Act, 2006 (Bill 51) within the context of the Official Plan Review. This information will be forwarded to the Official Plan Working Groups and interested members of the public for review and comment. Drafl policies will then be brought back to Planning Committee for consideration.
