10 Green Building Trends for 2011What’s to come on the sustainability

Green building is going mainstream no doubt. But exactly how is building science evolving, and where are eco-minded builders and consumers likely to focus their attention in the year ahead, in light of current economic conditions? The nonprofit Earth Advantage Institute, which to date has certified more than 11,000 sustainable homes, makes some predictions for 2011 in its annual forecast of green building trends.

Affordable green. Many consumers typically associate green and energy-efficient homes and features with higher costs. However the development of new business models, technologies, and the mainstreaming of high-performance materials is bringing high-performance, healthy homes within reach of all homeowners. Steinberg wants big review to kill regulations

California Senate President Pro Tem Darrell Steinberg D-Sacramento, today said he will pursue emergency legislation forcing state agencies to review all regulations and recommend a wholesale re-writing of the state's regulatory scheme.

in an interview with The Bee Capitol Bureau, Steinberg said he'll propose "urgency legislation that directs each state agency to review its regulations, identify any duplicative archaic or inconsistent rules."

Steinberg said lawmakers could then act on the recommendations over the next six months perhaps expunging some rules from the 5,000-page California Code of Regulations as part of the state budget negotiations.

"To our knowledge, no one, not a previous governor, not the agencies and not the Legislature have ever compelled this sort of retrospective review to ensure that state regulations are streamlined, that they're up to date and that they're consistent with the law," Steinberg said.

The Democratic leader said his is not an effort to "weaken or undermine public health, environmental or worker safety protectionsbut rather to make it easier for businesses to "wade through the often difficult, complicated duplicative bureaucracies that delay economic investment and job growth."

Steinberg, who held a Senate Democratic Caucus meeting this week with high-profile business figures, said he also wants urgency legislation that allows businesses or others to request a “consolidated and coordinated” state review process to obtain permits. “Government needs to be more nimble,” Steinberg said.

The ideas emerge as Democratic leaders prepare for the Legislature to review Gov. jerry Brown's proposal to slash $12.6 billion in government spending. They are also trying to assemble a ballot measure for june that calls for extending tax hikes they say will be needed to avoid doubling those cuts.

"We need to do a whole lot better in providing a friendlier business climate," Steinberg said, adding that Democrats need to show businesses that they "get it."

if agencies are compelled to identify duplication, Steinberg said, "we ought to identify some of the most obvious" repetitive regulations and quickly eliminate them with executive or legislative action.

It’s Almost That Time Again TO File Cal/OSHA Form 300With little more than a week to go before the beginning of February, it’s time to get ready for the three-month period during which employers must post their summaries of work-related injuries and illnesses for the previous year. From Feb. 1 through April 30, employers are required to post Cal/OShA Form 300A in a conspicuous place. The form can be found at: http://www.cal-osha.com/Cal-OShA-Form-300A.aspxForm 300A information comes from Cal/OShA Log 300, which details work-related incidents. The summary includes information on types of injuries and illnesses that occurred, and their extent and outcome. it is intended to alert workers to possible hazards, and includes average number of employees at the workplace and hours used to calculate injury and illness rates. “A statement that the action would have a significant effect on housing costs, if a state agency, in adopting amending, or repealing any administrative regulation makes an initial determination that the action would that effect.”

Problem: A very common response to the administrative mandate cited above has been “The agency has determined that there will be no significant economic impact on business/housing”. however, there is rarely any indication of what it will cost to actually comply with the proposed regulation.

With regards to regulations related to housing, it would be useful for the public to have an understanding of what it will cost to comply with a proposed regulation. it would also be useful for the public to have access to the assumptions used by the state agency in arriving at that “estimated cost of compliance”.

Solution:With regards to regulations related to housing, require the proposing agency to specifically cite its “estimated cost of compliance” with the proposed regulation and to make available upon request the assumptions analysis used in arriving at that estimated cost of compliance.

Suggested Bill Language:Government Code 11346.2.(b)(5) Facts, evidence, documents, testimony, or other evidence on which the agency relies to support an initial determination that the action will not have a significant adverse economic impact on business. if the proposed regulation impacts housing, the initial statement of reasons shall include the estimated cost of compliance and the related assumptions used in arriving at that estimate.

Government Code 11346.5.(a)(12) A statement that the action would have a significant effect on housing costs, if a state agency, in adopting, amending, or repealing any administrative regulation, makes an initial determination that the action would have that effect. In addition, the agency officer designated in paragraph (14), shall make available to the public, upon request

Fine-tuning Cost-Impact Analysis relative

Background:Government Code Sections 11346-11348 establish the basic minimal procedural requirements for the adoption, amendment or repeal of administrative regulations by state agencies, including those related to residential construction.

