    The day being a Monday, on motion of Representative Lacson-Noel, there being no objection, the Chair declared a Privilege Hour.

    On her subsequent motion, the Chair recognized Rep. France L. Castro for her privilege speech.

    PRIVILEGE SPEECH OF REPRESENTATIVE CASTRO (F.L.)

    Representative Castro spoke about the government’s insensitivity and lack of immediate

    response to victims of recent tropical cyclones, including super Typhoon Ulysses, that hit the country. She noted that the Filipino resiliency and bayanihan spirit tend to be taken advantage of by government with its inadequacy in terms of immediate response and concrete plans and actions. She also pointed out the budget cuts in the Quick Response Funds (QRF) and Disaster Risk Reduction and Management (DRRM) funds of various agencies.

    As she raised how much Filipinos had suffered from the recent calamity, she criticized the televised government briefing on disaster response led by President Rodrigo Roa Duterte, which instead reflected indecent and sexist jokes.

    Representative Castro then called for an immediate response to assist the typhoon victims; rechannel funds from the National Task Force to End Local Communist Armed Conflict (NTF-ELCAC) and Confidential and Intelligence Funds to the assistance and rehabilitation efforts for the victims of calamities; and hold accountable those responsible for illegal logging, mining, and quarrying activities. She pointed out that it is not just an issue of the President’s visibility but his accountability over the recent calamities.

    On motion of Representative Lacson-Noel, the Chair recognized Rep. Stella Luz A. Quimbo for her privilege speech.

    PRIVILEGE SPEECH OF REPRESENTATIVE QUIMBO

    Representative Quimbo spoke about the devastation brought by the recent Typhoon Ulysses to Marikina City and expressed alarm that two massive floods—Typhoon Ondoy in 2009 and Typhoon Ulysses—had hit the city only in the span of 11 years.

    She said that it would take weeks for the residents to rebuild and be back to their routines; and acknowledged the bayanihan spirit between the government and the private sector, and also the assistance of her colleagues from the House Representatives.

    She underscored the need to institutionalize and fully implement the Philippine government’s Flood Management and Control Masterplan for Metro Manila and Surrounding Areas which was approved by the National Economic and Development Authority (NEDA) Board in 2012. She explained that

    said masterplan includes three pillars: 1) structural interventions particularly infrastructure projects to manage floods; 2) non-structural interventions such as reforestation and flood forecasting; and 3) institutional interventions with government agencies such as provision of technical assistance.

    She stressed the need for its full implementation because flooding, including its effects and the solutions to it, cuts across administrative borders. She then mentioned about the pending Pasig-Marikina Dam, which is intended for flood control despite being a high-priority project. She also cited the decay of the Marikina Watershed which had been worsened by illegal logging and quarrying, and illegal settlements; and stated that long-term forest restoration is as important as the infrastructures and curbing of said illegal activities.

    Thereafter, Representative Quimbo said that she would file a bill to institutionalize a flood management control masterplan and ensure that it is properly, completely, and swiftly implemented. The bill, she said, will mandate the Departments of Public Works and Highways (DPWH) and Environment and Natural Resources (DENR) to adopt and strengthen the NEDA-approved Flood Management Masterplan for Metro Manila and surrounding areas, as well as formulate flood management plans for Luzon, Visayas, and Mindanao; increase penalties for violators of the Philippine Mining Act; and increase the wage level of forest rangers. She then called on her colleagues’ support for the passage of her proposed bill.

    On motion of Representative Lacson-Noel, the Chair recognized Deputy Speaker Jose L. Atienza Jr. for his interpellation.

    INTERPELLATION OF DEPUTY SPEAKER ATIENZA

    Deputy Speaker Atienza initially inquired whether Representative Quimbo believed that the condition of Laguna de Bay is not related to the Marikina City’s flood problem.

    The Deputy Speaker recalled that there was a flood control mitigating program crafted during the administration of former President Gloria Macapagal-Arroyo but was not implemented during the term of former President Benigno C. Aquino III. He opined that the solution to the flooding is to conduct a heavy dredging of Laguna de Bay.

    At this juncture, Deputy Speaker Pimentel relinquished the Chair to Deputy Speaker Michael L. Romero, PhD.

    Deputy Speaker Atienza opined that the current flood control problem of Marikina and the whole nation could be solved not only through natural waterways and modern technologies, but for the government to respond and act accordingly; and underscored the need to act as a nation by setting aside political differences and doing what is right for the people.

    Representative Quimbo explained that she called for the review of the flood control master plan which includes the proposed dredging of Laguna de Bay; although she emphasized her focus on the problems of the dredging of Marikina River.

    Deputy Speaker Atienza then stated for the record that in looking into the problem of Marikina River and the flooding of Marikina City, the administration of former President Aquino should also be held responsible due to its failure to implement the aforecited dredging of Laguna de Bay.

    ACKNOWLEDGMENT OF GUESTS

    Thereupon, Rep. Alfred C. Delos Santos acknowledged the presence in the Session Hall of guests of Speaker Lord Allan Jay Q. Velasco from the Philippine National Police headed by Maj. Gen. Debold M. Sinas.

