The south produces 85% of Sudan’s oil. By supporting south Su- dan’s rebels, USA now has access to another source of fuel, and a springboard for imperialism in East Africa. But, like all of USA’s imperi- alist adventures, this one is not going to be smooth sail- ing. There are at least 7 re- bel groups in south Sudan, all vying for power. Yet an- other country, like Somalia, Afghanistan, Iraq and Cen- tral America, seems to be headed for a mess-up in the wake of serving America’s personal interests. When the world’s newest country came into existence on 9 July 2011 as South Su- dan, the world led by USA rushed in with congratula- tory messages. Seemingly a simple case of a country whose people wanted independence. But a look behind the scenes re- veals the murky world of anti-Muslim politics: SUPPORT America gave the south Su- dan rebels every possible support. USA - Talks to break the deadlock over the US na-tional debt broke up without agreement. The US risks defaulting on its debts in three weeks, when the federal budget runs out. (BBC, 11 Jul) USA - USA breached the international law of the Vienna Convention when Texas executed a Mexican citizen, the UN's senior human rights official said. (BBC, 8 Jul) BANGLADESH - 31 school children died after their vehicle crashed into a canal. (BBC, 11 Jul) PAKISTAN - US cut $800m in military aid to Paki-stan. In a sign of their deteriorating relationship, Pakistan expelled more than 100 US military trainers and threatened to shut a CIA base. (BBC, 11 Jul) BANGLADESH - Four strikes in a week called by Islamist groups shut down schools and businesses. Clashes between security forces and protesters left 50 injured. 100 were arrested in the protests over an amendment which drops the phrase 'absolute faith and trust in Allah' from the constitution, and makes secularism a principle. (BBC, 11 Jul) LEBANON - A maritime border dispute is looming between Israel and Lebanon over lucrative energy reserves. The countries declared overlapping boundaries in the Mediterranean Sea where two gas fields were recently discovered. (BBC, 11 Jul) PALESTINE - Foreign western pro-Palestinian activ-ists planning to visit the West Bank were barred from flying and others deported. Two US women were among the first to be deported from Israel. Airlines in France, Germany and Switzerland pre-vented ticket-holders from boarding planes. Groups of Israelis were also arrested after gathering to wel-

come foreign activists. Greece blocked a 10-ship aid convoy trying to break the blockade on Gaza. Israel sabotaged two ships, one Irish and one Swedish, and pressured Greece to block the sailings of French, US and Canadian vessels. (BBC, 8 Jul) MALAYSIA - Police used tear gas and water can-nons against thousands of people assembling for a protest. 1,650 people were arrested after activists called the protest to urge the government to imple-ment electoral reform. (BBC, 9 Jul) SOMALIA - 10 million people affected by the Horn of Africa's worst drought in 60 years. Somalia is worst affected and 3,000 people flee each day for neighbouring countries. Dadaab in Kenya is the world's biggest refugee camp and could soon be holding 500,000 Somali refugees. (BBC, 11 Jul) NIGERIA - The army in Maiduguri dragged men out of their homes, shot them on the spot and burnt homes down after they came under attack from Boko Haram fighters, who want to establish an Is-lamic state in the north. (BBC, 10 Jul) SUDAN - South Sudan was given independence by Sudan. (BBC, 9 Jul) MADINAH - The Islamic Organization for Education and Sciences selected Madinah as the cultural capital for Islamic world in 2013. Tlemcen in Algeria, was announced as the 2011 capital. (PressTV, 11 Jul) FRANCE - Demonstrations held in Paris after hun-dreds of pro-Palestinian western foreigners were de-nied flights to Israel. More than a hundred were ar-rested by French police after demonstrating near the Paris town hall. (PressTV, 10 Jul) �

Western brands are increasingly optimizing their advertising in Muslim countries, hoping to win customers in this lucrative market. An example is Sunsilk’s shampoo ad in Malaysia which targets Muslim women who wear the headscarf. For decades western companies failed to ap-preciate the Muslim consumer as Muslims failed to adopt an Islamic consciousness. This has changed as more Muslims are discovering their Islamic heritage and moving away from a western lifestyle. Now, instead of just im-porting products and advertising from the west, companies are developing marketing campaigns and formulating products with Muslims in sight. Islamic marketing is the next wave in branding, say experts. After China and India, the next big market is the Muslim market. Colgate-Palmolive ob-tained Halal certification for toothpaste and mouthwash products in Malaysia. Nokia intro-duced Islamic applications for their cell-phones. Ogilvy & Mather introduced the Noor Index which rates the appeal of brands to Muslim consumers. Lipton Tea topped the list, followed by Nestlé. The global Halal market is estimated at $2.1 trillion annually, and 85 of Nestlé’s 456 factories are certified Halal. Emirates, the Dubai based airline, was ranked at the bottom of the poll as it serves alcohol, and therefore not seen as a Muslim brand. It’s encouraging that research shows young Muslim consumers increasingly believe that by staying true to their religious beliefs they are more likely to achieve success in the modern world. � From: temporalbrand.com

At a time when Muslims are surrounded with trials,

these are some things they need to bear in mind:

Patience. ‘…Bear with patience whatever be-falls you….’ (Quraan 31:17)

Don’t be Sad. ‘Be not sad, surely Allah is with us.’ (Quraan 9:40) ‘So do not become weak, nor be sad…’ (Quraan 3:139) ‘And grieve not over them, and be not distressed because of what they plot.’ (Quraan 16:127)

Allah’s Love. ‘Verily, if Allah loves a people, He makes them go through trials. Whoever is satisfied, for him is contentment, and whoever is angry upon him is wrath.’ (Tirmidhi) ‘Whoever Allah wishes good for, He inflicts him (with hardship).’ (Bukhari)

Trust Allah. ‘And put your trust in Allah if you are believers indeed…’ (Quraan 5:23)

Accept Life. All Prophets � went through tri-als. Life is a test: ‘Or think you that you will enter Paradise without such (trials) as came to those who passed away before you? They were afflicted with severe poverty, ailments and were shaken.’ (Quraan 2:214)

Relief. ‘Verily, with hardship there is re-lief.’ (Quraan 94:6)

Reward. The Prophet � said: ‘Whoever loses a loved one from the people of this world and then seeks recompense with his Lord, will be compensated with Paradise.’

Pre-ordained. ‘No calamity befalls on earth or in yourselves but is inscribed in the Book of Decrees – before We bring it into exis-tence.’ (Quraan 57:22) �

Times when Dua is more likely to be accepted:

6. While Prostrating (Making Sajda) ‘The nearest a slave can be to his Lord is when he is prostrating, so invoke (supplicate) Allah much in it. (Muslim) When a Muslim is in Salaah (prayer) and he prostrates he is the nearest he can be to Al-lah. It is said that while in Sajda, one should not ask for worldly needs (i.e. a nice car, job, etc), but for the Hereafter. 7. When Waking up at Night

‘Whoever wakes up at night and says La ilaha illallahu wahdahu la shrika lahu lahulmulku,

wa lahul hamdu, wa huwa ala kulli shai'in qadir. Alhamdu lillahi, wa subhanallahi wa la ilaha illallahu, wallah akbir, wa la hawla wala

quwata illa billah, or asks Allah, he will be re-sponded to… (Bukhari) 8. In our series on keeping quiet, we present Islam’s

teachings with regards to the tongue:

Good Speech. The Prophet � said: ‘Whoever believes in Allah and the Last Day should speak good or remain silent.’ (Bukhari) One should not talk unless it is good speech. If one doubts whether the speech has benefit then one should remain silent. Best Muslim. Abu Musa Ashari � reported: I said, ‘O Messenger of Allah �! Which of the Muslims is best?’ He responded, ‘He whose tongue and hand the Muslims are safe from.’ (Bukhari) Paradise. The Prophet � said: ‘Whoever can guarantee for me (that he will guard) what is between his jaws (tongue) and what is be-tween his legs (private parts), I will guarantee for him Paradise.’ (Bukhari) Fear. Sufyaan bin Abdullah � asked, ‘O Mes-senger of Allah �, what is the most serious thing that I should fear for myself?’ The Prophet � held his tongue and said: ‘This.’ Hardened Hearts. ‘Do not talk much without remembering Allah, for indeed, too much talk without the remembrance of Allah hardens the heart. And indeed the people who are furthest away from Allah are the ones who have hard-ened hearts.’ (Tirmidhi) Salvation. Uqbah ibn Aamir � asked the Prophet � how does one get salvation. He re-plied, ‘Restrain your tongue, remain in your home and weep over your sins.’ (Tirmidhi) �

Q: Can one use products

(e.g. pillows, cushions and clothing) that contain

bird or duck feathers that are sourced from non-Muslim countries? There

are two ways of plucking feathers. The first is

whilst the animal is dead or after being (most likely) un-Islamically

slaughtered and the sec-ond is whilst it is alive.

Is it permissible to use products containing feath-ers from a doubtful

source? A: Feathers plucked while an edible bird is alive, or after it is slaughtered, are pure. If the feathers are from an in-edible bird, or plucked from an edible bird after it dies without being slaughtered, then they are impure. In the instance that one doubts the source or whether they were taken before or after slaugh-ter, then the default ruling is that they are pure. (Mughni al-Muhtaj 1:235; Tuhfat al-Muhtaj 1:300)

Q: I recently read that it is obligatory to remove mucus in the mouth while

fasting. What if one has mucus at the back of the

throat constantly, like every few seconds, so

that when one spits it out or swallows it, in a matter or seconds it returns to

the back of the throat thus making it difficult to

spit it out every time? Is one permitted to swallow or does one have to con-

stantly spit it out? A: One’s swallowing saliva present in his mouth does not invalidate the fast. This

is established through con-sensus. (Tuhfat al-Muhtaj 3:405-06) It would be im-possible for a person to per-form a valid fast if such in-validated it. And the legal principle is: ‘Difficulty brings about ease.’ Accordingly, the saliva found in one’s mouth does not invalidate the fast. If something which would normally invalidate the fast is intended in the question, like nasal drainage/phlegm or ex-pectoration, then one with such a problem will be ex-cused; based on the afore-mentioned principle, analo-gously to blood from the gums which is difficult to avoid.

Q: How is it to feed the

common people and mourners at the home of the deceased after burial?

A: The source of the food could be either: 1. From the estate, while ap-portioned for another (like a minor, creditor, or absen-tee), it is unlawful; more-over, whoever spends from it is liable. (Umdat al-Mufti wa al-Mustafti 3:181) However, when from the estate, with-out being apportioned to an-other and with consent from all entitled to it, then such is a disliked innovation. (Tuhfat al-Muhtaj 1:437) This is an innovation as it is opposite to the established sunnah. The Prophet � said, ‘Cook for the family of Ja’far, they have been struck by something that keeps them busy.’ (Musnad Ahmad, 1751) 2. Not from the estate, it is

permissible; but it is disliked to eat at a house where the family is not cooking due to mourning. If the family is not cooking on ac-count of other reasons, then it is not disliked to eat there, with the condition that the food is not from the estate. Q: Is it valid to perform Ghusl (bath) in a swim-

ming pool with chlorine water?

A: If the chlorine changes the water to such an extent that it would no longer be considered absolute water, but rather ‘chlorine water’, then it would not be allowed, i.e. it would be pure but not purifying. (Mughni al-Muhtaj 1:116-18)

Q: If a person passes

away on Friday, is it bet-ter to bury him after Juma

or before Juma? A: If a Friday prayer and fu-neral prayer enter, and time is not tight, then the funeral prayer must be made first. If time is tight, then the Friday prayer may be performed first. (Sharh al-Muhadhdhab 5:56; Tuhfat al-Muhtaj 3:64)

Ibn Abd al-Salam was in charge of the Friday prayer in Egypt’s Amr bin al-As mosque. He would perform the funeral prayer before the Friday prayer, and then give fatwa that those needed to carry the deceased and the deceased’s family should proceed for burial (without performing the Friday prayer first). (Tuhfat al-Muhtaj 3:64) �

Q: Tupperware offered a

special called the ‘Summer Surprise’. The

offer entailed the pur-chase of a mystery pack for R150 and the pack will

contain Tupperware prod-ucts to the value of R300-

R400. Is it permissible for Muslims to purchase and sell this product?