These procedural requirements include a mandate for the proposing state agency to prepare an initial Statement of Reasons that includes, among other things:

“Facts, evidence, documents, testimony, or other evidence on which the agency relies to support an initial determination that the action will not have a significant adverse economic impact on business.” {GC 11346.2(b)(4)}.

In addition, GC 11346.5(a)(12) requires the related public notice of Proposed Adoption to include;

Every year, the cold and flu season takes its toll on U.S. industry, sidelining workers and derailing production. If you control the spread of germs in the workplace, you

The flu, as well as other viruses, can lead to losses in workplace productivity due to absenteeism from workers who are themselves sick or those who must stay home to care for others.

Up to 20 percent of the population gets the seasonal flu annually, while more than 200,000 people are hospitalized with flu-related complications. Some 36,000 people in this country die from flu-related causes each year.

Flu seasons are unpredictable in a number of ways including when they begin, how severe they are how long they last and which viruses will spread. The emergence of the H1N1 influenza virus in 2009 caused the first influenza pandemic in more than 40 years, which led to more uncertainties than usual and high levels of flu activity much earlier in the year than during most regular flu seasons.

The economic consequences of a flu pandemic are daunting. A 2005 study by the Centers for Disease Control and Prevention (CDC) estimated that the impact of a flu pandemic would be $71.3 to $166.5 billion, excluding disruptions to commerce and society.

HOW GERMS CAN SPREAD

The flu and other infections generally are spread by coughing, sneezing, talking near someone and by touching unsanitized hands to the face. People may become infected by touching something — such as a surface or object — with flu viruses on it and then touching their mouth or nose. Studies have shown that influenza virus can survive on surfaces and can infect a person for 2 to 8 hours after being deposited on the surface.

in addition to surface hazards, unwashed hands can pose an equal hazard in the workplace by spreading germs and other substances, such as toxic chemicals and heavy metals. Germs can be spread when people touch common surfaces, such as equipment and “hot spots” like dispensers doorknobs and handles in heavily trafficked communal areas such as bathrooms and break rooms.

GERM PREVENTION STRATEGIES

Workers who are ill, should, ideally, stay at home until they are better. Those who come to work while they are sick should take precautions to avoid spreading germs to co-workers, such as covering their noses and mouths with a tissue when coughing or sneezing — and then throwing the tissue in the trash after use. All workers should avoid touching their eyes and mouth and should keep a safe social distance from people who show symptoms of influenza-like illness. Masks that meet or exceed niOSh n95 standards also may provide protection.

SAFETY TOPICElectric Tools - Grounds for Concern

Each year workers suffer shock when handling electrical tools and equipment. To protect workers against the hazards of electricity, teach them the basic facts about the causes of shock and death. One of the big problems in understanding the dangers of electrical shock is the mistaken belief that only high voltages kill. it’s not the voltage that kills, but the amount of current that passes through the body. The condition and placement of the body has a lot to do with the chance of getting a shock.

Water and electricity can be a fatal combination. Damp areas and metal objects can offer good shortcuts for electricity to reach the ground. if a worker’s hands are sweaty, if socks and shoes are moist or damp, if the floor is wet, or if the worker is standing in a puddle of water, the moisture will allow more current to pass through the body. if work is to be done with metal objects or in damp areas, workers should recognize the hazards and take necessary precautions. These precautions include rubber gloves and boots, rubber mats, insulated tools, and rubber sheets which can be used to cover exposed metal.

Remembering a few tips can help avoid electrical accidents:

Treat every electric wire as if it were a live one. inspect equipment and extension cords before each use.

Take faulty equipment or plugs with bent or missing prongs out of service for repair.

Only qualified electricians should repair electrical equipment or work on energized lines.

This requirement applies to employers with 11 or more workers, excluding low-hazard establishments in the retail, services, finance and real estate sectors.

Employers who experienced no workplace injuries or illnesses in 2010 should post the form with zeroes across the total lines.

They also must mail or otherwise provide an annual summary to employees who do not report at least weekly to a location where the summary is posted.

Are Californians Overtaxed?Dan Walters of the Sacramento Bee reports today:Are Californians overtaxed, under taxed or, to crib from the fable about Goldilocks and the three bears, taxed just right? We're already being inundated with claims and counterclaims about tax burdens as Gov. Jerry Brown and the Legislature weigh whether to place about $9 billion a year in tax extensions on a june ballot to cover budget deficits. Sorting through the tax rhetoric is not easy. Reliable, up-to-date numbers are hard to find and there's no universal agreement on how data should be interpreted. But here's a shot.