    INTERPELLATION OF REPRESENTATIVE ROMULO

    To the queries of Representative Romulo, Representative Quimbo clarified that projects under the NEDA Flood Management and Control Masterplan for Metro Manila and Surrounding Areas are being implemented although very slowly, and that her bill will institutionalize said plan to ensure that solutions to the flooding problem are sustained.

    Representative Romulo then expressed concern that the bill would be used as an excuse for the non-

    implementation of existing flood control projects. Representative Quimbo emphasized that what is crucial is the availability of adequate funds to hasten the implementation of the masterplan.

    Thereupon, Representative Quimbo welcomed the suggestion of Representative Romulo to file a parallel resolution calling for an immediate action on flood control interventions, including the dredging project mentioned by Deputy Speaker Atienza; and also cited the need for short-term solutions such as addressing illegal activities in protected areas.

    REMARKS OF MAJORITY LEADER ROMUALDEZ

He then requested the latter, together with his family members, to ascend the rostrum and take his oath of office before Speaker Velasco.

    INTERPELLATION OF REPRESENTATIVE BARBERS

    To the questions of Representative Barbers, Representative Quimbo maintained that in spite of other possible factors which could have contributed to the flooding in Marikina City, quarrying near the Marikina Watershed is illegal because it is a protected area; and added that sediments have accumulated in the Marikina Riverbed, thus reducing its carrying capacity.

    Both Representatives Barbers and Quimbo then exchanged views on whether there is a need to pass another legislation on this matter, with Representative Barbers emphasizing that there are existing laws against illegal logging and quarrying and monitoring and regulation must be only observed to implement the laws effectively.

    In response, Representative Quimbo noted likewise the poor enforcement of related laws and negligible fines and penalties which, she said, are considered under the bill that she would file.

    Representative Barbers suggested that it may be time to revert the task of regulation to the national government through the DENR because local government units may be lax in regulating quarrying activities since these are local revenue sources. He suggested for the review of the Local Government Code for further improvement of Representative Quimbo's bill to which the latter agreed.

    Regarding Representative Barbers’ concern that mining is easily blamed for the flooding, Representative Quimbo emphasized that analysis of typhoons and their effects must be context-based and that she was particular in referring to illegal quarrying activities which is applicable to the Marikina Watershed.

    In conclusion, Representative Barbers said that he would fully support Representative Quimbo’s proposal and stressed that it is high time that they revisit existing laws and the implementation thereof.

    On motion of Representative Bolilia, the Chair recognized Rep. Edgar M. Chatto to deliver his privilege speech through Zoom videoconferencing.

    PRIVILEGE SPEECH OF REPRESENTATIVE CHATTO

    Representative Chatto initially discussed the devastating effects of the recent typhoons that

    ravaged different parts of the country and how the government could set its priorities to mitigate the effects of climate change. This, as he cited the government’s commitments and initiatives thereto.

    As chairperson of the Committee on Climate Change, he called on the Body to take the lead in declaring a national climate emergency in the country, which he believed should have been made two decades ago. He however stressed that such declaration should have a follow-through.

    Thus, Representative Chatto underscored the urgent need to convert all climate change action plans to climate emergency action plans at all levels of governance with the Climate Change Commission taking the lead in creating a single data platform to produce baseline climate risk assessments of high-risk cities and municipalities. He added the importance of drastic, aggressive, and urgent measures that would be best for the communities.

    In closing, he also enjoined his colleagues and the new House leadership to prioritize the congressional declaration of national climate emergency in the country.

    PRIVILEGE SPEECH OF REPRESENTATIVE DE VENECIA

    Representative de Venecia thanked the previous House leadership and Speaker Velasco for setting

    aside funds for the gig sector under the Bayanihan 2 Act; and expressed hope for the immediate passage of the proposed Freelance Workers Protection Act. He also stressed the need to implement capacity-building programs in order to retool the industry players as a way to adjust to the new normal; and craft a communication campaign to restore and inspire consumer confidence across all industries especially those that were heavily impacted by the COVID-19 pandemic.

    Representative de Venecia then shared the policy guidelines and recommendations of UNESCO on how the government and policy-makers could possibly help the creative industry recover from the effects of the pandemic; and introduced “R.E.S.T.A.R.T. Pilipinas” which is based on the said UNESCO guidelines.

    Using the “RESTART” acronym, he presented his proposed programs for the creative industry, starting with “R” which stands for “research and development.” He expounded on the need for wide consultation on both formal and informal platforms to assess the actual needs of the industry; and suggested the institutionalization of cultural mapping in the localities.

    He next discussed letter “E” which stands for “easing of regulations and obligations,” such as deferral of tax payments, so that businesses will not be forced into bankruptcy. Thereafter, under letter “S”, he suggested the granting of “safeguards and social benefits” and stressed the need for the “Eddie Garcia Bill” and the proposed Freelance Workers Protection Act.