A: In principle, the sale of an item the contents of which are unknown is impermissi-ble. E.g. if A sells to B his warehouse with its contents being unknown and unspeci-fied, the sake will be invalid due to the possibility of there being a substantial difference in what the purchaser was expecting. However, if the obscurity of the contents of the item is minor, it will be permissible. Scholars have cited the example of a per-son selling a pouch or box with unspecified contents. This is permissible. The mys-tery pack sold by Tupper-ware is similar to this and is thus permissible to buy and sell. (Raddul Muhtaar, 5:129; Bahrur Raiq, 5:295)

Q: If a person needs to perform his salaah sitting

on a chair due to knee problem, does he perform

his salaah while com-

pletely sitting, or does he stand up during qiraat or

ruku? He does not have any problem standing, the only problem is knee

bending (in Sajda or Ta-shahhud).

A: Jurists have mentioned that if someone is unable to perform sajda (prostration) during salaah, then the fol-lowing rulings apply to him:1. Qiyaam (standing posture) is not obligatory on him. 2. He will perform the ruku (bowing down) and sa-jda by gesture, i.e. by move-ment of the head in such a way that the gesture for sa-jda is lower than the gesture for ruku. A person who is able to stand (make Qiyaam) but cannot make sajda has the following options: 1. He may perform the entire sa-laah, including the gestures for ruku and sajda, standing up. 2. He may perform the qiyaam and ruku standing up and then sit down to perform the gesture for sajda. 3. He may perform the entire sa-laah, including the gestures for ruku and sajda, sitting down. From the three op-tions, the Jurists have stated that the last option (to per-form the entire salaah in a

sitting posture) is best. If a person sits and performs his fardh and wajib salaah due to a valid excuse, he may sit in any posture during the qi-yam, ruku and sajda. How-ever, at the time of reciting the tashahhud, if he can sit in the tashahhud posture without any difficulty, he should not sit in any other posture as sitting in the ta-shahhud posture is sunnat when reciting the tashahhud. If however sitting in the ta-shahhud posture is difficult, then he may sit in any other posture. Checked by: Mufti Ebrahim Desai

Q: Is the funeral prayer

valid without Surah Fatiha? What are the proofs?

A: In a hadith in Muwatta Malik, it is stated that when offering the funeral prayer, Abu Hurairah � recited the praise of Allah (which in-cludes thanaa), durood and dua. Surah Fatiha was not mentioned. This shows that Abu Huraira � did not con-sider Surah Fatiha to be a necessary component. Umar, Ibn Umar and Ali � also did not consider Surah Fatiha to be an integral part of Salatul Janaza (funeral prayer). If someone recites Surah Fatiha in Salatul Janaza, it is makrooh if it is done with the intention of qirah (i.e. recit-ing the Quran as one does in the 5 daily prayers), because Salatul Janaza is for making dua, not for reciting the Quran. If, however, someone recites Surah Fatiha with the intention of dua, then it is permissible. � Checked by: Mufti Ebrahim Desai