The most comprehensive data on state and local tax burdens – you have to combine the two to make meaningful comparisons – are maintained by the Washington-based Tax Foundation. And it uses the most commonly accepted measure: taxation as a percentage of personal income, which takes into account the wide state-to-state income variations. The Tax Foundation calculated Californians' state-local taxes in 2008 at 10.5 percent of personal income. That translated into about $170 billion in revenue and the nation's sixth-highest percentage. new jersey was highest at 11.8 percent, followed by new york, Connecticut, Maryland and hawaii.

That was in 2008. In 2009, however, then-Gov. Arnold Schwarzenegger and the Legislature enacted about $9 billion a year in temporary income, sales and car taxes. They wanted the taxes to remain for several years, but voters short-circuited them in May 2009 by rejecting a package of budget-related ballot measures.

That's why those taxes are now expiring and why Brown is seeking a five-year extension. And as long as they are in effect, they add roughly a half-percent to Californians' tax load pushing it to about 11 percent of personal income.

Whether that increase would change the state's relative ranking is unclear, however. Other states are also coping with budget crises and a number have raised their taxes as well. At the moment, therefore, the most accurate summary is that California has one of the nation's highest state- local tax burdens. More specific data from the Tax Foundation and other sources indicate that California's income and sales taxes are particularly high, compared with those of other states, while overall corporate taxes are a bit below average and property taxes fall somewhere in the middle.

While Proposition 13, enacted in 1978, strictly limits property tax rates, the state's relatively high property values push property tax bills into the upper ranks. in 2009, the Tax Foundation says, California property taxes as a percentage of value on owner-occupied houses were 44th in the country, while the median tax bill of $2,839 was 10th highest, nearly $1,000 above the national average.

Those are the facts. Keep them handy as the political rhetoric escalates.

Another contractor draws a fine line in asking about the rules regarding advertising. Finally, an important question for anyone who may be a Qualifier, in these tumultuous times for the industry…

Q: Can we self perform structural steel work under our “A” and “B” license or do we need a separate license?A: I cannot give you a definitive response at this time since I don’t know what the specific project involves. Generally speaking you should be able to self- perform structural steel work under the “B” since structural steel is often considered “framing”. if the work is industrial in nature, then the “A” would come into play since a General engineering contractor can self perform most portions of an industrial project. This being said, the cautious approach would be to apply for the “C-51” (structural steel) class. Q: i have questions regarding advertising requirements in CA that i’m hoping you can help me with. We have a situation where one of our subsidiaries, does both manufacturing and installation. Recently one of our trucks was warned by the CSLB that failure to disclose a license number on the vehicle could result in a citation. As i understand, it’s a requirement for all forms of advertisement to include the CA License number as well as the name of the entity holding the license. The question: because this entity does both manufacturing and installation under the same name, must all advertising, even if it is only for product and not installation, include our license number? Any insight you can offer would be

A: yes, advertising does need to include the contractor's license number; however, manufacturers or suppliers do not need to disclose their license even if they have one. you're also correct a license number is not required if only advertising the sale of the product.

Since it’s possible a “manufacturing” truck may be at an “installation” job site – even if they’re nOT doing Any installation -- you'll want them to list a license number on the vehicle if for no other reason than preventing issuance of a citation. Why take a chance; put the number on all vehicles.

Q: i was the Qualifying individual for my Corporation “C-10” license. They cut back on business, laid me off and let the Worker’s Comp insurance and our Bond lapse. how do i change the license to my name and reactivate it? Thanks so much for your input.

A: Sorry these tough economic times have affected this business and your employment. According to the CSLB web site, this license is indeed suspended. The present status shows the company license is under Suspension because both the Contractors Bond and Qualifier's Bond have been cancelled and Worker’s Compensation has expired. you are still listed as the Responsible Managing Employee (RME), so i would strongly advise that you remove yourself or disassociate immediately, since you are still responsible for any work performed until you officially do so in writing.

Unfortunately, you cannot change the business name since this is a corporation and you are not an officer. The license belongs to the corporation, not to you as an individual and i could not locate another license that you’re listed on.

you will need to apply for a new (sole owner) license and will be issued a new number. no test is required but you’ll need to secure a new Contractor’s Bond and, if you hire employees, proof of Worker’s Compensation insurance.