    As letter “T” stands for technological innovation and technology transfers, Representative de Venecia spoke on investing in technology both as a form of subsidy and a way of adjusting to the safety protocols to ensure consumer safety and confidence. He however underscored the need for financial support to be able to promote technology within the industry; and then called on the House leadership to heed the request of the cultural and creative arts agencies for additional funding support so they can keep up with technological innovations and technology transfers.

    Continuing with letter “A” which stands for aid, he spoke on the need for remuneration and financial support for freelance workers, artists and performers in the creative industry considering that most of them belong to the hem of society; and letter “R”

    for risk management, which essential aims to provide targeted loans and guaranty programs for creative industry stakeholders. He stressed that government financial institutions and private banking institutions must exercise flexibility in granting loans so that micro, small and medium enterprises in the creative industry are given the necessary assistance.

    At this juncture, Deputy Speaker Oaminal relinquished the Chair to Deputy Speaker Pimentel.

    For the last “T,” Representative de Venecia said that it stands for talent, skills and content development which basically refers to capacity building for creative workers especially as they join the Fourth Industrial Revolution. He then gladly announced that the Technical Education and Skills Development Authority (TESDA) has already tailored some of its programs to the needs of the creative industry; and suggested that TESDA further coordinate with its stakeholders to come up with more relevant programs.

    REMINDER FROM THE CHAIR

    At this point, the Chair requested Representative de Venecia to wrap up his privilege speech.

    In closing, he pointed out that the creative sector needs support from both the government and private sectors.

    to extend the Privilege Hour by another 10 minutes; and the Chair recognized Rep. Edgar Mary S. Sarmiento to deliver his privilege speech.

    PRIVILEGE SPEECH OF REPRESENTATIVE SARMIENTO

    At the outset, Representative Sarmiento expressed sympathy to all those who lost their loved ones and whose properties were damaged due to the onslaught of calamities that came one after another in recent weeks. Considering that the country is prone to typhoons and other natural calamities, he raised the question as to why the country continue to largely suffer from disasters.

    Representative Sarmiento pointed out that even the approved House Bill No. 5959, creating the Department of Disaster Resiliency, is being questioned in the Senate as it is considered an additional layer in the bureaucracy, and would take up a large portion of the national budget for the proposed department’s personnel services.

    He said that he intends to file a bill that would restructure and strengthen the Office of Civil Defense (OCD) to enable it to focus on calamity management through scientific knowledge approach and preparedness response, rescue, recovery, and reconstruction using mitigated and resilient designs. He mentioned that the bill was previously filed by his brother, who was then a Member of the 16th Congress.

    Representative Sarmiento then narrated the history of OCD starting from its creation as the National Civil Defense Administration; and opined that with the grant of expanded powers to OCD through Republic Act No. 10121, OCD should have been on top of the situation and should be responsible in convening the National Disaster Risk Reduction and Management Council (NDRRMC), which has not been the case.

    In his proposed legislation, Representative Sarmiento explained that OCD would be given authority and powers to adequately prepare prior to disaster, and its office would be under the Office of the President with its head having the rank of a Cabinet secretary. He further explained that it should be removed from the Department of National Defense so that OCD could focus exclusively on natural disasters.

    He asked for the support of his colleagues in passing the Bill on strengthening OCD, and thereafter

    thanked the leadership for giving him time to deliver his privilege speech.

    REFERRAL OF PRIVILEGE SPEECH OF REPRESENTATIVE SARMIENTO

    On motion of Representative Lacson-Noel, there being no objection, the Body referred Representative Sarmiento’s speech to the Committee on Rules for its appropriate action.

    On another motion of Representative Lacson-Noel, the Chair recognized Rep. Eufemia “Ka Femia” C. Cullamat to deliver her privilege speech through Zoom videoconferencing.

    PRIVILEGE SPEECH OF REPRESENTATIVE CULLAMAT

    Representative Cullamat stated that on November 23, the world commemorates the International Day to End Impunity to recognize local and international laws against crime and human rights. She however decried the lack of accountability and justice to said violations up to the present. She added that the commemoration was set on the same day of the 2009 Maguindanao Massacre; and said that despite the strong condemnation and cry for justice in the whole world, justice remains elusive for the families of victims of extrajudicial killings such as of the said massacre.

    Citing the Global Impunity Index ranking the Philippines as 7th worst country in the world in terms of investigations and prosecution for killings of journalists, Representative Cullamat believed that changes in the administration only increased the number of victims of bloody military and police operations and enumerated the injustices committed against victims of massacres and drug war, and against human rights lawyers and peace consultants.

    Representative Cullamat likewise condemned what she considered the de facto martial law that was declared in various parts of the country through the Duterte administration’s NTF-ELCAC that resulted in illegal arrests, harassments, and threats against unionists, activists and cultural minorities. She also denounced the government’s strategy of red-tagging legal organizations and presentation of fake rebel surrenderees.

    In closing, Representative Cullamat pointed out that the 11-year lack of justice for the Maguidanao Massacre reflects impunity in the country; and thus called for justice for the victims of all unjust killings and human rights violations, and an end to rampant impunity.