A British man came to the Sheikh and asked: Why is it not permissible in Islam for women to shake hands with a man? The Sheikh said: Can you shake hands with Queen Elizabeth? The Prophet � said: ‘Shall I not advise you on an excellent Sadaqah (charity)? It is what you spend to provide for a daughter who has been sent back to you, and who has no one but you to earn her livelihood.’ (Musnad Ahmed) ‘Has been sent back to you’ means a daughter sent back to her parents after being widowed or divorced by her husband. It may also mean that some other circumstances have necessi-tated her coming back to her parents. In these cases, all that is spent to meet her require-ments is treated as an excellent charity, for it combines several acts of virtue: 1. Charity, 2. Helping a person in difficulty, 3. Strengthening family ties, 4. Loving care for one’s children. The Prophet � said: ‘For anyone helping a dis-tressed person, Allah records 73 grades of for-giveness, one of which shall suffice him for his well-being in all worldly affairs and 72 will raise him spiritually on the Day of Qiyaamah.’ Umme Salamah � once asked the Prophet �: ‘Shall I gain any reward for what I spend on the sons of Abu Salamah, my previous hus-band, for they are my sons?’ He replied: ‘Spend on them, you will be rewarded for spending on them.’ (Mishkaat) It is a praiseworthy act to treat one’s children with loving care even when they are not in need of help. Once, the Prophet � embraced his grandsons. The chief of Banu Tameem said: ‘I have 10 children and have never shown affection to any of them.’ The Prophet � looked at him sharply and said: ‘He who does not show mercy, will not be shown mercy.’ � Adapted from: Al Jamiat Vol 10.1

Food of Hell

‘No food will there be for them except bitter dhari (a thorny plant), which will neither nour-ish nor satisfy hunger.’ (Quraan 88:6-7) ‘Verily, the tree of Zaqqum will be the food of the sinful. Like molten brass it will boil in their insides like the boiling of scalding wa-ter.’ (Quraan 44:43-46) Drink of Hell

‘Thus, All this. But indeed for the oppressors will be an evil place of final return. It is Hellfire – they will burn therein, and how evil is that bed, Thus, then will they taste it – a boiling fluid and a filthy fluid of pus and blood and other penalties of a similar kind to match them.’ (Quraan 38:55-58) Clothes of Hell

‘These two opponents dispute with each other about their Lord. But those who disbelieve will have garments of fire cut out for them. Over their heads will be poured boiling wa-ter.’ (Quraan 22:19) Torture ‘Those who have disbelieved in Our signs – We will burn them in fire. As often as their skins are roasted through, We will exchange them for other skins so that they may taste the punishment... (Quraan 4:56) The Prophet � said: ‘Verily, of the inmates of the Fire, the one with the easiest punishment will be one who will have a pair of sandals and straps of fire. His brain will boil from them as a kettle boils… (Bukhari) �

How do we deal with differences among Ulama on Is-

lamic rulings?

There were differences among the Sahaba re-garding laws on Witr Salaah, the missed fasts of Ramadaan and making Wudhu with sea wa-ter among others. Among the early Ulama, there are 50 theories regarding the moment on Friday when Dua is accepted, as well as when the Night of Qadr occurs, and a mini-mum of 150 differences in 4 Rakaats of Sa-laah. How did these giants of Islam handle themselves in these cases? Abdullah ibn Masood � and almost all the Sa-haaba used to perform 2 Rakaats of Fardh Sa-laah instead of 4 while on a journey. Uthman � performed 4 at Mina while on a journey. Ibn Masood � objected to this, yet he still per-formed 4 Rakaats with Uthman � at Mina. Someone asked why he did this and he re-plied: ‘Opposing someone is a severe thing.’ According to Imam Shafi rahimahullah it is Sunnah to recite Qunoot in Fajr. Once he vis-ited the area where the grave of Imam Abu Hanifah rahimahullah was and had to perform Fajr. He read it without Qunoot as is the view of Imam Abu Hanifah rahimahullah. When asked about this, he replied, ‘The respect for the inmate of this grave prevented me.’ There were always differences regarding non-principle issues in Islam. They did not become a battleground because: 1. Ulama did not can-vass their supporters to side with them and insult Ulama holding an opposing view, and 2. laymen did not pass judgement on the differ-ent views held by the Ulama. �

Goolam Muhammad Ismail Padia, known as Haji Bhai Padia rahimahullah was born in Umzinto, South Africa in 1935. His father was Hafiz Ismail and his mother Zuleikha Salejee. He married his cousin, Zuleikha Salejee and they had one son and six daughters. Around 1961 Haji Sahib left with his wife and other family members for Hajj where he first came into contact with the work of Tabligh. He left for Nizamudeen, India, the headquarters of Tabligh, where he met Moulana Yusuf rahima-hullah. He is credited with starting Tabligh in South Africa and his efforts had an impact on the lives of senior Ulama like Moulana Yunus Patel, Moulana Mahmood Madni and Mufti Ebrahim Desai as well as countless other Ulama in South Africa. The first Jamaat to sail from South Africa went to Mauritius and Reun-ion in 1966. A chartered flight took a Jamaat for the first Ijtima in Africa to Zambia in the same year. Haaji Sahib was instrumental in obtaining land for a Darul Uloom in Isipingo Beach, and in establishing a graveyard in Clairwood. He used to write letters of support to, among others, the anti-Apartheid activist Professor Fathima Meer. He passed away in 1998 in Isipingo Beach and 3,000 people at-tended the funeral. His contribution to Islam in South Africa as well as the West Indies, Fiji, Zambia Zimbabwe, Australia, New Zealand, USA, Britain, France, Paraguay, Panama, Bra-zil and Russia is phenomenal. He walked to the shanties of Chatsworth and Phoenix, the mansions of Laudium and Westville, through the streets of District Six and Soweto, Harlem and Kingston, through the slums of Rio and the affluence of New York and Paris, through the dust of Mewat and the swamps of Indone-sia and Malaysia, reforming and uniting. �

I recently discovered some interesting anecdotes

on the lifestyle of one of South Africa’s senior

Ulama. Knowing that he might not want his name

mentioned, yet feeling that there are valuable les-

sons for us in them, I recount some episodes:

Maids. This Aalim had the distinction of hav-ing all his maids over the years convert to Is-lam after having seen his lifestyle. The maxi-mum period needed was 3 months. On one occasion, his landlord’s maid needed to go to hospital in the middle of the night to give birth. This Aalim, with his wife, took the lady to hospital and waited with her until she was released, as the landlord had refused. Another maid accepted Islam and wished to take up Islamic studies. This Aalim sponsored her studies and set her up with household ba-sics when she got married. Mother. This Alim’s mother recounted that once, when she was old, and her son was also advanced in age, he came to her house and saw her working. He made her rest while he cleaned the place and tidied everything up. His high status did not stop him from caring for his mother. Ulama. This Aalim being does not feel it below his dignity to visit junior Ulama. We need to seek out these senior Ulama who are gems among us and benefit from their company and teachings just as the Sahaaba benefited from the Prophet �. These are Ulama who epitomise the Sunnah of the Prophet � and are described in the Hadith as the heirs and inheritors of the Prophets �. �

Islamic rule was present in modern Spanish soil for 781 years from 711 until 1492 under the Arab Muslims. As of 2007, an estimated 1 million Muslims live in Spain, most recent im-migrants from North Africa, Middle East and South Asia; although there are 20,000 Span-ish converts. The first Musjid was built after 500 years in 1982. Islam came to Spain in 711 when the Muslim Berber leader Tariq ibn Ziyad landed at Gibral-tar and by the end of the campaign most of the Iberian Peninsula and the Basque region were brought under Muslim rule. Muslims from North Africa to Yemen came to live in Spain. called Al-Andalus, the root for the name of the present-day region of Andalusia, the southernmost region of Spain. Under Muslim rule, the area that is today Spain and Portugal was one of the greatest civilizations. 400 years after Tariq's conquest a majority of the population practiced Islam (including descen-dants of Visigoths and Romans). The Chris-tians retook Spain by 1492. There were mass forced conversions and thousands of texts in Arabic were burned. Despite all this some peo-ple continued to practice as Muslims, well into the sixteenth century. In 1567 the use of Ara-bic became illegal, and Islamic religion, dress, and were forbidden. Muslim towns were de-stroyed and entire populations slaughtered. By 1614 the remaining Muslims in Spain, who made up 33% of the population in Valencia were expelled, although up to 10,000 Muslims possibly remained in Spain. Muslim buildings remain in Spain and words borrowed from Arabic are found in Spanish and Portuguese. �
