Section 3. Definition of Terms As used in these rules and regulations, unless the
contextotherwiserequires,thefollowingtermsshallbeunderstoodtomean:
(a) Act refers to Republic Act No. 9775, otherwise known as the AntiChildPornographyActof2009.
(b) "Child"referstoapersonbeloweighteen(18)yearsofageoroverbutisunableto fully take care of, or protect, himself/herself from abuse, neglect, cruelty,exploitation or discrimination because of a physical or mental disability orcondition.ForthepurposeofthisAct,achildshallalsoreferto:(1) apersonregardlessofagewhoispresented,depictedorportrayedasachild
asdefinedherein;and(2) computergenerated, digitally ormanually crafted images or graphics of a
personwhoisrepresentedorwhoismadetoappeartobeachildasdefinedherein.
(c) "Child pornography" refers to any representation, whether visual, audio, or
writtencombinationthereof,byelectronic,mechanical,digital,optical,magneticoranyothermeans,ofachildengagedorinvolvedinrealorsimulatedexplicitsexualactivities.
(d) CouncilreferstotheInterAgencyCouncilagainstChildPornography(IACACP)createdunderSection20oftheAct.
(e) "ExplicitSexualActivity"includesactualorsimulated(1) sexualintercourseorlasciviousactincluding,butnotlimitedto,contact
involvinggenitaltogenital,oraltogenital,analtogenital,ororaltoanal,whetherbetweenpersonsofthesameoroppositesex;
(2) bestiality;(3) masturbation;(4) sadisticormasochisticabuse;(5) lasciviousexhibitionofthegenitals,buttocks,breasts,pubicareaand/or
anus;or(6) useofanyobjectorinstrumentforlasciviousacts.
(f) "Internetaddress"referstoawebsite,bulletinboardservice,internetchatroom
ornewsgroup,oranyotherinternetorsharednetworkprotocoladdress.
(g) "Internet cafe or kiosk" refers to an establishment that offers or proposes toofferservicestothepublicfortheuseofitscomputer/sorcomputersystemforthepurposeofaccessingtheinternet,computergamesorrelatedservices.

(h) "Internet content host" refers to a person who, or entity that, hosts or whoproposestohostinternetcontentinthePhilippines.
(i) "Internetserviceprovider(ISP)"referstoapersonwho,orentitythatsuppliesor
proposestosupply,aninternetcarriageservicetothepublic.(j) "Grooming"referstotheactofpreparingachildorsomeonewhotheoffender
believes to be a child for a sexual activity or sexual relationship bycommunicatinganyformofchildpornography.Itincludesonlineenticementorenticementthroughanyothermeans.
(k) "Luring" refers to the act of communicating, bymeansof a computer system,
withachildorsomeonewhotheoffenderbelievestobeachildforthepurposeof facilitating thecommissionofa sexualactivityorproductionofany formofchildpornography.
(l) "Pandering"referstotheactofoffering,advertising,promoting,representingor
distributing through any means, any material or purported material that isintended to cause another to believe that thematerial or purportedmaterialcontainsanyformofchildpornography,regardlessoftheactualcontentofthematerialorpurportedmaterial.
(m) "Person"referstoanynaturalorjuridicalentity.

Section4.Inter-Agency Council Against Child Pornography (IACACP)TheInterAgencyCouncil against Child Pornography (IACACP) is established as the body that is primarilytaskedtocoordinate,monitorandoverseetheimplementationoftheAct.
Section5.Composition TheCouncilshallbecomposedofthefollowing:
(a) Secretary of the Department of Social Welfare and Development (DSWD) asChairperson;
(b) SecretaryoftheDepartmentofJustice(DOJ);(c) SecretaryoftheDepartmentofLaborandEmployment(DOLE);(d) SecretaryoftheDepartmentofScienceandTechnology(DOST);(e) ChiefofthePhilippineNationalPolice(PNP);(f) ChairpersonoftheCommissiononHumanRights(CHR);(g) ChairpersonoftheCommissiononInformationandCommunicationsTechnology
(CICT);(h) CommissioneroftheNationalTelecommunicationsCommission(NTC);(i) ExecutiveDirectoroftheCouncilfortheWelfareofChildren(CWC);

(j) ExecutiveDirectorofthePhilippineCenterforTransnationalCrimes(PCTC);(k) ExecutiveDirectoroftheOpticalMediaBoard(OMB);(l) DirectoroftheNationalBureauofInvestigation(NBI);and(m) Three (3) representatives from children's nongovernmental organizations.
These representatives shall be nominated by the government agencyrepresentativesof theCouncil for appointmentby thePresident for a termofthree(3)yearsandmaybereneweduponrenominationandreappointmentbytheCouncilandthePresident,respectively.
TheCouncilshallelectaViceChairpersonfromamongitsmemberswhoshallpresidein
theabsenceoftheChairpersonandhis/herpermanentrepresentative.
ThemembersoftheCouncilmaydesignatetheirpermanentrepresentatives,whoshallhave a rank not lower than assistant secretary or its equivalent, to meetings and shallreceive emoluments as may be determined by the Council in accordance with existingbudgetandaccountingrulesandregulations.
Section6.Functions of the CouncilTheCouncilshallhavethefollowingpowersand
functions:
(a) Formulate comprehensive and integrated plans and programs to prevent andsuppressanyformofchildpornography;
(b) Promulgate rules and regulations as may be necessary for the effectiveimplementationoftheAct;
(c) MonitorandoverseethestrictimplementationoftheAct;
(d) Coordinate the programs and projects of the various member agencies toeffectivelyaddresstheissuesandproblemsattendanttochildpornography;
(e) Conduct and coordinate massive information dissemination campaign on the
provisionsofthelawandtheIRR,andthevariousissuesandproblemsattendanttochildpornography,bothatthenationalandlocal levels,preferablywiththeparticipationoftheFilipinochildrenandyouthaspeertrainersandcounselors;
(f) Establishandmaintainadatabaseonchildpornographyactivitiesandcases,to
be shared among the concerned government agencies, without violating therighttoprivacyofthechildandhis/herfamily,andconsistentwiththeprovisionof,standards,andprocedures,fordisclosureinSection13oftheAct;
(g) Setclearobjectivesandstandardsfordatasharing,includingbutnotlimitedto,
policy and program development, monitoring the status of cases,implementation of the law, evaluation of the effectivity of the programs andservices,andidentificationofkeyresultindicators;

(h) Developasecuresystemofdatasharingandcoordinationamongagencies,anddevelop a uniform format for gathering data on child pornography, and forgeneratingreportsforinformationandmonitoring,includingbutnotlimitedto:the profiling of perpetrators; sex disaggregated data; themodus operandi ofperpetrators;themediumofpropagatingchildpornography;thecircumstancesthat hinder, facilitate and accompany the incidence; and other relevantinformation;
(i) Directotheragenciestoimmediatelyrespondtotheproblemsbroughttotheir
attentionandreporttotheCouncilontheactiontaken;(j) Assist in the filing of cases against individuals, agencies, institutions or
establishmentsthatviolatetheprovisionsoftheAct;(k) Formulateaprogramforthereintegrationofvictimsofchildpornography;(l) Secure from any department, bureau, office, agency or instrumentality of the
governmentorfromNGOsandothercivicorganizationssuchassistanceasmaybeneededtoeffectivelyimplementtheAct;
(m) Complementthesharedgovernmentinformationsystemrelativetochildabuseand exploitation and ensure that the proper agencies conduct continuingresearch and study on the patterns and schemes of any form of childpornographywhichformbasisforpolicyformulationandprogramdirection;
(n) Develop the mechanism to ensure the timely, coordinated and effective
responsetocasesofchildpornography;(o) Recommend measures to enhance cooperative efforts and mutual assistance
among foreigncountries throughbilateraland/ormultilateralarrangements topreventandsuppressanyformofchildpornography;
(p) Adoptmeasuresandpolicies toprotect the rightsandneedsof thevictimsof
childpornographywhoareforeignnationalsinthePhilippines;(q) Participateininternationalforafortheexchangeofinformationandknowledge,
multilateralcooperation,andcoordinatedresponsiveaction incombatingchildpornography;
(r) Initiatetrainingprogramsinidentifyingandprovidingthenecessaryintervention
orassistancetovictimsofchildpornography;and(s) Exerciseallthepowersandperformsuchotherfunctionsnecessarytoattainthe
purposesandobjectivesoftheAct.

Section 7. Reportorial Functions Within sixty (60) days after the closing of eachcalendaryear,theCouncilshallsubmittotheOfficeofthePresidentandtheCongressionalOversightCommittee, theannual reporton thepolicies,plans,programsandactivitiesoftheCouncilrelativetotheimplementationoftheAct.
Section 8. Meetings of the Council The Council shall meet regularly at least once
every quarter, and the venue for such meetings shall be agreed upon by the Council.SpecialmeetingsmaybecalledbytheChairperson,astheneedarises.
Section9.Implementation of the Law at Sub-National and Local Levels TheCouncil
shalldevelopmechanismsandpartnerships toensure the implementationof the lawandtheserulesandregulationsatthesubnationalandlocallevels.

Section10.OrganizationTheDSWDshallestablishaSecretariattoassisttheCouncil
in the performance of its functions. The Secretary of the DSWD shall determine theorganizationalstructureandstaffingpatternoftheSecretariat.TheDSWDshallensuretheconstitutionofaSecretariatinthelocallevelsandthatappropriateknowledge,capabilitybuilding and projectmanagement tools and skills are possessed by the Secretariat in alllevels.

Section 11. Common Roles and Responsibilities of Council Member Agencies
Consistentwiththeirmandates,andincoordinationwithotherCouncilMembersandothernational government agencies, allmember government agencies shall have the followingcommonrolesandresponsibilities:
(a) Formulatepoliciesanddevelopprogramssupportiveandconsistentwiththe
objectivesoftheAct;(b) Enhancethecapabilityofitsofficersandpersonnelinvolvedinchild
pornographyissuesthroughappropriatetrainingandstaffsupportprograms;
(c) Undertakeinformation,educationandadvocacycampaignsagainstchildpornography,incoordinationwiththeDepartmentofEducation,wheneverappropriate;
(d) Coordinatewith,andtapexistingstructuresandresourcesforaddressing
childrenswelfareandconcerns;

(e) EnsuresufficientappropriationsfortheeffectiveimplementationoftheActandprovisionofmandatoryservices;and
(f) Documentbestpracticesasbasisforpolicyformulationandprogram
development.
Section12. Specific Roles and Responsibilities of National Government Agencies as Members of the Council Thefollowingnationalgovernmentagencies,whicharememberagenciesoftheCouncil,shallnotbelimitedto,thefollowingspecificrolesandresponsibilities:
(a) Department of Social Welfare and Development (DSWD)
(i) Provide,throughitsFieldOffices,psychosocialcounseling,temporaryshelterandothersupportservicestovictims/survivorsofchildpornographyandtheirfamilies;
(ii) Developprogramsandothersupportinterventions,suchasskillstrainingandlivelihoodservice,wheneverappropriate,tofacilitatetherecoveryandreintegrationofchildpornographyvictims/survivorsintotheirfamiliesandcommunities;
(iii) ProvidesocialwelfareservicestoFilipinovictimsofchildpornographyinothercountries,throughtheDSWDSocialWelfareAttachandsocialworkerspostedinforeigncountries,incoordinationwiththeLaborAttachesoftheDOLE,andtheofficialsofthePhilippineEmbassyandConsularOffices,whichservicesmayinclude,butnotbelimitedtostressmanagement,repatriationandotherappropriatepsychosocialinterventionsfortheirprotectionandwelfare;
(iv) Providetechnicalassistanceandconductcapabilitybuildingactivitiesforsocialwelfareofficers/socialworkersofLGUs,LocalChiefExecutives,LocalLegislators,andNGOs;
(v) AccreditNGOsthatprovideprogramsandservicestoensurethattheymeetthestandardssetbytheDepartment;and
(vi) Providetemporaryshelterandpsychosocialservicestoforeignnationalswhoarevictimsofchildpornography,asconfirmedbytheBureauofImmigration.
(b) Department of Justice (DOJ)
(i) Ensuretheimmediateinvestigationandprosecutionofpersonsfor
violationoftheAct,inaccordancewiththeRulesofCriminalProcedureandotherapplicablelaws,rulesandregulations;
(ii) Developappropriateproceduralrulesand/orguidelinesforthehandlingandprosecutionofchildpornographycases;
(iii) Designateandtrainprosecutorswhoshallinvestigateandprosecutechildpornographycases;

(iv) ConductcapabilitybuildingactivitiesinalllevelsoftheNationalProsecutionService(NPS)soastoensureasfaraspracticablethatthereareprosecutorsatthenationallevelandineachprovincialandcityleveloftheNPSwhohavespecializedtrainingintheinvestigationandprosecutionofchildpornographycases;
(v) Establishamechanismforfreelegalassistanceandmedicolegalservicesforchildpornographyvictimsandsurvivors,incoordinationwiththeDSWD,CHR,IntegratedBarofthePhilippines(IBP),DepartmentofHealth(DOH),localgovernmenthospitals,andotherNGOsandvolunteergroups;
(vi) Providewitnessprotectionandbenefittovictimsofchildpornography,theirfamilies,andtheirwitnesses,subjecttothequalificationsandrequirementsprescribedbyexistinglaws;
(vii) Conduct,incoordinationwithotherconcernedstakeholders,trainingandcontinuingeducationprograms,specificallyforDOJprosecutors,lawyers,andstatecounsels,publicattorneys,NBIagentsandotherlawenforcementofficersontheproperinvestigationandprosecutionofchildpornographycasesandrelatedtopicssuchastheuseofelectronicand/ordigitalevidenceintrialandcomputerforensics;
(viii) Receive,evaluate,processandinvestigateclaimsforcompensationofvictimsofchildpornographythroughtheBoardofClaimssubjecttotheprovisionsofR.A.No.7309andotherexistinglaws,rulesandregulations;
(ix) ReviewexistingprogramsontheprotectionofchildpornographyvictimsandtheirfamiliesandrecommendtotheIACACP,wheneverappropriate,theinstitutionofnewpoliciesandmeasuresfortheirenhancement;
(x) Conduct,astheCentralAuthorityoftheRepublicofthePhilippines,andincoordinationwiththeDFA,negotiationsformutuallegalassistanceandextraditiontreatieswithothercountriestoaddresscasesofchildpornographyandrelatedcrimes;and
(xi) Coordinatewithand/orseekassistancefromtheAntiMoneyLaunderingCouncil(AMLC)oncasesofchildpornographywithpossiblemoneylaunderingunderpinnings.
(c) Department of Labor and Employment (DOLE)
(i) Ensurethestrictimplementationofandcompliancewithexistinglaws,rulesandguidelinesrelativetotheemploymentofpersonslocallyandoverseas;
(ii) Reportcasesofchildpornography,involvingemployersandlaborrecruiters;
(iii) Makeavailableexistinglivelihoodprogramstothefamiliesofchildpornographyvictims;

(iv) Conductpublicawarenessprogramsandactivitiesamongemployersandemployeesintheprivatesector,topreventvictimizationandtosuppresschildpornography.
(d) Philippine National Police (PNP)
(i) Undertake surveillance and investigation of persons suspected to be
engaged in child pornography on its own orwhen public interestmayrequire;
(ii) Conduct capabilitybuilding activities for its members on gathering,preservation,andchainofcustodyofelectronicanddigitalevidence;
(iii) Provide technical assistance and support in the investigation of casesthat cut across regional and international borders, including but notlimited to training by local and international experts, acquiring thenecessaryhardwareandsoftwarefacilities,andnetworkingservices;
(iv) Coordinate closely with various law enforcement agencies to secureconcerted efforts for effective investigation and apprehension ofsuspectedchildpornographyoffenders;
(v) Develop guidelines for receiving criminal complaints and calls/requestsfor assistance to child pornography victims, investigation of childpornographycases,andrescueoperationprotocols;
(vi) DirectandsupervisetheenforcementofitsmandateundertheActanditsrulesandregulations;
(vii) Formulateplansandprogramsforthepreventionofchildpornography;(viii) Integratecourses/subjectson thecomprehensive,gendersensitiveand
childfriendly investigation and handling of child pornography cases intheprogramofinstructionoftrainingschoolsmanagedbythePNP;
(ix) Establish an AntiChild Pornography Section under the Women andChildrenProtectionDesk(WCPD)inallcityandmunicipalpolicestationsthat shall be responsible for the detection and investigation of childpornographycases;
(x) Developmanualsandinvestigationprotocols;and(xi) Issuedirectivesandguidelines for theregularsubmissionofreportson
childpornographycases,incoordinationwiththeDOJandtheDSWD,tosupport the establishment and maintenance of national databases,including the DSWD database of cases and the DOJ database ofoffenders.
(e) Commission on Human Rights
(i) Conductadvocacyandtrainingprogramsrelatingtoantichildpornography,amongtheAFP,PNPandtheacademicinstitutions;
(ii) InvestigateandrecommendforprosecutionviolationsoftheAct;(iii) Providelegalandfinancialassistancetovictimsofchildpornography;

(iv) IntegrateantipornographyeffortsintheBarangayHumanRightsActionCenter(BHRAC);and
(v) Monitorgovernmentcompliance to international human rights treatyobligationsrelatedtothesuppression/eliminationofchildpornography,particularlytheConventionfortheSuppressionofTrafficinPersonsandExploitation of the Prostitution of Others, the Convention on theElimination of All Forms of Discrimination Against Women, theConventionontheRightsoftheChild,theConventionontheProtectionof Migrant Workers and Members of Their Families, and the UNConvention Against Transnational Organized Crimes including itsProtocol to Prevent, Suppress and Punish Trafficking in Persons,EspeciallyWomenandChildren.
(f) Council for the Welfare of Children (CWC)
(i) Integrateinthenationalactionplansforchildren,strategiestoaddress
childpornography,andensuretheadoptionofsuchframeworksbythenationalgovernmentagencies,localgovernmentunitsandotherstakeholders;
(ii) Formulateandimplementadvocacycampaignsagainstchildpornography;
(iii) Integratetheindicatorsonchildpornographywithinthemacromonitoringsystemforchildren;and
(iv) Activelyadvocateandparticipateininternationalandregionaldiscussionandinitiativesonchildpornography,andincludethesameinallofitsinternationalcommitmentsandpolicypronouncements.
(g) Philippine Center on Transnational Crime (PCTC) (i) Serveasthefocalpointininternationallawenforcementcoordination
onchildpornography,particularlywiththeINTERPOL;(ii) Providetechnicalassistanceintheconductofinvestigationofchild
pornographycaseswithtransnationaldimension;and(iii) Undertakestrategicresearchesonthestructureanddynamicsofchild
pornographywithtransnationalcrimedimension,predicttrendsandanalyzegivenfactorsfortheformulationofindividualandcollectivestrategiesforthepreventionanddetectionofchildpornography,andtheapprehensionofcriminalelementsinvolved.
(h) National Bureau of Investigation (NBI) (i) Investigatepersonsandestablishmentssuspectedtobeengagedinchild
pornographyactivities,uponitsowninitiativeandaspublicinterestmay

require, and file appropriate charges against child pornographyoffenders;
(ii) Developaprotocolinhandlingchildpornographycases;(iii) Conductraidandrescueoperationincoordinationwiththeappropriate
localgovernmentunitsandtheirsocialwelfareanddevelopmentoffices;(iv) StrengthenthecapabilityofNBIagents/investigatorsandpersonnel,and
upgradethefacilitiesoftheunitshandlingchildpornographyandothercomputercrimescases;
(v) Provide technical assistance and capability building support on thegathering preservation and chain of custody of electronic and digitalevidence,wheneverproperlyrequestedininvestigationandprosecutionofchildpornographycases;
(vi) CoordinatewithalltheCouncilmemberagencies,andshareintelligenceinformationwhennecessary;and
(vii) Foster cooperation and coordination with international policeorganizations and law enforcement agencies of other countries in thedetection and apprehension of child pornography offenders, within oracrossnationalborders.
(i) Department of Science and Technology (DOST) (i) Support the Council in capacitybuilding activities particularly in its
programsandprojectstosupplementthelawenforcementaspectoftheAct;
(ii) Providetheassistanceinthedevelopmentofchildfriendlymaterialsaspart of its information dissemination campaign against childpornography. Also support the Council in developing internet controlmeasuresandcyberspaceregulations;
(iii) Foster and promote thedevelopment of onlinesafety and knowledgebasedproducttechnologiestodeterchildpornographyandhelpprovidesoftware and hardware support in coordination with other fundingagencies (international and local) for the development ofeducation/informationmodulesforchildren/students,teachers,parents,andthegeneralpublic;
(iv) Provide technical assistance in the interconnection, sharing ofdatabanks, and other cooperative action of government agencies inhandlingchildpornographycases.
(j) Commission on Information and Communications Technology (CICT) (i) Issuedirectives,setstandards,andpromulgaterulesandregulations,to
institutionalize the monitoring and periodic reporting mechanisms fortheregulationofISPsandICHs;

(ii) Coordinate closely with all the Council member agencies for effectivedetectionandinvestigationofsuspectedchildpornographyoffenders;
(iii) Issuedirectives,setstandards,andpromulgaterulesandregulations,foreffective pubic and private partnership initiatives against childpornography;
(iv) Formulateand implementplansandprogramstoencouragetheuseofICTinsupportofeffortsandinitiativesoftheIACACP
(v) Assist government agencies in formulating and implementing policies,programsandtheIACACPscampaignagainstchildpornography;
;
(vi) Coordinate with the concerned government agencies, LGUs and otherNGOs for the enhancement of investigation, reporting, rescuetechniques;and
(vii) Disseminate guidelines to all its network members on policies andprogramsaddressingissuesonchildpornography.
(k) National Telecommunications Commission (NTC) (i) Issuedirectives,setstandards,andpromulgaterulesandregulationsto
institutionalize the monitoring and periodic reporting mechanismsagainstchildpornographybytheISPs;
(ii) Protect consumers against themisuse of telecommunications facilitiesthat promote the proliferation of child pornography, and incorporateappropriate prevention measures in the service standards for theinformationandtelecommunicationsproviders;
(iii) Issue directives, set standards, and promulgate necessary proceduralrules for the preservation of evidence and/or log retention incoordinationwiththeDOJ;
(iv) Assist government agencies in formulating and implementing policies,programs and the InterAgencyCommittee campaign against childpornography;and
(v) Enlist the assistance of the telecommunication, broadcast and ICTsectors in theeffectivemonitoring, reportingand investigationof childpornographycases.
(l) Optical Media Board (OMB) (i) Integrate the provisions of the Act in regulating optical media
establishments including theprocessofgrantingor renewalof licensesfor specific periods, or to deny, suspend, or cancel the same, forviolationsoftheAct;
(ii) Conduct inspections, by itself or in coordinationwith other concernedagencies, of establishments or entities under its jurisdiction for thedetectionofopticalmediarelatedactivities thatwouldconstitutechildpornography;

(iii) Applyfororobtainsearchwarrantsfromanycourtof law,ortake intopreventive custody any optical media and/or material or equipment,including parts, accessories and paraphernalia used for themastering,manufacture or replication of optical media containing childpornography, including those media that are pandered as childpornography;
(iv) ActascomplainantinthecriminalprosecutionofviolatorsoftheActinrelationtoRANo.9239ortheOpticalMediaActof2003;
(v) Hearand resolveadministrative cases, imposeadministrative sanctionsincluding but not limited to the imposition of fines and penalties;confiscation of optical media; and suspension, nonrenewal orcancellationof the license tooperateand/or closureofestablishmentsor entities that violate the provisions of the Act in relation to RA No.9239;
(vi) Sharedataonchildpornographywithotherlawenforcementagencies(vii) Assist government agencies in formulating and implementing policies
andprogramsandtheIACACPinitscampaignagainstchildpornography;(viii) Coordinate with the concerned government agencies, LGUs and other
NGOs for the enhancement of investigation and reporting of childpornographycases;and
(ix) Disseminate guidelines to all its network members, local andinternational, on policies and programs addressing issues on childpornography.
Section 13. Roles of Non-Government Organizations. The NGOs shall have the
followingroles:(a) Assistgovernmentagenciesinformulatingandimplementingpolicies,programs
andadvocacycampaignsagainstchildpornography;(b) Develop and disseminate information, education and communication (IEC)
materialsagainstchildpornography;(c) Conduct capabilitybuilding activities for stakeholders and share their
experiencesandexpertiseinhandlingchildpornographycases;(d) Undertake programs and activities for the prevention, investigation and
prosecution of child pornography cases, in coordination with governmentagenciesandlocalofficials,whenappropriate;
(e) Undertakeprogramsandactivitiesfortherescue,recoveryandreintegrationofthe victims of child pornography and provision of support services for theirfamilies in coordination with government agencies and local officials, whenappropriate;
(f) Documentchildpornographycasesandbestpracticesandmodelsincombatingchildpornography;
(g) Conductresearchesandstudiesrelatedtochildpornography;and(h) Disseminate information guidelines to all its network members, local and
international,onpoliciesandprogramsaddressingissuesonchildpornography.

Section 14. Roles and Responsibilities of Other Concerned National Government Agencies. Consistent with their mandates under existing laws, the following agenciesshall: (i) Integrate child pornography issues in their strategy and program formulation;(ii)Implement programs and services for the prevention and suppression of childpornography as well as for the protection of child pornography victims; (iii) Assist theCouncil in the conductof informationdisseminationand training to frontlinegovernmentagencies, NGOs and the general public; and (iv) Ensure sufficient appropriation for theeffective implementationof theAct,especiallywith regard to theprovisionofmandatoryservices.
Theyshalllikewisehavethefollowingrolesandresponsibilities:
(a) Department of Foreign Affairs (DFA) (i) Make available its domestic and overseas resources and facilities
overseas and to provide services for Filipino victims and survivors ofchildpornography;
(ii) Explore means to further enhance its assistance in eliminating childpornography activities through closer networking with governmentagencies, nongovernment organizations, and other institutions in thecountry and overseas, particularly in the formulation of policies andimplementationofrelevantprograms;
(iii) Activelyparticipateinbilateral,regionalandinternationalinitiativesandcooperative arrangements aimed at suppressing child pornography,tracking, arresting and prosecuting offenders, assisting victims of childpornography,andmonitoringintercountryadoptioncases;
(iv) Further improve and enhance the security and reliability of Philippineissued passports, visas and travel documents in order to curtail childpornographyperpetratedthroughtheuseoffraudulentidentification,toproperlyandstrictly identifytravelers,andtorestrictthemovementofwouldbevictimsandoffendersalike.
(v) Integrate into the training and predeparture orientation seminars forForeignServicepersonnelatrainingmoduleonchildpornography.
(b) Department of the Interior and Local Government (DILG) (i) Conducta systematic information dissemination, advocacy, and
preventioncampaignsagainstchildpornography;(ii) Advocate and encourage the LGUs to issue directives, guidelines or
ordinances regulating the establishmentswithin their jurisdictions, andin coordinationwith the DSWD, developmodel ordinances to preventandsuppresschildpornography;
(iii) Assist theCouncil inmonitoringthe implementationof theActby localgovernmentunits;

(iv) AssisttheLGUsinstrengthening,activatingandmobilizingexistingchildfocused committees, councils, similar organizations, and special bodiesatthelocalleveltopreventandsuppresschildpornography;and
(v) Institutionalize a comprehensive, gender sensitive and childfriendlycurriculum in the Philippine Public Safety College on the investigationandhandlingofchildpornographycases.
(c) Department of Tourism (DOT)
(i) Formulateandimplement,incoordinationwithlocalgovernmentunits,
measures to stop sex tourism and other activities of tourismestablishmentsthatmightcontributetochildpornography;and
(ii) Provide training and capacitybuilding activities to its staff and touristsecurity officers on surveillance, investigation, and rescue operationproceduresandstrategies.
(d) Department of Education (DepEd)
(i) Integrate in the appropriate subject areas, core messages on child
pornographyintheelementaryandsecondarylevels,byprovidinglessonexemplar, with emphasis on their implications and social costs topersonsandcountry;
(ii) Issuedirectivestotheschoolsandrelatedorganizationstoensurestrictimplementationofthelaw;
(iii) Conductseminarworkshopsfortheeffectiveimplementationofthelaw;(iv) Submit quarterly reports to the IACACP on cases of child pornography
withinschools;(v) Immediatelyreportcasesofchildpornographytopoliceauthorities;(vi) Provideopportunitiesforvictimsofchildpornographyintheeducational
mainstream through the basic education, curricula, or alternativelearningsystems;and
(vii) Provide education and raise consciousness among schoolchildren inordertodiscouragetheuseandbuyingofchildpornography.
(e) Department of Health (DOH) (i) Makeavailable itsresourcesandfacilities inprovidingfreemedicaland
psychosocial services tovictimsofchildpornographywhichshall,atalltimes,beheldconfidential;
(ii) Conduct capabilitybuilding activities for health service professionals inhandlingchildpornographycases;and
(iii) Assist in the conduct of a systematic information dissemination,advocacy,andpreventioncampaignsagainstchildpornography.

(f) Department of Transportation and Communication (DOTC) (i) Provideguidelines for the land,seaandair transportproviderstotrain
theirpersonnelinchildpornographyrelatedissues;(ii) Standardizeguidelinesformonitoringchildpornographyineveryport;(iii) Deputize its attached agencies to provide free transportation and
assistancetochildpornographyvictims;and(iv) Monitor the promotion or advertisement of child pornography on the
Internet.
(g) Bureau of Immigration (BI) (i) Adoptmeasures for the apprehensionof suspected child pornography
offenders,bothattheplaceofarrivalanddeparture;(ii) EstablishnetworkswithLGUs for theeffectiveapprehensionof foreign
nationalssuspectedtobechildpornographyoffendersandtheircohorts;and
(iii) Developanddistributematerialscontainingadvisoryandotherpertinentinformationtoenhanceawarenessagainstchildpornography.
(h) Philippine Commission on Women (PCW) (i) Assist the Council in the formulation and monitoring of gender
responsive policies addressing the issue of child pornography, incoordinationwithrelevantgovernmentagencies;
(ii) Assist in thedevelopmentofgender responsivedocumentationsystemin coordination with other agencies and the National StatisticalCoordination Board (NSCB) through its monitoring of the situation ofwomenandgirlsparticularlyonchildpornography;and
(iii) Assist the Council in the formulation of prevention and reintegrationprograms.
(j) Overseas Workers Welfare Administration (OWWA) (i) Assist in the informationandadvocacycampaignamongdepartingand
onsite OFWs and their families through its PreDeparture OrientationSeminar, PostArrival Orientation Seminar, and other educationalactivitieslocallyandoverseas
(ii) Assist in thedocumentationofcasesofchildpornographyandproviderepatriation,psychosocialandotherwelfareservicestooverseasFilipinovictimsofchildpornographyandtheirfamilies.

(k) Philippine Information Agency (PIA) (i) Enhance public awareness on child pornography, pertinent laws and
possible actions to prevent victimization and revictimization bydeveloping communication advocacy plans, as well as printing anddistributingappropriateinformationmaterials;
(ii) Spearhead and provide training seminars to media practitioners toensure the widest possible information dissemination, and optimizepublic awareness and participation in the battle against childpornography,aswellastoprotecttheprivacyrightsofvictimsandtheirfamilymembers.
(iii) Assist in the conduct of a systematic information dissemination,advocacy,andpreventioncampaignsagainstchildpornography.
(l) Technical Education and Skills Development Authority (TESDA) (i) Formulateaspecialprogramtoprovideskillsandenhancementtraining
programsforvictimsofchildpornographyaspartoftheirrecovery,reintegrationandmainstreamingprogram;and
(ii) Assistintheconductofasystematicinformationdissemination,advocacy,andpreventioncampaignsagainstchildpornographythroughthedistributionofantichildpornographymaterialsdevelopedbytheCounciltopublicandprivatetechnicalvocationalinstitutions.
Section15. Assistance of Other Agencies and Institutions. InimplementingtheActand
these IRR, the IACACPand the agencies concernedmay seek and enlist the assistanceofNGOs,peoplesorganizations(POs),civicorganizationsandothervolunteergroups.
Section16. Roles and Responsibilities of Local Government Units (LGUs). TheLGUsin
alllevels,consistentwiththeirrespectivemandatesundertheLocalGovernmentCode,shallhavethefollowingrolesandresponsibilities:
(a) Monitor and regulate the establishment and operation of internet cafs and
kiosksorsimilarestablishmentsinordertopreventviolationoftheprovisionoftheAct;
(b) Monitoranddocumentcasesofchildpornographyintheirareasofjurisdiction,throughtheirrespectivesocialwelfareanddevelopmentoffices;
(c) Undertakeeducationandinformationcampaignstopreventandsuppresschildpornography;
(d) Support theestablishmentofnationaldatabases, incoordinationwith theDOJand the DSWD, through the regular submission of reports by the respectivesocialwelfareanddevelopmentoffice;
(e) Establish and support communitybased initiatives which address childpornography;

(f) Providebasicsocialservicesfortheprevention,rescue,recovery,rehabilitationand reintegration/after care support services to victims of child pornographyandtheirfamilies;
(g) Enactandimplementordinancesorissuancesaimedatprovidingprotectionandsupport to victims of child pornography and adopt measures to prevent andsuppresschildpornographycases,includingthecancellationoflicensesfortheirviolation;
(h) CoordinatewiththeCouncilandtheDILGtoensureuniformityandconsistencybetweenthelocalordinancesorissuancesandtheseRules;
(i) EnsuretheparticipationoftheSangguniangKabataan(SK),andtheallocationofsufficientfundsfromtheSKfundsandresourcesfortheinitiativesagainstchildpornographyatthebarangaylevel;
(j) Strengthen, activate andmobilize existing childfocused committees, councils,similarorganizations, and LGUs at theprovincial, city,municipal andbarangaylevelstopreventandsuppresschildpornographycases;and
(k) Assistinthefilingofcases.

Section17. Duties of an Internet Service Provider (ISP). All Internet ServiceProviders (ISPs)shallnotify thePNPortheNBIwithinseven(7)days fromobtaining factsandcircumstancesthatanyformofchildpornographyisbeingcommittedusingitsserverorfacility. Nothing in this Sectionmay be construed to require an Internet Service Provider(ISP)toengageinthemonitoringofanyuser,subscriberorcustomer,orthecontentofanycommunicationofanysuchperson:Provided,Thatno InternetServiceProvider (ISP)shallbeheldcivillyliablefordamagesonaccountofanynoticegiveningoodfaithincompliancewiththisSection.
Furthermore, an ISP shall preserve such evidence for purposes of investigation and
prosecutionbyrelevantauthorities. An ISPshall, upon the requestofproperauthorities, furnish theparticularsofuserswhogainedorattemptedtogainaccesstoanInternetaddresswhichcontainsanyformofchildpornography.
All Internet Service Providers (ISPs) shall install available technology, program or
software toensure thataccess toor transmittalof any formof childpornographywill beblockedorfiltered.
An ISPwho shall knowingly,willfully and intentionally violate this provision shall be
subjecttothepenaltyprovidedunderSection15(k)oftheAct.

Section 18. Responsibilities of Mall Owners/Operators and Owners or Lessors of other Business Establishments.Allmallowners/operatorsandownersorlessorsofotherbusinessestablishmentsshallnotifythePNPortheNBIwithinseven(7)daysfromobtainingfacts and circumstances that child pornography is being committed in their premises:Provided, That public display of any formof child pornographywithin their premises is aconclusive presumption of the knowledge of the mall owners/operators and owners orlessorsofotherbusinessestablishmentsoftheviolationoftheAct:Provided,further,Thatadisputablepresumptionofknowledgebymallowners/operatorsandownersorlessorsofotherbusinessestablishments isestablished if, through theexerciseofordinarydiligence,mallowners/operatorsandownersorlessorsofotherbusinessestablishmentsshouldknoworreasonablyknowthatviolationsoftheActarebeingcommittedintheirpremises.
Photo developers, information technology (IT) professionals, credit card companiesand banks, and any personwho has direct knowledge of any form of child pornographyactivities shall have the duty to report any suspected child pornography materials ortransactionstotheproperauthoritieswithinseven(7)daysfromdiscoverythereof.
Anywillful and intentional violationof this provision shall be subject to thepenalty
providedunderSection15(l)oftheAct.
Section19.Duties of an Internet Content Host3AnInternetcontenthostshall:a) NothostanyformofchildpornographyonitsInternetaddress;
b) Withinseven (7)days, report thepresenceofany formofchildpornography,as
well as the particulars of the personmaintaining, hosting, distributing or in anymannercontributingtosuchInternetaddress,totheproperauthorities;and
c) Preservesuchevidenceforpurposesofinvestigationandprosecutionbyrelevant
authorities.
An Internet content host shall, upon the request of proper authorities, furnish theparticulars of users who gained or attempted to gain access to an internet address thatcontainsanyformofchildpornographymaterials.
AnInternetcontenthostwhoshallknowingly,willfullyandintentionallyviolatethisprovisionshallbesubjecttothepenaltyprovidedunderSection15(j)oftheAct:ProvidedThat,thefailureoftheinternetcontenthosttoremoveanyformofchildpornographywithinfortyeight(48)hoursfromreceivingthenoticethatanyformofchildpornographyishittingitsservershallbeaconclusiveevidenceofwillfulandintentionalviolationthereof.
Section20. Liability for Failure to Report Child Pornography.Anypersonwhois the owner, manager, partner, member of the board of directors, responsible officerand/or employee of the above mentioned business establishments who willfully andintentionallyfailstocomplywiththeirdutiesandresponsibilitiesasprovidedunderthisruleshallbeliableforviolationofSections9,10and11oftheAct.

Section21. Duty of Persons with Direct Knowledge of Child Pornography Activities. Any person who has direct knowledge of any form of child pornographyactivities shall have the duty to report any suspected child pornography materials ortransactionstotheproperauthorities.

Section22. Unlawful or Prohibited Acts.Itshallbeunlawfulforanyperson:
a) To hire, employ, use, persuade, induce or coerce a child to perform in thecreationorproductionofanyformofchildpornography;
b) Toproduce,direct,manufacture,orcreateanyformofchildpornography;
c) To publish, offer, transmit, sell, distribute, broadcast, advertise, promote,
export,orimportanyformofchildpornography;
d) To possess any form of child pornography with the intent to sell, distribute,publish,orbroadcast:Provided,Thatpossessionofthree(3)ormorearticlesofchildpornographyof thesame formshallbeprima facieevidenceof intent tosell,distribute,publish,orbroadcast;
e) Toknowingly,willfully,andintentionallyprovideavenueforthecommissionof
prohibited acts such as, but not limited to, dens, private rooms, cubicles,cinemas,houses,orinestablishmentspurportingtobealegitimatebusiness;
f) For film distributors, theaters, and telecommunication companies, by
themselvesorincooperationwithotherentities,todistributeanyformofchildpornography;
g) For a parent, legal guardian, or personhaving custodyor controlof a child toknowinglypermitthechildtoengage,participate,orassistinanyformofchildpornography;
h) Toengageintheluringorgroomingofachild;
i) Toengageinpanderingofanyformofchildpornography;
j) Towillfullyaccessanyformofchildpornography;
k) To conspire to commit any of the prohibited acts stated in this Section.Conspiracytocommitanyformofchildpornographyshallbecommittedwhen

two(2)ormorepersonscometoanagreementconcerningthecommissionofanyofthesaidprohibitedactsanddecidetocommitit;and
l) Topossessanyformofchildpornography.
Section23. Penalties and Sanctions. 3ThefollowingpenaltiesandsanctionsareherebyestablishedforoffensesenumeratedintheAct:
a) AnypersonfoundguiltyofsyndicatedchildpornographyasdefinedinSection5oftheAct shall suffer thepenaltyof reclusionperpetua anda fineofnot less thanTwo million pesos (P2,000,000.00) but not more than Five million pesos(P5,000,000.00).
b) AnypersonfoundguiltyofviolatingSection4(a),(b),(c)oftheActshallsufferthe
penaltyof reclusion temporal in itsmaximumperiodanda fineof not less thanOne million pesos (P1,000,000.00) but not more than Two million pesos(P2,000,000.00);
c) AnypersonfoundguiltyofviolatingSection4(d),(e),and(f)oftheActshallsufferthepenaltyofreclusiontemporalinitsmediumperiodandafineofnotlessthanSevenhundredfiftythousandpesos(P750,000.00)butnotmorethanOnemillionpesos(P1,000,000.00);
d) AnypersonfoundguiltyofviolatingSection4(g)oftheActshallsufferthepenaltyof reclusion temporal in its minimum period and a fine of not less than Fivehundred thousand pesos (P500,000.00) but not more than Seven hundredthousandpesos(P700,000.00);
e) AnypersonfoundguiltyofviolatingSection4(h)oftheActshallsufferthepenaltyofprisionmayorinitsmaximumperiodandafineofnotlessthanThreehundredthousand pesos (P300,000.00) but notmore than Five hundred thousand pesos(P500,000.00);
f) AnypersonfoundguiltyofviolatingSection4(i)oftheActshallsufferthepenaltyofprisionmayorinitsminimumperiodandafineofnotlessthanThreehundredthousand pesos (P300,000.00) but notmore than Five hundred thousand pesos(P500,000.00);
g) AnypersonfoundguiltyofviolatingSection4(j)oftheActshallsufferthepenaltyof prision correccional in its maximum period and a fine of not less than Twohundredthousandpesos(P200,000.00)butnotmorethanThreethousandpesos(P300,000.00);
h) AnypersonfoundguiltyofviolatingSection4(k)oftheActshallsufferthepenaltyof prision correccional in its medium period and a fine of not less than One

hundred thousand pesos (P100,000.00) but not more than Two hundred fiftythousandpesos(P250,000.00);
i) AnypersonfoundguiltyofviolatingSection4(l)oftheActshallsufferthepenaltyofarrestomayorinitsminimumperiodandafineofnotlessthanFiftythousandpesos (P50,000.00) but not more than One hundred thousand pesos(P100,000.00);
j) AnypersonfoundguiltyofviolatingSection11oftheActshallsufferthepenaltyofprisioncorreccionalinitsmediumperiodandafineofnotlessthanOnemillionpesos (P1,000,000.00) but notmore than Twomillion pesos (P2,000,000.00) forthefirstoffense.Inthecaseofasubsequentoffense,thepenaltyshallbeafineofnotlessthanTwomillionpesos(P2,000,000.00)butnotmorethanThreemillionpesos (P3,000,000.00) and revocation of its license to operate and immediateclosureoftheestablishment;
k) Any ISP found guilty ofwillfully and knowingly failing to complywith thenotice
andinstallationrequirementsunderSection9oftheActshallsufferthepenaltyofafineofnot lessthanFivehundredthousandpesos(P500,000.00)butnotmorethan One million pesos (P1,000,000.00) for the first offense. In the case ofsubsequentoffense,thepenaltyshallbeafineofnotlessthanOnemillionpesos(P1,000,000.00) but not more than Two million pesos (P2,000,000.00) andrevocationofitslicensetooperate;
l) Anymallowneroroperatorandownerorlessorofotherbusinessestablishments,including photo developers, information technology professionals, credit cardcompanies, and banks, found guilty of willfully and knowingly failing to complywiththenoticerequirementsunderSection10oftheActshallsufferthepenaltyofafineofnotlessthanOnemillionpesos(P1,000,000.00)butnotmorethanTwomillion pesos (P2,000,000.00) for the first offense. In the case of a subsequentoffense, the penalty shall be a fine of not less than Two million pesos(P2,000,000.00) but not more than Three million pesos (P3,000,000.00) andrevocationof its licensetooperateand immediateclosureof theestablishment;and
m) AnypersonfoundguiltyofviolatingSection13oftheActshallsufferthepenalty
ofarrestomayor in itsminimumperiodandafineofnot lessthanOnehundredthousandpesos(P100,000.00)butnotmorethanThreehundredthousandpesos(P300,000.00).
Section24. Syndicated Child Pornography.Thecrimeofchildpornography is
deemedcommittedbya syndicate if carriedoutbyagroupof three (3)ormorepersonsconspiringorconfederatingwithoneanotherandshallbepunishedunderSection15(a)oftheAct.

Section25. Common Penal Provisions.3
a) Iftheoffenderisanascendant,parent,guardian,stepparentorcollateralrelativewithinthethirddegreeofconsanguinityoraffinity,oranypersonhavingcontrolormoralascendancyoverthechild,thepenaltyprovidedhereinshallbereclusiontemporal in itsminimumperiod:Provided, That thisprovision shall notapply toSection4(g)oftheAct;
b) Iftheoffenderisajuridicalperson,thepenaltyshallbeimposedupontheowner,manager, partner, member of the board of directors, and/or any responsibleofficer,whoparticipated inthecommissionofthecrimeorshallhaveknowinglypermittedorfailedtopreventitscommission;
c) If the offender is a foreigner, he / she shall be immediately deported after thecompleteserviceofhis/hersentenceandshall foreverbebarredfromenteringthecountry;and
d) Thepenaltyprovided for in theAct shallbe imposed in itsmaximumduration if
theoffenderisapublicofficeroremployee.

CO'FIDE'TIA%IT;
Section26. Confidentiality.Therighttoprivacyofthechildshallbeensuredatanystageof the investigation,prosecutionandtrialofanoffenseundertheAct.Towardsthisend,thefollowingrulesshallbeobserved:
(a) The judge, prosecutor or any officer of the law towhom the complaint has beenreferredtomay,whenevernecessarytoensureafairandimpartialproceedingandafter considering all circumstances for the best interest of the child, conduct acloseddoorinvestigation,prosecutionortrial;
(b) Thenameandpersonalcircumstancesofthechild, includingthechild's immediatefamily, or any other information tending to establish his/her identity shall not bedisclosedtothepublic;
(c) Anyrecordregardingachildshallbeconfidentialandkeptunderseal.Exceptuponwritten request and order of the court, a record shall be released only to thefollowingpersons:
(1)Membersofthecourtstaffforadministrativeuse;
(2)Theprosecutingattorney;
(3)Defensecounsel;
(4)Theguardianadlitem;

(5)Agentsofinvestigatinglawenforcementagenciesand
(6)Otherpersonsasdeterminedbythecourt.
(d) Anyformofchildpornographythatispartofthecourtrecordsshallbesubjecttoa
protectiveorderthatprovidesasfollows:(1) Anyformofchildpornographymaybeviewedonlybytheparties,theircounsel,
theirexpertwitnessandguardianadlitem;
(2) Neitherformofchildpornographynoranyportionthereofshallbedivulgedtoanyotherperson,exceptasnecessaryforinvestigation,prosecutionortrial;and
(3) Nopersonshallbegrantedaccesstoanyformofchildpornographyoranypart
thereofunlesshe/shesignsawrittenaffirmationthathe/shehasreceivedandreadacopyof theprotectionorder; thathe/shesubmits to the jurisdictionofthe court with respect to the protective order; and that, in case of violationthereof,he/shewillbesubject tothecontemptpowerof thecourtaswellas,any other penalties for the violation of the Act and other existing applicablelaws.
(e) In cases when prosecution or trial is conducted behind closed doors, it shall be
unlawful for any editor, publisher and reporter or columnist in case of printedmaterials, announcer or producer in case of television and radio, producer anddirectorofafilmincaseofthemovieindustry,oranypersonutilizingthetrimediafacilitiesorinformationtechnologytopublishorbroadcastthenamesofthevictimsofanycaseofchildpornography.
Any violation of this provision shall be subject to the penalty provided for under
Section15(m)oftheAct.The Rule on Examination of a Child Witness as well as other existing Rules of
Procedure shall be suppletorily applied to protect the privacy of the child and theconfidentialityoftheproceedings,providedtheirprovisionsareconsistentwiththeActandtheseRules.

Section27. Responsibility of the DSWD. The DSWD, and the local social
welfareanddevelopmentoffice(LSWDO),shallensurethatthechildwhoisavictimofanyformof child pornography is providedwith appropriate care, assistance, and support fortheirrecovery,rehabilitation,andreintegration,inaccordancewithexistinglaws.

The DSWD, through its Regional Offices, will provide technical assistance to,prescribeareportingsystem,andshallmonitor,theLSWDOsandtheNGOs.Towardsthisend,theDSWDshallperformthefollowingtasks:
1. Promulgate and enforce standards for accreditation of shelters, programsandservicesbyLGUsandNGOs;

Section28. Protective Custody of the Child Victim.TheDSWD,andthesocialworker, officer or representative of the local social welfare and development office(LSWDO) and the social worker, officer or representative of a licensed childcaringinstitution, shall immediatelyplace thechild victimunderprotective custody,pursuant toRepublicActNo.7610andExecutiveOrderNo.56,Seriesof1986,andensurethatthechildvictim is provided with appropriate care, assistance, and support for their recovery,rehabilitation,andreintegration,inaccordancewithexistinglaws.
Section29. Immunity of Officer Taking the Child Under Protective Custody.In
the regular performance of this protective custody function, the DSWD, and the socialworker,officeror representativeof local socialwelfareanddevelopmentoffice (LSWDO),and the social worker or officer of a licensed childcaring agency, shall be free from anyadministrative,civilorcriminalliability.

Pursuant toRepublic ActNo. 7610, all establishments and enterpriseswhichpromote or facilitate child pornography, obscene publications and indecent shows, andotheractsofabuse, shallbe immediatelyclosedand theirauthorityor license tooperatecancelled, by the DSWD and/or the LGUs, without prejudice to the owner or manager

thereofbeingprosecutedundertheAct,RepublicActNo.7610,and/ortheRevisedPenalCode, as amended, or special laws. A sign with the words "OFF LIMITS" shall beconspicuouslydisplayedoutsidetheestablishmentsorenterprisesbytheDSWDand/ortheLGUs, for suchperiod,which shall not be less thanone (1) year, as theDepartmentmaydetermine. The unauthorized removal of such sign shall be punishable by prisioncorreccional. Pursuant to Section 6 of Republic Act No. 9231, the Secretary of Labor andEmployment,orhis/herdulyauthorizedrepresentative,mayordertheimmediateclosureofsuch establishment or enterprise, if such establishment or enterprise is engaged inprostitutionorinobsceneorlewdshows.
An establishment shall be deemed to promote or facilitate child pornography,obscenepublicationsandindecentshows,andotheractsofabuse, iftheactsconstitutingthesameoccurinthepremisesofsaidestablishmentundertheAct,RA7610,orinviolationof theRevisedPenalCode, asamended.Anenterprise suchasa sauna, travel agency,orrecruitmentagencywhich:promotestheaforementionedactsaspartofatourforforeigntourists;exhibitschildreninalewdorindecentshow;provideschildmasseursforadultsofthe same or opposite sex and said services include any lascivious conduct with thecustomers; or solicits children or activities constituting the aforementioned acts shall bedeemedtohavecommittedtheactspenalizedherein.

Section32.Non-Discrimination.TheLGUsshallprovidetheMandatoryServicestothe
child victims and their families, who are rescued and/or found within their areas ofjurisdiction,regardlessoftheiractualoriginorhabitualresidence. FailuretoprovidesuchMandatoryServicesshallconstitutegrossneglectofduty.
Section 33. Programs. The Council shall develop and implement the necessaryprograms that will prevent any form of child pornography, as well as protect, heal andreintegratethechildintothemainstreamofsociety.Suchprogramsshallincludebutisnotlimitedtothefollowing:
(a) Ensuretheprovisionofmandatoryservices,includingcounseling,freelegalservices,medical or psychological services, livelihood and skills training and educationalassistancetothechildpursuanttoSection18oftheAct;
(b) Sponsorshipofanationalresearchprogramonanyformofchildpornographyandotheractscoveredbythelawandtheestablishmentofadatacollectionsystemformonitoringandevaluationpurposes;
(c) Ensure the provision of necessary technical and material support services toappropriategovernmentagenciesandnongovernmentalorganizations:
(d) Sponsorshipofconferencesandseminars toprovidevenue forconsensusbuildingamongstthepublic,theacademe,government,nongovernmentalandinternationalorganizations;and
(e) Promotionofinformationandeducationcampaign.

Section34. Duty to Report. Any person who has direct knowledge of any
form of child pornography activities shall have the duty to report any suspected childpornographymaterialstotheproperauthorities,includingbutnotlimitedtotheDSWD,totheLSWDO,tothepoliceorother lawenforcement agency,or toaBarangayCouncil fortheProtectionofChildren.
Section35. Immunity for Reporting. Any person who, acting in good faith,
shallreportacaseofchildpornographyshallbefreefromanyciviloradministrativeliabilityarisingtherefrom.Thereshallbeapresumptionthatanysuchpersonactedingoodfaith.
Section36. Structures and Mechanism for Reporting. Each AntiChild
PornographySectionundertheWomenandChildrenProtectionDesk(WCPD)inallcityandmunicipalpolicestationsshallberesponsiblefortheperiodicreportingoftheincidenceofchild pornography to the WCPD in Camp Crame, every quarter, or as often as may berequiredbythe latter. TheWCPDshallconsolidatethedata,andsubmit thesametotheIACACP.
The LSWDO in all cities and municipalities shall be responsible for the periodic
reporting of the cases of child pornography to the Regional Offices of the DSWD, everyquarter,orasoftenasmayberequiredbythelatter.TheDSWDshallconsolidatethedatainitsDatabaseofCases,andsubmitthesametotheIACACP.
TheOfficeoftheCityandProvincialProsecutorsshallberesponsiblefortheperiodic
reportingofthechildpornographyoffenderstotheDOJ,everyquarter,orasoftenasmayberequiredbythelatter.TheDOJshallconsolidatethedatainitsDatabaseofOffenders,andsubmitthesametotheIACACP.

Section37. Who may file a Complaint. Complaints on cases of any form of
child pornography and other offenses punishable under the Act and these Rulesmay befiledbythefollowing:
(a) Offendedparty;(b) Parentsorguardiansofthechild;(c) Ascendantorcollateralrelativewithinthethirddegreeofconsanguinityofthechild;(d) Officer,socialworkerorrepresentativeofalicensedchildcaringinstitution;(e) Officer or social worker of the Department of Social Welfare and Development
(DSWD);(f) Localsocialwelfaredevelopmentofficer;(g) Barangaychairperson;

(h) Anylawenforcementofficer;(i) At least three (3) concerned responsible citizens residing in the place where the
violationoccurred;or(j) Anypersonwhohaspersonalknowledgeofthecircumstancesofthecommissionof
anyoffenseundertheAct. Section38. Appointment of Special Prosecutors. The Department of Justice
(DOJ)shallappointordesignatespecialprosecutorstoprosecutecasesfortheviolationoftheAct.
TheprosecutorsshallundergoatrainingprogramdevelopedbytheCouncilinorderforthemtobeequippedtoprosecutecasesfortheviolationoftheAct.
Section39. Institution of Criminal and Civil Actions.TheinstitutionofcriminalandcivilactionshallbegovernedbytheRulesonCriminalProcedureandother issuancesfromtheSupremeCourt.
Section40. Exemption from Filing Fees. The Council will advocate for theexemptionfromthepaymentoffilingfees,whenthevictimofchildpornographyinstitutesaseparatecivilactionfortherecoveryofcivildamages.
Section41. Venue.Theactionmaybefiledintheplacewheretheoffensewas
committed or where any of its elements occurred Provided, that the court where thecriminalactionisfirstfiledshallacquirejurisdictiontotheexclusionofothercourts.
Section42. Jurisdiction.JurisdictionovercasesfortheviolationoftheActshallbe vested in the Family Courtwhich has territorial jurisdiction over the placewhere theoffenseoranyofitsessentialelementswascommittedpursuanttoRepublicActNo.8369,otherwiseknownas"FamilyCourtsActof1997".
Inprovincesorcitieswhere therearenoFamilyCourts, jurisdictionovercases fortheviolationoftheActshallbevestedwiththeRegionalTrialCourt.

Section43. Confiscation and Forfeiture of the Proceeds, Tools and Instruments
Used in Child Pornography.InadditiontothepenaltyimposedfortheviolationoftheAct,thecourt shallorder the confiscationand forfeiture in favorof thegovernmentofall theproceeds,toolsandinstrumentsusedinthecommissionofthecrime,unlesstheyaretheproperty of a third person not liable for the unlawful act;Provided,however, That allawards for damages shall be taken from the personal and separate properties of theoffender;Provided,further, That if suchpropertiesare insufficient, thedeficiency shall betakenfromtheconfiscatedandforfeitedproceeds,toolsandinstruments.

All proceeds derived from the sale of properties used for the commission of anyformofchildpornographyshallaccruetothespecialaccountoftheDSWDwhichshallbeusedexclusivelyfortheimplementationoftheAct.
When theproceeds, tools and instrumentsused in the commissionof theoffensehavebeendestroyed, diminished in valueor otherwise renderedworthless by any act oromission, directly or indirectly, of the offender, or it has been concealed, removed,convertedor transferred toprevent the same frombeing foundor to avoid forfeitureorconfiscation, the offender shall be ordered to pay the amount equal to the value of theproceeds,toolsandinstrumentsusedinthecommissionoftheoffense.

Section44. Child Pornography as a Transnational Crime. Pursuant to the
Convention on Transnational Organized Crime, the DOJ may execute the request of aforeign state for assistance in the investigation or prosecution of any form of childpornography by: (1) conducting a preliminary investigation against the offender and, ifappropriate, to file the necessary charges in court; (2) giving information needed by theforeign state; and (3) to apply for an order of forfeiture of any proceeds or monetaryinstrumentorproperlylocatedinthePhilippinesusedinconnectionwithchildpornographyinthecourt;Provided,ThatiftheDOJrefusestoactontherequestoftheforeignstate,itmust inform the foreign state of any valid reason for not executing the request or fordelaying the execution thereof:Provided,further, That the principles of mutuality andreciprocityshall,forthispurpose,beatalltimesrecognized.
Section45. Extradition. The DOJ, in consultation with the Department ofForeign Affairs (DFA), shall endeavor to include child pornography among extraditableoffensesinfuturetreaties.

Section46. Appropriations. The amount necessary to implement the
provisionsoftheAntiChildPornographyActandtheoperationalizationoftheInterAgencyCouncil againstChildPornography shall be included in theannualGeneralAppropriationsAct.
Allproceedsderivedfromaswellasthesaleofpropertiesusedforthecommissionof any formof child pornography shall accrue to the special account of theDSWDwhichshallbeusedexclusivelyfortheproperimplementationoftheAct. Section47. Funding for Mandatory Services. The LGUs shall ensure theinclusion of funds in the Local Investment Plan to ensure the full implementation of the

MandatoryServicesforvictimsofchildpornographyandtheirfamilies.Likewise,theLGUsare further mandated to integrate the Mandatory Services in their Annual Gender andDevelopment(GAD)Plan.

Section48. Suppletory Application of the Revised Penal Code. The Revised
PenalCode,theRulesofCourt,otherlawsandIRRs,shallbesuppletorilyapplicabletotheseRules.
Section49. Separability Clause. If any part of these Rules is declaredunconstitutionalorinvalid,theotherprovisionsnotaffectedtherebyshallcontinuetobeinfullforceandeffect.
Section50. Repealing Clause. All rules and regulations inconsistent with or
contrary to the provisions of these Rules are deemed amended, modified or repealedaccordingly.
Section51. Effectivity. These Rules shall take effect after fifteen (15) daysfollowingitscompletepublicationandfiling,inaccordancewithlaw.
